THAT the contract for the preparation of Phase 3 of the Sustainable Neighbourhood Retrofit Action Plan (SNAP) for the County Court neighbourhood in Brampton be awarded to the consulting team lead by Dillon Consulting, at a total cost not to exceed $149,500.00, plus HST;

AND FURTHER THAT authorized Toronto and Region Conservation Authority (TRCA) officials be directed to take the necessary action to implement the contract including obtained needed approvals and signing and execution of documents.

CARRIEDBACKGROUNDIn follow-up to watershed plans and directions toward catchment-based, neighbourhood scale implementation planning, TRCA is initiating a pilot program of SNAP projects in collaboration with municipal partners. The purpose of this initiative is to identify ways to accelerate the transformation of existing communities to improve sustainability and increase their contributions to climate change mitigation and adaptation. The SNAPs will showcase a broad range of innovative sustainability initiatives of TRCA and its partners, and support the implementation of various watershed and community planning initiatives within a retrofit context.

The first SNAP pilot project is located in Brampton, Ontario and is focused on a neighbourhood called “County Court”. The community is bounded by Hurontario Street to the west, Steeles Avenue East and the Etobicoke Creek to the north, Kennedy Road to the east, and Highway 407 to the south.

At Executive Committee Meeting #8/09, held on October 9, 2009, Resolution #B143/09 awarded Phases 1 and 2 of the SNAP development to a consultant team led by LURA and Planning Alliance with ARUP, ERA Architects, Aquafor Beech and Beacon Environmental.

Phases 1 and 2 have identified a series of key neighbourhood actions and projects for further analysis in Phase 3. These include a suite of low impact development (LID) stormwater management measures and eco-landscaping on single family lots and innovative end-of-pipe facilities for further analysis (e.g. use of neighbourhood stormwater for golf course irrigation); and an enhanced public space at the County Court Park and Upper Nine Stormwater facility. The development of the SNAP has been managed by the TRCA and guided by a Project Management Team comprised of representatives from the TRCA, Region of Peel and City of Brampton. Technical staff, the community and other partners have been engaged throughout the process.

This Phase 1 and 2 contract is now complete and has resulted in:establishment of an existing condition baseline for energy and water consumption, natural heritage and stormwater systems; a sustainability framework of goals, indicators and working targets to guide SNAP development and future monitoring; future scenario analysis to identify strategic actions to meet working targets; and identification of key actions and projects with estimates of expected performance.

Consulting services are now required to undertake the final Phase 3 to fully develop the SNAP for County Court so partners can begin implementation. The selected consultant team will engage TRCA, Region of Peel, City of Brampton, and the community in:

developing engaging visuals and detailed concept plan mapping;integrating and refining technical work to detail and assess actions;building a strategy for community behaviour change;creating a community engagement plan to allow for input to SNAP development;creating a concept plan for County Court Park retrofit through a Preliminary Feasibility Study (optional City of Brampton funded item);developing the business case for actions requiring significant investment;identifying innovative approaches and developing an Implementation and Financing Strategy; andfacilitating partner discussions in support of monitoring plan development.

RATIONALEThe consultant selection process for the Phase 3 contract involved a Request for Proposal (RFP) as outlined below. To solicit bids for Phase 3 work, TRCA staff made use of the list of qualified consultants including those identified through the previous Request for Expression of Interest (REOI) and RFP process for Phases 1 and 2.

Request for Proposal process – Phase 3 contractBased on TRCA staff’s review of the top previously submitted EOIs and consulting firms with the required qualifications to undertake the work, the RFP for Phase 3 of the County Court SNAP was sent to the following five (5) teams on November 23, 2010:

Proposals were received on December 13, 2010 from the following teams, at a value of:Team Fees and expenses

Proposals were reviewed by a selection committee comprised of TRCA staff, as well as staff from engineering, environmental planning, water conservation and education from the City of Brampton and Region of Peel.

Proposals were reviewed based on the following selection criteria:approach to developing an integrated, action-oriented SNAP to achieve neighbourhood objectives and targets;understanding of Phase 3 requirements (knowledge of Phases 1 and 2 studies and local technical and environmental conditions);

work plan that streamlines and integrates technical refinement and analysis, community input and social marketing research; past experience with similar projects; qualifications of individual team members and ability to manage complex projects with multiple partner involvement; overall quality of proposal; and cost.

The selection committee conducted interviews on December 20, 2010 with the two consultant teams scoring highest; those lead by Dillon Consulting and XCG Consulting.

The committee felt that the team led by Dillon Consulting with urbanMetrics and Aquafor Beech best met the work requirements for integrated technical analysis and assessment; community engagement and behaviour change strategy; and business case and implementation plan development. In addition, this team’s proposal and interview conveyed significant enthusiasm and a compelling vision which demonstrated their understanding of the unique nature of the project. They set out a clear and innovative workplan that gave the selection committee confidence that immediate start-up and efficient delivery of Phase 3 would occur. Several of the consultant team members have previous experience with the City of Brampton.

As a result, the selection committee is recommending award of the contract to the consulting team lead by Dillon Consulting for the development of Phase 3 of the County Court SNAP in Brampton, at a total cost not to exceed $149,500, plus HST.Funds for the consulting contract are available from the Region of Peel under the TRCA’s 2010 Capital Budget (account 416-10) and a recently awarded grant of $86,625 under the Federation of Canadian Municipalities (FCM) Green Municipal Fund (GMF). Staff will continue to pursue innovative partnerships and funding opportunities to secure resources and financial support for plan development and implementation.

THAT Contract RSD10-59 for repairs to the day mooring dock at Bluffer’s Park be awarded to McPherson-Andrews Contracting Limited at a total cost not to exceed $97,226.00, plus a contingency amount of $5,000.00 to be expended as authorized by Toronto and Region Conservation Authority (TRCA) staff, plus HST, it being the lowest bid that meets TRCA staff cost estimates and specifications;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to implement the contract including obtained needed approvals and signing and execution of documents.

CARRIEDBACKGROUNDBluffer’s Park is a large waterfront park located at the southern limit of Brimley Road South, south of Kingston Road in the City of Toronto. Bluffer’s Park was created to increase public access to Lake Ontario, increase the amount of lakefront recreational facilities present along Toronto’s east waterfront and promote further commercial and residential developments within the surrounding area. Construction of the park began in 1971 and by 1981 the facility was opened to the public. In October of 2010 the City of Toronto approached TRCA to assist with the planning, design, approvals and implementation of repairs to the Day Mooring Docks at Bluffers Park. The failing dock was identified to TRCA by the City of Toronto as an area of concern due to severe erosion of the Gabion baskets underneath the concrete dock, therefore the entire front face of the dock wall is undermined. The City of Toronto requested that TRCA develop a plan to address the issue, while providing long-term protection to the dock. The repairs to the Day Mooring Dock will improve safety for pedestrian traffic and recreational activities within Bluffer’s Park.

The Tender for the repair of the Day Mooring Dock at Bluffer’s Park was issued on December 6,

2010, based on a design provided by Brown and Co. Engineering Limited.

RATIONALETender packages were sent to five suppliers as follows:

Somerville Construction Ltd.;Serve Construction Ltd.;McPherson-Andrews Contracting Ltd.; Hobden Construction Ltd.; andBryron Contracting Ltd.

THAT the contract for supply of aquatic plant propagation materials for 2011 projects and programs be awarded to Acorus Restoration at a cost not to exceed $70,000.00 including delivery, plus HST, it being the quotation that best meets Toronto and Region Conservation Authority (TRCA) specifications;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to implement the contract including obtained needed approvals and signing and execution of documents.

CARRIEDBACKGROUNDFor many years the TRCA Nursery has undertaken the collection, propagation and supply of aquatic plants to facilitate the implementation of a variety of regeneration projects across TRCA's watersheds. Over the past several years Nursery staff has diversified the range of products by adding a limited selection of wet meadow herbaceous plants to this product line. From the early outset of aquatic plant propagation activities, the Nursery has seen growth in annual demand from fewer than 15,000 plants to an ongoing demand of 40,000 or more units per year. More recent changes in Restoration Services program focus has pushed the demand for aquatic and herbaceous plants to over 60,000 in 2010. Staff project the same level of demand for the 2011 season. This demand is again predominantly comprised of needs related Tommy Thompson Park wetland habitat development and shoreline enhancement projects. Demand is anticipated to subside to 40,000 units annually in subsequent years based on current project plans and known build out schedules.

In late 2006, staff surveyed the marketplace to obtain proposals from potential growers for the supply of the specified propagating materials. On the basis of the outcome of that market survey, TRCA has purchased the required propagation materials from Acorus Restoration, they being the only regionally local supplier that could both provide the range of species and quantities at the specified time lines necessary to allow TRCA's Nursery to deliver the products on time. Each successive year since 2007 yielded a similar outcome and conclusion - the result being that annual supply contracts were awarded to Acorus Restoration on the basis of price and availability.

RATIONALEOver the past five years, some growers have expanded and/or entered this market and as a result staff again sent out Requests for Proposals to supply for the 2011 season and to confirm how the supply landscape had changed as a result of evolving environmental restoration project demands. TRCA Nursery staff contacted the following five potential suppliers of aquatic plants and propagation materials covering local, regional and international representation to review the suitability and compatibility of these grower's supplies and techniques to our own:

Acorus Restoration; Wild Canada; Native Plant Source; Taylor Creek Restoration Nurseries; Environmental Concern.

All of the potential grower/suppliers were requested to provide their quotation for the supply and delivery of specific items in terms of species, quantity, size, condition (eg. bare root, plugs, pot, etc.), timing and price in accordance with TRCA’s known 2011 requirements.

The results of these enquiries yielded the following result:

Within the last two years, significant improvements in nursery facilities and crop scheduling have enhanced the ability to supply bio-regionally appropriate materials in the required quantities. However, current demands on physical propagation space and staff resources by the expansion of project demands continues to put a strain on current production limits. Coupled with TRCA's inability to deal with inconsistent weather in the early spring period, it further hampers our ability to produce the product to the required stage of development requested by internal client groups to meet optimal time lines for out-planting and successful establishment.

Based on the responses received, Acorus Restoration and Native Plant Source are the only two local sources that claim the ability to supply the materials from regionally acceptable genetic sources.

Prior attempts to obtain similar materials from Native Plant Source based on quoted lowest price have met with disappointing results, requiring TRCA to procure from alternative sources in order to fulfill project commitments made by the Nursery. Any such repeat performance failure would undoubtedly result in significant setbacks in project implementation schedules and may incur additional cost to mitigate - making TRCA subject to prevailing market retail pricing and limited species/quantity availability in order to meet commitments for project completion timelines.

Procuring materials through a distant American supplier, solely on the basis of lowest unit cost and unknown cross-border duties/tariffs/taxes, carries with it a significant element of risk given that these materials are highly perishable and subject to abiotic stresses during shipment, notwithstanding TRCA’s stated focus on locally sourced, genetically adapted and bio-regionally appropriate plant materials. TRCA's projects are based on this ecological precept and our partners have come to accept and respect this important principle.

Therefore, based on TRCA's past experiences in procuring these materials, staff recommend award of the contract to Acorus Restoration, as they have a proven track record of supplying regionally appropriate materials - on time, to specification and at a cost effective price. They comply with the seed collection standards set out by the Forest Gene Conservation Association. Further, the quality of the materials received to date gives staff confidence in their ability to supply what TRCA needs in the required time period. The price differential between Acorus and the lowest bidder is quite modest.

Furthermore, staff recommend that the contract value be set at a maximum of $70,000 (plus HST) for the year ending December 31, 2011, in order to have flexibility to adapt quickly to changing project requirements throughout the balance of 2011.

TRCA Nursery staff believe that procuring materials in this manner is the simplest way and remains a cost effective approach to achieve the required unit production. This procurement approach also allows existing staff resources to be focused on other priority woody plant production during the critical and short spring season.

FINANCIAL DETAILSFunds in the amount of $16,265.00 are available to provide for the 30% deposit payment to secure the Acorus Restoration order from account 125-17-230.

The balance of the order cost, $37,954.50 plus HST will be paid on delivery and confirmation in spring 2011. Individual projects receiving plants will be billed for the materials they receive following delivery next year. Costs are recoverable from various project budgets as materials are delivered to individual projects in 2011.

Further material orders, should they be required, will be assigned under the balance of the purchase contract to a maximum upset limit of $70,000 plus HST.
