    BE IT REMEMBERED, that a regular meeting of the Board of supervisors of Harrison

    county, Mississippi was begun and held in tile meeting room of the Board of Supervisors of

    Harrison county, located in the second Judicial District Courtllouse at Biloxi, Mississippi, on

    AN ORDER OF THE HARRISON COUNTY BOARD OFSUPERVISORS DENYING THE REQUEST OF LEE MAGEE TOREMOVE A FENCE ON AN UNOPENED PUBLIC RIGHT-OF-WAYOFF CANAL ROAD, AND FOR RELATED PURPOSES

    WHEREAS, Mr. Lee Magee appeared before the Harrison (ounty Board of Supervisol~s

    (i1ereafter "tile Board"), anej stated that Me AI Jones 11ad placed a fence across an unopened

    PULllic rigI1t-of-way off Canal Road, and

    WHEREAS, tile Board IleaI'd and considereej statements from Mr. Lee Magee, Mr. AI

    Jones ancl tile County Engineer anel determined that indeed tile rigllt-of-way 11ael not IJeen

    openeej and was not LWlIlg L1sed IJY tile PUIJlic; and

    WHEREAS, tile 80arel furtller determined that til ere was a gate, Wl1ich would provide

    access to tllis portion of tile unopened rigllt-of-way, if needed, and t/1at Mr. Jones agreed

    t11at tilE QClte wOLllel remain open for public access aneJ further, if tile need arises, Silme will

    11e removed, if and when tile right-otway is opened to tile public.

    NOW THEREFORE, BE IT ORDERED:

    WHEREl\S, it now appears, according to records in the OUice of State Aid RoadConstruction, that unexpendcd and unencumbered Federal Bridge Replacement Funds and FederalOtT-System Bridge Program Credit are available for the inspection, inventory and evaluation ofeligible bridges located in the above mentioned county as of the date of this Agreement, andhereinafter referred to as designated bridges, and

    WHEREAS, the Board has complied with all the rules and regulations promulgated by theState Aid Engineer under the Jaw and has lhereby become eligible to expend funds to inspect,inventory and evaluate bridges according to the estimate prepared and approved by the State AidEngineer, imd
