THE DEVELOPMENTOF THE INTEGRATED CUSTOMSINFORMATION SYSTEM BASED

ON THE ASYCUDA WORLD SOFTWARE

TheCustoms Service under the Ministryof Finance of the Republic of Moldova(Customs Service) and theUnited NationsConference on Trade and Development(UNCTAD), hereinafter referred to as theParties;

Recognizing the UNCT AD role in thepromotion of trade facilitation and themodernisation of Customs AdministrationslServices;

Having agreed that the strategic aims andobjectives of the Customs Service are beingachieved more efficiently by using modemtechnologies and applying integratedinformation systems, thereby facilitatingCustoms and Trade Community alike;

Recognizing the extensive experience of theUNCTAD/ASYCUDA Programme in theanalysis and modernisation of national customslegislation, procedures and systems in line withthe international standards and best practice,and in the design, development andimplementation of customs automated systemsworldwide;

Recognizing the UNCT AD intellectualproperty of the ASYCUDA software,including ASYCUDAWorld, and theassociated technical and functionaldocumentation;

Serviciul Vamal de pe linga MinisterulFinantelor al Republicii Moldova (ServiciulVamal) ~iConferinta Natiunilor Unitepentru Comert si Dezvoltare (UNCT AD),denumite ill continuare Parti;

Recunosciind rolul UNCT AD in promovareafacilitarii comertului si modernizariiAdministratiilor/Serviciilor Vamale;

Convenindcs scopurile si obiectivele strategiceale Serviciului Vamal sunt atinse mult maieficient prin utilizarea tehnologiilor modeme siaplicarea sistemelor informationale integrate,facilitand astfel atat Varna cat si Comunitateade Afaceri;

Recunosciind experienta vasta a ProgramuluiUNCTAD/ASYCUDA in analiza simodernizarea legislatiei, procedurilor sisistemelor vamale nationale in conformitate custandardele si cele mai bune practiciinternationale, precum si ill elaborarea,dezvoltarea si implementarea de sistemeinformatice vamale ill intreaga lume;

Recunosciind proprietatea intelectuala aUNCT AD asupra softului ASYCUDA,inclusiv ASYCUDA World, asupradocumentatiei functionale si tehniceinsotitoare;

Having agreed upon the strategic decision ofthe Customs Service to furtherdevelop itsIntegrated Customs Information System (lCIS)based on the ASYCUDAWorld system(Automated System for Customs Data),developed by UNCT AD;

Taking into account the strategic objective ofthe Customs Service to gain the compatibilitywith the European legislation, standards andbest practice in the Customs field, and futureinter-operability between ICIS and theEuropean Commission systems;

Have agreed as follows:

Article 1

The Parties will continue to cooperate in themodernisation of the Customs Service and, inparticular, in the development of ICIS, in orderto be in line with European and internationalstandards and best practice in the areas ofcustoms and trade facilitation.

Article 2

UNCT AD will provide to the Customs Service,through the Community Domain of theASYCUDA website, on request and at no cost:

• the latest version of the modules andASYCUDAWorld application software formultiple license use within the legalnational boundaries of the CustomsService;

• the functional and technicaldocumentation of the latest version of theASYCUDAWorld application software;

• remote "ad-hoc" functional and technicalsupport for the ASYCUDA Worldapplication software.

UNCT AD shall not be responsible for anymalfunctioning of the system due to anincorrect functional and/or technicalinstallation and/or operation performedwithout prior adequate UNCT AD technicalexpertise or training.

Convenind asupra deciziei strategice aServiciului Vamal de a continua sadezvolteSistemul Informational Integrat Vamal (ICIS)bazat pe sistemul ASYCUDAWorld(AutomatedSystem for Customs Data),dezvoltat de catre UNCT AD;

Lutind in considerare obiectivul strategic alServiciului Vamal de a obtine compatibilitateacu legislatia, standardele si cele mai bunepractici europene ill domeniul vamal, precumsi viitoarea interoperabilitate intre ICIS ~isistemele Comisiei Europene;

Au convenit urmiitoarele:

Partile vor continua sa coopereze ill domeniulmodernizarii Serviciului Vamal, ill special illdezvoltarea ICIS, pentru a fi ill conformitatecu standardele si cele mai bune practiciinternationale si europene in domeniul vamalsi facilitarii comertului.

Articolul2

UNCT AD va oferi Serviciului Vamal, prinintermediul domainului comunitar al paginiiweb ASYCUDA, la solicitare si gratis:

• cea mai recenta versiune a modulelor sisoftului aplicativ ASYCUDAWorld cupermisiunea de utilizare multipla ill cadrulServiciului Vamal;

• documentatia functionala si tehnica acelei mai recente versiuni a softuluiaplicativ ASYCUDA World;

• suportul functional ~i tehnic "ad-hoc" dela distanta pentru softul aplicativASYCUDA World.

UNCT AD nu va fi responsabil pentru nici 0disfunctionalitate a sistemului, ca urmare ainstalarii si/sau operarii function ale si/sautehnice incorecte efectuate fara expertizatehnica sau instruirea prealabila adecvata aUNCTAD.

Article 3

The Customs Service will use theASYCUDAWorld application software withinCustoms, and will not provide any copy of thesoftware (source code) to a third party withoutUNCT AD prior and explicit written approval.

Article 4

UNCT AD will provide the Customs Servicewith strategic and technical assistance, supportand training, through technical assistanceprojects, on standard UNCT AD conditions, inthe areas of customs procedures processing,trade facilitation, development andimplementation of ICIS, in compliance with theinternational and European standards andrequirements.

Article 5

The Parties agree to

• exchange information on regular basis,related to the ASYCUDAWorld evolutionand ICIS consolidation and development;

• review periodically strategic issuespertaining to the integration andimplementation of Internet based customssystems, at national, regional andinternational level.

Article 6

The Parties shall use their best efforts to settleamicably any dispute, controversy or claimarising out of this Memorandum ofUnderstanding or the breach, termination orinvalidity thereof.

Article 7

Nothing in or relating to this Memorandum ofUnderstanding shall be deemed a waiver,express or implied, of any of the privileges andimmunities of the United Nations, including itssubsidiary organs.

Article 8

This Memorandum of Understanding may beamended by mutual written agreement of the

Articolul3Serviciul Vamal va utiliza softul aplicativASYCUDA World in cadrul vamii si nu vatrans mite nici 0 copie a softului (coduluisursa), fara aprobarea prealabila si explicita inscris a UNCT AD.

Articolul4UNCTAD va acorda Serviciului Vamalasistenta strategica si tehnica, suport ~iinstruire, prin intermediul proiectelor deasistenta tehnica, conform conditiilor standardale UNCT AD, in domeniul dezvoltariiprocedurilor vamale, facilitarii comertului,dezvoltarii si implementarii ICIS, inconformitate cu standardele si cerinteleinternationale ~i europene.

Articolul5

Partile au con venit de a

• efectua schimb regulat de informatiireferitor la evolutia ASYCUDAWorld,consolidarea si dezvoltarea ICIS;

• revizui periodic problemele strategice cetin de integrarea si implementareasistemelor vamale bazate pe Internet lanivel national, regional ~i international.

Articolul6Partile vor depune toate eforturile pentru asolutiona pe cale amiabila orice disputa,divergenta sau pretentie ce reiese din prezentulMemorandum de Intelegere sau din incalcarea,incetarea actiunii sau invaliditatea acestuia.

Articolul7

Nimic din, sau legat de prezentulMemorandum de Intelegere nu va presupunerenuntarea, expresa sau implicita, laprivilegiile si imunitatile OrganizatieiNatiunilor Unite, inclusiv ale organelor eiauxiliare.

Articolul8

Prezentul Memorandum de Intelegere poate fiamendat cu consimtamantul reciproc in scris

Parties.

Article 9

This Memorandum of Understanding isconcluded for a 5 (five) years period and willenter into force on the date of receipt byUNCT AD of the notification of the Moldovanparty that the internal procedures necessaryfor its entry into force have been met.

In witness whereof the undersigned, dulyauthorised thereto, have signed thisMemorandum of Understanding.

Done at Geneva, on 2016,in 2 (two) original copies in English andRomanian languages, both texts being equallyauthentic. In case of any divergence ofinterpretation the English text shall prevail.

Articolul9

Prezentul Memorandum de Intelegere seincheie pentru 0 perioada de 5 (cinci) ani ~iva intra in vigoare la data primirii de catreUNCT AD a notificarii partii moldovenestiprivind indeplinirea procedurilor internenecesare pentru intrarea lui in vigoare.

Drept dovada subsemnatii, fiind 'imputernicitiin modul cuvenit pentru acest scop, au sernnatprezentul Memorandum de Intelegere.

Intocmitla Geneva, la 2016,in 2 (doua) exemplare originale in limbaengleza si rornana, ambele texte fiind egalautentice. In cazul oricareidivergente lainterpret are, textul in limba engleza va fi dereferinta.
