MERCHANT SHIPPING (SEAFARERS) (MEDICALSTORES) REGULATION(Cap. 478 sections 96, 100 and 134)

PART I

PRELIMINARY

1. (Omitted as spent)

2. Interpretation(1) In this Regulation, unless the context otherwise requires—“chemical” (化學品 ) means any chemical listed in the following

International Maritime Organization publications—(a) the General Index of the International Maritime

Dangerous Goods Code;(b) the Index of Dangerous Chemicals Carried in Bulk; or(c) Chapter XIX of the International Code for the

Construction and Equipment of Ships Carrying LiquefiedGases in Bulk;

“crew” (船員) means all seafarers employed on board a ship;“employer” (僱主) means the person for the time being employing

the master;“IMDG Code” (《國際海運危險貨物守則》 ) means the 1988

edition of the International Maritime Dangerous Goods Codepublished by the International Maritime Organization;

“offshore installation” (離岸裝置) means any installation which ismaintained, or is intended to be established, for underwaterexploitation or exploration;

“seagoing” (海域航行), in relation to a ship, means any ship otherthan a ship which navigates exclusively within inland watersor in areas where port regulations apply;

“submersible craft” (潛水艇) means any vessel used or designed foruse under the surface of any waters;

“voyage” (航程) means a journey from a port to the next port of callof a ship (which may be the same port).

(2) Any reference in this Regulation to the British Pharmacopoeia,the European Pharmacopoeia, or the British NationalFormulary shall in its application to a particular case beconstrued as a reference to the edition thereof current at, or notmore than 3 months before, the time when any requirement ofthis Regulation has effect.

(3) Any reference in this Regulation to a publication (other thanthose referred to in subsection (2)) includes a reference to anyamendment thereof published before the date on which thisRegulation is published in the Gazette (and, in the case of theUnited States Pharmacopoeia, means the edition current atsuch date, as so amended); and shall include any documentamending the same, or shall mean any new edition thereoftogether with any document amending the same, which isconsidered by the Authority to be relevant from time to time.

(4) Any reference in this Regulation to a specified scale shall be areference to that scale of medicines and medical storesspecified in Schedule 1.

3. Application(1) This Regulation shall apply to all Hong Kong ships other than

—(a) pleasure vessels or fishing vessels;(b) offshore installations whilst on or within 500 metres of

their working stations; or(c) submersible craft unless being operated without shore or

surface vessel support.(2) The Authority may grant exemptions from all or any of the

provisions of this Regulation for classes of cases or individualcases on such conditions, if any, as he thinks fit and may,subject to giving reasonable notice, alter or cancel any suchexemption.

PART II

MEDICINES AND MEDICAL STORES

4. Medicines and medical stores(1) The medicines and medical stores of the scale specified in

column 2 of the table to this section shall be kept on boardevery ship satisfying the conditions set out in column 1 of thattable in the numbered paragraph opposite that scale; and if aship satisfies the conditions contained in more than one of thenumbered paragraphs in column 1, medicines and medicalstores kept on board shall comply with the sum of therequirements of the scales specified opposite those paragraphs.

(2) Any ship falling within paragraph 3 of column 1 of the table tothis section need to have on board for the purposes ofcomplying with the requirement to carry the medicines andmedical stores of Scale III only those medicines or medicalstores laid down in the International Maritime OrganizationMedical First Aid Guide for use in Accidents InvolvingDangerous Goods, 1985 edition (published by theInternational Maritime Organization) as the treatments to befollowed after contact with the chemicals carried by that ship,or residues present from earlier voyages.

(3) There shall be kept on board every ship on a voyage on whicha medical practitioner is carried as a member of the crew, anyadditional supplies which he may reasonably require havingregard to the size of the crew, the number of passengers onboard and the intended voyage.

5. Standards of medicines and medical storesAll medicines and other medical stores required by this Regulationto be kept on board a ship shall conform to the standards andrequirements of the British National Formulary or the BritishPharmacopoeia or the European Pharmacopoeia or the United StatesPharmacopoeia and with the requirements of and with thespecifications set out in Schedules 1, 2, 3 and 4.

6. Packaging and labelling of containers(1) Without prejudice to any other enactment, any container of

medicines or other medical stores required by section 4 to bekept on board a ship—(a) shall have, in the English language, on a label the

particulars specified in subsection (3);(b) in the case of a container of tablets or capsules, shall be

capable of reclosure to prevent ingress of moisture;(c) in the case of a container of disinfectant, shall not show

deleterious reaction with the disinfectant after storage innormal conditions for 6 months or less;

(d) in the case of a container of insecticide, shall be air­tight,water­tight, packed in a suitable and sturdy case and, ifthe container is a pressure canister, have a cap or othermeans of protecting the valve against accidental openingwhen the canister is not in use; and

(e) in the case of medicine or disinfectant not in thecontainer supplied by its manufacturer, shall be packedin a sturdy, brown­coloured or non­translucent container.

(2) Any label referred to in subsection (1)(a) shall either be firmlyaffixed to the container and rendered resistant to moisture byvarnish or other effective means or be an integral part of thecontainer.

(3) The particulars required by subsection (1)(a) to be shown onlabels are—(a) the ordering name by which the medicine or medical

store is referred to in Schedules 1 and 2;(b) any storage requirements laid down in any of the

publications referred to in section 5, elsewhere in thisRegulation or in Schedule 1;

(c) if the medicines or medical stores are perishable, theexpiry date as defined in section 8;

(d) the name and address of the supplier of the medicinesand medical stores, the product licence number and batchnumber;

(e) in the case of any container of a disinfectant or of anantiseptic prescribed in any of the scales set outinSchedule 1, the dilution recommended for anypurposes stated thereon;

(f) in the case of any container of an insecticide prescribedin any of the scales set out in Schedule 1, instructions foruse and precautions to be taken as detailed in Schedule 4;

(g) in the case of a container of hypochlorite, a noticeindicating that the chemical may combust spontaneouslyand that the hypochlorite should be stored in a cool, darkplace; and

(h) any further information required by Schedules 1, 3 and 4.

7. Storage of medicines(1) Any medicine or medical store shall be stored in accordance

with any instructions on its container or prescribed inSchedule1.

(2) Any medicine shall, where applicable, be stored in accordancewith the requirements for controlled drugs contained in theShip Captain’s Medical Guide, and subject thereto, unless it isrequired to be kept in a refrigerator or in a first aid satchel orbox, shall be stored—(a) in the medical cabinet if, under the Merchant Shipping

(Seafarers) (Crew Accommodation) Regulation (Cap.478 sub. leg. I), the ship is required to have a medicalcabinet; or

(b) in a cool, dry, locked cabinet or locked container.(3) Any medicines or medical stores kept in a hyperbaric

decompression chamber or otherwise in such a way as not tobe readily accessible at all times to the master or any personauthorized by him shall not be taken into account in respect ofthe requirements of section 4.

8. Replenishment of dated medicines(1) Where—

(a) a ship is required pursuant to section 4 to have on boardany medicine or other medical stores in accordance withany of the scales set out in Schedule 1 or 2; and

(b) any label required by section 6(1)(a) to be borne by anycontainer of any such medicine or other medical stores,indicates a date after which the medicine or othermedical store contained in it is not to be used (hereaftercalled “the expiry date”),

that medicine or medical store shall be replaced at the earliestpossible date after the expiry date, and in any case within 3months of the expiry date.

(2) Medicines or medical stores which have passed the expiry dateshall, once replacements have been obtained, or after 3months, whichever is the earlier, be disposed of in accordancewith the Ship Captain’s Medical Guide.

PART III

MISCELLANEOUS

9. Offences(1) Where any requirement under section 4, 5, 6, 7 or 8 is

contravened in respect of a ship, the owner of the shipcommits an offence and is liable on conviction to a fine atlevel 4.

(2) It shall be a defence for any person charged in connection witha contravention of section 4 to show that the deficiency wascaused by medicines and medical stores being used for theirpurpose and that it has not been reasonably practicable toreplace them.

(3) It shall be a defence for a person charged under this section,including a person charged by virtue of subsection (4), toshow that he took all reasonable precautions and exercised alldue diligence to avoid commission of the offence.

(4) Where an offence under this Regulation is committed, orwould have been committed except for the operation ofsubsection (3), by any person due to the act or default of someother person, that other person shall be guilty of the likeoffence, and a person may be charged with and convicted ofthe offence by virtue of this subsection whether or notproceedings are taken against the first­mentioned person.

10. Inspection and detention(1) The Authority, or a person authorized by him for the purposes

of this section, may inspect a ship for the purposes ofascertaining whether it complies with the requirementsofsections 4, 5 and 6.

(2) Where the Authority or a person referred to in subsection (1)has carried out an inspection of a ship pursuant to thatsubsection and is not satisfied that the ship complies with therequirements referred to in that subsection, then the Authorityor that person, as the case may be, may, if that ship is withinthe waters of Hong Kong, detain that ship until the Authorityor that person, as the case may be, is satisfied that the shipcomplies with those requirements.

(3) The Authority and a person referred to in subsection (1) shallnot in the exercise of his powers under this sectionunreasonably delay or detain a ship.

11. Amendment of SchedulesThe Authority may, by notice in the Gazette, amend Schedule1, 2,3 or 4.

SCALES

1. In the case of ships required to carry Scale I items, the items to becarried are those in Scale IA provided that the number of persons onboard does not exceed 30. When more than 30 persons are carried,then in addition to the items required under Scale IA, 1 set of eachof the items listed in Scale IB must be carried for each additional 30persons or part thereof but it will not be necessary to carry morethan Scale IA plus twice Scale IB­which is adequate for 99 persons.Ships with greater complements must carry a medical practitionerwho may require such additional supplies as he considers necessary.

2. Where an item is in a bottle, container, tube, ampoule, etc. of agiven capacity, the bottle, container, tube, ampoule, etc. shallcontain that capacity of the item unless otherwise stated in thescales. The use of the word “ampoule” should not be taken toexclude the use of pre­filled syringes where available and preferred.

3. The quantity of any items to be included in the First Aid Box orSatchel in Scale I is in addition to the quantity for the same itemsrequired to be carried in the ship’s appropriate scale. Similarlywhere a ship is required to carry items of Scale I and also of ScaleIII and/or IV, the items in Scale III and IV are in addition to those inthe ship’s basic scale.

PART 5­SCALE IV

1. The notes at the head of this Schedule apply to this Part.

2. All of the medicines in this scale shall be kept in a medicalpractitioner’s attache case, as should most of the medical stores inthis scale. Any item which cannot be included in the case should,where possible, be strapped to it; otherwise, the item shall be kept ina place adjacent to the case. The case shall be locked, the key to thecase kept in the possession of the master (or someone nominated byhim), and the case kept in a locked cabinet. The case should belabelled clearly as follows—“The medicines in this case are to be used only by a qualifieddoctor, or by someone under the direct supervision of a doctor onboard the ship.”.

3. The obtaining, use, and disposal of morphine from this case shall berecorded in the ship’s controlled Drugs Register, as stated in “TheShip Captain’s Medical Guide”.

1. When a ship is carrying a chemical (in quantities in excess of thosedefined in Volume 1, Section 18 of the IMDG Code) as whole orpart of the cargo the master must ensure that the correct antidote tothe chemical (plus the necessary ancillary equipment, e.g. syringes)is carried.

2. The correct antidote can be identified from the following table. Thetable numbers shown at the top of each column relate to the tablesin the IMO Medical First Aid Guide (MFAG).

3. The IMO MFAG has been adopted in place of the ChemicalSupplement to the SCMG and the following points should be noted—

(a) where Ampicillin is recommended by the MFAGAmoxycillin should be used instead.

PRECAUTIONS AGAINST MALARIA

1. No medication can be guaranteed to protect against malaria in everyinstance. Chloroquine is regarded as the most generally effectivedrug for this purpose. Even in some areas of the world where strainsof malarial parasites are developing which can resist its effect chloroquine remains an effective preventative when used inconjunction with other tablets.

2. Although the overall area of the world in which there is a risk ofmalaria changes only slowly, the chloroquine­resistant strains arespreading quite rapidly and it will be necessary to revise this Schedule from time to time. It must be stressed that advice from acompetent local source should be followed in preference tothisSchedule when the former is available.

3. Although “Fransidar” is included in the medical scale (Scale I only),it has dangerous side­effects and is only to be used under veryspecific medical instructions when treating a case of malaria. Itshould not be used as a routine preventative drug.

4. The preventative doses of anti­malarial drugs should start one weekbefore reaching such a port. Vessels regularly trading in such areaswill have established their own regimes but masters of ships boundfor malarial areas should ensure that anti­malarial tablet treatment isstarted 7 days before arrival at the first port, using the map whichforms part of this Schedule.

5. Anti­malarial tablet treatment varies geographically depending onthe nature and resistance of local malarial germs.

(a) Areas where chloroquine resistance has not beenreported: 2 chloroquine tablets weekly or 2 proguaniltablets daily.

(b) Areas where chloroquine resistance is not yet widespreadand predominantly low grade (e.g. East Africa and theIndian subcontinent): 2 chloroquine tabletsweeklytogether with 2 proguanil tablets daily.

(c) Areas where chloroquine resistance is widespread (e.g.South America, South East Asia (except the Indiansubcontinent) and the Pacific Islands): One maloprimtablet weekly together with 2 chloroquine tablets weekly.

Treatment should be continued for 6 weeks after leaving a malarialarea. The development of fever either in a malarial area or after leaving amalarial area requires medical advice as soon as possible.

DISINFECTANTS AND INSECTICIDES

PART 1

Specification of Disinfectants

1. General description­The disinfectant shall be a white fluid and shallbe a finely dispersed, stabilised emulsion containing coal­tar acidsor other phenolic bodies, with or without hydrocarbons.

2. Germicidal value and the method of its determination­Thegermicidal value shall not be less than 1.7 when determined by themodified Chick­Martin method as laid down by the BritishStandards Specification No. 808, confirmed by PD 2627, 1960.

3. Stability before dilution­On standing for 3 months at ordinarytemperatures (5 to 30 ) the disinfectant fluid shall notprecipitate nor show separation of more than traces of oil. Acreamed fluid which can be rendered homogeneous by gentlemixing may be carried.

4. Stability after dilution­The disinfectant fluid shall be miscible withdistilled water and artificial seawater (27 grams of sodium chlorideand 5 grams of crystalline magnesium sulphate (MgSO47H2O)dissolved in and made up to 1000 mL with distilled water andfiltered before use) in proportions of 1, 2, 3, 4 and 5% to give astable emulsion which shall not break nor show more than traces ofseparation of either top or bottom oil, when maintained at 18 to22 for 6 hours, the sample and diluent having each been broughtto a temperature within that range before mixing by pouring thesample into the diluent from a cylinder.

5. Odour and corrosive action­The fluid shall be free fromobjectionable smell, and when used as directed, shall have no morecorrosive action on metals than that occasioned by the wateremployed as a diluent.

PART 2

Specification of Insecticides and Means of Application

6. Insecticide formulations—(a) when used in accordance with instructions for use which

shall be specified on the label affixed to the container ofan insecticide spray solution or insecticide powder—(i) shall be effective for the purpose specified in those

instructions; and(ii) shall not be harmful to humans;

(b) shall be suitable for use in crew and passengeraccommodation and in spaces used for the preparation offood; and

(c) shall be free from offensive odour and, so far as possible,shall be non­staining.

7. Insecticide formulations shall be—(a) in the form of a spray solution not having a flash point

lower than 48.9 (120 ) when tested by the Abelmethod and containing an effective concentration ofinsecticide, when applied as a space spray or as aresidual spray in accordance with instructions referred toin section 6(a) by either—(i) a hand­operated, continuous­action sprayer fitted

with a nozzle capable of producing a fine mistwithout coarse droplets; or

(ii) a pre­packed press­button pressure canister; and(b) in the form of a powder packed in a dredger and effective

when applied to the body or clothing of an infectedperson in accordance with the instructions referred toinsection 6(a).
