THE EXECUTIVE COMMITTEE RECOMMENDS THAT 3.2 hectares (8.0 acres), more or less, of land including the flood protection landform, located to the south of Queen Street East and west of the Don River in the City of Toronto, said land being parts of Block 7, 8, and 9 on Registered Plan 66M-2473, designated as Parts 1 to 7, 9 to 19, and 23 on draft R-Plan from Holding Jones Vanderveen Inc., dated as October 14, 2014 and referenced as Job No:. 05-1670- REF23, be purchased from Infrastructure Ontario;

THAT the purchase price be $2.00;

THAT TRCA receive conveyance of the land free from encumbrance, subject to existing service easements;

THAT the firm of Gardiner Roberts LLP, Barristers & Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary actionto finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

CARRIEDBACKGROUNDResolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

In 2003 TRCA initiated the "Lower Don River West Remedial Flood Protection Project" Class Environmental Assessment (EA) and it was successfully completed in September 2005. The Class EA included the creation of a Flood Protection Landform (FPL) on the west side of the Don River between Queen Street and the Canadian National and GO Transit rail lines.

In 2007 construction began on the 8-hectare FPL. Infrastructure Ontario has led the development and construction of the FPL to standards identified by TRCA. The FPL has been incorporated into the design of Athlete's Village venue for the 2015 Pan Am / Para Pan Am Games. Also the unique topography of the FPL has been utilized to build Corktown Common Park, which is a signature piece of the community.

The FPL and Corktown Common Park are organized into two distinct halves. The west, or 'dry' side, of the FPL will provide urban park recreational opportunities and park amenities such as trails, benches and a pavilion. The eastern half, or 'wet' side, of the FPL is defined by sloped topography that will see the creation of an urban prairie which includes an upland meadow on the upper slope, and a lowland wet meadow at the base.

The subject lands are to be transferred to TRCA from Infrastructure Ontario (IO) on terms and conditions which are satisfactory to TRCA staff and its solicitor and are defined as the easterly side, or ‘wet' side, of the FPL.

Following transfer of the subject lands to TRCA, permanent easements on other lands currently owned by, or to be acquired by, the City of Toronto would be negotiated and registered. These include portions of certain roadways and the westerly side, or 'dry' side, of Corktown Common Park. The proposed easements would allow TRCA access to the City-owned lands for the purpose of inspecting, repairing, servicing and maintaining the landform and would be the subject of a further staff report to the Authority.

DETAILS OF WORK TO BE DONEDetails of the work to be done involving the subject lands include:

Obtaining as-built drawings of the flood protection landform.

Satisfaction of the environmental condition of lands.

Registration of easements across City of Toronto lands.

Negotiations have been conducted with Mr. Chris Farquhar, Project Manager, Major Projects Division of Infrastructure Ontario.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015.

The lands to be acquired from IO would be parts of Blocks 7, 8, and 9 on Registered Plan 66M -2473 and include the flood protection landform work with associated grading and meadow landscaping.

TAXES AND MAINTENANCEIt is proposed that the lands be turned over to the City of Toronto under the terms of the existing management agreement.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) has been requested by Rogers Communications Inc. to enter into a lease arrangement for lands located at Bolton Heights Drive and Queen Street North, Town of Caledon, Regional Municipality of Peel;

WHEREAS it is in the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with Rogers Communications Inc. in this instance;

THEREFORE LET IT BE RESOLVED THAT TRCA enter into a lease with Rogers Communications Inc. of 0.008 hectares (0.020 acres), more or less, together with the use of a 0.020 hectare (0.051 acre) parcel of land for access and utilities for the construction and operation of a cellular phone tower and associated equipment, said land being Part of Lot 11, Concession 6, Town of Caledon, Regional Municipality of Peel;

THAT the lease with Rogers Communications Inc. be premised on the following:

(i) the initial term of the lease will be for five years, with three renewal options for successive five year periods subject to the concurrence of TRCA to the renewals;

(ii) the lease rate is to be $16,830.00 per annum;

(iii) Rogers Communications Inc. is to be responsible for all approvals required for construction of a cellular phone tower and associated equipment;

(iv) Rogers Communications Inc. shall be solely responsible for all costs associated with the construction of a cellular phone tower and associated equipment;

(v) any other terms and conditions deemed appropriate by the TRCA's solicitor;

THAT an archaeological review is to be completed at the expense of Rogers Communications Inc. with any mitigative measures being carried out to the satisfaction of TRCA;

AND FURTHER THAT the authorized TRCA officials be directed to take the necessary action required to implement the lease, including obtaining any necessary approvals and signing and execution of documents.

CARRIEDBACKGROUND TRCA has been approached by Rogers Communications Inc. to utilize this site to locate their cell phone tower and associated equipment. The subject site is currently vacant the proposed installation is approximately 270 metres from the nearest residence.

Town of Caledon Council approved on March 24, 2015 the construction and operation of the cellular phone tower and associated equipment site location.

Rogers Communications Inc. equipment requirement for this proposal includes a tower not to exceed 40 metres in height together with an equipment cabinet within a 10 metre by 8 metre housed fence compound. The access right-of-way will be approximately 4.5 metres in width which may include connection to existing utilities. Rogers Communications Inc.’s proposed installation is a 30 metre flagpole tower which provides for a minimum visual profile.

Lease Agreement The area subject to this lease consists of 0.008 hectares (0.020 acres), more or less, together with the use of a 0.020 hectare (0.051 acre) parcel of land for access for the construction and operation of a cellular phone tower and associated equipment, all of which are located on tableland. A sketch showing the subject land is attached.

The following are the key terms of the proposed lease arrangement:

1. Lease Payment: $16,830.00 plus HST per annum to be increased by 2% per year;

2. Initial Term: five years;

3. Renewals: three successive five year renewal periods subject to TRCA concurrence;

4. Access: Rogers Communications Inc. will be provided with unobstructed access to the tower and equipment cabinet at all times;

5. Insurance: Rogers Communications Inc. will provide $5,000,000 in commercial general liability insurance;

6. Realty Taxes: Rogers Communications Inc. will pay all taxes levied against the subject property;

7. Hydro: Rogers Communications Inc. will be responsible for electrical connections and charges relating to this use;

8. Approvals: Rogers Communications Inc. will comply with all required laws, directions, rules and regulations;

9. Equipment Removal: Rogers Communications Inc. will remove all equipment and restore the site to the satisfaction of TRCA within 120 days of termination of the lease.

DETAILS OF WORK TO BE DONE Upon TRCA approval, the necessary other approvals required to bring the lease into effect will be pursued.

FINANCIAL DETAILS The $16,830 per year in revenues generated from this lease will be used for TRCA purposes.

RES.#B31/15 - UNIONVILLE SPECIAL POLICY AREA Policy Update, City of MarkhamReport to Follow. The City of Markham is updating the policies of the Unionville Special Policy Area in accordance with provincial guidelines. The Authority is requested to endorse the updated Special Policy Area policies that will be implement through the City's new Official Plan.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS the City of Markham has undertaken a review to update the policies of the Unionville Special Policy Area (SPA) in accordance with provincial guidelines for amending the policies of existing SPAs;

THEREFORE LET IT BE RESOLVED THAT the Authority support the request by the City of Markham to update the policies of the Unionville Special Policy Area in the City's new Official Plan for approval;

AND FURTHER THAT the Authority reaffirm the position held since 2007 that a multi-level municipal parking structure is not recommended within the flood plain at the location as detailed in this report in the absence of a thorough evaluation of options and a demonstrated reduction in risk;

AND FURTHER THAT Authority staff be directed to continue discussions with the City of Markham staff to assist in finding alternatives for parking outside the flood plain;

AND FURTHER THAT the City of Markham, the Ministry of Municipal Affairs and Housing and Ministry of Natural Resources and Forestry be so advised by the CEO's Office.

CARRIEDBACKGROUNDA “Special Policy Area” designation is a planning mechanism provided by the Province of Ontario to recognize the unique circumstances of historic communities that existed within flood vulnerable areas prior to the implementation of a provincial flood hazard planning policy and where it has been demonstrated that the application of the other flood plain management approaches (One Zone or Two Zone) would not allow for the continued social and economic viability and revitalization of these areas. New SPAs and any amendments to the policies, land use designations or boundaries of existing SPAs must be approved by both the Minister of Municipal Affairs and Housing (MMAH) and the Minister of Natural Resources and Forestry (MNRF) because they reflect a relaxation of natural hazard policies for flood-related events, where this is deemed appropriate. As stated in the Provincial Policy Statement (PPS), SPAs are not intended to allow for new or intensified development, if a community has feasible opportunities for development outside the flood plain.

The proposal for a new SPA or modifications to the boundaries or policies of an existing provincially approved SPA may only be initiated by lower-tier or single-tier municipalities as the proponent. Such proposals must be undertaken in accordance with the Ministry of Natural Resources Technical Guide, Appendix 5 – River and Stream Systems: Flooding Hazard Limit, “Procedures for Approval of New Special Policy Areas (SPAs) and Modifications to Existing SPAs Under the Provincial Policy Statement, 2005 (PPS, 2005), Policy 3.1.3 – Natural Hazards- Special Policy Area, dated January 2009". The policies and boundaries of an SPA are determined through a consultative process between the municipality, TRCA, MNRF and MMAH, and implemented through amendments to a municipality’s Official Plan/Secondary Plan and Zoning By-law. These site specific SPA policies are used by TRCA staff to inform and guide TRCA's regulatory permitting responsibilities under Section 28(1) of the Conservation Authorities Act.

In 1990, the City of Markham was granted approval by MMAH and MNRF to implement the Unionville SPA. The SPA consists of 15 subareas located within the flood plain of the Rouge River and forming part of the Unionville Heritage Conservation District, the Unionville Core Area, Markham Centre and the Highway7/McCowan Road commercial retails lands (Attachment 1). The SPA boundary was revised by amendment to the City's Official Plan and approved by the Province in 2008 to reflect changes resulting from new flood plain mapping for the Rouge River prepared by TRCA. It was acknowledged at the time of the boundary update, that the SPA policies would be comprehensively reviewed and updated as part of the City's pending new Official Plan process. The recommendations of this report pertain to the comprehensive SPA policy review process that has now been completed as a component of Markham's new Official Plan, the outcome of which is to provide clarity within the policy framework that will enable appropriate revitalization and redevelopment of the historic area to ensure its long term heath and vitality.

RATIONALEThe proposed policy modifications to the SPA and related policies in the City of Markham's new Official Plan reflect a collaborative and consultative effort between staff from the City of Markham, TRCA, York Region, MMAH and MNRF. The provincial approval procedures require an endorsement of the proposed SPA policies by City Council as part of the City’s final submission package to the Province. A similar endorsement of the SPA policies from TRCA's board is also required. On February 24, 2015, City Council approved the updated SPA policies, as detailed in the staff report to the Development Services Committee dated February 17, 2015 which can be found at the following link: http://www2.markham.ca/markham/ccbs/indexfile/Agendas/2015/Development%20Services/pl150217/official%20plan%20policy%20report.pdf

The SPA policies have been updated to reflect current provincial legislation and technical standards and requirements related to land use, flood risk and emergency management. No changes to the SPA boundary are being proposed as the flood plain information from the 2008 update remains applicable. To assist the City with the risk assessment and emergency management component of the policy review and update, TRCA generated a Regional Risk Analysis map (Attachment 2) in accordance with criteria set by MNRF, to identify areas within the SPA that would be considered low and high risk for pedestrian access during a Regional Flood, and areas where flood depths would be less than 0.3 metres, (considered to be safe during a Regional flood for vehicular access). The following is a summary of some of the changes and updates to the SPA policies:

clarification that SPA policies shall prevail over all other policies in the Official Plan

an updated list of prohibited sensitive uses (e.g. institutional uses, essential emergency

services, storage of hazardous substances)identification of conditions where no new development would be permitted in a Special

Policy Area (e.g. creation of adverse downstream/upstream impacts, major structural damage, an unacceptable risk to life or property)clarification that development is permitted subject to meeting the technical floodproofing

and safe access/egress criteria in accordance with the underlying land use designationidentification that intensification beyond what is permitted by the Official Plan must

demonstrate no alternatives outside the flood plain exist and be assessed in a comprehensive manner and require the approval of the Ministers of MMAH and MNRFrestriction of new residential units/overnight accommodations where safe access and

egress cannot achieve provincial standardsrequirement for a flood evacuation plan for multi-unit developments

prohibition of new lot creation or additional dwelling unit on lands designated 'Residential

Low-Rise'

In addition to the above, a modification to the general land use policy in Section 8.5.1 of the Official Plan is being proposed to clarify that increases in height and density above the maximum permitted in a designation within a SPA shall not be permitted without provincial ministerial approval as part of a comprehensive secondary plan review. Notwithstanding the prohibition policy on new lot creation and additional dwelling unit creation, it is proposed that certain area and site specific policies be modified for undeveloped lands in South Unionville to allow new lot and additional dwelling unit creation in accordance with previously approved Secondary Plans (Section 9.19.2 and 9.19.10).

As part of the SPA policy review process, the Province requested an explanation of how the City's emergency response services would be provided within the SPA. A response was provided by the City's Deputy Fire Chief and Emergency Preparedness Coordinator, in a letter dated October 31, 2014 (refer to the City's report at the link noted above). The Province has indicated that this letter satisfies their requirements.

Upon review of the City's staff report, it has come to the attention of TRCA staff that there are some instances, very minor in nature, where the policy wording is not in keeping with the wording agreed to by TRCA and as set out in the Ministry of Municipal Affairs and Housing letter to the City dated December 11, 2014. This matter has been brought to the attention of both City and Ministry staff and will be addressed through the final provincial review and approval process. Future Unionville Heritage Conservation District PlanTRCA staff want to reiterate a concern associated with the future use of the Unionville parking lot, east of Main Street. In TRCA's report on the updated SPA boundary dated April 20, 2007, and adopted at Authority Meeting #3/07 by Resolution #A104/07, TRCA identified this parking lot as being highly constrained for redevelopment by significant flood depths, based upon the technical criteria established by MNRF. For this reason, TRCA had recommended that the parking lot be removed from the SPA to preclude the area from new development and reduce the risk to public health and safety. However, recognizing the importance of the Unionville parking lot in terms of servicing the economic viability of the businesses and residents in Main Street Unionville, TRCA supported City Council's desire to retain this area within the SPA, on the basis that the continued use of this area remain as an at grade parking lot.

Recently, TRCA staff participated in the City's Main Street Unionville Community Vision Plan exercise. At a charrette workshop in June 2013, senior TRCA staff presented a brief history of the Special Policy Area and identified the opportunities and constraints from a flood risk perspective to the consultants preparing the Plan, City staff and local residents. It was noted at this time that the parking lot area is subject to significant flood depths (3-5 metres) during a Regional flood event and that these depths are high risk for both pedestrian and vehicular access/egress based on MNRF technical standards. On this basis, staff advised that development options for a parking structure would not be supportable from a provincial policy and TRCA regulatory perspective. Despite this, the Vision Plan has come forward through a report to City Council in January 2015 that proposes a municipal parking structure in the form of a parking platform located over the existing parking lot on the valley floor. The City's staff report acknowledges that the introduction of the parking structure is not supported by TRCA from both a policy perspective as well as technical constraints.

TRCA is supportive of the preservation of the cultural heritage and unique character of historic Main Street Unionville. A new Secondary Plan is to be prepared for the Unionville Heritage Conservation District, as recommended in the City's new Official Plan. Markham Development Services Commission staff have been authorized to initiate discussions with senior staff at TRCA to determine the feasibility of introducing a parking platform. We will continue to provide our commitment to work with the City and landowners to explore other options to revitalize the neighbourhood while respecting provincial policy. However, staff takes the opportunity at this time to reiterate that a parking structure in this location is not supported by staff.

Next Steps in the SPA ProcessThe Ministry of Municipal Affairs and Housing requires City Council to endorse the updated Special Policy Area policies, and a similar resolution of support from TRCA prior to Ministerial approval. Markham's new Official Plan was approved by Regional Council on June 12, 2014, subject to a number of modifications and deferrals. Decision on the Special Policy Area policies were withheld pending the outcome of the provincial review and approval process. The Markham Official Plan is currently under appeal to the Ontario Municipal Board. It is anticipated that the Ministerial decision on the SPA policies will be entered through the OMB process.

CONCLUSIONThe City of Markham, in collaboration with TRCA, has undertaken a comprehensive review of the Unionville Special Policy Area policies in accordance with provincial guidelines for amending the policies of existing SPAs. The updated SPA polices are based upon a flood risk assessment using provincial technical standards and emergency management practices and set out a framework that will enable appropriate revitalization and redevelopment to ensure the long term heath and vitality of the historic Unionville area. The development of the City's proposed SPA polices has been subject to extensive discussions with MMAH and MNRF. On this basis, TRCA staff recommends that the Authority support the proposed updates to the Unionville SPA policies as outlined in this report, in order to advance to the next steps of the Provincial approval process. Furthermore, it is recommended that the Authority direct staff to continue discussions with the City of Markham staff on alternatives to structural parking within the flood plain.

BACKGROUNDTRCA is working in partnership with multiple partners to revitalize through sustainable design, construction and maintenance the grounds of the San Romanoway towers - an affordable housing complex consisting of three multi-unit buildings at the corner of Jane Street and Finch Avenue in Toronto. Partners include the building owners, property managers, residents, numerous community organizations and the City of Toronto.

The San Romanoway Revival project is an innovative project of the Black Creek Sustainable Neighbourhood Retrofit Action Plan (SNAP). Implemented at the neighbourhood scale, the Black Creek SNAP entails an integrated, one-window approach to urban retrofits and renewal in older communities. The Action Plan addresses a broad range of objectives to improve the local environment with measureable results and build resiliency against climate change by greening local infrastructure and encouraging positive behavior changes among residents and landowners. Most importantly, the Black Creek SNAP achieves these objectives while addressing key socio-economic objectives of the Jane and Finch community.

The San Romanoway Revival project specifically addresses food security, employment, water conservation, stormwater management, beautification, and tree, shrub and flower planting, while giving special attention to community cohesion and cultural pride. It is a high profile demonstration project that could serve as an urban renewal precedent for the hundreds of apartment complexes built in the Toronto region in the 1960s and 1970s.

One of the diverse components of the San Romanoway Revival project is the design and construction of a large community garden, the tender for the construction of which is the issue of this report. TRCA’s Restoration and Infrastructure staff was asked to assist the Black Creek SNAP project lead to help develop a workable master plan for the site and to oversee the detailed design, tendering and construction of the community garden.

RATIONALEThe work outlined in the Request for Tender (RFT) is to:

construct the community vegetable garden (including excavation, supplying timber and soil

for all planters and garden beds);supply and install metal perimeter fencing;

supply and install pollinator garden bed site preparation;

install shed from “Shed Man”; and

supply and install a trellis, accessible garden, shredded bark mulch, limestone screening

and decorative wooden landscape features.

A list of contractors was compiled, based on their previous involvement with similar projects and their expertise in this field. The RFT was sent to the following four landscape construction firms:

CARRIEDBACKGROUNDThe TRCA web presence has evolved dramatically from its starting point as a static one way communication tool, originally developed 16 years ago, into an dynamic and interactive relationship system. Today the TRCA web platform plays a critical role in how the public interacts with and perceives TRCA, but the current website remains essentially the same as it was when the content management system was launched in 2009.

Starting in 2008, the current TRCA website required a large one-time investment in a content management software system called dotCMS. TRCA now hosts and supports more than 50 websites and web applications that vary in size and complexity, 30 of which utilize this platform and will be rolled over to the new platform. While the dotCMS platform has served TRCA well, it has officially reached its end of life and is no longer supported by the software vendor.

With the need to replace TRCA's website content management system, and TRCA's website traffic quickly moving from traditional computers to a wide variety of mobile devices such as tablets and smartphones, TRCA is looking to build a new and modern website software platform that will allow for ongoing development, feedback and iteration to ensure TRCA continues to evolve to the ever changing internet landscape

This approach will not only improve the customer experience but also provide TRCA with a new set of interaction metrics, allowing for a real-time feedback loop for monitoring audience engagement and content trends. This feedback will provide insights into our audience demographic and will ensure that our website is optimized and tuned, on an ongoing basis, to the needs of our various end users.

RATIONALEWhile TRCA’s web traffic has seen continued growth since its launch in 2009, the software platform that is used to power the content management capabilities has not been able to evolve adequately with the changes in the internet landscape. We have seen a very dramatic move to mobile devices over the past few years and are already seeing a need to build more dynamic, user centric websites that can conform to TRCA's varied audience segments and provide a more tailored experience for each visitor. With this in mind, staff is looking to replace the current content management system with a new platform that will allow for ongoing development, user feedback and software iteration to ensure TRCA can continue to grow its web presence over the coming years.

In order to minimize time requirements on staff and on potential proponents, the procurement process was broken down into two stages:

An open online Expression of Interest (EOI) was issued via the Biddingo Tendering Service 1.and submissions were evaluated based on organizational capabilities, suggested approach and methodology, past success with similar project and the vendor’s involvement in the open source software community.

CARRIEDBACKGROUND Watercourses and adjacent park areas within the City of Toronto sustained a significant amount of damage as the result of the August 19, 2005 storm event. In response to the damage caused, City of Toronto Parks Forestry and Recreation (PF&R) entered into an agreement with TRCA in February of 2007 to complete the repairs required to return the damaged areas to a state of good repair in order to ensure protection of life and property within the City of Toronto parks systems while funding for long term rehabilitation of key sites was sought.

The Wilket Creek tributary of the East Don River was one of the watercourses that suffered a significant amount of damage as the result of the August 19, 2005 storm event. In 2007/8 TRCA staff undertook large scale restoration works within Edwards Gardens, and a series of 10 state of good repair projects within Wilket Creek Park, as part of the aforementioned agreement entered into by the City of Toronto and TRCA in February of 2007.

Following the completion of the State of Good Repairs work, TRCA entered into a multi-year agreement with Toronto Water and PF&R of the City of Toronto to undertake the completion of additional repair works within Wilket Creek Park, and a Geomorphic Systems Master Plan for the entire Wilket Creek subwatershed.

To date works have been completed at Sites 6, 7 (2011/12) and Site 3 Phase 1(2012/2013). The restoration work at Site 3, Phase 2 commenced in 2015 and includes the protection of at-risk sanitary sewer infrastructure and associated channel stabilization works.

The estimated 1,700 tonnes of 2 – 4 tonne uniform stackable armourstone is required as part of the sanitary sewer protection.

TRCA has been approached by National Wildlife Centre (NWC), who is currently operating in partnership with the University of Guelph, using a mobile veterinary clinic to attend to the needs of their current catchment area being the western Toronto region. NWC has expressed an interest in leasing for a 20 year period with options to renew, lands from TRCA located on Glen Haffy Conservation Area, as outlined in Attachment 1. NWC is currently looking for lands within the Town of Caledon that are suitable for the phased development and operation of a wildlife centre to service the western Toronto region. 

Representatives from the Town of Caledon Planning Department and TRCA’s Parks and Culture division have been involved in preliminary discussions with NWC regarding this proposed use and are in support of moving forward with discussions and negotiations.

RATIONALE NWC is a registered charity that provides wildlife clinical research, wildlife medicine, training and education. NWC has been able to provide an important community service since 2014. NWC is funded primarily by donations and by like minded organizations and foundations. As there appears to be a desire for this type of service within the western Toronto region, it would be beneficial for TRCA to consider making this land available for their use.
