    2012 Legislative Session

    January 10 - March 9, 2012

    The 2012 Legislative Session has come to a close, with the Florida Legislature adjourning Sine

    Die at 11:59 PM on Friday, March 9th. The 2012 Session proved to be a difcult process, with

    reapportionment and an increasingly difcult economic outlook placing challenges on the State of

    Florida. While over two thousand bills were led this year, only a few hundred passed, and very

    few have gone to the Governor for his signature or veto.

    Earlier last month, the House and Senate took up the new House, Senate, and Congressional

    maps, and passed SB 1174 (Congressional Maps) and SB 1176 (House & Senate Maps). Lawsuits

    against the maps were immediately led by concerned citizens working with interest groups. On

    Friday, the sixtieth and nal day of Session, the Florida Supreme Court notied the Legislature

    that they had accepted the House maps, but were marking the Senate maps as invalid. As

    such, Governor Rick Scott has issued a proclamation convening the Florida Legislature in an

    Extraordinary Apportionment Session commencing at 1:00 PM, Wednesday, March 14, 2012,

    and extending through 11:59 PM, Wednesday, March 28, 2012. During this time, the House and

    Senate will conduct meetings and oor time to adjust the Senate maps and re-submit them to the

    Supreme Court.

    The posturing of the respective House and Senate budgets has been the other primary focus of the

    2012 Session. The Legislature is required to pass a balanced budget every year. On Friday, theHouse passed the budget by 80-37, and the Senate passed it by a vote 32-8. The Fiscal Year 2012-

    2013 budget is almost exactly $70 billion, and takes effect on July 1st.

    In the following pages, you will nd updates on some of the issues we have been tracking for you.

    The status of each piece of legislation is current as of Tuesday, March 13, 2012. Many bills still

    need to be prepared and signed in order to send to Governor Rick Scott, for his signature or veto.

    Environmental Regulaon

    House Bill 503 by Representave Jimmy Patronis/Senate Bill 716 by Senator Mike Benne

    House Bill 503 has been cosponsored by Representavs Broxson, Coley, Dorworth, Drake, Mayeld, Oliva, Trudi

    Williams, and Young. This is the second year in a row Representave Patronis has championed this bill and is

    moving it through the process quickly.

    In overview, the bill does the following:

    More commercial or industrial development projects will qualify for expedited perming;

    Duplicave and costly agency and local government reviews for environmental permits will be

    eliminated;

    Agencies will act on environmental permits faster;

    Claries the sequencing of permits by local and state governments;

    Reduces permit decisions from 90 days to 60 days;

    Directs the Department of Environmental Protecon (DEP) to seek authority from the United States

    Army Corps of Engineers to issue small scale wetland permits (less than 3 acres);

    Expands the circumstances where general permits and self-cercaon can be used to simplifyperming

    House Bill 503 was been referred to the following House commiees:

    State Aairs Commiee

    The bill passed the Agriculture and Natural Resources Subcommiee on December 6th as a commiee substute.

    The vote was 13-1. Commiee Substute for House Bill 503 was heard in the House Rulemaking and Regulaon

    Subcommiee on January 11th and passed as a commiee substute for commiee substute. The vote was12-3.

    CS/CS/HB 503 passed the House Agriculture & Natural Resources Appropriaons Subcommiee on January 25th

    by a vote of 13-1.

    CS/CS/CS/HB 503 was taken up by the State Aairs Commiee on February 1st. There was a delete-everything

    amendment oered by Rep. Patronis, which was added to the bill. The bill passed the commiee by a vote of

    16-0.

    HB 503 passed the Florida House by a vote of 112-0 on February 23rd. The Senate took up HB 503 on March 8th,

    and substuted in lieu of SB 716. The Senate passed HB 503 by a vote of 40-0. The Enrolled text of HB 503 has

    been led, and the bill now awaits the signature of the presiding ocers. At that point, it will be presented to

    the Governor for his signature or veto. We have aached the Enrolled text for your review.

    The companion bill in the Senate is Senate Bill 716 by Senator Mike Benne. The bills are similar.

    Senate Bill 716 was referred to the following commiees in the Senate:

    Senate Bill 716 was heard in Senate Community Aairs on January 12th and passed as a commiee substute

    8-0. The next stop is the Senate Environmental Preservaon and Conservaon Commiee.

    CS/SB 716 was on the agenda for the Environmental Preservaon & Conservaon Commiee on February 6th.

    The bill had a delete-everything amendment put on in the commiee, as well as an amendment to the delete-

    everything amendment.

    CS/CS/SB 716 was on the agenda for the General Government Appropriaons Subcommiee for February

    28th. The bill passed the commiee with two amendments by a vote of 6-0. It was withdrawn from the Budget

    Commiee on March 6th, and placed on the Senate Special Order Calendar for March 8th. It was laid on the

    table, and HB 503 was taken up in substuon for the bill.

    Law Enforcement

    House Bill 1383 by Representave Rich Glorioso/Senate Bill 1782 by Senator Jack Latvala

    MIAF followed House Bill 1383 and Senate Bill 1782 very closely this session.

    Simply, the bill transfers all powers, dues, funcons, records, oces, personnel, etc. from the Division of Law

    Enforcement within the Department of Environmental Protecon to the Division of Law Enforcement within

    the Florida Fish and Wildlife Conservaon Commission. The bill also transfers sworn posions funded by

    Conservaon and Recreaon Lands Program within the Department of Agriculture and Consumer Services and

    the aquaculture invesgator at the Department of Agriculture and Consumer Services to the Division of Law

    Enforcement at the Florida Fish and Wildlife Conservaon Commission.

    Senate Bill 1782 by Senator Latvala was referred to the following commiees:

    Agriculture

    Budget

    SB 1782 was on the Senate Environmental Preservaon & Conservaon Commiee agenda for Monday, January

    30th. Sen. Latvala oered a delete-everything amendment, and the bill passed with the amendment by a vote

    of 7-0.

    SB 1782 passed the Senate Agriculture Commiee on February 13th by a vote of 7-0, and passed the Senate

    Budget Commiee on March 2nd by a vote of 21-0. It was placed on the Senate Special Order Calendar for

    March 8th, at which point it was laid on the table in lieu of HB 1383.

    House Bill 1383 by Representave Glorioso was referred to the following commiees:

    Agriculture & Natural Resources Appropriaons Subcommiee

    Appropriaons Commiee

    State Aairs Commiee

    HB 1383 was on the Agriculture & Natural Resources Subcommiee agenda for Tuesday, January 31st. Rep.

    Glorioso oered a strike-all amendment to the bill, and it passed by a vote of 15-0.

    Several weeks ago, the bill had its reference to the Agriculture & Natural Resources Subcommiee removed. It

    was re-referenced to the full Appropriaons Commiee. It passed the Appropriaons Commiee by a vote of

    19-0.

    The bill passed the State Aairs Commiee by a vote of 17-0. HB 1383 was passed on the House oor on

    February 29th by a vote of 115-0. The Senate took up the bill on March 8th, at which me it was substuted for

    its companion, SB 1782. The Senate passed HB 1383 by a vote of 40-0. The Enrolled text of this bill has beenled, and is aached to our report for your review. The bill will be signed by the presiding ocers, and then sent

    to the Governor for his signature or veto.

    Ethanol

    Marine Industries Associaon of Florida supported eorts by Senator Greg Evers and Representave Ma Gaetz

    to repeal the state mandate requiring fuel in Florida contain ethanol.

    House Bill 4013 sponsored by Representave Ma Gaetz and Senate Bill 238 sponsored by Senator Greg Evers

    were moving quickly through the commiee process but ran into strong opposion by the ethanol industry who

    argued that the benets of the product and the ethanol plants they are planning to build in Florida and the jobsthey will create are important.

    Marine Industries Associaon of Florida tesed on the record for their support of the bill.

    Below are the commiee references and bill history for both bills.

    Senate Bill 238 was referred to:

    Communicaons, Energy, and Public Ulies

    Commerce and Tourism

    SB 238 passed the Senate Communicaons, Energy and Public Ulies on November 2nd with a vote of 10-1.

    Senate Bill 238 was temporarily postponed in the Senate Commerce and Tourism Commiee on December 7th.

    Senator Don Gaetz is a cosponsor of Senate Bill 238.

    SB 238 died in the Commerce & Tourism Commiee.

    House Bill 4013 was referred to:

    Energy & Ulies Subcommiee

    State Aairs Commiee

    House Bill 4013 passed the House Energy and Ulies Subcommiee on December 6th with a vote of 10-4.

    HB 4013 died in the State Aairs Commiee.

    Some addional bills that we tracked for MIAF are as follows:

    Senate Bill 88 by Sen. Latvala and House Bill 13 by Rep. Frishe,

    Relang to Sovereignty Submerged Lands.

    These bills provide for the lease of sovereignt submerged lands for private residenal single-family docks and

    piers, private residenal mulfamily docks and piers, and private residenal mulslip docks. The bill deals with

    the term of the lease and lease fees, provides for inspecon of such docks, piers, and related structures by the

    Department of Environmental Protecon, and claries the authority of the Board of Trustees of the Internal

    Improvement Trust Fund and the department to impose addional fees and requirements, etc.

    Senate Bill 88 was referred to the following commiees:

    Environmental Preservaon & Conservaon

    Budget Subcommiee on General Government Appropriaons

    Budget

    SB 88 passed out of the Environmental Preservaon & Conservaon Commiee with one amendment on

    October 5th, by a vote of 5-0.

    The bill had its references to the Budget Subcommiee and full Budget Commiee removed. It was placed on

    the Senate Special Order Calendar for March 8th, at which point it was laid on the tabel and HB 13 was taken up

    in lieu of SB 88.

    House Bill 13 was referred to the following commiees:

    Agriculture & Natural Resources Subcommiee

    Agriculture & Natural Resources Appropriaons Subcommiee

    State Aairs Commiee

    The bill passed the Agriculture & Natural Resources Subcommiee on November 15th by a vote of 14-0.

    HB 13 passed the Agriculture & Natural Resources Appropriaons Subcommiee agenda on February 14th by a

    vote of 13-0. It then passed the State Aairs on February 22nd by a vote of 16-0.

    HB 13 passed the House of Representaves this week by a vote of 111-0. The bill was sent to the Senate, where

    it passed by a vote of 40-0 on March 8th. The Enrolled text of the bill has been led, and is aached for your

    review. The will be signed by the presiding ocers, and then sent to the Governor for his signature or veto.

    House Bill 1103 by Rep. Goodson and Senate Bill 1362 by Sen. Hays,

    Relang to Ordinary High-Water Mark for Navigable, Nondal Waterbodies

    These bills are idencal, and provide criteria for determining locaon of ordinary high-water line for navigable,

    nondal waterbodies, as well as providing denions & construcon.

    House Bill 1103 was referred to the following commiees:

    The bill passed the Agriculture & Natural Resources Appropriaons Commiee by a vote of 9-4. The bill has two

    more commiee stops before heading to the House oor.

    HB 1103 died in the Civil Jusce Commiee.

    Senate Bill 1362 was referred to the following commiees:

    Budget

    SB 1362 died in the Environmental Preservaon & Conservaon Commiee.

    House Bill 599 by Rep. Pilon and Senate Bill 824 by Sen. Dean,

    Relang to Migaon

    HB 599 and SB 824 revise legislave intent to encourage use of certain migaon opons, provide DOT

    or a transportaon authority the opon of parcipang in migaon projects, and requires DOT or

    a transportaon authority to submit a list rather than survey of threatened or endangered species &

    species of special concern aected by proposed projects. The bills also provide condions for release

    of certain migaon funds, prohibit implementaon of migaon plans under certain condions,

    and provide criteria that DOT must use in determining which projects to include in or exclude from

    migaon plans. Addionally, the bills authorize a governmental enty to provide or create migaon

    for projects other than its own under specied circumstances.

    Senate Bill 824 was referred to the following commiees:

    Budget Subcommiee on Transportaon, Tourism, and Economic Development Appropriaons

    Budget

    The bill passed the Transportaon Commiee on January 19th with one amendment. It passed

    the Environmental Preservaon & Conservaon Commiee on January 30th. The bill had four

    amendments oered by Sen. Dean, and they were all voted favorable. The bill is now CS/CS/SB 824. It

    has two remaining commiee references.

    SB 824 was on the Transportaon, Tourism, & Economic Development Appropriaons Subcommiee

    agenda for February 28th, and passed by a vote of 14-0. It withdrawn from the Budget Commiee, and

    placed on the Senate Special Order Calendar for March 9th. It was then laid on the table in lieu of HB

    599.

    House Bill 599 was referred to the following commiees:

    The bill passed the Transportaon & Highway Safety Subcommiee on January 11th with one

    amendment. It passed the Agriculture & Natural Resources Subcommiee on January 24th.

    HB 599 was taken up by the Tranportaon & Economic Development Appropriaons Subcommiee on

    January 31st by a vote of 14-0 with three amendments. It was then taken up in the Economic Aairs

    Commiee on February 8th, where it passed 15-0 with one amendment. It now moves to the House

    oor.

    HB 599 passed the House of Representaves by a vote of 99-17 on February 23rd, and was sent to the

    Senate. The Senate added and withdrew amendments, and passed the bill by a vote of 40-0. It was

    then sent back to the House. The House concurred with the Senate amendment, and passed the bill by

    a nal vote of 93-20. The 2nd Engrossed version of the bill has been led. The will be ordered Enrolled,

    then sent to the presiding ocers for signature, and then sent to the Governor for his signature or veto.We have aached a copy of the 2nd Engrossed version of the bill for your review.

    Thank you for the opportunity to represent MIAF in Tallahassee. The 2012 Legislave Session was

    a long and hard bale, and there could be more than one special session awaing the Legislature

    this summer. Thank you for all of your hard work to advance the marine industries in the State of

    Florida.

    definitions of the terms "blended gasoline" and120

    "unblended gasoline"; defining the term "alternative121

    fuel"; authorizing the sale of unblended gasoline for122

    certain uses; providing that holders of valid permits123

    or other authorizations are not required to make124

    payments to authorizing agencies for use of certain125

    extensions granted under chapter 2011-139, Laws of126

    Florida; providing retroactive applicability and127

    effect; providing a 2-year permit extension; providing128

    an effective date.129

    Be It Enacted by the Legislature of the State of Florida:131

    Section 1. Section 125.022, Florida Statutes, is amended to133

    read:134

    125.022 Development permits.When a county denies an135

    application for a development permit, the county shall give136

    written notice to the applicant. The notice must include a137

    citation to the applicable portions of an ordinance, rule,138

    statute, or other legal authority for the denial of the permit.139

    As used in this section, the term "development permit" has the140

    application filed with the county after July 1, 2012, a county142

    may not require as a condition of processing or issuing a143

    development permit that an applicant obtain a permit or approval144

    from any state or federal agency unless the agency has issued a145

    final agency action that denies the federal or state permit146

    before the county action on the local development permit.147

    Issuance of a development permit by a county does not in any way148

    create any rights on the part of the applicant to obtain a149

    permit from a state or federal agency and does not create any150

    liability on the part of the county for issuance of the permit151

    if the applicant fails to obtain requisite approvals or fulfill152

    the obligations imposed by a state or federal agency or153

    undertakes actions that result in a violation of state or154

    federal law. A county may attach such a disclaimer to the155

    issuance of a development permit and may include a permit156

    condition that all other applicable state or federal permits be157

    obtained before commencement of the development. This section158

    does not prohibit a county from providing information to an159

    applicant regarding what other state or federal permits may160

    apply.161

    Section 2. Subsection (5) is added to section 161.041,162

    Florida Statutes, to read:163

    161.041 Permits required.164

    (5) Notwithstanding any other provision of law, the165

    department may issue a permit pursuant to this part in advance166

    of the issuance of an incidental take authorization as provided167

    under the Endangered Species Act and its implementing168

    regulations if the permit and authorization include a condition169

    requiring that authorized activities not begin until the170

    incidental take authorization is issued.171

    Section 3. Section 166.033, Florida Statutes, is amended172

    to read:173

    166.033 Development permits.When a municipality denies an174

    application for a development permit, the municipality shall175

    give written notice to the applicant. The notice must include a176

    citation to the applicable portions of an ordinance, rule,177

    statute, or other legal authority for the denial of the permit.178

    As used in this section, the term "development permit" has the179

    same meaning as in s. 163.3164. For any development permit180

    application filed with the municipality after July 1, 2012, a181

    municipality may not require as a condition of processing or182

    issuing a development permit that an applicant obtain a permit183

    or approval from any state or federal agency unless the agency184

    has issued a final agency action that denies the federal or185

    state permit before the municipal action on the loca
