What is Copyright?

• Applicable law and legal considerations.• Copyrights are species of the genus intellectual property

and endow the authors of intellectual works a temporaryprivilege of use and enjoyment for having contributed tothe development of arts and scientific progress of

humanity.The protection of such rights is, therefore, two reasons of adifferent nature:1) reward authors with the prerogative to realize the fruitsof their labor,guaranteeing them the exclusive right to use, reproduceand publish their works, and2) promote the development of arts and science in searchof the common good desired by society.

Copyright in the Constitution of Brazil

• Given the importance of these rights, many countrieshave come to include them in the list of fundamentalrights and guarantees provided in the Constitutionitself. This is the case of Brazil, a country whoseConstitution contains the following provision:Section 5 - All are equal before the law, withoutdistinction whatsoever, guaranteeing Brazilians andforeigners residing in the country the inviolable right tolife, liberty, equality, safety and property, asfollows :(...)XXVII - belongs to authors the exclusive right to use,publication or reproduction of their works,transmissible to the heirs as long as the law setting.

Brazilian Copyright Law (Law 9.610/98) provides:

• Article 7 intellectual works that are protected are creationsof the spirit expressed by any meansor fixed in any medium, tangible or intangible, known or isinvented in the future,such as

(...)XI - adaptations, translations and other transformations oforiginal works,presented as a new intellectual creation;XIII - collections or compilations, anthologies,encyclopedias, dictionaries, databases andother works, which, in selection, organization orarrangement of their contents, constituteintellectual creation.

Protection of shapes / forms of expression.

• To fit the format as a literary work, it is essentialthat it be fixed in writing, must necessarily be astory or argument with detailed description ofthe elements on which the format is based andmade operational.In regard of item XIII, it is shown that the formatis actually the result of a selection of severalelements arranged, constituting therefore a workintellectual worthy of protection.

• The Mimbdstar fits as a literary work, it constitutes a systematic roadmapand various elements that constitute themselves as a creation of theirown. The passage from the decision of action against copyright MimbdstarPhilips reinforces just that:"Saying, in short, that anoints created" intellectual work of informationengineering, namely the structuring of multimedia information for durablegoods in the database, which called Multimedia Instruction ManualDurable Goods - "© Mimbdstar."
