Healthcare privacy and data security has become one of the major policy, technology, and operations issues in the American healthcare arena. The Healthcare Insurance Portability and Accountability Act The Healthcare Insurance Portability and Accountability Act The Healthcare Insurance Portability and Accountability Act The Healthcare Insurance Portability and Accountability Act (HIPAA), privacy rule compliance date was April 14, 2003. At this time, all covered entities should have a Privacy Officer to oversee compliance of this privacy regulation. Employees should attend a HIPAA training session. Patients should be receiving a Notice of Privacy Practice from your office, and there should be a posting of the notice in your office. Authorization to use and disclose Protected Health Information (PHI) forms should meet the HIPAA requirements. All practices should make a reasonable effort to limit PHI to the minimum necessary need to accomplish the intended purpose. This would also include using caution when discussing patient information in a public area. Business Association Agreements should be developed for outside services you may use such as, billing, data analysis, legal and accounting services. HIPAA’s transaction and code sets standards compliance date is October 16, 2003. This regulation covers only those healthcare providers who transmit any health information in electronic form in connection with a transaction governed by HIPAA. For example, with health care claims, CMS urges all covered entities to conduct outreach with their trading partners, engage in test-ing of their electronic transactions, and document their efforts towards compliance. Lastly, the HIPAA security rule becomes effective on April 20, 2005. This rule will provide requirements in the following five categories: Administrative Safeguards, Physician Safeguards, Technical Safeguards, Organizational Requirements, Policies, Procedures and Documentation. The Security Rule will be covered in more detail at a later date. If you have any questions, feel free to contact Bob Demers, (Privacy Office) at the hospital, ext. 67001.
