' Violation of Medical Practice Act
The Board adopted a motion made by Dr. Koontz that the Board ofMedical Examiners refer this matter to the Attorney General forthe purpose of resolving the differences between the twoBoards. The Board adopted an additional motion made by Dr.Koontz that the Board of Medical Examiners inform the AttorneyGeneral that the Board believes the acts i n question constitutethe practice of medicine.

Fitz, M. D. , presided at this hearing held at 9:00 a.m. , Sunday,August ll, at the Raleigh Hilton, Raleigh, North Carolina. No
one appeared to speak regarding the proposed regul ationchanges: (1) to change the Board's regulations to conform tostatutory provisions of Chapter 739 of the General Assembly ofNorth Carol i na, Sessi on 1985, by: (a) increasing fees forresi dent' s training 1 i cense, 1 i cense by endorsement, and1 imi ted license; and by (b) changing regul ations regardingpostgraduate training requirements for licensure; (2) todelete the regulation regarding special limited license to work
in state mental hospital while applying for FLEX exam; and (3)to change regulations to conform both to current statutes and
to Board policy and to correct typographical errors.
The Board recommended the following amendments to the proposedregulation changes:

The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners approve the proposed changes in the rules andr egul ations as amended wi th instructions that, af tercoordinating the amended changes with the Board's attorney, thestaff file these proposed changes in accordance with theAdministrative Procedures Act and furnish this information inan appropri ate manner to appl i cants for 1 i censure.The President declared the hearing concluded at 10:10 a.m.

The Board adopted a motion that the staff, with all haste andas rapidly as possible, institute proceedings to hold a hearingon regulatory provisions for residents' training licenses; thatthe staff adverti se thi s hearing appropri ately; and that theBoard change its regul ations to require all applicants forresidents' training licenses who have graduated from medicalschools not approved by the AOA or the LCME to furnish evidencethat they have satisfactorily completed clinical clerkshipsrequired by their medical schools at teaching hospitals in theUnited States with residency programs in the areas of thecl inical cl er kships.

The Executive Secretary contacted the eight Board members bytelephone and Thomas E. Fitz, M. D. ; Jack A. Koontz, M. D. ;Charles H. Duckett, M. D. ; Rose Pully, M. D. ; Mrs. MarthaWalston; David S. Charlton, Warwick Anthony, M. D.
The Board adopted a motion made by Dr. Duckett that the Boardof Medical Examiners approve Dr. Charlton's postgraduatetraining and issue him a license to practice medicine in thestate of North Carolina.
Hanham, William, M. D.
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners instruct its attorney to prepare a ConsentAgreement for Dr. Hanham's signature containing the followingstipul ations:
1. that he surrender his Schedule 2 and 2N prescribingpri vi1 eges;
2. that he participate in an active,structured continuing medical education program; and
3. that he take and pass Component II of FLEX by the date ofthe August, 1986, Board meeting;
Ber rios, Oswald, M. D.
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners instruct its attorney to prepare a ConsentDecree for Dr. Berrios' signature containing the followingstipulations:
1. that he surrender his Schedule 2 and 2N prescribingpri vi1 eges;
2. that he participate in an active,structured continuing medical education program; and
3. that he take and pass Component II of FLEX by the date ofthe August, 1986, Board meeting;
The Board adopted a motion made by Dr. Koontz that the Board ofMedical Examiners request an opinion from the Attorney Generalconcerning this matter and that the Board inform FLEX
applicants it has requested an opinion from the AttorneyGeneral of the State of North Carolina concerni ng the effect ofthe new legislation on their applications.

The Board of Medical Examiners adopted a motion made by Dr.Daniel that the Board approve these proposed changes with thefollowing modifications:
(1) To be certified as an MICN, an individual mustcomplete the Emergency Nurse Education Program to includeACLS and BTLS materials.
(23 EMT-Intermediate Advanced certification entitles EMS
personnel to prescribe Lydocaine, Atropine, SodiumBicarbonate, and Epinepherine.
Guilford County Study Project
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners approve this study project for a period oftwo years and strongly recommend that Guilford County alternatethe cases randomly.
Charlotte Memorial ~Hos ital Study Project
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners approve a study project using thepharyngeo-tracheal lumen airway at Charlotte Memorial Hospitalfor a period of one year with the request that the Boardreceive a report on this study project at the end of a year.
Letters to be Sent to Judy Seamon, R. N. , and Judy Johnson, R. N.
The Board adopted a motion made by Dr. Alexander that the Boardof Medical Examiners approve the proposed response to Ms.Seamon, that the Office of EMS prepare a similar response toMs. Johnson; that the letter to Ms. Seamon include a statementindicating the Office of Emergency Medical Services mailed ahearing notice to the home address of each MICN in NorthCarolina; that this letter include an additional statement tothe effect that the Board of Medical Examiners believes 39% tobe a commendable response; and that the Office of EMS furni shthe Board with a copy of the response it prepares to Ms.Johnson.

The Board adopted a motion made by Dr. Alexander that the Boardof Medical Examiners prefer charges against this physicianbased upon immoral and dishonorable conduct, indecent assault,and adultery.

The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners send the following letter to this physician.
Information has reached this Board concerning an investigationconducted by the United States Air Force relating to yourprofessional competence. The Board of Medical Examiners'records show that you presently have a lecense to practicemedicine in this state. In order to maintain this license, itwil 1 be necessary for you to regi ster it for the bienniumbeginning in 1986.

The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners notify all licensed Ophthalmologi sts in NorthCarolina, the Ophthalmologists' Association, and the NorthCarolina Medical Society that it has come to the attention ofthe Board of Medical Examiners that there are a growing numberof situations in North Carolina in which ophthalmologi sts haveentered i nto arrangements with optometri sts whereby theoptometri sts refer to the ophthalmologi sts patients forcataract surgery and that following such surgery these patientsare then returned by the ophthalmologi sts to the care of theref erri ng optometri sts for post-operati ve care and fol 1 owing.Because i t i s the vi ew of the Board that such post-operati vecare and following con sti tutes the practice of medicine, thepractice of permitting persons who are not licensed to practicemedicine in the State of North Carolina to provide such care isspecifically disapproved by the Board.
Carlan, Susanne Stanley, M. D.
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners not approve Dr. Carlan's request forlicensure reinstatement.
FLEX Fee for Separate Components
The Board adopted a motion made by Dr. Duckett that aregulation be adopted to provide, if a physician takes FLEXcomponents separately, the Board of Medical Examiners willcharge a fee of $250. 00 for Component I and a fee of $250. 00for Component II
Thomas, John Evans, N. D.
The Board adopted a motion made by Dr. Duckett that the Boardof Medical Examiners issue this physician a temporary licensefor a period of one year and that the Board request Dr. Thomasto appear for an informal interview prior to the expiration ofthi s temporary license.
Outer Banks Medical Center
The Board of Medical Examiners adopted a motion made by Dr.Citron that it approve Thomas John Byrne, M. D. , to act as aback-up supervi sing physician at the Outer Banks MedicalCenter, but that it not approve Thomas Janney Roberts, M. D. , tosupervi se medical acts performed by a physician extender atthi s practi ce site.
The Board of Medical Examiners adopted a motion made by Dr.Citron that the Board send the following letter to Dr. Buoni:
At its August, 1985, meeting, the Board of Medical Examiners ofthe State of North Carolina reviewed your letter dated June 7,1985, concerning physicians' countersigning chart entries ofnurse practitioners.
As a result of its review, the Board advises you that a nursepractitioner's chart entries documenting the performance ofnursing acts do not require countersignature by a physician;however, when a nurse practitioner performs a medical act,physician supervision is necessary and must be documented bycountersi gnature.
The Board of Medical Examiners cannot exempt you from the risksinvol ved in the supervi sion of nurse practitioners. If youhave questions about these ri sks, the Board suggests that youconsul t your attorney. If you do not wi sh to foll ow
regulations, you shoul d rel inqui sh your supervi soryresponsibility for nurse practitioners and so advise the NorthCarolina Board of Medical Examiners.

The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners initiate the proper procedures to invalidateDr. Suppal 's examination because of irregularities during theadministration of the FLEX, and that the North Carolina Boardof Medical Examiners report thi s matter to the Board of theFederation of State Medical Boards.
Mansoor, Azra, M. D,
The Board adopted a moti on made by Dr. Pul ly that, af terconsul ting wi th i ts attorney, the Board of Medical Exami nersinform Dr. Mansoor that the Board does not have the authorityto reimburse her for travel expenses.

The Board adopted a motion made by Dr. Duckett that the Boardof Medical Examiners notify Dr. Barron that her medicaleducation does not meed the Board's requirements.
Ekelund, Lars C. , M. D.
The Board adopted a motion made by Dr. Pully that the Boardissue Dr. Ekelund a license limited to the University of NorthCarolina and Duke University Medical Center and hospitalsaffiliated with these institutions.

The Board adopted a motion made by Dr. Pully that the Board ofMedical Examiners refer information concerning this instituteto the Attorney General.
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners advi se Dr. Chri stensen, before the NorthCarolina Board of Medical Examiners can make a decision on therequest for approval of a corporate name, it must know thegeographical location of this practice. The Board also adopteda motion made by Dr. Citron that the Board of Medical Examinersfurther advise Dr. Christensen, upon receipt of additionalinformation, the Board will act upon his request.

The Board adopted a motion that the Board of Medical Examinersapprove the issuance of a resident's training license to Dr.Lay for a peri od of one year and that the Board of MedicalExaminers request a letter from the Chairman of the Departmentof Psychiatry prior to the expiration of this temporary license.

Dr . Dani el inter vi ewed thi s physic i an who has appl i ed forlicense by endorsement of credentials. He stated that he is arecovering alcoholic. Dr. Rigdon told the Board that he plansto work at the Charlotte Treatment Center. He stated that he
has abstained from alcohol for almost four years. "There weretimes I took drugs when I could not get alcohol. " Dr. Rigdonstated he became addicted to narcotics in 1955 and went fortreatment in 1959. He indicated that he became an alcoholic atsixty-three and that he is now seventy-two. Dr. Citron askedDr. Rigdon if he realized that his work at Charlotte TreatmentCenter will be emotionally demanding. Dr. Rigdon responded, "Iwant to pass my serenity

The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners issue Dr. Rigdon a temporary license for aperiod of one year limited to the practice of medici ne withinthe Charlotte Treatment Center; and that the Board request him
to appear prior to the expiration of this temporary, limitedlicense.
Rubin, Richard Bennett, M. D.
The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners issue this physician a temporary license fora peri od of two years until Regi strati on in 1988, to expireFebruary 1, 1988, at which time he should contact the Board ifhe wishes to extend his licensure.

The Board adopted a motion that it issue Dr. Glaser a two yeartemporary license; that the Board advise her to request Dr.Clark and Dr. Bullen to provide progress reports during thistwo year period; that the Board i nform Dr. Glaser it is herresponsibility to request licensure extension; and that, if shedoes so, the Board interview Dr. Glaser prior to the expi rationof this temporary license.

The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners issue Dr. Landau a temporary license for aperi od of two years and that it interview him prior to theexpiration of this temporary license.
Edens, Clarence, M. D.
The Board adopted a motion made by Dr. Koontz that the Board ofMedical Examiners not reinstate Dr. Edens' license. Mrs.Walston added that the Board has not taken this action becauseof his controlled substance prescribing in the past but becauseit believes evidence exists which indicates Dr. Edens cannotcurrently practice medicine with reasonable skill and safety topatients.

The Board adopted a motion made by Dr. Fitz that the Board ofMedical Examiners i nstitute the proper procedures to prefercharges agai nst Dr. Wailer, that it so notify this physician inwriting, and that it further notify Dr. Wailer the Board ofMedical Examiners will hold a hearing on the charges preferredagainst him. The Board also adopted a motion made by Dr. Fitzthat the hearing be held in Asheville, if possible; and thatthe basis for the charges be immoral conduct, aiding andabetting a known addict, unprofessional conduct, andprescribing controlled substances for no medical indication.

The Board al so i ndi cated that Dr.Daniel and the Office of EMS may process these applications.The Board adopted a motion made by Dr. Citron that the Board ofMedical Examiners write a letter to Dr. Frazier requesting thathe provide the Board with anecdotal statistics documenting thebenefits of the "Bee Sting" legislation.
