Minutes May 16, 2013 Joshua D. Shapiro Chair Leslie S. Richards Bruce L. Castor, Jr. Call to Order Chair Shapiro called the meeting to order. Roll Call and Pledge of Allegiance Chair Shapiro, Vice Chair Richards and Commissioner Castor were present. Chair Shapiro’s daughter, Sophia Shapiro, led the Pledge of Allegiance. Commissioners’ Comments Chair Shapiro stated that there was an Executive Session held on May 2, 2013 to discuss current and pending litigation Chair Shapiro commented that Recorder of Deeds Nancy Becker was appointed to the Pennsylvania Electronic Recording Commission. Chair Shapiro stated that eight Recorders will sit on the Commission (4 Republican – 4 Democratic) along with a representative from the PA Historical & Museum Commission, Department of State (DOS), PA Association of Notaries (PAN), PA Land Title Association (PLTA) and PA Bankers Association. Chair Shapiro, Vice Chair Richards and Commissioner Castor congratulated Ms. Becker for her appointment and commended her for all of the work that she does for the taxpayers of Montgomery County. Chair Shapiro commented that Recorder of Deeds Nancy Becker was appointed to the Pennsylvania Electronic Recording Commission. Approval of Minutes May 2, 2013 Vice Chair Richards made a motion to approve the minutes of the May 2, 2013 meeting of the Montgomery County Board of Commissioners. Chair Shapiro, Vice Chair Richards and Commissioner Castor praised Ms. Heverly and her organization for raising awareness of diabetes across the County.

Commissioners Proclamation for Foster Parent Month- Laurie O’Connor and Michelle Kristofco Laurie O’Connor and Michelle Kristofco made a presentation on the importance of foster parents and asked residents to consider volunteering their own time to become foster parents. Chair Shapiro and Vice Chair Richards commended Ms. O’Connnor, her department and the foster parents for the work that they do on behalf of foster children throughout the County. The Board of Commissioners presented Ms. O’Connor and Ms. Kristofco with a proclamation, establishing May 2013 as Foster Parent Month in Montgomery County. Telecommunicator/Trainee of the Year Presentation- John Geib and Mike Vest John Geib presented Erin Taylor and Derrick Schlitter with awards, recognizing them as Telecommunicator Employee and Trainee of 2012, respectively. Commissioner Castor, Vice Chair Richards and Chair Shapiro commented on the high quality of service that the Department of Public Safety provides the citizens of Montgomery County. The Commissioners commended Ms. Taylor and Mr. Schlitter on receiving their awards. Commissioners’ Commendations for Montgomery County Telecommunicators- John Geib and Mike Vest John Geib presented on the efforts of the members of the Montgomery County Department of Public Safety who responded to the three-alarm fire in Horsham on April 7, 2013. Commissioner Castor, Vice Chair Richards and Chair Shapiro commented on the exceptional quality of work that the Department of Public Safety does on behalf of the residents of Montgomery County. Commissioner Castor presented Fire Dispatcher Mike McGuigan and Telecommunicator Supervisors Tori Rosa and Tippy Brookings with Commendations, recognizing them for their work during this incident. Office of Veterans Affairs Report- Tracy Pennycuick Tracy Pennycuick, the Director of Veterans Affairs, provided and overview of the ongoing activities of the Office of Veterans Affairs and the status of Veterans in the County.

Vice Chair Richards thanked Ms. Pennycuick and her department for the work that they do on behalf of the Veterans of Montgomery County. Commissioner Castor asked if there is any sort of questionnaire that veterans could fill out that would ascertain whether or not they are eligible for certain benefits. Ms. Pennycuick stated that determining whether or not an individual is a veteran or the spouse of a veteran is a part of the initial screening process for the Department of Aging & Adult Services and is incorporated into the entry questionnaire of the Navicates program. Ms. Pennycuick stressed the importance of being proactive in reaching out to veterans and their spouses to make them aware of the benefits available. Ms. Pennycuick stated that the Navicates program will help to promote these benefits and the services of her office. Commissioner Castor expressed his desire for the Office of Veterans Affairs to create a questionnaire that veterans can fill out that will enable members of her staff to determine what benefits they are eligible for and streamline the claims process. Ms. Pennycuick stated that she would work to have such a form created. Chair Shapiro commended Ms. Pennycuick for the outreach that she is doing on behalf of her office and expressed his belief that the Navicates Program will work in tandem with this outreach.

Ordinances Bridge Vehicle Weight Posting Ordinance- Ken Starr Vice Chair Richards made a motion to adopt the bridge vehicle weight posting ordinance as described by Mr. Starr, setting forth the maximum allowable weights on certain County-owned bridges. Commissioner Castor seconded the motion. Vice Chair Richards stated that this ordinance will give the municipal police departments the ability to enforce weight postings on bridges. Vice Chair Richards stated that this will help to expand the future use of these bridges. There was no further Board comment. There was no public comment. Resolutions Authorization of a Memorandum of Understanding with Bimbo Bakeries- Josh Stein

Vice Chair Richards made a motion that the proper County officials are authorized to enter into a Memorandum of Understanding with Plymouth Township and Bimbo Bakeries, which will allow for the construction of a new County-owned roadway between Ridge Pike and Alan Wood Road, subject to approval by the County Solicitor. Commissioner Castor seconded the motion. There was no Board comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. Authorization of Transfer of Affordable Housing Trust Funds- Carolyn Mayinja Vice Chair Richards made a motion that the Commissioners of Montgomery County, upon recommendation of the Montgomery County Department of Housing & Community Development, hereby approve the funding as outlined above to be funded from the Affordable Housing Fund in order to meet the relocation and case management needs of former CHS clients. Commissioner Castor seconded the motion. There was no Board comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. Authorization of a Revitalization Grant Extension- Jody Holton Vice Chair Richards made a motion that the Montgomery County Commissioners hereby extend the time under which Lower Merion Township may utilize the Community Revitalization Program grant awarded for the Ardmore Transit Center Project, to December 31, 2015, and authorize the use of the grant for design and engineering purposes, subject to the execution of an agreement between the County and Lower Merion Township containing the conditions listed on the attached Exhibit and described by Ms. Holton. Commissioner Castor seconded the motion. Vice Chair Richards stated that this is the only Amtrak Transit Station in Montgomery County and that all of the money for Phase I is secured by Lower Merion Township. Vice Chair Richards stated that if this project is not completed by 2015, the County will be refunded its financial contribution. Commissioner Castor expressed concerns regarding the cost and feasibility of this project that were stated to him by members of the Lower Merion Township Board of Commissioners. Commissioner Castor asked Mr. Soltysiak if he was able to address these concerns throughout the formation of this Resolution. Mr. Soltysiak stated that he was able to confirm with the township that the money for Phase I was available. Mr. Soltysiak stated that the township has agreed to use these funds for engineering and design, on the condition that if

the project is not substantially completed by 2015, the County’s funding would be returned. Mr. Soltysiak stated that in the past, the County’s contribution to revitalization projects have been around 50% of the total cost. Mr. Soltysiak pointed out that the County’s contribution to Phase I of this project represents only 1%. Commissioner Castor inquired if the concerns raised to him by Lower Merion Commissioners were sufficiently addressed. Mr. Soltysiak answered in the affirmative. There was no further Board comment. Authorization to Apply for Federal TIGER Grant- Jody Holton Vice Chair Richards made a motion that the Board of County Commissioners authorizes the proper County Officials to execute all documents in connection with an application for the federal Transportation Investment Generating Economic Recovery grant, subject to review and approval by the County Solicitor and that the County hereby authorizes the commitment of funds necessary to equal the required TWENTY PERCENT (20%) County matching contributions required for this grant. Commissioner Castor seconded the motion. Vice Chair Richards expressed her hope that the County is awarded this grant, stating that it would be very beneficial to the County and the businesses of Plymouth Township. Chair Shapiro commended Mr. Bagley for finding another potential funding opportunity for the County. There was no further Board comment. There was no public comment. Authorization to Opt Out of Pennsylvania Civil Service- Donna Pardieu Chair Shapiro commented that about 300 County employees work under the civil service program. Chair Shapiro stated that after a yearlong review by the Department of Human Resources, the Solicitor’s Office and representatives from the Offices of Children & Youth, Behavioral Health and Aging & Adult Services, it was determined that a switch to a merit-based system may best serve the interests of the County and its employees in the future.

Chair Shapiro stated that the change from a Civil Service System to a Merit-based system will allow greater opportunities for County employees for promotions and rewards for good work and will offer them protections during the grievance process. Chair Shapiro stated that he held meetings with the employees from the Offices of Children & Youth, Behavioral Health and Aging & Adult Services to discuss this transition. Chair Shapiro stated that their comments were positive and that the affected employees have had the opportunity to make their concerns heard. Chair Shapiro stated that, should the Commissioners decide to move forward with this Resolution, notification of this change would be sent to the state for review. Chair Shapiro stated that the County would then have to draft its own proposed policies for the state’s review. Chair Shapiro stated that once the state has approved of these new policies, the County would then be free to enact the new merit-based system. Chair Shapiro commented that during this interim period, the current civil service system remains in effect. Vice Chair Richards made a motion that the appropriate County Officials are hereby authorized to draft and send a letter to the Pennsylvania Department of Labor, indicating the County’s desire to opt-out of the agreement with the Commonwealth which established a Civil Service Hiring system, and indicating the County’s intent to establish a new merit-based hiring system. Commissioner Castor seconded the motion. Chair Shapiro thanked Ms. Pardieu and Ms. Glogowski for their work throughout this process. There was no further Board comment. There was no public comment. Advertisement of Bids and RFPs On motion of Commissioner Castor, seconded by Vice Chair Richards, the following requests for advertisement of Bids and RFP’s were adopted unanimously, subject to the approval of the County Solicitor: Bid on behalf of the Coroner’s Office for a C-Arm Fluoroscope, RFP on behalf of ITS and the Recorder of Deeds for Image Scanning and an RFP on behalf of Parkhouse for Engineering Service to Prepare Specifications for the Laundry Roof Replacement. Commissioner Castor made a motion to authorize the preceding awards of contract as described by Chief Operating Officer Lauren Lambrugo and to authorize the proper County officials to execute the same, subject to the approval of the County Solicitor. Vice Chair Richards seconded the motion.

Chair Shapiro commented that the County has selected a new broker for its commercial lines of insurance, who was able to achieve projected 13% savings ($250,000) for 2013. The broker has also been leading an effort for reducing risk across the County, identifying adequate and appropriate insurance levels, and providing new risk-related resources to employees. Chair Shapiro stated that the broker has also reviewed vehicle inventory and identified vehicles for which the County was still paying insurance but no longer owned and reviewed flood insurance and identified parcels where the County had flood insurance but parcel was not in a flood plain. There was no further Board comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. General Public Comment Doris Smith-Starks of the Norristown Town Watch stated that the Commissioners are doing a great job. Commissioners’ Comments Vice Chair Richards commented on her participation at the following events: The Bridgeport Police Memorial, the Montgomery County Police Officer Memorial Ceremony, the Courting Art Contest Presentation at the Montgomery County Community College, the Montgomery County Senior Games, taking a tour of the Central Montgomery County Technical School, attending an event honoring former Open Space Board Member Phoebe Driscoll and visiting with Ms. Holton as she experienced her first few days as the Director of the Planning Commission. Vice Chair Richards also expressed her excitement to participate in Bike to Work Day the following morning. Commissioner Castor asked Mr. McGarry to investigate the possibility of a receiving a credit for the automobile insurance that was overpaid. Mr. McGarry stated that he would look into the possibility of receiving such a credit. Chair Shapiro commented on his experience visiting with the employees at the Juvenile Probation Office and stated that the Department of Assets & Infrastructure would be implementing a plan to address the working conditions at this location.

Chair Shapiro then commented about his experience participating in a bocce competition at the Prison Barbeque. Chair Shapiro then commented about his experiences attending the ACLAMO breakfast and speaking to a group of Holocaust survivors at an event in Lower Merion. Upcoming Meeting Dates The next meeting of the Montgomery County Board of Commissioners will take place at 10am on June 6, 2013 in the Commissioners’ Board Room.

Adjournment On motion of Vice Chair Richards, seconded by Commissioner Castor, the May 16, 2013 meeting of the Montgomery County Board of Commissioners was adjourned. Salary Board Controller Greenleaf made a motion to approve the May 16, 2013 Salary Board presentation as given by the Director of Human Resources, Donna Pardieu, and to authorize the proper County Officials to execute the same. Commissioner Castor seconded the motion. There was no Board Comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. Commissioner Castor inquired if the reason that the Department of Public Safety is hiring all of the hourly fire instructors is due to the fact that the County is taking over this responsibility from the Community College. Ms. Pardieu answered in the affirmative. Adjournment On motion of Controller Greenleaf, the May 16, 2013 meeting of the Montgomery County Salary Board was adjourned. Election Board Chair Richards called the meeting to order.

Resolutions Amendment of Appointment of Individuals to Conduct Elections at Parkhouse – Nicole Forzato Commissioner Shapiro made a motion to amend Resolution 13-E.03, removing Joan Fidler and replacing her with Barbara Hammerle, to serve as one of the three individuals appointed to help conduct the elections at Parkhouse Providence Pointe for the 2013 primary and general elections. Vice Chair Castor seconded the motion. There was no Board comment. There was no public comment. Chair Richards brought the motion to a vote and it was

Appointment of Temporary Election Workers – Nicole Forzato Vice Chair Castor made a motion to appoint the individuals listed in the document identified as Exhibit 1 of this resolution, who shall serve as members of the various local boards of elections throughout Montgomery County for the May 21, 2013 primary election. Commissioner Shapiro seconded the motion. There was no Board comment. There was no public comment. Chair Richards brought the motion to a vote and it was adopted unanimously. The complete text of Resolution 13-E. 8 can be found in the appendix of this document. Chair Richards inquired if there are currently a number of these vacancies remaining. Ms. Forzato answered in the affirmative. Chair Richards asked Mr. McGarry if it would be the best course of action to recess this meeting of the Election Board until Monday afternoon in order to provide more time to collect recommendations for individuals to fill the vacancies. Mr. McGarry answered in the affirmative. General Public Comment Vice Chair Richards asked if there was any public comment, prior to considering a motion to adjourn. There was none. Commissioners’ Comments Vice Chair Richards stated that any Board comments would be held until the Board reconvened.

Recess Commissioner Shapiro made a motion to recess this meeting of the Election Board until Monday, May 20th, at 1:00pm. Vice Chair Castor seconded the motion. There was no Board comment. County Commissioners May 16, 2013

An Ordinance of the County of Montgomery, Pennsylvania to establish

maximum gross weight limits for all motor vehicles upon various bridges owned and maintained by the County of Montgomery; establishing penalties for violation of the same; providing for the disposition of fines and forfeitures; On motion of Vice Chair Richards, seconded by Commissioner Castor, the following Ordinance was adopted unanimously. WHEREAS, the County of Montgomery owns and maintains various bridges in townships located within Montgomery County, Pennsylvania; and WHEREAS, Section 4902 of the Pennsylvania “Vehicle Code,” 75 Pa. C.S. § 4902, as amended, authorized local authorities to impose restrictions as to the weight or size of vehicles operated upon any highways and bridges under their jurisdiction, whenever such local authorities shall determine that any such highway or bridge may be damaged or destroyed unless the permissible size or weight of vehicles is reduced; and

WHEREAS, the County of Montgomery’s Roads and Bridge Division of the Department of Assets and Infrastructure acting in coordination with the County’s Consulting Engineers have recommended maximum weight limits for various bridges owned and maintained by the County of Montgomery; and

WHERAS, the County Commissioners have determined that the bridges

herein-after mentioned, unless the permissible weight of vehicles is reduced, may be damaged or destroyed, all of said bridges being under the jurisdiction of the County of Montgomery, Pennsylvania. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Board of Commissioners of the County of Montgomery, Pennsylvania, as follows: Section 1. Prohibition. The operation of any motor vehicle, commercial vehicle, other tractor, trailer or tractor trailer with a gross weight in excess of that herein respectively prescribed, upon any of the bridges or portions thereof described below is hereby prohibited.

Section 2. Fine or Penalty. Any person operating a vehicle with a gross weight in excess of the limits prescribed above will be subject to penalties as set forth is section 4902 (g) (1) of the Pennsylvania “Vehicle Code,”; 75 Pa. C.S. § 4902 (g) (1), as amended, or as shall be set forth in any amendment thereto or successor legislation enacted by the General Assembly of the Commonwealth of Pennsylvania.

Section 3. Fines and Forfeitures All fines, penalties, and forfeitures imposed and collected under this Ordinance shall be disposed of by the collecting authority in the manner prescribed by the laws of the Commonwealth of Pennsylvania: Provided, however, that in any case in which a prosecution under this Ordinance is the result of local police action, the collecting authority shall transmit to the municipality employing such police officer or officers fifty percent (50%) of any fine, penalty, and/or forfeiture collected, and shall transmit to the Treasurer of the County of Montgomery the balance of any such fine, penalty and/or forfeiture. Section 4. Public Official Authorized to Act The Director of the Department of Assets and Infrastructure of the County of Montgomery is declared to be the “public official authorized to act,” pursuant to the provisions of Section 6109 (b) (2) of the Pennsylvania “Vehicle Code.” 75 Pa. C.S. § 6109 (b) (2), on the following specified matters:

a) He shall have the authority to increase or decrease the Gross Weight limits of any bridge enumerated in Section 1 of this Ordinance.

b) He shall have the authority to establish and once established, to increase or to decrease the Gross Weight limits for any bridge which may now or hereafter be owned by or be under the jurisdiction of the County of Montgomery, notwithstanding that such bridge is not enumerated in Section 1 of this Ordinance.

In exercising his powers and duties under this Section, the Director of the Department of Assets and Infrastructure of the County of Montgomery shall rely upon his own professional expertise and shall obtain the advice and recommendations of such consulting engineers, if any, as he shall deem appropriate; he shall file a written statement with

the County Clerk of the County of Montgomery setting forth any new or modified Gross Weight limits to be posted as set forth in Section 5 of this Ordinance.

Section 5. Restriction Signs The Director of the Department of Assets and Infrastructure shall erect or cause to be erected and shall maintain or cause to be maintained such restriction signs, including, if necessary, any advance informational signs, as shall be required to effectuate the enforcement of this Ordinance under applicable provisions of the Pennsylvania “Vehicle Code” and any other laws of the Commonwealth of Pennsylvania.

Section 6. Permits Pursuant to the applicable provisions of the Pennsylvania “Vehicle Code,”

as now set forth in 75 Pa, C.S. § 4902 (c), the Director of the Department of Assets and Infrastructure shall have authority to issue permits for the movement of vehicles of weight in excess of the restrictions provided for by this Ordinance for bridges now or hereafter owned by the County of Montgomery. No such permit shall be issued unless and until the applicant for such permit provides such security as the Director deems necessary to cover the cost of repairs and restoration necessitated by the permitted movement of such vehicles over the said bridges; in addition to such security the applicant for such permit shall also agree to indemnify and save harmless the County against any and all claims which may be asserted against the County for any personal injury or property damage claims which may arise out of the movement of such vehicles over the said bridges.

Section 7. Saving Clause.

If any section, paragraph, part or provision of this Ordinance shall be found to be unconstitutional, illegal or invalid by any court of competent jurisdiction, such decision of the court shall not affect any other section, paragraph, part or provision of this Ordinance. It is hereby declared to be the intent of the Board of Commissioners that this Ordinance would have been adopted without such unconstitutional, illegal or invalid section, paragraph, part or provision.

Section 8. This Ordinance supersedes any and all Ordinances that may be in effect for the purpose of establishing Gross Weight limits on bridges owned and maintained by the County of Montgomery either individually or collectively.

WHEREAS, the County of Montgomery has established the Affordable Housing Fund through enactment of Ordinance No. 93-1 dated July 15, 1993, ordained by Act 137 of the 1992 General Assembly of the Commonwealth of Pennsylvania; and WHEREAS, the Commissioners of Montgomery County have defined the “Affordable Housing Effort” as any program or project duly approved by the Montgomery County Commissioners, which increases the availability of quality housing, either by sale or rental, to any Montgomery County resident whose annual income is at or below the Montgomery County median income; and WHEREAS, the Department of Housing and Community Development of Montgomery County have been specifically charged with the responsibility of making recommendations to the Board of Commissioners of the County of Montgomery with regard to policies, programs and projects related to the creation of affordable housing opportunities; and WHEREAS, as a result of the closure of the non-profit agency Community Housing Services (CHS) on February 1, 2013; it became necessary to relocate all CHS clients to other suitable housing; WHEREAS, the Salvation Army Norristown, Laurel House and Resources for Human Development, non-profit agencies continue to provide housing relocation services through rental payments and case management services to the relocated CHS clients;

WHEREAS, the Department of Housing and Community Development recommends to the Commissioners the allocation of an initial $86,929.00 of Affordable Housing Trust Fund dollars to the following agencies as follows:

1. Salvation Army, Norristown - $54,173.00 for rental payments and utility

assistance on behalf of relocated CHS clients. Amendment of Resolution 11-C.284 to replenish rental assistance program funds already awarded to the Salvation Army.

2. Laurel House - $31,810.00 for rental assistance and case management services for CHS domestic violence clients.

WHEREAS, pursuant to Resolution 00-C. 353, dated August 24, 2000, the Montgomery County Commissioners established the Community Revitalization Program and adopted the Montgomery County Community Revitalization Program Guidelines; and

WHEREAS, Lower Merion Township submitted a grant application in 2009

for the Ardmore Transit Center Project (“Project”) as part of the Community Revitalization Program; and

WHEREAS, on June 25, 2009, the County Commissioners approved a grant

to Lower Merion Township for the Project, in the sum of $250,000, for the construction of a parking garage, train station, pedestrian linkages, high level train platforms, and new public green space; and

WHEREAS, Lower Merion has broken the Project into phases, with Phase 1

to include demolition of the existing station, construction of high level boarding platforms, tunnel improvements, pedestrian access improvements, garage foundation, canopies and shelters, passenger amenities, and site lighting; and

WHEREAS, Lower Merion has requested an extension of the grant, in

keeping with the current Project schedule; NOW THEREFORE BE IT RESOLVED, the Montgomery County

Commissioners hereby extend the time under which Lower Merion Township may utilize the Community Revitalization Program grant awarded for the Ardmore Transit Center Project, to December 31, 2015, and authorize the use of the grant for design and engineering purposes, subject to the execution of an agreement between the County and Lower Merion Township containing the conditions listed on the attached Exhibit.

NOW, THEREFORE BE IT RESOLVED, that the Board of County Commissioners authorizes the proper County Officials to execute all documents in connection with an application for the federal Transportation Investment Generating Economic Recovery grant, subject to review and approval by the County Solicitor. agreement with the Pennsylvania Department of Public Welfare, establishing a Civil Service Hiring system for certain County employees; and

WHEREAS, the County now desires to transition from the antiquated

Commonwealth system, and create a new Merit-Based hiring system, which will offer similar or superior protections for employees, while also offering greater flexibility in the staffing of positions.

NOW THEREFORE BE IT RESOLVED that the appropriate County

Officials are hereby authorized to draft and send a letter to the Pennsylvania Department of Labor, indicating the County’s desire to opt-out of the agreement with the Commonwealth which established a Civil Service Hiring system, and indicating the County’s intent to establish a new merit-based hiring system.

On motion of Commissioner Castor, seconded by Vice Chair Richards, it was unanimously adopted that: WHEREAS, Spec. #6205, bids for furnishing and delivering of Milk, Milk Products and Juice to the Dietary Departments of Parkhouse Providence Pointe and the Montgomery County Youth Center, for a period of two (2) years beginning July 1, 2013 and may be extended for one (1) additional one (1) year period, were sent to five (5) vendors and one (1) vendor responded, and was opened May 2, 2013; and WHEREAS, it is the recommendation of Parkhouse Providence Pointe and the Montgomery County Youth Center to accept the bid of Wawa, Inc. of Wawa, Pennsylvania for an estimated total lump sum price of $157,426.76, it being the only responsive estimated total lump sum price bid received in strict accordance with the Specifications and being within budgetary limitations. NOW THEREFORE BE IT RESOLVED, that the bid of Wawa, Inc. of Wawa, Pennsylvania for an estimated total lump sum price of $157,426.76 is hereby accepted. 13-E. 7 Election Board May 16, 2013

On motion of Commissioner Shapiro, seconded by Vice Chair Castor, it was unanimously adopted that:

WHEREAS, on March 21, 2013, Resolution 13-E.03 was passed by the County Election Board, appointing Democrat, Joan Fidler, to serve as one of three representatives of the election board, to conduct the Primary Elections on Friday, May 17, 2013, as well as the General Election on Friday, November 1, 2013 at Parkhouse Providence Pointe; and

WHEREAS, Mrs. Fidler is unable to serve as a representative to conduct

the elections at Parkhouse Providence Point; and WHEREAS, the County Election Board now seeks to Amend Resolution

13-E.03, to appoint, Democrat, Barbara Hammerle, to serve in place of Mrs. Fidler, as one of the representatives to help conduct the elections at Parkhouse Providence Pointe on Friday, May 17, 2013 and Friday, November 1, 2013; and

NOW, THEREFORE, BE IT RESOLVED, that Resolution 13-E.03 is amended as follows, that Democrat, Barbara Hammerle, is hereby appointed to replace Joan Fidler, to help conduct the elections at Parkhouse Providence Pointe on Friday, May 17, 2013 and Friday, November 1, 2013.

On motion of Vice Chair Castor, seconded by Commissioner Shapiro, it was unanimously adopted that:

WHEREAS, in accordance with the Pennsylvania Election Code, 25 P.S. §2601 et. seq., the County Board of Elections is permitted to make temporary appointments to local boards of election at designated polling places, in the event that vacancies exist at any time during the five day period prior to a primary or general election; and

WHEREAS, vacancies still exist on certain local boards of elections as of

today’s date, which marks the beginning of the five day period prior to the May 21, 2013 primary election; and

WHEREAS, in accordance with the authority conferred by the Election

Code, the County Board of Elections, in concert with the affected parties in the relevant voting districts, intends to appoint the individuals named in the attached Exhibit A, to serve as members of the various elections boards throughout the Montgomery County, as specifically designated on Exhibit A; and

WHEREAS, the individuals appointed to serve on the various election

boards throughout the county shall serve only on the date of the May 21, 2013 primary election.

NOW THEREFORE, BE IT RESOLVED, that the individuals whose

names are set forth on the attached Exhibit A are hereby designated to serve as members of the various boards of elections throughout Montgomery County for the May 21, 2013 primary election.
