RES.#B102/11 - SUPPLY OF RENTAL RATES FOR OPERATED HEAVY CONSTRUCTION EQUIPMENT AND DUMP TRUCKS Tender RSD11-25. Award of Contract RSD11-25 for the supply of operated heavy construction equipment and dump trucks.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT the Restoration Services Division utilize, as required, the services of Sartor and Susin for the supply of operated heavy construction equipment and dump trucks for the period August 1, 2011 to July 31, 2012, be awarded to Sartor and Susin Limited, it being the tender that bests meets Toronto and Region Conservation Authority's (TRCA's) requirements at a competitive cost;

THAT staff be authorized to use the second tender for the supply of operated heavy construction equipment and dump trucks (D.D.R. Landscape Contractors Ltd.) that next best meets TRCA's requirements, as the need arises;

AND FURTHER THAT authorized officials be directed to take the necessary action to implement the contract including the signing and execution of documents.

CARRIEDBACKGROUNDTender RSD11-25 was publicly advertised in Daily Commercial News and provided for the supply of rental rates for operated heavy construction equipment and dump trucks to be utilized by the Restoration Services Division in carrying out the 2011/2012 work programs.

As a result of the advertisement, 35 tender packages were forwarded to potential bidders as follows:

RATIONALEThe tender selection process included a review of the prices submitted and an assessment of previous performance in a number of areas including, but not limited to, similar work experience, quality of work, and health and safety.

Prices submitted by Sartor and Susin Ltd. and DDR Landscape Contractors Ltd. (DDR), were the two most competitive bids, with Sartor and Susin being overall lower than DDR on a majority of the required equipment. While DDR had lower rental rates than Sartor and Susin Ltd. on five pieces of equipment, upon further investigation, three out of those five pieces of equipment did not meet the required specifications for Contract RSD11-25.

Sartor and Susin Ltd. have worked on numerous successful environmental projects over many years with TRCA. In addition, they have over 40 years of expertise in environmental construction, and are capable of addressing TRCA’s project needs for the next 12 months.

Staff recommend awarding the contract to Sartor and Susin Ltd.. In the event Sartor and Susin Ltd. is unable to supply all of the specified equipment needed during peak construction periods, staff will solicit services from the DDR Landscape Contractors Ltd. This will be dependent on what equipment is specified and will help to ensure that equipment is always available.

FINANCIAL DETAILSThe value of this contract is estimated to be approximately $2,000,000 based upon a review of similar workloads in previous years. An increase or decrease in workload will have an impact on the value of this contract. The contractor understands both the potential cost and resource implications associated with potential workload changes. The operated equipment is rented on an 'as required' basis with no minimum or maximum rental hours guaranteed.

Funds for the contract are identified in TRCA's 2011 and 2012 capital budgets from various funding sources.

RES.#B103/11 - CITY OF TORONTO AND THE RIVERHOUSE AT THE OLD MILL LIMITEDRequest for a permanent easement for a 300mm stormwater outfall located north of Bloor Street West and east of Jane Street, City of Toronto, CFN 45942. Receipt of a request from the City of Toronto and The Riverhouse at the Old Mill Limited to provide a permanent easement for a stormwater outfall, north of Bloor Street West and east of Jane Street, City of Toronto, Humber River watershed.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto for a stormwater outfall which will assist The Riverhouse at the Old Mill Limited with their developments in this vicinity;

AND WHEREAS it is in the opinion of TRCA that it is in the best interests of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the City of Toronto, and The Riverhouse at the Old Mill Limited in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing 0.00241 hectares (0.00595 acres), more or less, be granted to The Riverhouse at the Old Mill Limited for a 300mm stormwater outfall to facilitate the development of adjacent lands owned by The Riverhouse at the Old Mill Limited, said land being part of Block C and Registered Plan M-385 and Part of Lot 1, Registered Plan M-416, designated as Part 5 on draft R-Plan, City of Toronto, subject to the following terms and conditions:

(a) the easement price is $10,000 which is to be paid by The Riverhouse at the Old Mill Limited to TRCA, plus all legal and survey costs incurred to complete the transaction;

(b) all disturbed areas are to be restored to the satisfaction of TRCA and the City of Toronto as soon as possible after completion of construction;

(c) sediment control measures in a manner satisfactory to TRCA are to be practiced during construction;

(d) The Riverhouse at the Old Mill Limited is to be responsible for all repairs and/or maintenance of the stormwater outfall which may be required in perpetuity and for indemnifying TRCA from any and all claims arising from the construction;

(e) an archaeological investigation is to be conducted before any site disturbance, with any mitigative measures required being carried out all at the expense of The Riverhouse at the Old Mill Limited to the satisfaction of TRCA;

(f) any additional considerations as deemed appropriate by TRCA staff or its solicitor;

THAT The Riverhouse at the Old Mill Limited is to fully indemnify TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from the granting of these easements or the carrying out of construction;

THAT said easement be subject to an Order in Council being issued in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended;

AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to implement the easement agreement, including the obtaining of necessary approvals and the signing and execution of any documents.

CARRIEDBACKGROUNDThe proposed 300mm stormwater outfall will service lands owned by The Riverhouse at the Old Mill Limited, north of Bloor Street West and east of Jane Street, City of Toronto, Humber River watershed.

In accordance with TRCA guidelines ''Use of Authority Owned Lands For Storm Water Management" approved at Authority Meeting #11/92, held on January 22, 1993, the proponent has demonstrated that the proposed location on TRCA-owned land is reasonable and all technical requirements of TRCA staff has been satisfied. A permit is required under Ontario Regulation 166/06 and has already been approved at Executive Committee Meeting #4/11, held on April 29, 2011 (RES.#B81/11). The permit (#C-110255) is issued with the condition that an easement is granted by TRCA.

Extensive public consultation has taken place as part of the approval of the Official Plan Amendment, Zoning By-law Amendment and Site Plan applications. No concerns with the stormwater outlet were brought up during any of the public consultations.

The subject land is part of a larger parcel acquired from The Corporation of the City of York on October 25, 1984.

Staff has carried out negotiations with representatives of the developer and respectfully submit that the compensation package relating to the 0.00241 hectares (0.00595 acres) easement, is fair and reasonable.

The total compensation package includes $10,000 for purchase of the permanent easement and an additional planting of 1,068 native trees off-site in a location in the Humber River watershed to produce an ecological net gain.

PlantingsAll lands disturbed by construction have been stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan has been prepared and will form part of the permit pursuant to Ontario Regulation 166/06.

The permanent easement will be in private ownership and the City of Toronto will continue to manage the lands for TRCA. The City of Toronto will not take on the liability of the permanent easement. An easement agreement will be developed between the TRCA and The Riverhouse at the Old Limited to address maintenance of the stormwater outfall.

FINANCIAL DETAILSIt is proposed that the compensation obtained from this easement be utilized for the purchase of priority properties under the Greenlands Acquisition Project.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto to provide a permanent easement for a 400 mm diameter watermain, east side of Kirkhams Road, north of the Meadowvale Road intersection, Rouge River watershed, City of Toronto (Scarborough Community Council Area);

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the City of Toronto in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.17 hectares (0.41 acres), more or less, be granted to the City of Toronto for a 400 mm watermain, said land being Part of Lot 5, Concession 3, City of Toronto (Scarborough Community Council Area), as shown on a plan prepared by City of Toronto - Technical Services;

THAT consideration be the nominal sum of $2.00, plus all legal, survey and other costs to be paid by the City of Toronto;

THAT the City of Toronto is to fully indemnify TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from the granting of these easements or the carrying out of construction;

THAT an archaeological investigation be completed, with any mitigative measures being carried out to the satisfaction of TRCA staff, at the expense of the City of Toronto;

THAT all TRCA lands disturbed by the proposed works be revegetated/stabilized following construction and, where deemed appropriate by TRCA staff, a landscape plan be prepared for TRCA staff review and approval in accordance with existing TRCA landscaping guidelines;

THAT a permit pursuant to Ontario Regulation 166/06 be obtained prior to commencement of construction;

CARRIEDBACKGROUNDThe City of Toronto has formally requested a permanent easement for a 400 mm diameter watermain located on the east side of Kirkhams Road, north of the Meadowvale Road intersection. This proposal has been reviewed under the Schedule C Municipal Class Environmental Assessment (EA) process by TRCA staff and is part of a larger project which consists of the removal of the severely deteriorated Kirkhams Road bridge and substructure; re-instatement and renaturalization of the Rouge River valley; creation of cul-de-sacs north and south of the river; and a gate at Meadowvale Road which will be used for access by maintenance vehicles. Installation of the new watermain will be accomplished by trenchless technology under the Rouge River. The EA process has been completed and a permit application pursuant to Ontario Regulation 166/06 for the proposed watermain project was approved by the Executive Committee at Meeting #5/11, held on June 10, 2011.

Rouge Park has reviewed all aspects of the proposed works and is supportive of the overall project as it will ultimately be ecologically beneficial to this section of the Rouge River valley.

The subject TRCA-owned lands were acquired from Marian V. Laidlaw on May 25, 1970, under the Rouge River Flood Plain Lands Acquisition Project.

PlantingsAll lands disturbed by construction have been stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan has been prepared and will form part of the permit pursuant to Ontario Regulation 166/06.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Town of Richmond Hill, Regional Municipality of York and Duke of Richmond Development Inc. for permanent easements for a watermain, and stormwater drainage culverts which will assist Duke of Richmond with their developments in this vicinity;

BACKGROUNDMunicipally known as 123 Hillsview Drive, the subject property (David Dunlap Observatory or DDO) lands are approximately 72 hectares (177.9 acres) in area, located north of 16th Avenue, south of Hillsview Drive, east of the Canadian National Railway (CNR) Bala Line, and immediately west of Bayview Avenue, within the Town of Richmond Hill. The property is located within the Don River watershed, however the majority of the site is outside of TRCA's Regulated Area of the Don River, and therefore is predominantly not subject to Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourse Regulation) with the exception of a localized wetland, located at the south eastern corner of the site.

The David Dunlap Observatory Lands contains three key building structures identified as having cultural heritage value: the Administration Building, the Elms Lea farmhouse which was used as the former residence of the DDO Director, and the Telescope building. The property contains significant woodlands which are comprised of a combination of arboretum plantings, natural forests and cultural landscape plantings. All of these plantings contribute to the different aspects of the natural heritage system on the property which has been identified in the Region of York Official Plan (ROP 2009) as significant woodlands, based on the criteria of location and size. The 2009 ROP contains policies to prohibit the development and alteration of lands containing significant woodlands.

The University of Toronto acquired the property as a gift by the widow of David Dunlap in the mid 1930's. The site functioned as an astronomical research observatory and contributed to several astronomical discoveries for over 70 years, including confirmation of the existence of 'black holes'. When the University of Toronto announced its intent to sell the lands in 2007, the Town of Richmond Hill expressed interest to acquire the property for public use, in collaboration with other public agencies, including TRCA. However, in July 2008, Corsica Development Inc. (Corsica) purchased the property from the University of Toronto with the intent to develop the lands for residential purposes.

As a response to the University of Toronto's intent to sell the lands, the Town of Richmond Hill also began the process to designate the lands under Part IV of the Ontario Heritage Act and issued a Notice of Intention to Designate the lands, at which time objections were filed by interested parties. Under Part IV of the Ontario Heritage Act, the Conservation Review Board issued a report to the Town in June 2009, acknowledging the property as lands with significant cultural heritage value at a municipal, provincial and federal scale. Subsequently in September 2009, the Town of Richmond Hill Council passed a By-law on the DDO lands to designate a portion of the lands as Cultural Heritage Landscape. The by-law established the boundaries of the extent of the Cultural Heritage Landscape and identified key heritage attributes on the property.

The current proposal is to amend the Town of Richmond Hill Official Plan and Zoning By-law to permit the development of 822 low and medium density residential units on the subject lands. The property is designated "Major Institutional Area" in the old Town of Richmond Hill Official Plan, which permits the current uses, however it provides little direction concerning redevelopment of the properties as it was approved in the 1980's. As the site represents the last remaining undeveloped site within the Town's south urban area, the Town has therefore had regard for the Town's New Official Plan (endorsed by Town Council July 2010) which designates a significant portion of the lands as "Natural Core" and "Natural Linkage", which does not permit development. In January 2010, Town Council endorsed the Planning and Conservation Management Plan, further strengthening the policies and guidelines for the preservation of the DDO lands. Concurrently, TRCA has been working, and continues to work in concert with the Town to provided input into the Terms of Reference for the Master Environmental Servicing Plan (MESP) to ensure the natural heritage features are appropriately assessed.

On March 18, 2011, the proponent appealed the applications to the OMB under subsection 34(11) and 51(34) of the Planning Act, for the Town's refusal or neglect to render a decision with respect to the Official Plan, Zoning By-law and Subdivision applications within the review period prescribed in the Planning Act.

TRCA staff has provided technical advisory services to the Town of Richmond Hill, Region of York and Province of Ontario under our agreements and Memoranda of Understanding (MOU's), to ensure that policies relevant to TRCA's jurisdiction are adhered to. As part of this service, TRCA advises partners on matters related to natural heritage issues. Under this MOU and TRCA's working agreement with the Town of Richmond Hill, TRCA reviewed the MESP in concert with the proposed plan of subdivision. The areas proposed for development are primarily located within areas which would require the removal of several portions of the existing woodlands, and the implementation of a stormwater management pond adjacent to the local wetland on the property. These natural features have been identified as a part of TRCA's Terrestrial Natural Heritage System (TNHS) within the Don River Watershed Plan (2009). The TNHS targets are essential in integrating natural heritage features and areas, together with restored adjacent lands, into a system which protects the ecological functions and biodiversity over the long term. It is in the interest of TRCA to protect the lands within the TNHS for restoration and enhancement. Staff is of the opinion that the applications (as submitted) would significantly compromise the function of the ecological system, and undermine the form and function of the TNHS.

As such, it is the opinion of TRCA staff that the proposed applications which are under consideration, would negatively impact the ecological form and function of the lands, and are therefore not consistent with TRCA, Town of Richmond Hill, Region of York and provincial policy requirements pertaining to the preservation of significant woodlands and natural heritage systems.

RATIONALEThe OMB prehearing meeting was scheduled for June 2 and 3, 2011 to determine the scope of the issues and establish a date for the hearing. On June 2, 2011, TRCA staff attended the prehearing conference, at which time, staff requested party status. During the prehearing, the Board Member encouraged mediation as an option to be considered by all parties. On June 3, staff met with the Board Member to discuss TRCA's interests in the subject property.

It was conveyed to the Board that TRCA's interests were identified in a letter provided by TRCA staff. TRCA's initial review of the MESP identified the need for additional information and a complete characterization of the natural systems on the site. Staff also noted concerns related to the approach, methodology and characterization of the site contained within the document, and the implementation or lack of implementation of the final recommendations, and how these recommendations are reflected in the proposed plan of subdivision.

TRCA staff also identified a number of environmental policy conformity issues which would need to be appropriately addressed, which would likely result in the need for significant modifications to the plan of subdivision, as currently submitted for consideration. To date, TRCA staff does not feel that the proponent has adequately addressed the integration of the preservation of the natural heritage system.

Under our MOU's with the Town and Region, TRCA staff has provided technical comments related to the proposed application and is of the opinion that:

the proposal is not consistent with the protection of the TRCA's Terrestrial Natural Heritage

System targets within the Don River Watershed Plan (2009);

a small portion in the southeast portion of the site is regulated by TRCA, which will require

additional review under Ontario Regulation 166/06 and under the policies of TRCA's Valley and Stream Corridor Management Program (VSCMP);the Town of Richmond Hill's New Official Plan identifies the property as containing

'significant woodlands', however the proposed plan does not adequately address preservation;the proposal does not adequately address the Regional Official Plan with respect to the

identification and protection of significant woodlands;the proposal does not adequately address provincial policies with regard to the

preservation of significant woodlands.

DETAILS OF WORK TO BE DONETRCA staff is requesting authorization of the TRCA Executive Committee to retain legal counsel to ensure TRCA's interests, as identified above, are protected and addressed during mediation and at any future hearings. In the event that the proponent agrees to modify their proposal to the satisfaction of TRCA, or a mutually mediated resolution, staff may not need to be further involved in the proceedings. BACKGROUNDThe subject property is located on the west side of Woodbine Avenue, north of Steeles Avenue, in the Town of Markham. The site is approximately 4.13 hectares in size. The site is directly north of Cummer Creek (also known as the Don Mills Ditch, an urbanized tributary of the Don River). The southwest portion of the property is located within the Regulatory Floodplain and is subject to Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation).

A 11,870 m² single storey industrial building currently exists on the site, which contains uses such as a paper packaging facility, rental car operation and a leather goods retail store. The current proposal includes the demolition of the existing building and the reconstruction of a new single storey, 12, 201.42 m², large format retail development (Wal-Mart) which would be located almost entirely within the existing extent of the floodplain, at the western most limit of the property. The balance of the lands are intended for surface parking to support the new retail building.

The property is designated "Industrial - Business Corridor Area" in the Town of Markham Official Plan, and is zoned Business Corridor which permits the retail use. The applications have been appealed to the OMB by the proponent for the Town's failure to render a decision on the proposed site plan application within the review period prescribed in the Planning Act.

TRCA staff has been involved in the review of these lands since January 2008, when staff received an application for concept development. At that time, staff reviewed the floodplain analysis provided by the consultants. Staff has advised the consultants, and has remained consistent in TRCA's message that any new building construction would be required to be located out of the floodplain, with the appropriate environmental buffers, and would be required to adhere to TRCA's Valley and Stream Corridor Management Program (VSCMP).

In November 2010, Woodbine Road Developments Inc. submitted a formal site plan application to the Town of Markham for consideration. TRCA staff provided comments on the proposed site plan and revised Floodplain Analysis Report to the Town and the applicant in March 2011. Staff concluded that the proposed works can not be supported as the location of the proposed building would result in an increase safety risk to the general public, an increase in risk to property associated with the proposed use, and set a precedent as the proposed works does not comply with TRCA's VSCMP policies. Furthermore, as the application does not give any consideration for improvements beyond the impacts of their development, TRCA advised the Town to consider undertaking additional studies within this area to develop an overall flood remediation strategy for the general area, given the known historical flooding concerns.

In meetings with the consultants in May 2011, TRCA staff acknowledged that the 100 year flood elevation was greater than the Regional Elevation in this location. Staff recognized that there are opportunities to redevelop the site, however the proposal that was submitted was not in line with previous comments, which was to physically relocate the new building out of the floodplain. The proposal under consideration includes the reshaping of the existing watercourse corridor and installing a small retaining wall within the channel to provide additional flood storage capacity, and therefore create more developable land outside of the floodplain. This approach does not comply with TRCA policy.

The proposed site plan would further exacerbate the current flooding situation within the area. As such, it is the opinion of staff that the proposed works are not consistent with TRCA and provincial policy requirements.

RATIONALEThe OMB Hearing is scheduled for July 26, 2011, and is scheduled for four days. A prehearing was not scheduled as part of the proceedings. TRCA staff consider TRCA's involvement to be critical in this hearing because the proposed development is:

not consistent with TRCA's Valley and Stream Corridor Management Program policies on

replacement structures;not consistent with TRCA's VSCMP policies related to alterations to the floodplain; and

fails to demonstrate consistency with Section 3.1 of the 2005 Provincial Policy Statement

(PPS 2005);

DETAILS OF WORK TO BE DONETRCA staff is requesting authorization of the TRCA Executive Committee to retain legal counsel to ensure TRCA's interests, as identified above, are protected and addressed at the hearing of July 26, 2011. CARRIEDBACKGROUNDThe Port Union Waterfront Improvement Project (Phase 2) is located south of Lawrence Avenue east, along the Lake Ontario shoreline between Chesterton Shores and the Rouge River in the City of Toronto. The preferred option through the Class Environmental Assessment process includes the construction of six headlands and seven beach cell units. As part of the project, a bridge is required to cross the Adams Creek outlet channel which is located just east of the eastern limit of Chesterton Shores. Toronto Waterfront Revitalization Corporation (TWRC) authorized TRCA to assume a leadership role in the planning, design and implementation of Phase 2 of the project which includes the construction of the proposed pedestrian bridge.

I have been asked to contact you by Ward 1 Councilor Vincent Crisanti.  It is my understanding that the 

councilor informed you of my request to purchase the small strip on land directly behind my house at 5 

Attercliff Court. I would like to obtain some more information regarding this process and the possible 

value of this land.  If we cannot come to an agreement on a market value, I would be interested in simply 

having a right of use agreement for this parcel.  I have no intentions of building on this land, nor could I 

given the zoning requirements in place. I would simply like to have a bit more space in my backyard as 

my wife and I enjoy entertaining in the summer.  Our dog would also definitely enjoy the extra space as 

well!

 

I look forward to your response and hope that we can come to an agreement in the near future.

 

I have attached a copy of my house survey and a survey of the excess land in question.
