Dr. Petraglia provided an overview of her attendance to the Multidisciplinary Board Fact Finding Work Group on Controlled Substances. Mr. Hall addressed the Board regarding Senate Bill 8, and requested that the Board review the materials and possibly provide a response to their stance of the Bill. Tad Fisher, President Florida Physical Therapy Association, addressed the Board.

The above reports were presented as informational only. 4. FSBPT Updates, if any

2017 Annual Meeting Dr. Ellen Donald, Dr. Patrick Pabian, and Traci Zeh attended the FSBPT Annual Meeting held on November 2-4, 2017. Dr. Tasso provided an overview of the presentation that was given at the annual meeting regarding the Florida laws and rules exam. She also provided an overview of the presentation she attended on Disciplinary Guideline Matrix’s. Dr. Pabian provided an overview of the presentation he attended on Telehealth. He also provided an overview of the new National Physical Therapy Exam standards. Dr. Donald provided an overview of the Licensure COMPACT. Dr. Tasso communicated on using the “Know Your Law” email blast to reach the public on updates of the laws and rules to educate licensees. Ms. Zeh provided an overview of her attendance to the Council of Board Administrators Forum and communicated the new requirements for the National Physical Therapy Exam to be implemented in 2020. APPLICANT RATIFICATION LISTS 5. Ratification Lists for Approved Applicants

Physical Therapist Applicants MOTION: Dr. Tasso made a motion to ratify the list of physical therapists for licensure by examination/endorsement (Exhibit A), 427 in number starting with PT 32513 and ending with PT 33091. Upon successful completion of the National Physical Therapy Exam and/or the Florida Laws and Rules Exam, shall be licensed. The motion was seconded by Dr. Petraglia and carried 5/0.

Physical Therapist Assistant Applicants

MOTION: Dr. Petraglia made a motion to ratify the list of physical therapists assistants for licensure by examination/endorsement (Exhibit B), 315 in number starting with PTA 27451 and ending with PTA 27967. Upon successful completion of the National Physical Therapy Exam and/or the Florida Laws and Rules Exam, shall be licensed. The motion was seconded by Dr. Tasso and carried 5/0.

6. Ratification List for Disqualification from Employment Exemptions MOTION: Dr. Petraglia made a motion to ratify the list of physical therapists who administratively approved exemptions, starting with Pamela Cartier, PT 61 and ending with Seth Myers, PT 31589. The motion was seconded by Dr. Tasso and carried 5/0. NEW BUSINESS 7. Continuing Education for Post Residency Hours James Moore, PhD, PT, PCS, Vice Chair for residency programs at the University of Miami, Department of Physical Therapy, inquired about residents or fellows-in-training obtaining continuing education credit for completion of an accredited, post-professional training program. Dr. Moore referred to the August 2006 minutes where the Board discussed the issue. After discussion the Board determined that based on 486.109 Florida Statutes, Continuing Education, any residency hours would qualify for continuing education credit, as long as the program holds an accrediting status with the American Physical Therapy Association or the Florida Physical Therapy Association as specified in the law. OLD BUSINESS 8. Board of Physical Therapy Minutes

August 3-4, 2017 General Business Meeting MOTION: Dr. Tasso made a motion to approve the August 3-4, 2017 minutes as amended. The motion was seconded by Dr. Donald and carried 5/0.

Respondent was charged with the following violation: Section 486.125 (1) (h), Florida Statutes (2015). Licensee violated a lawful order of the board or department previously entered in a disciplinary hearing. MOTION: After discussion, Dr. Tasso made a motion to find that the Respondent was properly served and has requested an informal hearing. The motion was seconded by Dr. Donald and carried 3/0. MOTION: Dr. Tasso made a motion to adopt the materials under Tab 1 and any addendum materials into evidence in this proceeding. The motion was seconded by Dr. Donald and carried 3/0. Suspension to be stayed for sixty (60) days pending successful completion of four (4) contact hours in Ethics and Professionalism. The courses must be completed through either the American Physical Therapy Association or the Federation of State Boards of Physical Therapy.

(Case No. 2016-07356) (PCP – Petraglia, Watson, Kuhns)

Respondent was present and sworn in by the court reporter. Ms. Taylor was represented by Jeffery Howell, Esq. Dr. Petraglia was recused due to participation in the Probable Cause Panel. Mr. Wilson summarized the case for the Board. Respondent was charged with the following violation: 486.125 (1) (e), Florida Statutes (2015). Failing to maintain acceptable standards of physical therapy practice. And 64B17-6.001 (2)(e), Florida Administrative Code (2015). Physical Therapist Assistants shall not use or participate in the use of any form of communication containing false, fraudulent, misleading, deceptive, unfair or sensational statement or claim or misrepresentation of services of self, nor engage in other unprofessional conduct. The case was presented as a Settlement Agreement that would impose the following:

Appearance Fine of $3,000.00 to be paid within five (5) years of the filing of the Final Order Costs $2,518.74 to be paid within five (5) years of the filling of the Final Order Completion of the Laws and Rules Exam. Respondent must register for the exam within

ninety (90) days of the filing of the Final Order and take and pass the exam within six (6) months of the filing of the Final Order

Respondent’s license shall be placed on one (1) year probation with conditions. Conditions to include, quarterly reports, chart review, and weekly contact. The Board approved Respondent’s monitor at the board meeting.

MOTION: After discussion, Dr. Tasso made a motion to accept the Settle Agreement with minor modifications. The motion was seconded by Mr. Steve Chenoweth and carried 4/0. Counter offer was accepted by Respondent and Counsel at the board meeting.

Respondent was present and sworn in by the court reporter. Mr. Ed Gray was present on behalf of Mr. Gochenauer. Dr. Tasso was recused due to participation in the Probable Cause Panel. Mr. Wilson summarized the case for the Board. Respondent was charged with the following violations: Count I: 456.072 (1) (c), Florida Statutes (2008-2010), being convicted or found guilty of, or entering a plea of nolo contendere to regardless of adjudication, a crime in any jurisdiction which relates to the practice. Count II: 456.072 (1) (c), Florida Statutes (2011-2012), crimes related to the practice. Count III: 456.072 (1) (x), Florida Statutes (2008), for failing to report to the Board. Count IV: 456.072 (1) (x), Florida Statutes (2010), failing to report to the Board. Count V: 456.072 (1) (x), Florida Statutes (2010), failing to report to the Board. Count VI: 456.072 (1) (x), Florida Statutes (2012), failing to report to the Board. The case was presented as a Settlement Agreement that would impose the following:

Appearance Fine of $7,000.00 to be paid within six (6) years of the filing of the Final Order Costs of $ 2,2013.97 to be paid within 6 (six) years of the filing of the Final Order Laws and Rules exam within six (6) months of the filing of the Final Order Complete Continuing Education course in the area of ethics and professionalism within

six (6) months. Respondent must submit proposed course within 60 days of the Final Order for Board

approval.

MOTION: Dr. Pabian made a motion to reject the Settlement Agreement and counter offer with the following penalties:

MOTION: Dr. Tasso made a motion to find that the Respondent was properly served and waive the right to a proper hearing. The motion was seconded by Dr. Patrick Pabian and carried 4/0.

MOTION: Dr. Tasso made a motion to adopt the materials under Tab 6 and any addendum materials into evidence in this proceeding. The motion was seconded by Dr. Pabian and carried 4/0.

MOTION: Dr. Tasso made a motion to adopt the conclusions of law as set forth in the Administrative Complaint and find that this constitutes a violation of the Chapters 486 and 456, Florida Statutes. The motion was seconded by Dr. Pabian and carried 4/0.

7. Michael Roger Garrett, PT 27801 (Case No. 2015-22795) (PCP – Chenoweth, Parker, Watson)

Respondent was not present nor represented by counsel.

Mr. Chenoweth was recused due to participation in the Probable Cause Panel.

Mr. Wilson summarized the case for the Board. Respondent was charged with the following violations: Count I: 486.125 (1) (g), Florida Statutes (2015), for having a license revoked or suspended. Count II: 486.125 (1) (i), Florida Statutes (2015), for making or filing a report or record which the licensee known to be false. Count III: 486.125 (1) (k), Florida Statutes (2015) and Rule 64B17-6.001(2)(f), Florida Administrative Code (2015) for violating any provision of this chapter or chapter 456 and the therapist should not exploit the patient or client for financial gain of the licensee or a third party.

MOTION: Dr. Tasso made a motion to find that the Respondent was properly served and waive the right to a proper hearing. The motion was seconded by Dr. Pabian and carried 4/0.

MOTION: Dr. Tasso made a motion to adopt the materials under Tab 7 and any addendum materials into evidence in this proceeding. The motion was seconded by Dr. Pabian and carried 4/0.

PETITION FOR MODIFICATION OF FINAL ORDER 8. William Justin Tait, PT 24174 Respondent was present and sworn in by the Court Reporter. Mr. Tait is represented by Allen Grossman, Esq. Dr. Martha Brown was present on behalf of Professional Resources Network (PRN). On March 11, 2011 a Final Order was filed requiring Mr. Tait to participate in a lifelong contract with Professional Resource Network (PRN). Mr. Tait submitted a Petition for Modification of the Final Order and requested the Board to consider removing the conditions on his license. MOTION: After discussion, Dr. Tasso made a motion to grant Mr. Tait’s request for Modification of the Final Order filed March 11, 2011 and remove the lifelong PRN requirement. The motion was seconded by Mr. Chenoweth and carried 5/0. NOTIFICATION OF ADMINISTRATIVE VOLUNTARY RELINQUISHMENT 9. John Brant, PT 19415, Case Number 2016 – 21151 The Board took disciplinary action at the August 2017, meeting against Mr. Brant’s license. Mr. Brant submitted a request on August 21, 2017, for an extension of time to complete a Professional Resource Network (PRN) evaluation. On September 22, 2017, board staff received a request from Mr. Brant to voluntarily relinquish his license.
