Care of PropertyStudents are responsible for the care of their own personal property. The school will not be responsible for personal items, including cell phones and money. Students found with sums of money or other values may have these items taken. The school will return the property to the student only when their parent/guardian comes to the school office. Valuables such as jewelry, cell phones, or expensive games should not be brought to school; if so items must be brought to the office at the beginning of the day and picked up at the end of the day.

Damage or loss of Academy equipment and facilities wastes taxpayers’ money and undermines the school program. Therefore, if a student does damage to or loses school property, the student or his/her parents will be required to pay for the replacement or damage. If the damage or loss of that property is found to be intentional, the student may be subject to further discipline.

Kindergarten thru 6th Grade Dress and GroomingStudents come to school for the primary purpose of learning. Any fashion, dress, accessory or hairstyle that disrupts the educational process or presents a safety risk will not be permitted. Students who come to school in violation of the dress code or in disruption of learning may be subject to having their parents called for a change of clothing. Continued disregard for the policy may result in additional disciplinary action. Students should come to school based on the weather. In the winter, boots, hats and gloves are a necessity.

Shabazz Academy is no longer a uniform school. Uniforms are optional. Although uniforms are not required, students should remain in appropriate attire.

Our dress code prohibits the following: Ripped jeans or pants with exposer to inappropriate skin Hoods worn during school hours Skinny or “spaghetti” straps Crop tops or shirts that show the stomach Shorts that are not past fingertip length

`7

AttendanceAttending school is both necessary and required by law. State law requires school attendance until the age of eighteen. Students who do not maintain good attendance may fail, lose privileges, and/or have their parents taken to court. All students are required to attend school the day of any extracurricular activities unless administration approves the absence (ex. Dances, programs, and sporting events).

School HoursClasses for students begin at 8:30am. Afternoon dismissal is at 3:30pm. Students are allowed to enter the building at 7:45am and must leave school and go home directly after dismissal unless they are involved in a special after-school activity. Students are expected to be in their after-school activity by 3:30pm.The school office is open from 7:30am until 4:30pm on school days.

Attendance PolicyStudents are expected to be in school every day and on time. Students who miss the school bus are still expected to attend school. Plans should be made ahead of time by parents, as to the best possible procedure to follow if a bus does not come at the expected time, or if a student misses the bus.

TardyStudents who are tardy to school are to report directly to the main office to sign in. Excessive tardy students will be given first a verbal warning, followed by a written warning. Students will then be reported to the Truancy Officer with the Ingham County ISD.

Excused AbsencesStudents may be excused for dentist and doctor appointments. Shabazz Academy encourages parents to make these appointments during non-school hours when possible. Students are excused because of illness or suspension. The opportunity to make up work that is missed is given under these circumstances.

Unexcused AbsencesAny student who is absent for all or part of the day without legitimate excuse shall be considered truant. No credit need be given for any school work not completed as a result of truancy. After two days of absence truancy action

`8

will follow that may include house visits and reports. Notification of AbsenceIf a student is going to be absent, the parents should contact the Attendance Line at (517) 252-8800 as soon as possible and provide an explanation. In the event that a parent is unable to contact the main office, a written excuse should be provided. When no excuse is provided, the student is considered truant. Excessive or questionable absences will require attention from the school staff. We will work closely with our families to help the student improve attendance. An excused absence allows the student to obtain missed assignments. Some work may be impossible to complete outside of school and this may negatively impact a student’s grade. An unexcused or unauthorized absence will not allow the student to make up the work. Skipping class for all or part of a day is considered unexcused. No work can be made up, and disciplinary action may follow.

`9

`10

Permission to Leave SchoolStudents leaving school during the school day may only do so with parent permission. The parent must notify the school by note or by telephone as to the time the student is to be excused and who will be signing the student out of school. Only persons listed on the Enrollment/Emergency Contact sheet may sign a student out. The designated guardian MUST SIGN the student out by reporting to the Main Office and meeting the student being excused.

Make-Up of Tests and Other School WorkStudents who have an unexcused absence from school or who have been suspended shall have the opportunity to make up work that has been missed. This work should be completed within 3 days after returning to school. If a student misses a teacher’s test due to an excused absence, arrangements should be made with the teacher to take the test. Standardized tests or other assessments should be arranged with the Chief School Administrator.

DisciplineIt is important to remember that the Academy’s rules apply going to and from school, at school, on school property, at school-sponsored events and on school transportation. In some cases, a student can be suspended from school transportation for infractions of school bus rules. Ultimately, it is the Chief School Administrator’s responsibility to keep things orderly. In all cases, the Academy shall attempt to make discipline prompt and equitable and to have the punishment match the severity to the incident.

The Behavior Resource Center (BRC) will be a location in the building to redirect all behavior that required discipline. In the BRC room students will receive behavior support as well as positive behavior reinforcement.

Positive Behavior Interventions and Support (PBIS) will be the approach used to establish the behavioral support and needs for all students to accomplish success. A guide and full description of the PBIS structure can be found in the office.

`11

Two types of discipline are possible: Informal and Formal.

Informal DisciplineInformal discipline takes place within the school. It includes:• Eating breakfast/lunch separate from homeroom• Spending time with administration • Change of seating or location• Lunch or after-school detention• BRC room reflection sheet • Behavior action plan • Mediation

`12

Informal discipline takes place within the school. It includes:• 1st Warning• 2nd Color Change on behavior chart• 3rd Discipline coaching • 4th BRC Room• 5th Administrative decision up to suspension

Order of procedure may change depending on severity of action.

Policies/Procedures for

Classrooms Formal DisciplineFormal discipline removes the student from the school or places the student in school suspension. It includes emergency removal for up to 72 hours, suspension for up to 10 days, and expulsion from school. Suspensions and expulsions may carry over into the next school year. Removal for less than one school day without the possibility of suspension or expulsion may not be appealed. Suspension and expulsion can be appealed. Students being considered for suspension or expulsion are entitled to an informal hearing with the Chief School Administrator, prior to removal, at which time the student will be notified of the charges against him/her and given the opportunity to make a defense.

If a student is suspended, the parents may appeal the suspension, in writing, to the Chief School Administrator and a formal investigation appeal hearing will be held. Suspension from co-curricular and extra-curricular activities may not be appealed.

When a student is being considered for expulsion, a former investigation hearing is scheduled with the Academy’s Board of Directors. Parents/guardians will be given written notice of the hearing and will be expected to be present. The Academy’s Board takes testimony and determines if a student is to be expelled. This decision may also be appealed. In the case of expulsion, the student remains out of school during the appeal period. Work missed during expulsion cannot be made up and usually results in a loss of credit.

Students involved in co-curricular and extra-curricular activities such as clubs or athletics can lose their eligibility for violation of the Academy rules. This is especially true for infractions involving drugs, alcohol, and tobacco use or harassment/bullying.

If a student commits a crime while under the Academy’s jurisdiction, s/he may be subject to school disciplinary action as well as to action by the community’slegal system. These are separate jurisdictions and do not constitute double jeopardy (being tried twice for the same crime).

If a student is suspended a parent or guardian must meet with behavior support team prior to a student returning to school. A behavior action plan for the student will be put in place.

Kindergarten – 6th Grade Behavior Management System Shabazz Academy will be using the “Stop light” method behavior management system. The system is made up of three levels of behavior represented by color. According to their behavior, students will be able to earn the color they have presented. Of course, students want to earn and remain on the color green which exemplified great behavior choices. If a student makes poor behavior choices, (depending on the severity) the student will move to yellow or red. Yellow will be a color earned by a student that has chosen a minor poor activity. From yellow, a student will be coached in the classroom to make better decisions. If a student’s choice places them on the red color, the student will be removed from the classroom and consequences will follow.

Color Codes:Green – Good BehaviorYellow – Needs to Make Better ChoicesRed – Consequences depending on severity of action

Students that continue to exemplify great behavior (remain on the color green) will be rewarded. Students who make poor choices will be placed on a behavior plan and could result into formal discipline.

Students will come home with a weekly display of their behavior. Each day will show the color they earned. Students will be responsible for retuning their weekly behavior chart signed every Monday.

14

Due Process RightsBefore a student may be suspended or expelled from school, there are specific procedures that must be followed.

Suspension from SchoolWhen a student is being considered for a suspension of ten days or less, an administrator will notify the student of the charges. The student will then be given an opportunity to explain his/her side and the administrator will then provide the student the evidence supporting the charges. After a discussion, an administrator will make a decision whether or not to suspend. If a student is suspended, h/she and his/her parents will be notified by phone or in writing within one (1) day of the reason of and length of the suspension. The suspension may be appealed, within ten (10) days after receipt of the suspension notice, to the Chief School Administrator. The request for an appeal must be in writing.

• Suspension from co-curricular and extra-curricular activities may not be appealed

• During the investigation, the student shall not be allowed to remain in school

• The appeal shall be conducted in a private meeting and the student maybe represented; sworn recorded testimony shall be given

• When a student is suspended, he or she may make up work missed either upon returning to school or during suspension

• Any learning that cannot be made up, such as labs, field trips, skill practices, and the like, or any learning that the student chooses not to make up, may be reflected in the grades earned

• A student being considered for suspension of more than ten (10) days willbe given due process as described in the expulsion section below

15

Expulsion from SchoolWhen a student is being considered for expulsion, the student will receive a formal letter of notification addressed to the parents which will contain:• The charge and related evidence• The time and place of the hearing meeting• The length of the recommended expulsion• A brief description of the hearing procedure• A statement that the student may bring parents, guardians, or counsel• A statement that the student may request attendance of school

personnel who were party to the action or accused the student of the infraction

Student Discipline CodeThe Academy Board has adopted the following Student Discipline Code. The code includes the types of misconduct that will subject a student to disciplinary action. The board has also adopted the list of behaviors and the terms contained in the list.

It is the Academy staff’s responsibility to provide a safe and orderly learning environment. History has shown that certain student actions are not compatible with the words “safe” and “orderly”. Discipline is within the sound discretion of the Academy’s staff and Administration. Due process ensures that disciplinary action is imposed only after review of the facts and/or special circumstances of the situation.

Explanation of Terms Applying to Discipline CodeUse of Drugs

The school has a “Drug Free” zone that extends 1,000 feet beyond the school boundaries as well as to any school activity and transportation. This means that any activity-sale, use, distribution, or use of drugs, alcohol, fake drugs, steroids inhalants, or look-alike drugs is prohibited. If caught, the student could be suspended or expelled and law enforcement officials could be contacted.

16

The sale, distribution, possession, or use of drugs, alcohol, fake drugs, steroids, inhalants, or look-alike drugs is prohibited. This includes non-alcoholic beers and wines, steroids, and the like. Many drug abuse offenses are also felonies.

Use of Breath Test InstrumentsThe Chief School Administrator may arrange for a breath test for blood alcohol to be conducted on a student whenever h/she has individualized reasonable suspicion to believe that a student has consumed an alcoholic beverage.

The student will be taken to a private administrative or instructional area on Academy property with at least one other member of the teaching or administrative staff present as a witness to the test. The purpose of the test is to determine whether or not the student has consumed an alcoholic beverage.

The amount of consumption is not relevant, except where the student may need medical attention. If the result indicates a violation of Academy rules as described in this handbook, the student will be disciplined in accordance with disciplinary procedures described in this handbook.

Use of TobaccoSmoking and other tobacco uses are a danger to a student’s health and to the health of others. The Academy prohibits the sale, distribution, use, or possession of any form of tobacco during school time or any school activity. The prohibition also applies when going to and from school and at school bus stops. Violations of this rule could result in suspension or expulsion.

Student Disorder/DemonstrationStudents will not be denied their rights of freedom of expression, but the expression may not infringe on the rights of others. Disruption of any school activity will not be allowed. If a student feels there is a need to organize some form of demonstration, s/he is encouraged to contact the Chief School Administrator to discuss the proper way of plan such an activity. Students who disrupt the school may be subject to suspension or expulsion.
