Office of the GovernorEmergency Executive Order 20-69: Extending the Temporary Nighttime Curfew in the Cities of Minneapolis and Saint Paul
I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:
OnMay25,2020,GeorgeFloyddiedwhileincustodyoftheMinneapolisPoliceDepartment.SinceMr.Floyd’sdeath,thousandsofMinnesotanshaveexpressedtheirfrustrationinapeacefulandconstructivemanner.Peacefuldemonstrationsareessentialtoourdemocraticsystem.Unfortunately,someindividualshaveengagedinunlawfulanddangerousactivity,includingactsofarson,rioting,looting,anddamagingpublicandprivateproperty.Thissenselessviolencetearsatthefabricofoursociety,doesnotreflectourvalues,andpresentsaclearandpresentdangertolifeandpropertyinMinnesota.
TheCitiesofMinneapolisandSaintPaulhaveactivatedtheiremergencyoperationsplans,andthemayorsofbothcitieshaverequestedassistancetohelpprovidesecurityandrestoresafety.InresponsetothoserequestsandtothewidespreadcivilunrestandunlawfulactivityinMinneapolis,SaintPaul,andsurroundingcommunities,IdeclaredapeacetimeemergencyandactivatedtheMinnesotaNationalGuardonMay28,2020.IalsoimposednighttimecurfewsinMinneapolisandSaintPaulonMay29,30,and31,2020.Conditionshaveimproved,butthreatstopublicsafetyremain.SinceMay29,2020,whenIfirstissuedanighttimecurfew,over400individualshavebeenarrested,withover250individualsarrestedafterthe8:00pmcurfewonMay31,2020.MinnesotaStatePatrolrecoveredmultiplehandgunsandbulletproofvests.Thethreatofdangerousanduncontrollablefiresremainsaconcern.Forexample,lastnightlawenforcementstoppedavehiclewithnolicenseplatesorvehicleidentificationnumberwithsevenoccupants.Thevehiclecontainedgasolinecans,rags,sledgehammers,andothertoolsthatcouldbeusedtoengageinarsonandviolence.Becausemuchofthedestructionandviolencehastakenplaceunderthecoverofdarkness,wemustcontinueatemporarynighttimecurfewincoordinationwiththeCitiesofMinneapolisandSaintPaul.
InMinnesotaStatutes2019,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“generallyprotectthepublicpeace,health,andsafety”and“preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementandtocarryouttheprovisionsofMinnesota’sEmergencyManagementAct.
MinnesotaStatutes2019,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,andthemovementandcessationofmovementofpedestrians,vehiculartraffic,andallformsofprivateandpublictransportationduring,prior,andsubsequentto...actualemergencies.”Thisauthorityalsoextendstothedirectionandcontrolof“publicmeetingsorgatherings.”
PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectof

Executive Orderslawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.
Forthesereasons,Iorderasfollows:
1. Nighttime Curfew. AcurfewisimposedinallpublicplaceswithintheCityofMinneapolisandtheCityofSaintPaulduringthefollowingtimes:
a. From10:00pmonMonday,June1,2020until4:00amonTuesday,June2,2020.
b. From10:00pmonTuesday,June2,2020until4:00amonWednesday,June3,2020.
2. Travel Prohibited.Duringthecurfew,allpersonsmustnottravelonanypublicstreetorinanypublicplace.
3. Exemptions.Alllawenforcement,fire,medicalpersonnel,andmembersofthenewsmedia,aswellasotherpersonnelauthorizedbytheCityofMinneapolis,CityofSaintPaul,MinnesotaDepartmentofPublicSafety,MinnesotaStatePatrol,orMinnesotaNationalGuard,areexemptfromthecurfew.Individualstrav-elingdirectlytoandfromwork,seekingemergencycare,fleeingdangerouscircumstances,orexperiencinghomelessnessarealsoexempt.
4. Definitions.
a. ForthepurposesofthisExecutiveOrder,“travel”includes,withoutlimitation,travelonfoot,bicy-cle,skateboard,scooter,motorcycle,automobile,publictransit,oranyothermodeoftransportingapersonfromonelocationtoanother.
b. ForthepurposesofthisExecutiveOrder,a“publicplace”isanyplace,whetheronprivatelyorpubliclyownedproperty,accessibletothegeneralpublic,includingbutnotlimitedtopublicstreetsandroads,alleys,highways,driveways,sidewalks,parks,vacantlots,andunsupervisedproperty.
5. Enforcement.IurgeallMinnesotanstovoluntarilycomplywiththisExecutiveOrder.PursuanttoMinne-sotaStatutes2019,section12.45,anindividualwhowillfullyviolatesthisExecutiveOrderisguiltyofamisdemeanoranduponconvictionmustbepunishedbyafinenottoexceed$1,000orbyimprisonmentfornotmorethan90days.
PursuanttoMinnesotaStatutes2019,section4.035,subdivision2,andsection12.32,thisExecutiveOrderiseffectiveimmediatelyuponapprovalbytheExecutiveCouncil.ItexpiresonJune3,2020at4:00amoruntilitisrescindedbyproperauthority.
AdeterminationthatanyprovisionofthisExecutiveOrderisinvalidwillnotaffecttheenforceabilityofanyotherprovisionofthisExecutiveOrder.Rather,theinvalidprovisionwillbemodifiedtotheextentnecessarysothatitisenforceable.

Office of the GovernorEmergency Executive Order 20-70: Authorizing use of State Right of Way for Outdoor Dining During the COVID-19 Peacetime Emergency
I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:
TheCOVID-19pandemicpresentsanunprecedentedchallengetoourState.MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.AfternotifyingtheLegislatureonApril13,2020,andagainonMay13,2020,IissuedExecutiveOrdersextendingthepeacetimeemergencydeclaredinExecutiveOrder20-01.
SlowingthespreadofCOVID-19hasrequiredtheclosureorlimitedoperationofmanybusinesses.ThesenecessaryclosuresandlimitationsduringtheCOVID-19pandemichaveslowedthespreadandhelpusprepare,buttheyhavealsobeenaneconomichardshipforbusinessownersandemployeesofthoseimpactedestablishments.OurincreasedpreparednesstotreatthosemostvulnerabletoCOVID-19allowsustoslowlyandsafelyreopenoureconomyinaccordancewithguidancefromtheMinnesotaDepartmentofHealth(“MDH”),theDepartmentofEmploymentandEconomicDevelopment(“DEED”),andtheDepartmentofLaborandIndustry(“DLI”).BusinessesreenteringtheeconomymustensurecompliancewiththeMinnesotaOccupationalSafetyandHealthActof1973,MinnesotaStatutes2019,Chapter182(“MinnesotaOSHAStandards”),inadditiontoguidelinesrelatedtoCOVID-19setforthbyMDHandtheCentersforDiseaseControlandPrevention(“MDHandCDCGuidelines”).
CarefullyreopeningbarsandrestaurantstohelpmitigateboththepublichealthandeconomicimpactsoftheCOVID-19pandemiciscrucialforthewellbeingofourState.OnMay20,2020,IsharedtheStaySafePlan,whichoutlinesMinnesota’sphasedapproachforsafelyreopeningvariousbusinessandsocialsettings,andonMay27,2020,IissuedExecutiveOrder20-63,whichimplementedtheStaySafePlanandallowedbarsandrestaurantstoservefoodoutdoorsbeginningonJune1,2020.ExecutiveOrder20-63includesrequirementsforbarsandrestaurantswhoservefoodonsitetoprotectthehealthandsafetyofMinnesotans,suchassocialdistancingandmaskrequirementsforbarandrestaurantworkers.
Evidencefromrecentpublichealthstudiesshowsthatbarsandrestaurantscanenhancethesafetyofoperationsbyconductingoutdoordiningserviceandfollowingsafetyprotocols,includingspacingguidelinesandcapacitycontrols.Asrestaurantsreopen,creatingdistancebetweenrestaurantpatronsandwaitstaff,inadditiontoplacingseatingawayfromwalkspaces,entrances,andexits,willhelpimprovethepublichealth.Allowingrestaurantsadditionalusablespacewillhelpthemachievemaximumsocialdistancing.Usingadjacentstreetsforseatingallowsforadditionaloutdoorspace.Currently,MinnesotaRules2019,part8810.5400,providesthat“[n]opartoftheright-of-wayofatrunkhighwayorofastreetoverwhichatrunkhighwayisroutedmaybeusedfor...theconductofprivatebusiness.”Further,MinnesotaStatutes2019,section160.2715,prohibitsorlimitscertainusesofthehighwayandtherightofwaylocatedonorwithinthehighway.TheseprovisionshavetheeffectofprohibitingbarsorrestaurantsfromutilizingoutdoorspacelocatedonatrunkhighwayrightofwayforoutdoordiningpurposesasencouragedbyExecutiveOrder20-63.Byeasingtheserestrictions,wecanproviderestaurantswithadditionalspacetoachievesocialdistancinggoalswhilebeingoutdoorsandprotectthepublichealth.
InMinnesotaStatutes2019,section12.02,theMinnesotaLegislaturerecognizedthe“existingandincreasingpossibilityoftheoccurrenceofnaturalandotherdisastersofmajorsizeanddestructiveness”andconferreduponthe

Executive OrdersGovernortheemergencypowers“inorderto(1)ensurethatpreparationsofthisstatewillbeadequatetodealwithdisasters,(2)generallyprotectthepublicpeace,health,andsafety,and(3)preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontroltheState’semergencymanagementaswellascarryouttheprovisionsofMinnesota’sEmergencyManagementAct.
MinnesotaStatutes,section12.21,subdivision3,statesthattheGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthependencyofapeacetimeemergency.AnyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionoftheStatearesuspendedforthedurationoftheemergency.
Forthesereasons,Iorderasfollows:
1. Definitions.
a. “Bar”and“restaurant”meanonlythosefoodestablishmentslicensedunderMinnesotaStatutes2019,Chapter157.
b. “Trunkhighwayrightofway”meansthosestreetsandroadsunderthejurisdictionoftheMin-nesotaDepartmentofTransportation(“MnDOT”),andforthepurposesofthisExecutiveOrder,excludestheInterstateHighwaySystem.
c. “Municipality”meansacityortownshipauthorizedbytheCommissionerofTransportationtoissueanoutdoordiningpermittoabarorrestaurantfortheuseoftrunkhighwayrightofwaytoconductoutdoorfoodandbeverageservices.
d. “Outdoordiningpermit”isapermitissuedbyamunicipalitytoapermittedbusinessforuseoftrunkhighwayrightofwayfortheplacementofoutdoordiningcomponentstoconductoutdoorfoodandbeverageservices.
e. “Outdoordiningcomponents”arethoseitemsplacedonthetrunkhighwayrightofwaybythepermittedbusinesstocreateanoutdoordiningarea,includingtables,chairs,andrefusecontainers.
f. “Permittedbusiness”meansabarorrestaurantthathasbeenissuedanoutdoordiningpermit.
2. TherestrictionsinMinnesotaRules2019,part8810.5400,andMinnesotaStatutes2019,section160.2715,arewaivedtotheextentthattheyprohibitorlimituseofthetrunkhighwayrightofwaybybarsandrestau-rantsforthepurposesofprovidingoutdoordiningservices.ThisExecutiveOrderdoesnotapplytoanyrightofwaythatisunderthejurisdictionofalocalgovernmententitythathasbeendesignatedastheroadauthority.
3. IauthorizetheCommissionerofTransportationtodevelopandimplementaprocesstoissuetemporarypermitstomunicipalitiesinMinnesotatoallowandauthorizethemunicipalitytoissueanoutdoordiningpermittoabarorrestaurantfortheuseoftrunkhighwayrightofwaytoconductoutdoorfoodandbev-erageservices.ThedevelopmentandimplementationofthisprocessisnotsubjecttotherequirementsinMinnesotaStatutes2019,Chapter14,pertainingtoagencyrulemaking.
4. MnDOTisauthorizedtoexcludeareasoftrunkhighwayrightofwayforoutdoordiningservicesiftheareaisdeterminedtonotbesuitablebasedonsafetyconsiderations,currentusage,oranyotherpertinentdata.
5. MnDOTmayrequirepermittedmunicipalitiestocomplywithadditionalconditionsandrestrictions,suchassettingandenforcingappropriatetrafficcontrolmeasuresdesignedtoprotectthesafetyofthetravelingpublicandthoseindividualsparticipatinginoutdoordiningactivities.

OnMay25,2020,GeorgeFloyddiedwhileincustodyoftheMinneapolisPoliceDepartment.SinceMr.Floyd’sdeath,thousandsofMinnesotanshaveexpressedtheirfrustrationinapeacefulandconstructivemanner.Peacefuldemonstrationsareessentialtoourdemocraticsystem.Unfortunately,someindividualshaveengagedinunlawfulanddangerousactivity,includingactsofarson,rioting,looting,anddamagingpublicandprivateproperty.Thissenselessviolencetearsatthefabricofoursociety,doesnotreflectourvalues,andpresentsaclearandpresentdangertolifeandpropertyinMinnesota.
TheCitiesofMinneapolisandSaintPaulhaveactivatedtheiremergencyoperationsplans,andthemayorsofbothcitieshaverequestedassistancetohelpprovidesecurityandrestoresafety.InresponsetothoserequestsandtothewidespreadcivilunrestandunlawfulactivityinMinneapolis,SaintPaul,andsurroundingcommunities,IdeclaredapeacetimeemergencyandactivatedtheMinnesotaNationalGuardonMay28,2020.Incoordinationwithbothcities,IalsoimposednighttimecurfewsinMinneapolisandSaintPaulonMay29,2020andextendedthecurfewsthroughthemorningofJune3,2020.Conditionshaveimproved,butthreatstopublicsafetyremain.SinceMay29,2020,whenIfirstissuedanighttimecurfew,hundredsofindividualshavebeenarrested.Crediblethreatsofarsonandotherviolenceremain.SomeindividualshaveusedvehiclestoramlawenforcementandNationalGuardvehicles.Curfewsallowlawenforcementtosafelypursuesuchindividuals.Whenlawenforcementofficershavearrestedsuchindividuals,theyhaverecoveredweapons.Lawenforcementisalsotrackingincreasedreportsofincendiarydevicesthatcouldbeusedtocontinuepreviousarsonactivity.Becausemuchofthedestructionandviolencehastakenplaceunderthecoverofdarkness,wemustcontinueatemporarynighttimecurfewincoordinationwiththeCitiesofMinneapolisandSaintPaul.
InMinnesotaStatutes2019,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“generallyprotectthepublicpeace,health,andsafety”and“preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementandtocarryouttheprovisionsofMinnesota’sEmergencyManagementAct.
MinnesotaStatutes2019,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,andthemovementandcessationofmovementofpedestrians,vehiculartraffic,andallformsofprivateandpublictransportationduring,prior,andsubsequentto...actualemergencies.”Thisauthorityalsoextendstothedirectionandcontrolof“publicmeetingsorgatherings.”
PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.
Forthesereasons,Iorderasfollows:
1. Nighttime Curfew. AcurfewisimposedinallpublicplaceswithintheCityofMinneapolisandtheCityofSaintPaulduringthefollowingtimes:

b. ForthepurposesofthisExecutiveOrder,a“publicplace”isanyplace,whetheronprivatelyorpubliclyownedproperty,accessibletothegeneralpublic,includingbutnotlimitedtopublicstreetsandroads,alleys,highways,driveways,sidewalks,parks,vacantlots,andunsupervisedproperty.
5. Enforcement.IurgeallMinnesotanstovoluntarilycomplywiththisExecutiveOrder.PursuanttoMinne-sotaStatutes2019,section12.45,anindividualwhowillfullyviolatesthisExecutiveOrderisguiltyofamisdemeanoranduponconvictionmustbepunishedbyafinenottoexceed$1,000orbyimprisonmentfornotmorethan90days.
PursuanttoMinnesotaStatutes2019,section4.035,subdivision2,andsection12.32,thisExecutiveOrderiseffectiveimmediatelyuponapprovalbytheExecutiveCouncil.ItexpiresonJune5,2020at4:00amoruntilitisrescindedbyproperauthority.

TheClayCountySheriffandlocallawenforcementpartneragenciesareawareofcrediblethreatsthatviolentactivitiesduringdemonstrationsplannedinNorthDakotacouldspillintonearbyMinnesotacommunities.Respondingtoalarge-scaleeventtoprotectlife,safety,andpropertywouldquicklyexhausttheresourcesoftheClayCountySheriff’sOfficeanditsmutualaidpartners.MinnesotaStatePatrolpersonnelareassistingothercommunities.ClayCountyhasactivateditsemergencyoperationsplan,andtheSheriffhasrequestedassistancefromtheMinnesotaNationalGuardtohelpprovidesecurityandpreservepublicsafety.NationalGuardresourcesareavailabletoprovidethisassistance.
TheStateEmergencyOperationsCenter(“SEOC”)iscurrentlyactivatedandhasimplementedtheMinnesotaEmergencyOperationsPlan.TheSEOCcansupportthismissioninadditiontoitscurrentsupportofsecurityoperationsinothercommunitiesandtheState’sCOVID-19response.
Forthesereasons,IdeclareapeacetimeemergencyinClayCountyandsurroundingcommunitiesandorderasfollows:
1. TheAdjutantGeneralwillordertostateactivedutyonJune3,2020thepersonnel,equipment,andfacilitiesneededtosupportemergencyoperationsandresponse.
2. TheAdjutantGeneralisauthorizedtoprocurethegoodsandservicesneededtoaccomplishthemission.
3. TheDepartmentofPublicSafety’sDivisionofHomelandSecurityandEmergencyManagementwillcontinuetocoordinatetheprovisionofon-sitesupportandassistancetoaffectedlocalgovernmentandassesstheneedforsupplementaryemergencyassistance.
4. Stateagencies,incooperationwithappropriatefederalagencies,willprovideassistancetolocalunitsofgovernmentastheyrespondtoandrecoverfromthisemergency.

ThePresidentdeclaredanationalemergencyrelatedtoCOVID-19onMarch13,2020.Sincethen,andforthefirsttimeinhistory,thePresidenthasapprovedmajordisasterdeclarationsforallfiftystatesandtheDistrictofColumbia.Inconcertwiththesefederalactionsandtheactionsofstatesacrossthenation,Minnesotahastakenproactivestepstoensurethatweremainaheadofthecurve.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,endangersthelivesofMinnesotans,andlocalresourceswere—andcontinuetobe—inadequatetoaddressthethreat.AfternotifyingtheLegislature,onApril13,2020andagainonMay13,2020,IissuedExecutiveOrdersextendingthepeacetimeemergencydeclaredinExecutiveOrder20-01.
Theneedtoslowthespreadofthevirusrequiredtheclosureofcertainnon-criticalbusinessesinoureconomy.AlthoughMinnesota’sAprilunemploymentratewasthesecondlowestinthecountry,over700,000Minnesotanshave

Executive OrdersappliedforunemploymentinsurancesinceMarch16,2020.InExecutiveOrder20-33,seekingtobalancepublichealthneedsandeconomicconsiderations,webeganplanningtoallowmoreMinnesotaworkerstosafelyreturntowork.Wedraftedguidelinesandrequirementsforappropriatesocialdistancing,hygiene,andpublichealthbestpractices.ExecutiveOrder20-38expandedexemptionsforoutdoorrecreationalactivitiesandfacilities,andExecutiveOrders20-40,20-48,20-56,and20-63allowedforthegradualreopeningofcertainnon-criticalbusinessesthatplannedforandprovidedsafeworkplaces.
OurincreasedpreparednesstotreatthosemostvulnerabletoCOVID-19allowsustocontinueslowlyandsafelyreopeningoureconomyinaccordancewithguidancefromMDH,theDepartmentofEmploymentandEconomicDevelopment(“DEED”),andtheDepartmentofLaborandIndustry(“DLI”).BusinessesreenteringtheeconomymustensurecompliancewiththeMinnesotaOccupationalSafetyandHealthActof1973,MinnesotaStatutes2019,Chapter182(“MinnesotaOSHAStandards”),inadditiontoguidelinesrelatedtoCOVID-19setforthbyMDHandtheCentersforDiseaseControlandPrevention(“MDHandCDCGuidelines”).
DespitetheprogresswehavemadesincedeclaringtheCOVID-19peacetimeemergency,certainestablishments—includingthoseinwhichpeoplegatherandlinger,thosewithcommunalfacilities,andthoseinwhichclosephysicalcontactisexpected—continuetoposeapublichealthrisk.Wecontinuetocarefullyconsiderandprovideopportunitiesforsuchbusinessestoscaleuptheiroperations.
Likewise,certainnon-workactivitiesoutsideofthehomeareconducivetosocialdistancingandhygiene,whileothersraisesignificantpublichealthrisks.Indooractivitiesposehigherrisksthanoutdooractivities.Activitiesresultinginincreasedrespirationratesposehigherriskthansedentaryactivities.Unpredictablesettingsareriskierthanmorepredictablesettings.Largesocialgatheringsforextendedtimeperiodsincreasetheriskoftransmissionbetweenhouseholds.Buttherisksoftransmissionarediminishedintransitorysettings,suchasretailestablishments,whereindividualinteractionsandcontactaremorelimitedinduration.
InMinnesotaStatutes2019,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“(1)ensurethatpreparationsofthisstatewillbeadequatetodealwithdisasters,(2)generallyprotectthepublicpeace,health,andsafety,and(3)preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementaswellascarryouttheprovisionsofMinnesota’sEmergencyManagementAct.
MinnesotaStatutes2019,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,and...publicmeetingsorgatherings.”Pursuanttosubdivision3ofthatsamesection,theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency

6. Activities outside of the home. Guidelines.IndividualsengaginginactivitiesoutsideofthehomemustfollowtherequirementsofthisExecutiveOrderandMDHandCDCGuidelines.Individualsengaginginoutdoorrecre-ationalactivitiesmustfollowtheMinnesotaDepartmentofNaturalResources(“DNR”)andMDHguidelinesonoutdoorrecreationforfacilitiesandthepublic(“OutdoorRecreationGuidelines”)availableattheStaySafeMinnesotawebsite(https://staysafe.mn.gov).
b. Unnecessary travel strongly discouraged. Consistentwithfederalguidanceandtoprotectourneighbors,Minnesotansareencouragedtostayclosetohomeandarestronglydiscouragedfromengaginginunnecessarytravel.
c. Social gatherings. Allindoorsocialgatheringsofmorethan10peopleandalloutdoorsocialgatheringsofmorethan25peopleareprohibited,exceptassetforthbelow.Socialgatheringsare

i. Legislative and other governmental meetings. ThelimitsongatheringsinthisExecu-tiveOrderdonotapplytolegislativeandothergovernmentalmeetings. Remotemeetingsarestronglyencouragedwheneverpossibleaspermittedbystateorlocalauthority.
ii. The Judicial Branch.ThelimitsongatheringsinthisExecutiveOrderdonotapplytoproceedingsheldbytheMinnesotaJudicialBranch.ProceedingsheldbytheJudicialBrancharesubjecttothepoliciesestablishedbythechiefjusticeandwilloccurasdirect-edbycourtorder.IndividualsmayappearasdirectedbyaMinnesotastatecourt,includ-ingtoserveasajuror,appearasaparty,asawitness,oraslegalcounselonbehalfofaparty,orotherwisetocomplyasdirectedbyacourtorder,subpoena,orsummons.

A. Required Higher Ed Plan content.AssetforthinthePlanGuidance,atamini-mum,eachHigherEdPlanmustadequatelyaddressthefollowingareas:
1. Require distance learning wherever possible.EachHigherEdPlanmustrequirethatdistancelearningcontinuesforallstudentswhenpossible.Ifin-personindoororoutdooractivitiesarerequired,suchactivitiesmustbesubjecttolimitationssetforthbyrelevantOHEandMDHguidance.
2. Ensure that sick students and institution staff and instructors stay home.EachHigherEdPlanmustestablishpoliciesandprocedures,includinghealthscreenings,thatpreventsickstudentsorinstitutionstaffandinstructorsfromenteringtheinstitutionforin-personoron-siteactivities.
3. Social distancing.EachHigherEdPlanmustimplementsocialdistanc-ingpoliciesandproceduressetforthbytheCDCandMDH.SuchPlansmustalsoincludesignageincommonareastodiscouragegathering.EachHigherEdPlanshouldencourageallstudents,visitors,staff,andinstructorstowearmasksorfacecoverings.
4. Cleaning and disinfection protocols.EachHigherEdPlanmustestab-lishcleaninganddisinfectionprotocolsforareaswithintheinstitutionwherestudents,staff,andinstructorsmayvisitandprovideanenhancedsanitizing,cleaning,anddisinfectingregimenconsistentwithMinneso-taOSHAStandardsandMDHandCDCGuidelinesforcommonareas.
iii. Certification and signature.InstitutionalleadershipresponsibleforimplementingtheHigherEdPlanmustsignandcertifysuchHigherEdPlan,affirmingtheircommitmenttoimplementandfollowtheHigherEdPlan.
iv. Dissemination and posting.AhighereducationinstitutionmustmakeitsHigherEdPlanavailableaccordingtoapplicableguidelines.

l. DispersedandremotecampingsitesinaccordancewiththeOutdoorRecreationGuidelines.Adis-persedcampsiteisasinglecampsite,notinadevelopedcampground,usedforovernightcamping.Aremotecampsiteisadesignatedbackpackorwatercraftcampsite,notinadevelopedcamp-ground,usedforovernightcamping.

9. Respect for workers.Minnesotansmustrespecttheeffortsofemployersandbusinessestoprotectthe

10. Enhanced local measures permitted.NothinginthisExecutiveOrderorpreviousExecutiveOrdersshouldbeconstruedtoprohibitorpreventpoliticalsubdivisionsfromimplementing,withintheirjurisdic-tionsandpursuanttoapplicablelawandauthority,restrictionsbeyondtherestrictionscontainedinthisEx-ecutiveOrder,aslongasthoseadditionalrestrictionshavearealorsubstantialrelationtothepublichealthcrisiscausedbyCOVID-19.PursuanttoMinnesotaStatutes2019,section12.32,politicalsubdivisionsmaynotrelaxorreducethisExecutiveOrder’srestrictions.Inotherwords,totheextentthattheyhaveauthor-itytodoso,citiesandotherpoliticalsubdivisionsmaytakeactionsthataremoreprotectiveofthepublichealthbutmaynottakeactionsthatarelessprotectiveofthepublichealth.
11. Enforcement.IurgeallMinnesotanstovoluntarilycomplywiththisExecutiveOrder.PursuanttoMinne-sotaStatutes2019,section12.45,anindividualwhowillfullyviolatesthisExecutiveOrderisguiltyofamisdemeanoranduponconvictionmustbepunishedbyafinenottoexceed$1,000orbyimprisonmentfornotmorethan90days.Anybusinessowner,manager,orsupervisorwhorequiresorencouragesanyoftheiremployees,contractors,vendors,volunteers,orinternstoviolatethisExecutiveOrderisguiltyofagrossmisdemeanoranduponconvictionmustbepunishedbyafinenottoexceed$3,000orbyimprisonmentfornotmorethanayear.Inadditiontothosecriminalpenalties,theAttorneyGeneral,aswellascityandcountyattorneys,mayseekanycivilreliefavailablepursuanttoMinnesotaStatutes2019,section8.31,forviolationsofthisExecutiveOrder,includingcivilpenaltiesupto$25,000peroccurrencefrombusinessesandinjunctiverelief.Stateandlocallicensingandregulatoryentitiesthatinspectbusinessesforcompliancewithrulesandcodestoprotectthepublicareencouragedtoassessregulatedbusinesses’compliancewiththisExecutiveOrderanduseexistingenforcementtoolstobringbusinessesintocompliance.NothinginthisExecutiveOrderisintendedtoencourageorallowlawenforcementtotransgressindividualconstitu-tionalrights.
PursuanttoMinnesotaStatutes2019,section4.035,subdivision2,andsection12.32,thisExecutiveOrderiseffectiveimmediatelyuponapprovalbytheExecutiveCouncil.ItremainsineffectuntilthepeacetimeemergencydeclaredinExecutiveOrder20-01isterminatedoruntilitisrescindedbyproperauthority.
