Answer: The cover of the 2015 edition of Memphis Medical News’ InCharge Healthcare, a one-of-a-kind directory of healthcare executives in Memphis.

2014 has been one of the most interesting years in the recent history of American healthcare. Of course, we stand in awe of the medical breakthroughs we see and read about almost every day. But these days, we also stand in awe of those learning to navigate the changing face of American healthcare…those who manage our systems to keep the lights on, the labs running and the doors open. Memphis is fortunate to have some extraordinary talent in healthcare management. It is always a challenge to select just a few to put in the spotlight, but when these six assembled on the Mud Island Amphitheatre Stage, I knew we had made good casting decisions.

Ed Avery directs Consolidated Medical Practices and plays an important role in helping independent physician groups band together in order to remain autonomous while overcoming the financial obstacles that have become the new normal in healthcare. Denise Burke is a health law attorney who has gained the trust of the Memphis medical community through years of solid legal guidance. She’s also gained national attention by being named “Lawyer of the Year” for healthcare law for the Memphis and West Tennessee area by Best Lawyers, one of the oldest and most respected peer-review publications in the legal profession. Dr. Robert Sumter is part of the new senior leadership team helping transform Regional One Health. He has risen from Chief Information Officer at multiple naval hospitals to guiding information technology and the clinical and professional operations at the hospital.

I first met Michael Ugwueke in 2011 when he was running both Methodist North and South Hospitals. This May, he assumed an even larger role as president and COO of Methodist Le Bonheur Healthcare. In 2012, he was honored as one of Modern Healthcare’s Top 25 Minority Executives in Healthcare. Dana Dye recently became the first registered nurse to serve as administrator and CEO of Baptist Memorial Health Care’s flagship hospital. Formerly the Chief Nursing Officer for Baptist, she no doubt brings a unique and valuable perspective to one of Tennessee’s highest volume hospitals. Jeremy Clark took the helm of Saint Francis Bartlett in 2012 after serving as vice-president and chief of staff for Tenet Healthcare. He recently was named to the Becker’s Hospital Review 2014 list “Rising Stars: 25 Healthcare Leaders Under 40.”

The stage is set for the continuation of the gripping drama known as “Healthcare in the 21st Century.” It is difficult to predict the turns this tale might take, so improvisation often becomes critical for many decision makers.

One key plotline is the country’s response to the Affordable Care Act – still drawing plenty of attention from the critics – with its ramifications felt in every nuance of action. Dwindling reimbursement, resources and numbers of primary care physicians have meant incredible cliffhangers. Government regulation has created complex plot twists, testing everyone involved. Healthcare administrators are determined to give their best performance as an expectant audience sits on the edge of their seats . . . or examining room tables.

A group of six healthcare professionals who will play key roles in 2015’s developing local story and whose group photo is on the cover of this publication, generously agreed to share their thoughts with the Memphis Medical News about what might unfold. So, as the theater lights dim, let’s take a look at their forecasts.

more of his regulatory power through various agencies as a way to get things accomplished in these next years of presidency.

Denise Burke, partner, Waller, Lansden, Dortch and Davis, LLP, and former medical quality management employee, could foresee possible results of the Republican takeover of the Senate. She said the Senate now has an opportunity to reshape some of the most unpopular aspects of the law, such as eliminating less than 40-hour workweeks to counteract employers’ eschewing provision of health insurance. In addition, she cited possible positive tweaks to taxes.

“The medical device community in Memphis should keep an eye on reform to the medical device tax, which critics see as a 2.3 percent tax on innovation,” Burke said. “With bipartisan backing from Democratic senators, this community could be one of the early winners in the new landscape.”

Regardless of changes in Congress, there are still numerous obstacles facing small medical practices. Ed Avery, administrator, Consolidated Medical Practices of Memphis, PLLC, had several pieces of advice.

health care decisions—not the recent shift in congressional political power, said Dana Dye, vice president, administrator and CEO of Baptist Memphis. Hospitals will strive to be great healthcare providers, no matter who is in control, she predicted. Jeremy Clark, CEO of St. Francis Bartlett, and Robert Sumter, PhD, executive vice president and chief operating officer of Regional One Health, agreed. The consensus seems to be that effects of a rebalanced Senate, now Republican-controlled, is difficult to predict.

“My guess is that Congress will attempt to modify the Affordable Care Act, but you won’t see a total repeal because there are elements that are popular with the existing populations, such as being able to insure children up to 26 years of age and the removal of pre-existing conditions,” said Michael Ugwueke, DHA, FACHE, president and COO, Methodist Le Bonheur Healthcare.

Ugwueke predicted continued emphasis on Sustainable Growth Rate (SGR) and Medicaid expansion and that President Obama would likely use

“The state of Tennessee is working with insurance carriers to merge commercially insured patients with government employees and TennCare. Practices have been able to balance their cash flow by balancing the percentage of commercially insured patients with those of lower paying governmental plans,” he said. “The merger of these segments could create a race to the bottom for reimbursement.”

Another cash flow issue is high deductible plans, creating an environment where the doctor is a bill collector for the insurance companies and patients are reluctant to get necessary testing, Avery explained. He also warned physicians and practice administrators to do their homework, as it is not beneficial for everyone to sign up for all plans.

seeing more patients with high out-of-pocket insurance plans, and these patients are sicker, said Dye.

“Hospitalists are seeing sicker patients, with more focus on 24-hour service as opposed to seeing patients during the day. The very nature of hospital patients is that they tend to be sicker,” she added.

Dye, who was a nurse administrator for years before becoming Baptist’s first female CEO, expressed that nurses are working in a highly regulated and complex environment with electronic medical

records. Meanwhile, they are being challenged with ever-changing technology, medical procedures and treatments requiring continuing education and study. Recruiting and retaining good bedside nurses in this environment is a challenge, she said, as they have so many options from case management to working in minor medical centers or surgery centers.

Echoing the challenges facing nurses, Clark noted the increasing acuity of hospital patients as a result of illnesses associated with increasing life expectancies. Then, there is the increasing severity of disease.

“With the globalization of our society, nurses must be able to adapt quickly to situations they may have never faced before, as the recent Ebola situation has demonstrated,” Clark said.

As a level I trauma center, Regional One sees length of stay as a challenge. In past, a hospital kept a patient in the same place until that patient was healed and ready to return home. Today, patients are moved to differing levels of care. “Providing the appropriate level of care is vital for the patient and for our health care system. In 2015, we will continue our work to minimize the patient’s length of stay and transfer patients to the next level of care when appropriate,” said Dr. Sumter.

Most of the experts interviewed mentioned that a major challenge is moving from a fee for service system to a value based system. Burke said that financial incentives do not currently

align for physicians at this time. They are asked to design systems to reduce unnecessary care at a time when they are still paid based on the volume of services provided for most patient populations.

“It is difficult to live in both worlds,” said Burke. “All experts agree that there is significant waste in the system that can be removed through significant investment in infrastructure and better coordination of care, without sacrificing patient care.”

Coming AttractionsWith all the uncertainty in the

healthcare forecast, one would think it difficult to see the positives, yet these experts pointed to opportunities.

Ugwueke looks ahead to innovations driven by consumerism in healthcare and is excited for Methodist Le Bonheur Healthcare to find ways to help Memphis become a healthier community.

The shift in healthcare delivery from episodic care to preventative care is daunting, said Dr. Sumter, but it is a tremendous opportunity.

“It directly lines up with our mission to improve the health and well-being of the community we serve. We will be here for those who need a hospital, but we also want to be here for preventative care and outpatient services to reduce the need for hospitalization,” he said.

He also noted that meeting the requirements of meaningful use is a challenge with positives. Driving Regional One into the electronic age,

he said, it moves them away from paper as well as benefiting patients. “Their health information will be much more accessible, allowing them to take greater ownership in their health and strengthening their relationship with their health care providers.”

Collaboration was another emerging theme. Dye referenced managed care groups such as Select Health Alliance, started as a physician-led, clinically integrated organization in 2012. Its role, she said, is to improve the quality of patient care and preserve the independence of physicians.

One of the most hopeful things anticipated is emerging technology, which will completely transform healthcare. Genetic sequencing has given way to genetic testing, which not only allows prediction of what a patient might encounter, but also how to treat it. Personalized medicine, or the treatment of disease according to what drug has been genetically identified to be most effective for the particular patient, is already being used. That definition of “personalized medicine” broadens as the available technologies expand, including real-time tracking for patients to monitor their individual health.

“There are new consumer-facing technologies coming out every day such as a cell phone app that allows a patient to send an EKG to their cardiologist by placing his or her thumbs on the smart phone for a few seconds,” said Burke. “Similar apps allow hypertensive patients to monitor their blood pressure, and gives cardiologists more meaningful data than ever before, allowing BP information to be collected while the patient is sitting in traffic, in a stressful meeting or even while sleeping.”

Dirtiest four-letter word of digital health: “SILO”

“Silo” is a business term that has been passed around and discussed at many a board room table during the last 30 years. Unlike many other trendy management terms, this one has not disappeared over time. Silos are seen as a growing pain for most organizations of all sizes.

As written by Patrick Lencioni in his book, Silos, Politics and Turf Wars; “Silo-and the turf wars they enable devastate organizations. They waste resources, kill productivity, and jeopardize the achievement of goals.”

Just as an organization evaluates internal and external threats, they must include silos as major threats.

In their book, Systems Thinking Basics, Virginia Anderson and Lauren Johnson define systems thinking as “holistic and big-picture view of the whole. It is recognizing the interconnections between parts of a system and synthesizing them into a unified view.”

Healthcare Policy And ReformThe mind-set present among most healthcare stakeholders is

that they do not wish to share information with others to create a picture view from a macro-perspective. This type of mentality will reduce the efficiency of the overall operation, reduce morale, and most likely will contribute to the demise of parts or to the whole intention of reform.

• “CMS has done more to add to the costs of healthcare, with hurdles and regulations that they themselves could comply with. (Look at the organizational charts for both HHS and CMS)”

• “The first comment and criticism I have is that both HHS and CMS rely too much on processes and not enough on outcomes.”

• “The Obama Administration was obsessed with healthcare reform policy, but oblivious to the nitty-gritty of implementation.”

• “The biggest challenges to providers this year are meaningful use, HIPAA, the Administrative Simplification Act and the implementation of ICD-10, October 1, 2015.”

• “Processes upon processes with a changing target, there can be no positive outcomes. The providers and the patients will most definitely know / feel the negative unintended consequences and that is why the ACA will fail. It is not if it will fail, it is when it will fail, unless change and management within HHS / CMS changes and changes fast.

As I mentioned earlier, processes upon processes with ever-changing moving targets and the uncertainty in the amount of change is what we face each day.

With change, there is conflict and with new information, a spiraling of information. This new flavor of the month involves all levels of an organization, whether the stakeholders are directly or indirectly affected.

There are four stages in the change process. First, there is disruption, which causes anxiety, silo protection, and personal gain. The second stage is the intensification, rush, and chaos to make the changes. The time that individuals need to accept or be willing to accept the consequences of the change frequently is not properly allocated. The third stage is the adaptation and evolution stage. (Am I allowed to use the word evolution after this past election?)

This stage incorporates the formation of the change. What will the model look like and how will we get there and in what timeframe. The fourth and last stage is the stability phase of change. Once there is acceptance, it does become easier, but does going through this change process always make it better?

We as individuals need to accept, to make the new paradigm really work.

Despite the potential for improving patient care, a number of healthcare companies have been slow to go digital. Although some medical organizations have blamed the cost of implementation and the uncertain return on investment as reasons to stay away, one study now suggests that the Health Insurance Portability and Accountability Act (HIPAA) is keeping healthcare providers from diving in. The study; which was released in December, 2013, by the Bipartisan Policy Center, states that HIPAA is “often misunderstood, misapplied and over-applied in ways that may inhibit information sharing unnecessary.

“Despite the significant growth of electronic health information, for the most part, data continues to reside in silos – inaccessible for purposes of improving health as well as the quality, cost and experience of care,” according to the report.

Patrick Soon-Shiang, MD is a medical researcher, professor, surgeon and self-made billionaire, whose aim is solving the interoperability crisis and connecting the industry in the most powerful of ways – a direct response of the discontent with the federal government’s EHR Incentive Program.

He met with President Obama in 2008 with one single plea: “Please, do not fund EHR systems that will create what I call, medical bridges to nowhere, and unfortunately they’ve done exactly that. My concern is with the way meaningful use has been set up to capture processes. What we really need to do is capture outcomes.”

Members of the House Energy and Commerce Committee issued a report last year, saying health information technology would be “unable to truly transform our health system unless they can easily locate and exchange health information.” Spearheaded by Rep. Michael Burgess, R-Texas, House members said, “more must be done to bolster interoperability nationwide. Adopting these standards by 2018 is reasonable and should be the highest priority for the Office of the National Coordinator for Health Information Technology (ONC), lawmakers wrote. The office of ONC seemed to agree, with its new chief Karen DeSalvo, MD calling interoperability the “Top priority for 2014” earlier this year.

HHS Secretary Sylvia Mathews Burwell, in October, appointed Dr. DeSalvo to serve as acting assistant of health, effective immediately. Lisa Lewis, a lawyer who was ONC’s chief operating officer was named acting ONC coordinator. DeSalvo will serve as acting Assistant Secretary “while maintaining her leadership of ONC.” She will continue to work on high-level policy issues at ONC, and ONC will follow the policy direction that she has set.”

DeSalvo will continue as chair of the Health IT Policy Committee, continue leading the development of the interoperability road map and remain involved in meaningful-use policy making. She will also continue to co-chair HHS Cross-departmental work on delivery-system reform. Lewis will provide day-to-day leadership at ONC.

Dr. Joseph Schneider, chief medical information officer at Baylor Scott & White Health, in Dallas, expressed concern. “DeSalvo trying to handle two demanding jobs at the same time seldom has positive outcomes for anyone. If you give people too many things to do they don’t get it done terribly well,” he said. (Modern Healthcare, November 3, 2014.)

Earlier this year, the Department of Health and Human Services, Office of Inspector General (OIG) published a proposed rule to codify changes made by the Affordable Care Act (ACA) which authorize severe penalties for the failure to return Medicare and Medicaid overpay-ments promptly. Providers face civil monetary penalties, assessment, and exclusion for, among other things, failure to report and return a known overpayment within 60 days of the date the overpayment was identified or the date any corresponding cost report is due, if applicable. The proposed rule interprets the penalty as a per-day penalty of up to $10,000 for each day that a provider fails to report and return each overpayment. Even the lesser of the 60-day penal-ties could be crippling for a healthcare provider, and the per-day penalty is a heavy-handed approach that is intended to scare providers into settling cases rather than risk penalties that could bankrupt their organizations.

In July, the U.S. Department of Justice and the New York State Attorney General’s office filed a complaint charging Healthfirst, Inc., a not-for-profit managed care organization, and a number of sponsoring hospitals with failing to return overpayments within the 60-day period required by the ACA and New York state law. This is the first instance of enforcement of the 60-day rule, and all signs indicate that this is merely the opening salvo in what looms as a challenging new era for healthcare providers.

The Healthfirst Complaint states that sometime around 2009, “due to a software compatibility issue,” Healthfirst’s remittances to participating providers erroneously indicated that additional payment could be sought from secondary payors. As a result, numerous providers began gen-erating invoices automatically through electronic billing systems to secondary payors, includ-ing Medicaid. In September 2010, the NY State Comptroller’s Office raised questions regarding claims submitted on behalf of Healthfirst’s sponsoring hospitals. In February 2011, following an internal investigation, the hospitals were informed by an employee that more than 900 claims dating back to May 2009 had resulted from the billing error. The complaint continues that the hospitals did nothing further with the employee’s analysis and reimbursed the DOH for only five of the improperly submitted claims. The complaint concludes that the hospitals fraudu-lently delayed repayments for up to two years after knowing of the extent of the overpayments and “thus intentionally or recklessly failed to take the necessary steps to timely identify the claims affected by the software issue or to timely reimburse DOH for those affected claims that resulted in overbilling to Medicaid.” The proposed rules and the Healthfirst case are only one indication of the current aggressive healthcare environment. This year, for the first time in West Tennessee, we have seen Medicare contractors implement payment suspensions prior to the conclusion of investigations based on “credible allegations of fraud,” a standard that may be met merely by a hotline tip or findings of a Medicare audit contractor.

Now more than ever, providers need to be diligent about filing claims appropriately. Compli-ance programs need to be dusted off, updated and – most importantly – followed. Employees need to be trained on policies of what to do in the event of an audit or investigation before such an event occurs. Upon notice of an audit or investigation, physicians should notify their insurance carriers. Many physicians in Tennessee are insured by the physician-owned and physician-friendly State Volunteer Mutual Insurance Company which may provide some limited legal expense reimbursement coverage for investigations by governmental agencies or contractors.

It is unfortunate that providers are required to expend time and money avoiding or defending such aggressive enforce-ment actions at a time when energy and money is need to redesign care models, not to mention, treat patients.
