COTABATO CITY (Min-daNews)—With less than a week before the May 13 elections, unidentified men bombed a transmission tow-er of the National Grid Corp. Of the Philippines (NGCP) in Kabacan, North Cotabato Monday night, police said Tuesday.

Domingo who was seated at the left side of the back seat sustained the most fatal

injury when his face was hit by the back bumper of the truck which ripped off the side of the van and thrown him off the side of the road. Other passengers including the driver were critically hurt and were rushed to hospitals in Butuan City. The truck driver im-mediately escaped right after the accident and is now the subject of police manhunt. Alfredo Plaza, station manager of DXDA, said he had assigned several report-ers to deeply look into the accident after they found

out that the van which travels the San Francisco-Butuan City route turned out to be operating illegally and did not have franchise as public utility vehicle. Many passenger vans mostly running on air-condition has been thriving means of transportation in San Francisco town to-wards Butuan City and Davao City destinations that already threatened the long-time monopoly of Bachelor Express buses. DXDA reporters how-ever found out that some of these vans still bear

green plates issued by the Land Transportation Office which is considered just a private vehicle. Vans to be allowed to travel with passengers should bear yellow plates. Plaza said they are work-ing out for the P100,000 death benefit of Domingo from Kapisanan ng mga Brodkasters ng Pilipinas (KBP) since he is a regular member of the organiza-tion. CAMP ALAGAR, Cagayan de Oro City – The police regional command here has filed charges against 16 suspects in the ambuscade of the convoy of Nunungan town mayor Abdul Manam-paran in Lanao del Norte on April 25, 2013.

Pol. Supt. Ronnie Car-iaga, spokesperson of the Philippine National Police regional command here, said that the suspects were charged with multiple mur-der and frustrated multiple murder with the provincial prosecutor’s office in Lanao del Norte.

Cariaga said that the Special Investigation Task Group (SITG) created by Regional Pol. Chief Supt. Catalino Rodriguez filed the complaint after wit-nesses positively identified the suspects.

Cariaga said the PNP regional command did not release the names of the 16 suspects.

According to Cariaga, the task group also gathered material evidences such as

the yellow dump truck with plate no. SKH-429 used by victims which contained blood stains, several bul-let holes and a shattered windshield.

He said it is Congress-man Benaldo who has im-proved the road networks between the rural baran-gays especially at Lumbia,

Tumpagon, San Simon and Besigan.

“Congressman Benaldo has given each of the 24 barangays at least three or four projects including Ba-rangay Carmen,” he added.

Bascon said that because Congressman Benaldo is the assistant majority floor leader he was able to get more projects for the city’s first district.

“He has truly repre-sented his constituents,” Bascon said of Benaldo.

Asked why the people should re-elect Benaldo, he said it is because Be-naldo is in the best posi-tion to continue his public

service to the barangay residents and that he could add more to his already numerous projects cover-ing infrastructure, agri-culture, health, livelihood

programs, education and others.

Benaldo is running un-der the Padayon Pilipino party of Mayor Emano and Vice Mayor Caesar Ian Ace-

nas. The party’s candidates for the city council in the first district include Inday Dahino, Alden Bacal, Pepe Abbu, Gil Banaag, Maya Enteria and Annie Daba.

Sarmiento said ballots rejected four times, while feeding it into the machine will no longer be forced to be scanned in the ma-

an envelope and sent to Come-lec Manila, as part of the report recorded in the minutes.

“The PCOS machine won’t be able to read properly or even accept the ballot, if it incurs un-necessary marks.

Over-voting of candidates in a position also won’t reflect in the PCOS

machine, so voters have to ensure that their ballots are clean and

properly-shaded,” explained Sarmiento.

Sarmiento also said that on election day, an express lane for

pregnant women, persons with disabilities and senior citizens will be

PROSPERIDAD, Agu-sandel Sur - Soldiers of the 75th Infantry Battal-ion and elements of the PNP Special Action Force had an encounter with 10 NPA rebels on Road 88 in Brgy. Bunawan Brooks, Bunawan, Agusandel Sur, Monday evening

The troopers were on a joint security patrol in the area when they chanced on the armed group, be-lieved to be from Section Committee 14 of the North Eastern Mindanao Regional Committee.

The encounter resulted in the wounding of one government trooper and several on the rebel side.

C o l . G r e g o r y M.Cayetano, commander of the 401st Infantry Brigade, immediately ordered the 75IB to pursue the rebels.

Col. Cayetano thank the local residents for tipping them off about the presence of the enemies in the area even as he appealed to the families of the rebels to

encourage them to abandon the armed struggle and return to the folds of the law and live a normal life.

He also reminded the public that “for more than four decades now, “we have all felt the pain that the armed struggle has brought us.”

In fact, the struggle has deterred development and progress, particularly in the countryside, he pointed out.

Col. Cayetano described the AFP’s concept of Baya-nihan as far better than the revolutionary concept of completely overthrowing the government.

“In Bayanihan, we are all benefitted, while in the armed struggle, we are all losers,” said Col Cayetano.

“Here, the PNP aims to invest in human resources and processes, so as to earn the support of the stakeholders,” he added.

Meanwhile, the ‘pro-cess excellence’ perspec-tive refers to the differ-

ent core of operational processes and practices the PNP uses in carrying out its mission.

“With the PATROL concept, the PNP is giv-ing top consideration to the four core processes of intelligence, investigation, operat ions and pol ice community relat ions,” he stated.

Police Supt. Gamba further said that PATROL Plan 2030 highlights the two concrete strategic object ives of the PNP, such as as improvement on crime prevention and solution; and improving community safety aware-ness, through communi-ty-oriented and human rights-based policing.

He also said that “with the other regional offices of the PNP, we are giving so much importance to people in the community, they being the direct ben-eficiaries of an improved police service.”

PATROL Plan 2020 likewise emphasizes the need for every PNP per-sonnel to reach out to the communities they serve to obtain people’s active support, cooperation and eventually gain a higher level of trust and con-fidence in every police personnel and in the PNP organization, as a whole.

The new COMPLAN will be implemented in t h re e phas e s , namely

preparation, execution, and mon itor i ng and evaluation.

The PNP is still in the execution phase, provid-ing the stakeholders with deep sense of understand-ing and appreciation of the PNP PATROL Plan 2030.

Police Supt. Gamba enumerated such activities as cascading of enhanced PNP PATROL Plan 2013; promoting and nurturing governance culture; and strengthen partnership.

PROSPERIDAD, Agusan-del Sur-- Three armed reb-els, belonging to Guerrilla Front 88 of the New People’s Army’s North Central Min-danao Regional Committee, have voluntarily surren-dered to the 26th Infantry Battalion of the Philippine Army, under Lt. Col. Jose Leonard Gille, very recently.

The surrender was made possible through the ef-fort of the soldiers and

AS the May 13, 2013 election day nears, the true nature of candidates surfaced. What have these candidates (local) achieved in the last 45-day campaign period? These candidates exposed the rotten election system where personal destruction became the main focus of campaign platforms.

It is very frustrating that in reality, most candidates who delved on the platform of personal destructions were those who have more to explain about themselves and their accom-plishments. These candidates, especially the ambitious and power hungry candidates, believed they could get the sympathy of the voters through deceptive antics.

By the way, Oscar Moreno, a Liberal Party mayoral candidate in Cagayan de Oro City, has yet to answer allegations of his extravagance at the provincial capitol. Moreno has been accused of squandering more than P 100 million through cash advance that has remained unsettled. Is Moreno leaving Misamis Oriental scot-free?

It is sad to say that Moreno has not made a convinc-ing explanation of his failure to settle the cash advances. Although Moreno argued that the cash advances were availed of by capitol workers, there were still suspicions that Moreno benefited from those cash advances. One could not imagine that an ordinary employee (some were casuals) could get hundreds of thousands to millions of

Moreno must have learned the strategy from his pre-decessor who has the penchant of making cash advances through his staff. This method is one way of getting away with possible graft charges. The point is that the governor is not directly involved in the transaction. The cash advanced was made through the employee while the governor acted only as an approving authority.

When one examines the records, there is no paper trail that would point to the governor as directly involved in the cash advances. The record would show that it was the employee who applied and get the amount specified in the cash advance. These cash advances are subject to settlement as required by the Commission on Audit (COA).

Perhaps, it is for this reason that Moreno is not both-ered with the unsettled cash advances at the provincial capitol in Misamis Oriental. The worker who made the cash advance would go to jail – not Gov. Moreno.

Maybe, Moreno thinks that the people of Cagayan de Oro are not aware of what he has done at the provincial capitol. Moreno believes he has nothing to explain at all. After all, more than 50 percent of the workers at the provincial capitol lived or are registered voters in Cagayan de Oro City. For most, retirement usually “comes” at age 60 or 65. But for all, what is most empowering is to understand that “retire-ment” is something that either comes by choice or by force! When it comes to making personal choices, some people would like to be able to retire “early” so they would be able to enjoy doing what they want to for the rest of their lives with-out the constraint of being

forced to work just to pay for the bills and make ends meet. Nevertheless, it would do you best to consider one very important aspect by asking: “What if it comes by force?”

You retire by force if even though you may have the will to get up and work, yet you don’t any more have enough strength do so. Like company vehicles as physical business assets, our bodies do surrender to obsoles-cence. Whether you like it or not, illness and disability at times rears its ugly head somewhere. Oftentimes, a little tinkering here and there might do the trick. But there comes a point in time that replacement is the most cost-effective option, and you become a non-performing asset.

Time will take its toll, whether you face reality or not. What makes the difference is how prepared you are. Whether you retire

APPLICATION WITH MOTION FOR CONFIDENTIAL TREATMENT

OF INFORMATION

Applicant SURIGAO DEL SUR I ELECTRIC COOPERATIVE, INC. (“SURSECO I”), through counsel, unto this Honorable Commission, respectfully alleges, that: 1. SURSECO I is a non-stock, non-profit electric cooperative, duly organized and existing under and by virtue of Philippine laws, with principal office at Brgy. San Fernando, Bislig City, Surigao del Sur. 2. It is the holder of an exclusive franchise issued by the National Electrification Commission (NEC) to operate an electric light and power distribution service in the City of Bislig and the Municipalities of Lingig, Hinatuan, Tagbina and Barobo, all in the province of Surigao del Sur. 3. Pursuant to Rule 20 (B) of the Energy Regulatory Commission’s Rules of Practice and Procedure (“ERC Rules”), and other pertinent rules and regulations, this Application is being submitted to this Honorable Commission for its consideration and approval of the Energy Supply Agreement (“ESA”) executed by and between SURSECO I and Therma South, Inc. (“TSI”).

STATEMENT OF THE FACTS

4. SURSECO I currently sources the bulk of its electricity requirements from the Power Sector Assets & Liabilities Management Corporation (“PSALM”) and the remainder from Therma Marine, Inc. (“TMI”).

4.1. PSALM & SURSECO I executed a Contract for the Supply of Electric Energy (“CSEE”) which was in force from 26 August 2011 to 25 December 2012, or one (1) year after the Department of Energy’s declaration of open access in Mindanao, whichever comes first.1 However, in a certification dated 16 November 2012, PSALM confirmed that it has insufficient capacity to supply the additional power require-ments of the Mindanao distribution utilities beyond the contracted energy and equivalent demand in its existing CSEEs. 4.2. PSALM & SURSECO I subsequently executed a new CSEE covering the period from expira-tion of the previous CSEE and until 25 December 2016. However, the average contract energy from the previous CSEE was reduced by approximately 37% under the new CSEE. 4.3. On 16 November 2010, SURSECO I entered into an Energy Supply Agreement (ESA) with TMI for the supply of two (2) MW. The ESA is duly approved by this Honorable Commission and will expire on 25 September 2013.2

5. It is expected that the energy requirements of SURSECO I will significantly increase in the next few years as demonstrated by SURSECO I’s Actual and Forecasted Load Data and Distribution Development Plan. 6. The expiration of the PSALM CSEE in 2016 and the expiration of the ESA with TMI in 2013 as well as the projected increase in the energy requirements of SURSECO I customers will result in a shortage of the energy available to SURSECO I. 7. There exists a region-wide power supply deficiency problem in Mindanao resulting in frequent brownouts and power interruptions. Moreover, Mindanao is heavily reliant and dependent on hydro electric power;3 thus, during the onset of the summer months and the occurrence of the El Nino phenomenon during certain years, the supply of power in Mindanao is further and drastically reduced. The current power crisis in Mindanao underscores the need for SURSECO I to enter into a bilateral agreement with generation companies for the stable supply of electricity to its customers. 8. In 2012, TSI, a generation company duly organized and existing under and by virtue of Philippine laws with principal office address at the Brgy. Binugao, Toril District, Davao City, conducted a series of road shows to market the capacities of its 300MW coal-fired power plant to be constructed on a site straddling the boundary of Davao City and municipality of Sta. Cruz, Davao del Sur (“TSI Power Plant”). At the road shows, TSI declared its intention to supply energy in Mindanao by entering into bilateral agreements with interested distribution utilities and make available the 300MW capacity of the TSI Power Plant. 9. Sometime after the road shows, SURSECO I commenced negotiations with TSI for the execution of the ESA. On 7 February 2013, SURSECO I and TSI signed and executed the ESA, subject of the instant Application.

ABSTRACT OF THE ESA AND OTHER RELEVANT INFORMATION

10. In order to supply power to SURSECO I under the ESA, TSI shall construct, own, operate, manage and maintain the TSI Power Plant. The Commercial Operation Date of the power plant is expected to be in 2015. 11. Executive Summary. The Contract Capacity to be made available by TSI to SURSECO I is fixed on a monthly basis equivalent to Three Thousand kilowatts (3,000 kW) and to be delivered in accordance with the Schedule of Contract Energy which is fixed on a daily and hourly basis. TSI shall exert best efforts to source replacement or alternative supply replacement power during scheduled and unscheduled outages to supply all or part of the Contract Energy. On the other hand, when SURSECO I is unable to take the Contract Energy or a portion thereof for reasons other than Force Majeure and there is no WESM in Mindanao, SURSECO I may request TSI to make available to third parties all or a certain portion of the Contract Energy (“Available Contract Energy”), at such intervals specified by SURSECO I, subject to the payment of a Marketing Fee of Php0.02/kWh of the Available Contract Energy and the corresponding reduction in SURSECO I’s Contract Capacity. 12. Salient Features of the ESA. The ESA between SURSECO I and TSI contains the following salient terms and conditions: 12.1. Term. The ESA has a term or contract period commencing from the Effective Date until twenty-five (25) years after the Operations Effective Date. 12.2. Contract Energy. TSI shall make available and SURSECO I shall receive Contract Energy at the Delivery Point4 specified under the ESA. On the other hand, to make available for delivery, Contract Energy shall be based on the Schedule of Contract Energy attached to the ESA. 12.3. The Contract Capacity and/or Contract Energy in respect of a particular Billing Period may be adjusted either by (a) TSI submitting an offer to SURSECO I to increase the same, subject to SURSECO I’s acceptance or refusal, or (b) SURSECO I requesting an increase in the Contract Capacity and/or Contract Energy, subject to TSI’s approval. In both instances, SURSECO I or TSI, as the case may be, must send a written notice 30 days before the date the intended increase is to take effect. 12.4. At any time during the Contract Period, SURSECO I may also send a written request to TSI to increase the Contract Capacity and/or Contract Energy, no later than 60 days prior to the effectivity of the proposed increase, subject to TSI’s approval, to be paid by SURSECO I at the Contract Price. 12.5. Any proposed adjustments (increase/decrease) to the Contract Capacity and/or Contract Energy which is intended to apply to the succeeding contract year shall be sent by SURSECO I in writing to TSI no later than 60 days prior to each anniversary of the Operations Effective Date, subject to TSI’s approval. In case of an increase, the additional Contract Capacity and Contract Energy shall be paid for by SURSECO I at the Contract Price, while a decrease shall cause SURSECO I to compensate TSI in the amount of the Buy-Out Charge, computed as follows:

If no agreement in writing is reached by the anniversary of the Operations Effective Date, the prevailing Contract Capacity and/or Contract Energy shall continue to apply.

12.6. Stages of Supply. TSI shall supply power to SURSECO I in various stages, as follows: 12.6.1. During the period of testing and commissioning of the Power Plant, SURSECO I shall purchase the proportionate net electrical output of the Power Plant generated by TSI subject to the payment of Commission-ing Energy Charge as provided in Schedule 7.1 of the ESA. SURSECO I may also request for additional quantities subject to TSI’s approval. 12.6.2 In the event that TSI is ready to deliver capacity and energy prior to the Target Commercial Operation Date, TSI shall have the option to: (a) offer early commencement of delivery of Contract Capacity and Contract Energy to SURSECO I; or (b) sell the electrical output of the Power Plant to Third Parties until the Target

Commercial Operation Date. 12.6.3. Beginning on Operations Effective Date, TSI shall supply and deliver Contract Capacity and Contract Energy (whether from the capacity of the Power Plant or the power plants owned or operated by any of its affiliates, WESM, if any, or any other supplier) to SURSECO I during the Billing Periods specified in the Contract Energy Schedule. 12.7. Share in Minimum Load Requirement. In all Intervals as provided under the ESA, SURSECO I shall nominate no less than the Share in Minimum Load Requirement of One Thousand Two Hundred kilowatts (1,200kW), subject to the conditions under the ESA in case the aggregate nominated energy of all customers of TSI is less than the Minimum Load Requirement due to Force Majeure event affecting one or more customers. 12.8. Contract Price. SURSECO I shall pay the Contract Price which consists of variable and fixed charges, subject to annual adjustments. The Contract Price to be paid by SURSECO I will depend on whether the power is delivered before commercial operation date or beginning on commercial operation date. The formula for computing these Monthly Electricity Fees are computed under the ESA based on the following formula:

In the event that revisions are made on the above indices, including any shift made in the base year and other adjust-ments to such index made by the relevant authorized entity, its successor-in-interest, there shall be a corresponding change in the base index such that the use of the revised index will yield the equivalent values as the use of the original base index.

In the event that the index (a) becomes unavailable, (b) is replaced by a new benchmark rate as determined by the relevant authorized entity, its successor in interest, or (c) ceases to exist, or (d) in the reasonable determination of either Party, fails to reflect the real costs and forms an integral part of this price mechanism, the Parties shall agree to adopt a new price index.

VIII. Other Taxes and Charges Except for value-added tax, all existing and future taxes, any increase or adjustments on existing taxes, fees, imposts, including transmission charges and other charges imposed on the Power Plant shall be for the account of the Customer in accordance with Articles 11 and 14, which shall be computed based on the following formula:

B. BEFORE COMMERCIAL OPERATION DATE: Monthly Electricity Fees=Commissioning Charges+Other Taxes and Charges

All computations on payments to Supplier shall not be rounded off, except for the final PHP amount, which shall be rounded off to the nearest Philippine centavo. The Monthly Electricity Fees shall be subject to the applicable value-added tax. The Monthly Electricity Fees shall be subject to the applicable value-added tax.

I. Commissioning Charges The Customer shall pay the Supplier the Commissioning Charges subject to the applicable value-added tax for electricity supplied during the period of testing and commissioning of the Power Plant in accordance with the following formula:

12.9. The agreed amounts relevant to the computation of Contract Price are as follows:

Termination Fee. In the event that the ESA is terminated by TSI on the grounds of (a) the failure of SURSECO I to pay the Electricity Fee or any other amounts payable under the ESA; (b) failure by SURSECO I to replenish its Security Deposit in full as provided in Article 9.2.3 of the ESA; (c) breach by SURSECO I of any of the provisions of the ESA and its failure to cure the breach within a period of thirty (30) days from receipt of the notice of the breach; and (d) termination by TSI of the ESA upon the occurrence of any events of default under Article 17.2 of the ESA,SURSECO I shall be liable to pay a termination fee computed using the following formula:

RELATED INFORMATION

In support of the instant application, and in compliance with the ERC Guidelines for the Recovery of Costs for the Generation Component of the Distribution Utilities’ (DUs) Rates as well as Rule 20(B) of the ERC Rules of Practice and Procedure, SURSECO I is submitting herewith the following documents, attached hereto and made integral parts hereof as annexes of this Application, to wit:

Pursuant to ERC Resolution No. 9, series of 2010, TSI shall file the necessary application for a COC no later than three (3) months prior to the commencement of commercial operations. 15. Rate Impact. The following table shows the expected rate impact in the event that SURSECO I procures power from TSI when TSI Power Plant commences commercial operations in 2015 vis-à-vis SURSECO I procuring power from other sources in Mindanao:

Pursuant to its undertaking, SURSECO I respectfully moves that the information and documents contained in a sealed envelope and marked as Annexes M-1to M-5, respectively, be treated as confidential documents and not be disclosed. These documents contain certain information not generally available to the public, data and calculations involving business operations and financial trade secrets reflecting TSI’s investment and business calculations. 18. This request is likewise being made by virtue of Rule 4 of the ERC Rules of Practice and Procedure under which the Honorable Commission may, upon request of a party and determination of the existence of conditions which would warrant such remedy, treat certain information submitted to it as confidential.

the election paraphernalia,“ the order from City omelec chief Palmer Palamine said. Cagayan de Oro has a vot-ing population of 277,931. Legaspi immediately or-dered her personnel to no-tify all political parties, the National Citizens’ Movement for Free Elections (Nam-frel) and the Parish Pastoral Council for Responsible Vot-ing (PPCRV) to send heir representative to witness the inventory scheduled at 2 p.m. today (Tuesday).

She also provided the me-dia with copies of the inven-tory report of the ballots and other forms of supplies that the City Treasurer’s Office (CTO) received from the Comelec. FOLLOWING the lead of the Agri-Pinoy Rice Program’s Rice Achiever Awards, the Department of Agriculture (DA), this time, launches the first ever nationwide search for the set of Agri-Pinoy Corn Quality Awardees.

According to Larry ER. Paraluman, regional corn program coordinator of DA-10 said, the competition which nearly has P 29 mil-lion prizes at stake is open to all provinces, cities and municipalities, provincial and municipal corn coor-dinators, and agricultural extension workers (AEWs) part in the implementation of the DA Agri-Pinoy Corn Program.

The search, he added, seeks to recognize the achievement of top per-forming local government units (LGUs) with out-standing contribution to the corn industry; thereby intensifying the strong DA-LGU partnership in the production of quality and safe corn and sustaining awareness of the LGUs to the DA’s initiatives for corn.

Par a lu m an f u r t h e r said that the Corn Qual-ity Awards will commence in 2013 for two cropping seasons. Initially, the search shall grant P3M to the top five provinces and P500,000 to the top 25 cities/munici-palities in terms of infra-structures, farm equipment and machineries, etc.

Meanwhile, the top 5 provincial and 25 munici-pal corn coordinators will each receive P20,000 and P 15,000 cash prize, respec-tively. Top 100 AEWs, on the other hand, will get P10,000 each.

SKorea expects north’s missile test by Monday

UNITED States and South Korean forces remain on heightened alert for a North Korean missile test that of-ficials say could take place at any time.

Seoul’s defense ministry on Thursday said it is at a “full readiness posture” as it monitors the North for pos-sible launches. A spokesper-son said the South believes the test could take place on or before the Monday birthday of North Korea’s late founding leader, Kim Il Sung.

But the defense ministry refused to comment on a re-port by Japan’s Kyodo news agency, which on Thursday quoted an unnamed Tokyo defense official as saying Pyongyang has placed a missile launcher in a raised position in apparent prepa-ration for a test.

Joint U.S.-South Korean forces have already raised their alert level to “Watch-Con 2,” indicating a vital threat is present. At the Pentagon, Defense Secre-tary Chuck Hagel warned Pyongyang against making more threats.

North Korea is reported to be in the final stages of preparing for a mid-range Musudan missile test.

The previously untested missile could potentially reach South Korea, Japan, or the U.S. territory of Guam. Unconfirmed reports also suggest Pyongyang is pre-paring to test other missiles simultaneously.

Some analysts expect the test to occur sometime around the Monday birth-day of Pyongyang’s found-ing leader, Kim Il Sung.

The commander of the U.S. forces in the Pacific confirmed North Korea has moved a Musudan to its east coast in apparent preparation for a launch. Testifying Tuesday at a U.S. Senate hearing, Admiral Samuel Locklear insisted that any North Korean mis-sile could be intercepted if it poses a direct threat to the U.S. or its allies.

vision has been urging foreigners to leave South Korea, warning they could be caught up in an all-out military conflict or a “nuclear war.”

South Korea Unification Ministry spokesperson Kim Hyung-suk on Wednesday played down the threat to foreigners.

“Various actions from the North are very likely to be psychological, creating anxiety. I will say that we should not be paying too much attention or feeling anxious,” Hyung-suk said.

North Korea has threat-ened to attack the South, the United States and U.S. allies in the Asia-Pacific region in retaliation for the latest economic sanctions imposed on Pyongyang by the U.N. Security Council.

Those sanctions have been aimed at punishing Pyongyang for carrying out nuclear and missile tests in defiance of Security Council resolutions.

South Korean Foreign Minister Yun Byung-Se told lawmakers Wednesday it is “highly likely” North Korea will test one of its new missiles “at any time.”

2 died as commercial building catches fire

ZAMBOANGA City––Two persons were killed in a fire that hit a commercial building in Zamboanga City in the southern Philippines.

Zamboanga City Fire Marshall Dominador Zabala said the burned bodies were recovered during an in-spection at ZamSulu Building along Veteran’s Avenue. “Confirmed at may dalawa tayong bankay na na-recover sa loob ng building pero hindi pa natin matiyak kung sino ang mga ito, ngunit may balitang mga helpers ang dalawang biktima,” Zabala said.

The fire hit the 3rd floor of the building that houses residential units and various shops, including a bank. The building is owned by the Chua family, but none of its members spoke to the media about the fire.

CITY HALL welcomes six young professionals from Brazil who are visiting the city under the Group Study Exchange (GSE) program of the Rotary International.

This is contained in Resolution No. 11382 adopted by the City Council during its regular session yesterday presided over by Vice Mayor Caesar Ian E. Acenas upon the recommendation of Mayor Vicente Y. Emano.

The resolution also declares April 8 to 16 as Rotary Group Study Exchange Week in Cagayan de Oro City.

Noel M. Nalzaro, GSE Coordinator of Rotary International District 3870, Zone 1 informed the mayor that the GSE Program is aimed at fostering development and cooperation through the promotion of goodwill and better understanding among countries in the world.

According to Nalzaro, the GSE team members will meet with some of their local counterparts in their respective voca-tions and fields of interest for opportunities of learning from each other.

The purpose of the visit of the team is to learn the local norms and practices of their vocations and to experience and understand the local culture, he said.(LCR)

Cherry Orendain, Anak-bayan Southern Mindanao spokesperson, said the de-crease in the number of HEIs applying for tuition fee increase “does not please the youth and students,” adding that the CHED al-legedly failed to control the “alarming trend” of tuition fee increases among private schools in the region.

“The fact remains that education is still a busi-ness and that the CHED has perfected its role as the spokesperson of the capitalist educators,” she told MindaNews.

Bai Ali Indayla, second nominee of Kabataan Par-tylist, earlier said that some 150,000 students from pri-vate schools were affected by tuition fee increases in the school year 2012-2013.

She cited that in the last three years, tuition fee in-creases ranged from P3,150 to P4,200 per semester, with the average tuition paid by a student reaching P40,000 per school year.

Indayla said her group gathers complaints from parents and students on school violations related to tuition fee increases through the “Kabataan Hotline” with numbers 082- 221-6589 and 0942-980-8413.

She said that “redundant and exorbitant fees” have turned out as the most com-mon complaints of parents and students.

Indayla stressed that education in the country has become commercialized and expensive, making it hard to the reach of the poor.

Alvarez said the issues related to hikes in tuition and other fees require con-sultations as mandated by Article III of CHED Memo-randum Order (CMO) No. 3, Series of 2013.

Misuari said another way of solving the problem, is by making an appeal to his friend Malaysian Prime Minister Datuk Seri Najib Tun Razak. He claims the Prime Minister is a cousin of his grand nephew, whose grandfathers are brothers. “So I intend to send him there, to talk to Najib and persuade him to desist from sending more forces [in Sabah].”

He said he will also talk to Sultan Jamalul Kiram III, not to aggravate the situation.

“I can mediate with them, anyway, Sabah and Sarawak belong to me, and my clan. It doesn’t belong to the Sultanate, because this is the property of my great great grandfather Panglima Pahabasal Elija,” Misuari added.

Misuari flew in to Davao Saturday after attending a month-long meeting with the parliaments of the Or-ganization of Islamic Con-ference (OIC), conferred with Vice Mayor Rodrigo Duterte in Mandaya Hotel to talk on these options.

He clarified that the ac-cusations of his involvement in the Sabah tension are “baseless and unfounded.”

Duterte, for his part, as-sured Misuari of support if anything happens. The Vice Mayor, without elaborating, offered help “in connecting and talking it out” with the national government.

Misuari said he talked to Sultan Kiram in a discreet meeting the night before he left for Davao. He told the Sultan be careful because “(the government is) pre-paring to arrest you.”

Misuari thinks it is a big gamble on the Sultanate royal army to send their troops and mass up in Sabah. He is worried that violence might spread in Kunak, then to Kota Kinabalu in San-dakan and to other places.

Misuari said he does not want any trouble with Phil-ippine government and Ma-laysia. He thinks the prob-lem is better left between the Bangsamoro people and the Malaysian people to resolve. “We should not allow other people to come in. It might only aggravate the situation,” he said.

Misuari lashed at Presi-dent Benigno Aquino III for saying the Sultan’s claim and actions are “a hopeless cause”.

“He knows nothing about what he is talking about. He will become a laughing stock in the whole world with the way he pres-ents himself before the eyes of the peoples of the world.”

Maintaining that he has no hand in the incident, Misuari said he is in the

midst of preparing for the resumption of peace talks between the Philippine gov-ernment and the MNLF this month in Jakarta. Indonesia has offered to broker the resumption of the talks.

Misuari sounded firm that peace is at hand in Mindanao, “if not for the Sabah problem.”

Misuari said, he will leave the next day and meet with them [MNLF troops]. “Maybe the brother might want me to report to them about my travel abroad, and possibly will also include the whole Sabah,” he said.

entire sultanate is not to be intransigent but to start the long process of talks. What the situation required is listening to the sultanate’s demands,” said Abraham Idjirani, spokesman of the sultanate of Sulu and North Borneo in an AM radio interview this week. He bewailed Aquino’s tack which then consisted of sending a delegation to Lahad Datu to make them go back to the Philippines. “If they went there only to fetch our brothers, they are committing a sin against us, their brothers in the Philip-pines and not just those in Malaysia. In that case, there is already a connivance between governments of Malaysia and the Philip-pines,” Idjirani said.

The Aquino government also threatened the group that charges may be filed against them. Charges in-clude inciting to sedition and illegal possession of firearms, according to Jus-tice Secretary Leila de Lima. Some critics countered though that the Aquino government needs to look at the position of the Sultanate of Sulu beyond Philippine laws, considering that the said Sultanate has been in existence even before the Philippines was “discovered” and named by Ferdinand Magellan.

Tolentino of Katribu said the struggle for the rights of the country’s national minorities—both the indig-enous peoples and the Moro people – is not recognized by the State.

The Aquino government has a tendency to dismiss the indigenous peoples’ ancestral domain, and in the case of the Sultanate of Sulu, “Aquino has dismissed the Sultan’s assertion to claim Sabah as ‘foolhardy.’ This only reveals how the Philippine state abandons the issue and leaves the

Moro people on their own to assert their rights to their ancestral territory,” Tolentino said.

What is happening in Lahad Datu, Katribu says, is the result of “the State’s negligence of minority is-sues.”

The multi-sectoral group bagong Alyansang Maka-bayan (Bayan) also criticized Aquino’s “absurd point that recognizing the ownership of the Sultanate over Sabah and Sulu could pave the way for its eventual secession from the Philippines.” Sul-tan Jamalul Kiram and his siblings had repeatedly said they consider themselves as Filipinos and they are merely asking the govern-ment to assert their and the country’s claim to Sabah.

Aquino’s sham patrio-tism is the true spoiler

attitude concerning the Philippine claim on Sa-bah contrasts starkly with his administration’s treat-ment of the Spratlys and Panatag Shoal dispute with China, said Carol Araullo, chairperson of Bayan. She pointed out that in the case of Spratlys, no less than the head of state engages in open polemics on the territorial dispute at every available opportunity, domestic or international. “It has even filed a case against China for international arbitra-tion,” she said. While “we have strong grounds to as-sert our sovereignty over the Spratlys and Panatag Shoal, we have even more compelling historical and legal bases to claim Sabah,” Araullo said.

Bayan regards this dou-ble standard in handling the Sabah and Spratlys/Panatag Shoal issues as a demonstration of the Aqui-no government’s “deceitful and sham patriotism.” It demonstrates, they said, that Aquino’s noises with China over territorial dispute has little to do with its patriotic duty to defend the national sovereignty and territorial integrity but more about “using the Spratlys/Panatag Shoal dispute to promote US imperialism’s hegemonic schemes in the region.”

The Aquino govern-ment “is using the dispute with China to justify the ever increasing presence of American troops, warships, jet fighters and drones, and other war materiel in the country’s territory under the auspices of the Visiting Forces Agreement (VFA),” Araullo said.

About the same time the Malaysian troops started shooting at the guards of Sultan Kiram in Lahad Datu, the negotiating panels of the Aquino government and the Moro Islamic Liberation Front (MILF ) were sign-ing one of the completed annexes to the previously signed Framework Agree-ment. Unfortunately, the two parties reportedly said certain groups have been supposedly egging on the sultanate to act like a spoiler

to the peace process.“Aquino has subsumed

the Sabah claim to political and geopolitical consider-ations, in particular the wish to bring an end to the Moro secessionist movement in the South through US-backed peace negotiations with the Moro Islamic Lib-eration Front (MILF) where Malaysia has played a key role as facilitator,” Araullo of Bayan commented in a statement. She said the Aquino regime, together with the US which has taken a hands-off posture on the Sabah stand-off, apparently views the Sabah claim as a potential stumbling block, if not complete spoiler, to inking the coveted final peace compact with the MILF.

But Aquino’s handling of the Sabah issue is ultimately the true peace spoiler. In fact, Orendain said, such consultations are usu-ally “staged” to the effect that students are practically rendered powerless in the face of such exercise.

Orendain said they are dismayed as CHED is sup-posed to be “a regulatory body to control school fees,” but the agency instead, “has become an instrument in the launching of such staged consultations for tuition hikes in campuses.”

“The CHED is practi-cally useless in terms of protecting students from high costs of education,” Orendain said.

A first year student of the University of the Philippines –Mindanao for instance, pays P600 per unit, so if a student enrolls in 20 units of courses, he pays at least P16,000 pesos per semester, Orendain said.

A Bachelor of Science in Elementary Education student of the University of Mindanao pays P394 per unit, so he pays P7,900 for 23 units, on top of the almost P7,000 cost of miscellaneous fees, she added.

A student of Ateneo de Davao University pays P900 per unit, so 20 unit enroll-ment would entail a cost of P18,000 per semester, exclu-sive of miscellaneous fees.

Orendain said they ex-pect many students to drop out next school year. “The costs of basic goods are al-ready increasing. How can we expect our parents to be able to send us to school with such expected round
