Mr. Doub is the lead NRC terrestrial ecologist and wetland scientist assigned to the EIS. The August 8, 2011, meeting focused on Detroit Edison’s proposed least environmentally damaging practical alternative (LEDPA) and included a tour of the proposed site layout and wetlands potentially affected by the proposed project. Also discussed at the August 8, 2011, meeting were potential impacts to the Indiana bat (Myotis sodalis), which is Federally listed as endangered under the Endangered Species Act, and is known to visit potential maternity roost trees. The August 9, 2011, meeting focused on Detroit Edison’s proposed conceptual aquatic resources (wetland) compensatory mitigation strategy plan and a tour of the proposed compensatory mitigation site.

Olson - 2 - DAY 1 MEETING – PROPOSED FERMI 3 SITE LAYOUT ALTERNATIVE ANALYSIS & TOUR Time: 9:00 a.m. – 4:00 p.m. Location: Fermi Nuclear Training Center and Proposed Fermi 3 Project Site (all on Detroit Edison’s Fermi Plant Site in Monroe, Michigan) Attendees are noted in Table 1, below. This was a USACE pre-application meeting with Detroit Edison. USACE invited NRC, the FWS, and the U.S. Environmental Protection Agency (EPA) to attend for their situational awareness and to facilitate interagency collaboration on the proposed layout. Randy Westmoreland of Detroit Edison hosted the meeting. Representatives of two Detroit Edison contractors were present: Conservation Connects LLC, who assisted Detroit Edison in preparing the wetland delineation report and concept mitigation strategy and Black and Veatch, who conducted the terrestrial wildlife and vegetation surveys and reports for Detroit Edison’s COL application. The EPA will have to approve the EIS and can veto USACE permit decisions relative to the discharge of fill into waters of the United States, including adjacent wetlands, under Section 404(c) of the Clean Water Act. The NRC and USACE are required to consult with the FWS under Section 7 of the Endangered Species Act prior to licensing or permitting any actions that could adversely affect threatened or endangered species.

Detroit Edison’s Proposed On-Site Alternative Analysis Presentation (Randy Westmoreland): Colette Luff of USACE prefaced the presentation by explaining that the USACE evaluates projects proposing the discharge of dredged/fill material into waters of the United States, including adjacent wetlands, for compliance with the Section 404(b)(1) Guidelines of the Clean Water Act. This requires, in part, an evaluation of alternatives and identification of a LEDPA to the proposed discharge. She noted that Detroit Edison would be presenting the alternative analysis it conducted to demonstrate compliance with the Guidelines and identify its proposed LEDPA. Ms. Luff qualified Detroit Edison’s proposed LEDPA by explaining that the USACE had not yet verified it as the LEDPA, but that it would be included in the draft EIS to allow public review. She further explained that the USACE would identify and document the LEDPA in its permit decision document.

B. Olson - 3 - Randy Westmoreland then presented an overview of Detroit Edison’s proposed Fermi 3 site layout. He explained how the layout went through four iterations.

• The initial version (Rev. 0) was developed prior to the 2008 wetland delineation. The environmental report (ER) included with the COL application relied on the Rev. 0 site layout.

• The second layout version (Rev. 1), released in 2009, substantially reduced wetland

impacts, especially to forested wetlands in the northwestern and southwestern parts of the site. Mr. Westmoreland highlighted several elements of Rev. 1 that reduced wetland impacts, such as clustering support facilities along the edge of the existing Fermi 2 developed area, maximizing use of an upland agricultural field owned by Detroit Edison, and building compact parking garages instead of larger flat parking lots. He emphasized, however, the need to establish separate access roads for traffic into Fermi 2 and Fermi 3, for both logistical and security purposes.

• A third layout (Rev. 2) was submitted by Detroit Edison in January 2011. Rev. 2 further

minimized wetland impacts by avoiding construction laydown in forested wetlands in the part of the site termed the “Pork Chop,” based on its shape on aerial photographs. Rev. 2 also calls for relocating an existing onsite segment of the Fermi 2 transmission line to a new route across the western part of the site, thereby freeing upland and wetland areas that were not previously usable for project features due to overhead clearances.

• Subsequently, during detailed design of the access road along the western edge of the

site (Toll Road), Detroit Edison identified technical issues that necessitated realignment of the Rev. 2 road and the Fermi 2 transmissions lines (as realigned in Rev. 2) which resulted in the fourth layout version (Rev. 3). According to Detroit Edison, the Rev. 3 layout would further reduce unavoidable wetland fill impacts by avoiding wetlands (these wetlands were previously unaccounted for in Detroit Edison’s wetlands delineation and impact proposals) in exchange for a one-ac increase in the wetland vegetation trimming area necessary to provided the overhead clearance for the realigned transmission line. Detroit Edison has proposed the Rev. 3 layout as the LEDPA. The draft EIS currently in preparation by NRC and USACE also uses the Rev. 3 site layout data.

Detroit Edison is using the sequence of four site layout versions to demonstrate its effort to avoid and minimize wetland impacts. The consideration of alternative sites required by NRC serves as part of the avoidance effort, but the USACE also requires further detailed consideration of how to avoid and reduce wetland impacts once a site is selected.

Olson - 4 - Wetland Delineation & Functional Assessment Overview (Sheila Hess): Sheila Hess of Conservation Connects LLC (Detroit Edison consultant), made a detailed presentation addressing how the proposed Rev. 3 (fourth) site layout version affects wetlands and other waters of the United States. She noted that the project would unavoidably impact the wetland features noted in Table 2 (which presents the impact area data to be used in the soon to be published draft EIS):

Ms. Luff explained that USACE determined that approximately 1.9 ac identified as emergent wetlands in Detroit Edison’s wetland delineation report (that is part of the 6.1 ac proposed for permanent fill) are not adjacent to a navigable water of the United States and therefore are an area for which the State of Michigan has assumed Federal permit authority per Section 404(g) of the Clean Water Act and Title 40 of the Code of Federal Regulations, Part 23. She further explained that Michigan Department of Environmental Quality (MDEQ) subsequently determined that the site was not regulated by the state. While the EIS will note these unregulated impacts, the USACE is not factoring them into its mitigation requirements. EPA asked if USACE coordinated their “isolated” wetland determination with the EPA, as required. Ms. Luff explained that the USACE did not coordinate with EPA regarding the 1.9-ac area since USACE does not make isolated or otherwise determinations for “state assumed waters,” and therefore no coordination with EPA is warranted. She noted that this is the first instance she has encountered where “assumed waters” had not fallen under state jurisdiction. The state is not expected to require mitigation for the discharge of fill in the area in question. Indiana Bat Presentation (Ed Shaddrick): In a telephone call with the NRC, USACE, and Detroit Edison on July 26, 2011, Burr Fisher of the FWS had expressed concern over the clearing of trees capable of serving as Indiana bat maternity roosts. He indicated that the FWS may require Detroit Edison to conduct mist net field surveys for Indiana bats in forested areas containing potential maternity roost trees. As an initial step in addressing this issue, Detroit Edison tasked Ed Shaddrick, biologist with Black and Veatch (contractor to Detroit Edison), to visually inspect forested areas within the

B. Olson - 5- proposed project footprint (based on the Rev. 3 site layout version) for trees that could possibly function as maternity roosts. Mr. Shaddrick made a brief presentation discussing the results of this informal survey. He explained that for him to identify a tree as a possible maternity roost, it had to be at least 9 inches in trunk diameter at breast height (4.5 ft from the ground) and display substantial peeling or deeply furrowed bark or a pronounced deep split. Mr. Shaddrick identified five potential maternity roost trees in the project footprint. Three are in a forested wetland area just east of the Quarry Lakes that will be used for construction laydown and two are forested wetlands at the western site boundary. The latter two trees would have to be cut to accommodate the overhead clearance necessary for the Fermi 2 transmission lines that will be relocated as per the proposed layout (Rev. 3). Site Tour: Randy Westmoreland drove the group to inspect several areas of interest. He let representatives in the group request specific areas to visit. The first area visited was the site of a proposed temporary laydown area located southeast of the Quarry Lakes and immediately north of Pointe Aux Peaux Road. It is an area disturbed by past fill activities (possibly Fermi 2 construction) and contains some emergent wetlands that could be restored following usage. The second area visited was the forested wetland of the Quarry Lakes containing potential Indiana bat maternity roost trees. This area would be used as a temporary laydown area, and would require total vegetation clearing. The trees were healthy shagbark hickories (Carya ovata) with peeling bark (a trait common to this species) (Photo 1). Mr. Burr Fisher stated that the trees appeared to be too small and in too dense a tree canopy to function well as Indiana bat maternity roosts.

The third area visited was on the Lake Erie shoreline at the existing Fermi 2 intake and discharge structures (Photo 2). The proposed Fermi 3 intake and discharge structures would be built in this same area. The shoreline has already been armored and paved in connection with the previous Fermi 1 plant and currently operating Fermi 2 plant.

The fourth area visited comprised segments of man-made canal and lake features just west of the existing Fermi 2 developed areas (Photo 3). These surface water bodies; termed the north or overflow canal, south canal, and central canal; are surrounded by narrow fringes of phragmites (Phragmites australis) and steep, hardened man-made slopes. No emergent vegetation was visible in the north or central canals other than the narrow phragmites fringes. These areas would be filled to construct ancillary structures serving Fermi 3. The south canal would be “culverted” to allow the movement of construction equipment from the laydown area to the Fermi 3 construction site. The south canal contained an emergent fringe and also floating aquatic plants. According to Ms. Luff, the hydrology of the canals is tied to Lake Erie but existing connections would be maintained. Therefore, according to Detroit Edison, filling or culverting these waters would not negatively influence the hydrology of wetlands to the west. These impacts constitute the 5.2 ac of open water impacts reported in the JPA and draft EIS (see Table 2). The USACE requires permits to fill open waters of the United States and may require mitigation to replace the loss of aquatic functions. Ms. Luff explained that the MDEQ may consider these areas as emergent wetlands. If so, the MDEQ wetland mitigation requirements could be greater than currently proposed. This change would have to be reported in the final EIS.

The fifth area visited was the 1.9-ac area unregulated emergent wetland (Photo 4). It is situated under existing transmission conductors (proposed for realignment in Rev. 3) serving Fermi 2. Most of the wetland supports a dense stand of reed canarygrass (Phalaris arundinacea) with a small area of sedge (Carex spp.) near its center. The wetland was dry at the time of visit. A low ridge comprises its northern edge. A larger forested wetland is situated north of the ridge. Uplands to the east and west support Detroit Edison’s earlier tallgrass prairie project area. A portion of the tallgrass prairie would be permanently lost to accommodate the proposed Fermi 3 switchyard.

The last area visited was a strip of grassy upland and forested wetlands along the west edge of the Fermi site, where trees would be cut to accommodate the realigned Fermi 2 transmission lines (Photo 5). As previously discussed, the lines are proposed for relocation to further minimize proposed site layout wetland impacts. The forest consists of deciduous trees such as box elder (Acer negundo), swamp chestnut oak (Quercus michauxii), shagbark hickory, and

B. Olson - 8 - green ash (Fraxinus pennsylvanica). The ash trees had been killed by the emerald ash borer (Agrilus planipennis), an introduced insect pest that has killed most ash trees in the region.

Ed Shaddrick had identified two potential Indiana bat maternity roost trees in the forested wetland portion of this area (Photo 6). Both were dead green ash trees. Mr. Fisher of the FWS stated that the trees did have the appearance of possible maternity roost trees. However, on discussion, he agreed that the trees were in an advanced state of decay and would not likely provide maternity roost functionality for much longer. Mr. Fisher suggested that further investigation may not be warranted unless Detroit Edison planned to clear the trees within the next year or two.

DAY 2 MEETING – PROPOSED OFFSITE FERMI 3 AQUATIC RESOURCE (WETLAND) COMPENSATORY STRATEGY AND SITE TOUR Time: 9:00 a.m. – 1:00 p.m. Location: Detroit Edison Monroe Activities Center, Monroe, Michigan Attendees are noted in Table 3, below. This was a USACE preapplication meeting with Detroit Edison. USACE invited other State, Federal and local governmental agencies for their situational awareness and to facilitate interagency collaboration regarding the proposal. Representatives of two Detroit Edison contractors were present: Conservation Connects LLC, who assisted Detroit Edison in preparing the Fermi 3 wetland delineation report and concept mitigation strategy and Tetra Tech, who assisted Detroit Edison in preparing the Fermi 3 alternatives analysis and JPA. Agencies present, in addition to NRC, included the USACE, EPA, and FWS.

Overview Presentation (Randy Westmoreland): The day opened with a meeting in the Monroe Activities Center. Ms. Luff prefaced the presentation by explaining that the compensatory mitigation strategy to be presented by Detroit Edison is proposed as compensation for unavoidable aquatic resource losses associated with the proposed Fermi 3 site layout (Rev 3); the plan is conceptual in nature and has not been verified by USACE or MDEQ; will be made available for public comment in the draft EIS; and will be summarized in the USACE public notice. She further explained that the final compensatory mitigation requirements would be included in the USACE permit, if issued. Randy Westmoreland began the meeting with an overview of the Fermi 3 proposed site layout and the proposed aquatic resource mitigation. He explained that Detroit Edison’s mitigation planning for Fermi 3 is still at a conceptual stage and will be finalized to meet regulatory requirements as the planning process matures.

B. Olson - 10 - As presented by Detroit Edison, mitigation typically consists of examining opportunities to avoid and minimize impacts to wetlands and other aquatic resources, followed by consideration of methods to compensate for the impacts (compensatory mitigation). The four iterations of the

B. Olson - 10 - proposed Fermi 3 site plan constitute Detroit Edison’s proposed avoidance effort. Use of best management practices to reduce sedimentation and runoff into wetlands and surface waters constitutes Detroit Edison’s proposed minimization effort. Detroit Edison’s proposed compensatory mitigation effort consists of two elements: 1) restoration in place of all temporarily disturbed wetlands and 2) offsite restoration and enhancement of wetlands. The remainder of the presentation focused on the proposed offsite effort. The proposed mitigation site is a tract of approximately 210 ac already owned by Detroit Edison as part of the existing Monroe Power Plant (coal-fired plant). The roughly rectangular parcel is located approximately 7 mi south of the Fermi site on Lake Erie. Most of the parcel is currently in agricultural use. The parcel is surrounded by man-made dikes. Lake Erie is located waterward of the easternmost dike. Drainage ditches are located inside the dike along the south and eastern perimeters of the site. The drainage from the ditches is pumped into the ash basin at the northeast corner of the site. According to Detroit Edison, they anticipate restoring and enhancing a total of 82 ac of wetlands on the site to compensate for Fermi 3 aquatic resource impacts. Although Detroit Edison has quantified its Fermi 3 wetland impacts, the USACE and MDEQ cannot determine the exact extent of required aquatic resource compensation until formal review of the JPA. Detroit Edison expects that the proposed offsite project will exceed requirements. A basin used to handle coal ash generated at the Monroe Power Plant is situated directly north of the site. Lake Erie is situated to the east. A marina and a Monroe County Schools recreation site are situated directly south of the site. Land directly west of the site accommodates an existing tallgrass prairie conservation project developed jointly by Detroit Edison and the Detroit River International Wildlife Refuge. Overview of Proposed Offsite Compensatory Mitigation (Lisa Matis): Ms. Lisa Matis of Tetra Tech, contractor to Detroit Edison, provided an overview of the proposed concept. A historical 1897 navigation chart indicated that the site was largely wetlands with orchards occupying the western one-third, except for a waterway that flowed through the southwest. Historical aerial photographs from the 1950s indicate that this natural waterway, termed the Davis Drain, still flowed through the western part of the site and entered into La Plaisance Creek, which flows into Lake Erie to the south. Most of the site was still farmed. By the 1960’s it appears that dikes completely encompassed the site and that flow in Davis Drain had been rerouted south. Drainage ditches had been built elsewhere. Tile drains had been installed. Most of the site is still farmland today, except for dikes, drainage ditches, a drainage area that bisects the western two-thirds of the site and the former natural channel of Davis Drain, and an area at the foot of an old fill pile and forested wetlands in the northwest corner of the site.

B. Olson - 11 - Key elements of the concept plan call for:

1. Breaking an opening into the eastern dike to enhance inflow of surface water from Lake Erie while maintaining the rest of the dike to protect against coastal erosion and flooding;

2. Returning a portion of the flow of Davis Drain to its former channel in the western part of the site;

3. Connecting the restored Davis Drain channel to Lake Erie by a created channel following

a naturally meandering route across the eastern part of the site and grading adjacent areas to provide for a variety of water levels and habitats;

4. Plugging the drainage ditch outlet at the northeast corner of the site and plugging or

removing agricultural tile drains;

5. Allowing surface water from Lake Erie and Davis Drain to flow over the currently farmed areas, restoring hydrological conditions conducive to wetland vegetation;

6. Building a low berm to separate restored and enhanced wetlands in the western and

eastern parts of the site;

7. Installing a water control structure in the new berm so that surface water levels in the western part of the site can be controlled;

8. Seeding restored and enhanced wetlands for a temporary monitoring period to ensure

that desired hydrological conditions have been successfully established;

9. Final planting of vegetation targeting wetland plant communities impacted at the Fermi site; and

10. Monitoring and maintenance of the mitigation project as long as required by regulatory

agencies. As explained by Ms. Matis, hydrology in the eastern part of the site would be driven primarily by water levels in Lake Erie. Hydrology in the western part would be fed primarily by inflow from Davis Drain. The proposed water control structure would release excess water from the western part of the site into Lake Erie and admit inflow from Lake Erie during high water events (such as seiches). Investigations indicate that surface soils throughout the site consist of high levels of clay with no water table in the upper 18 inches of the soil profile. Hence, the hydrology of the restored and enhanced wetlands would be driven almost completely by surface water rather than groundwater.

B. Olson - 12 - Several attendees questioned the need for the proposed new central dike and water control structure. They stated that the mitigation project would better replicate natural lakeside wetland systems if the entire site were directly open to inflow from Lake Erie and that the water control structure would indefinitely require ongoing regular maintenance. Ms. Matis explained that the need for the water control structure stems from MDEQ requirements for exactly replicating specific wetland plant communities impacted by the Fermi 3 project. Specific plant communities in wetland systems adjacent to large bodies of water such as Lake Erie typically reflect specific seasonal high water depths. According to Ms. Matis, use of a water control structure is the only way to reasonably ensure establishment of specific targeted wetland plant communities. Proposed Wetland Mitigation Site Tour: The tour began in the northwestern corner of the proposed site. A farm lane runs along a low dike following the western perimeter of the site (Photo 7). The farmland (right of the farm lane in the photo) appeared to be in active cultivation.

The artificially channelized Davis Drain flows through a culvert located west of the proposed site and under a paved road to the south (left part of Photo 8) and into an artificially straightened canal leading to La Plaisance Creek, just upstream of its outlet to Lake Erie. The mitigation concept calls for directing a portion of the Davis Drain flow from a point farther upstream into the western part of the mitigation site. The flow would be used to inundate agricultural land to restore wetland conditions.

A segment of the former natural channel of Davis Drain in the western part of the mitigation site presently supports phragmites, common cattail (Typha latifolia), and other emergent wetland vegetation (Photo 9). Redirected flow from Davis Drain would be returned to this shallow channel and allowed to inundate the adjoining agricultural land.

The outlet of the artificial drainage ditches to the pumping station would be plugged and tile drains would be removed from the agricultural land occupying most of the site (Photo 10). Surface flow from Davis Drain and Lake Erie would be allowed to shallowly inundate the agricultural land and support restored wetland vegetation. Recent investigations by Tetra Tech indicate that soils over most of the agricultural land on the site are or were hydric soils.

The Lake Erie shoreline directly east of the proposed mitigation site appears to be low energy (Photo 11). Much of the lake close to the dike has low enough wave energy to support dense cover by the floating emergent plant American lotus (Nelumbo lutea). Several attendees suggested that the low wave energy might allow for breaching a wider gap in the dike (or multiple gaps), thereby increasing contact between the restored wetlands and the lake. Ms. Matis responded that despite the low wave energy under normal conditions, the shoreline is still subject to episodic high wave energy during high winds and seiche events. Too wide a breach would subject the restored wetlands to a high risk of erosion during these events.

SUMMARY OF KEY DISCUSSION POINTS The following lists the key discussion points from both the August 8-9, 2011, meetings.

1. The proposed site layout for Fermi 3 used in the JPA and draft EIS is the fourth sequential iteration (Rev. 3) produced since 2008. Rev. 1 substantially reduced wetland impacts; Rev. 2 further minimized wetland impacts; and Rev 3 reduced wetland impacts

B. Olson - 15 - even more but increased the forested wetland area that would require cutting to accommodate the overhead clearance for the relocated Fermi 2 transmission line corridor. Detroit Edison believes that no further avoidance of wetland impacts is possible and proposes the Rev. 3 layout as the LEDPA.

2. Detroit Edison is presenting the sequence of site layout revisions in its JPA to document its consideration of opportunities to minimize wetland impacts. The proposed layout and associated impacts, including the unavoidable wetlands loss, have not been verified as the LEDPA by USACE. The USACE would determine the LEDPA during its permit evaluation process.

3. The proposed site layout still unavoidably affects approximately 39.7 ac of wetlands and

other waters of the United States, although approximately 1.9 ac of the wetland impacts involve an area identified as emergent wetlands by Detroit Edison but not regulated by the USACE or MDEQ.

4. The wetland impact acreage data used by NRC and USACE in writing the draft EIS as of

July 31, 2011, are consistent with the JPA at the present time. At the time of the meeting, USACE had not yet received the JPA.

5. Mr. Ed Shaddrick of Black and Veatch was tasked by Detroit Edison to identify potential

Indiana bat maternity roost trees within the proposed Fermi 3 footprint. Mr. Shaddrick identified two clusters of potential maternity roost trees, one in a forested wetland directly east of the Quarry Ponds and one in a forested wetland along the western property boundary.

6. Mr. Burr Fisher of FWS informally stated that the trees west of the Quarry Lakes did not

appear to have a high potential to serve as Indiana bat maternity roosts, while the trees near the western property boundary were in an advanced state of decay and may only provide the potential for maternity roosting habitat for one or two more years.

7. Mr. Fisher’s informal statements suggest that further field survey effort for the Indiana

bat may not be warranted unless Detroit Edison plans to clear trees within the next couple of years. However, Mr. Fisher did not make any official statement on behalf of the FWS.

8. Detroit Edison proposes two forms of compensatory aquatic resource mitigation: onsite

restoration of wetlands temporarily disturbed during construction of Fermi 3 and offsite restoration and enhancement of approximately 82 ac of wetlands on a tract of approximately 210 ac of agricultural land owned by Detroit Edison located south of the Monroe Power Plant. The USACE has not verified that the proposed offsite work would
