In Be l l County, on WPSO 885-A,"Feeder" road, i n the matter of claim of D. H. Buchanan Construction Company f o r payment on 2.845 acres addi t ional "Clearing and Grubbing" at the u n i t price of $150.00 per acre, i t i s ordered by the Commission t ha t payment be made t o D. In Bexar County, due to the apparent p roh ib i t ive cost of r i g h t -of-way and property damage f o r the proposed grade separation project at the intersect ion of Fredericksburg road and M. P. Railway i n San Antonio, i t i s ordered that th i s pro jec t be withdrawn from the 1939 Grade Crossing Program and the $196,000.00 so released be reverted to the unassigned balance and the State Highway Engineer i s directed to submit a request to the U, 5. Bureau of Public Roads providing fo r t h i s pro jec t withdrawal

In Bexar County, the Ci ty of San Antonio having indicated i t s de­s i re to improve New Braunfels Avenue extending from the north l i m i t s of Port Sam.Houston nor th to the nor th c i t y l i m i t s of San Antonio, and i n consideration of the p o s s i b i l i t y o f t h i s Street a t t r ac t ing Highway Traf­f i c desiring to by-pass the business d i s t r i c t , "which establishes a State Highway Department in t e res t i n the proposed improvement; upon o f f i c i a l request from the governing body of the City of San Antonio, the State Highway E n g i n e e r i s directed to lend assistance to the Ci ty of San An­tonio i n working out t h e i r plan o f operation to be based upon detai led inves t igat ions , surveys, plans, estimates, e t c . , as necessary to c lear ly define r e s p o n s i b i l i t y of each party, thereby developing a fac tua l agree­ment consistent w i th pol ic ies established by the State Highway Commission to be submitted to the State Highway Cornmission fo r consideration and possible adoption.

In Bexar County, i t i s apparently the mutual desire of the U.S, A i r Corps, the County of Bexar, the Missouri Pac i f ic Railway Company, and the Southern Pac i f i c Railway Company to relocate the former route of Highway No. 2 ( l o c a l l y known as the Laredo Road) to connect w i t h the new locat ion of Highway ^o. 2 at a point just nor th of Leon Creek and near the south edge of K e l l y Field to form a part of the projected M i l i t a r y Drive Loop around the City of San Antonio. The f o l l o w i n g action i s , therefore, taken:

1. The State Highway Department agrees t o recommend approval to the U, S. Bureau of Public Roads, the construction of grade separations w i t h the M. P. and S, P. Railway Companies including e l i g i b l e approaches; t h i s work i s to be financed, i f approved, wi th funds from the 1939 Grade Crossing Program.

2. The County of Bexar to agree t o provide i n accordance with plans and specif icat ions approved by the State Highway Engineer and without cost to the State Highway Department, a l l of the required grading drainage structures, pavement, and other pertinent items of construction necessary to complete the road from former Highway No, 2 to new Highway No. 2; and, to maintain the ent ire project i n a manner sa t i s fac tory to the State Highway Department and the Bureau of Public Roads or t h e i r authorized representatives, wi th exception of the grade separation struo tures proper which are to be maintained by the respective Railway Compani

and, to provide a l l r ights-of-way not less than 120 f e e t i n width and easements f o r an o u t l e t pipe drain and open channel as needed f o r proper drainage; and t o provide i n tha f u t u r e , when construction funds become avai lable , r ights-of-way not less than 120 fee t i n width on location se­lected by the State ghway Department on a fu r ther pro jec t ion of M i l i t a r y Drive Loop around San Antonio, extending from a suitahie con­nection wi th th i s proposed project across Highway w o . 3 west to Highway No. 2 no r th .

3. This order o f the Commission s h a l l become e f f e c t i v e upon i t s acceptance by the U. S. A i r Corps, County of Bexar, M. P. Railway Com­pany, and S. P. Railway Company.

4. On the e f f e c t i v e date of this order, as provided above, the State Highway Engineer i s directed to submit a request to the U. 5. Bureau of Public Roads providing f o r the programing of the work discus­sed under section No. 1 above, at a t o t a l estimated cost of $194,000.00.

In Bowie County, on U. S. Highway 67, the State Highway Engineer i s di rected to make a survey on the proposed by-pass route at Texarkana traversing McCartney Lane and Ohio-Fish Boulevard and Texas Avenue t o an in tersect ion wi th West Seventh Street, the present route of U. S. Highwa; 67. I t i s f u r t h e r ordered that upon completion of such survey, e s t i ­mates be prepared covering the cost of the construction of those sec­t ions of t h i s route that have not been previously constructed and that a complete report be made as to the probable t r a f f i c u t i l i t y of the pro­posed by-pass route .

WHEREAS, Minute No. 14111 passed hy the Highway Commission i n session September 21, 1937, provided f o r the placing of addit ional shel l on tha t section of Highway ^o. 19 from Angleton to Phair, a distance of 10.3 mile s ; and

WHEREAS, t h i s work has been done and there remains an unexpended balance in the funds provided f o r th is pro jec t ; and

WHEREAS, there are cer ta in other sections of t h i s highway adja­cent to t h i s pro jec t -which are badly in need of addi t ional s h e l l ,

IT IS ORDERED BY THE COMMISSION, that the l i m i t s of th i s p ro^ c t be extended from Phair to Velasco, and that the balance of funds remaining i n the o r i g i n a l appropriation be expended i n placing addi t iona l she l l on the worst sections of the highway from Phair to Velasco. WHEREAS, State Highway No. 66 i s the American Legion Memorial Highway, and has been so recognized by the State Highway Department; and

WHEREAS, the Texas State Department of the American Legion, t h ru i t s Commander, Dr. Danforth, desires the State Highway Department to i n ­s t a l l an American Legion Plaoue on the new bridge at Marble Fa l l s , on State Highway No. 66, Tdiioh is the American Legion Memorial Highway,

Since Dave McCullough was w i l l i n g to perform the work at the un i t prices bid by him and as called f o r I n the plans and speci f ica t ions but was unable t o sign the contract papers on account of the surety com­panies refusing t o execute the contract bond.
