The Chairman of the Sub-Committee called the meeting to order at 2.00 PM on the

realization of quorum. The Subcommittee has reviewed the item wise agenda and

examined the proposals for alienation of Government land and the decisions taken after

deliberations are as follows:

1. APIIC - Land Alienation - IP- Chennappanaidupeta (V), Pellakur (M), SPSR Nellore District – To an extent of Ac. 869.54

The VC & MD, APIIC Limited, Vijayawada in his Lr.No. LO:1/93/2016/Lands /Nellore dated 27.07.2016 has requested the DOI to alienate 869.54 Acres of Land at Nellore District. The details of the proposal are as follows:

2. Utility for the State Development of industrial base, which in turn will boost economic growth of the state.

3. Clearances APIIC is obtaining Pollution Control Board clearances at Industrial Park level and the allottee companies will obtain necessary clearances from the concerned Depts.

4. Mechanism for adopting the Resettlement and Rehabilitation.

There are no project displaced families (PDFS) in this project. Hence, there is no need for R&R in this case. However, APIIC is implementing R&R as per G.O.Ms.No.68, Irrigation and CAD (Project Wing-LA-IV-R&R) Dept, dt.8.4.2005 and will implement as per provisions of Fair Compensation, transparency in Land Acquisition and Rehabilitation and Resettlement Act,2013 wherever necessary through the District Collectors concerned.

Mechanism to be adopted to Monitor the utility of the land as per the schedule.

Allotment of land shall be made to individual Units based on APIICs Land Allotment Regulation, 2015. APIIC shall monitor implementation of the project time to time. If the allotted company fails to implement the project within the stipulated period, action shall be taken for cancellation of allotment and resumption of the land.

7.

Mechanism for observations of the Environmental and Zonal Regulations.

Project site does not fall under environmental sensitive area. DTCP regulations apply. Necessary permissions/approvals will be obtained wherever required from the competent authorities.

8. Basis of requirement On Out-right sale basis to APIIC.

9. Detailed project Report to be enclosed along with location sketch.

The proposed land is exclusively for establishment of Industrial Park by APIIC and allotment will be made to the units basing on the land allotment Regulation, 2015 as amended from time to time after assessing the land requirement of the unit. Hence, no DPR is prepared at this stage.

III LAND ALIENATIONS PROPPOSALS OF INDIVIDUAL CASES

1. M/s. Gerdau Steel India Limited, Jambulapadu (V), Tadipatri (M), Anantapur Dist ::

M/s. Gerdau Steel India Limited, Jambulapadu and Verrapuram (V), Tadipatri (M), Anantapur District has taken over M/s. SJK Steel Plant Limited, and planning for an expansion from the existing capacity of 0.3 MnTPA to 1.00 MnTPA of Special Steel / alloy Steels, with an investment of (i) Rs.15.00 Crs on Coke Oven Plant; (ii) Rs.7.00 Crs on Power plant (15MW) and (iii) Rs.15.00 on Sinter plant. Now it is requesting for alienation of 38.14 acres of Govt. lands for its expansion. The unit is providing employment to 3000 persons directly and indirectly. The Company is spread in 850 acres of land out of which 122.19 acres of Government land has been alienated to the Steel plant on 16.01.1995. The unit commenced its production in the year 2005. The GM, DIC, Anantapur furnished the Annexure XI, Agenda, DPR, FMB Sketch and other supporting documents and reported that all stator permissions were obtained from the Govt. departments concerned and the land alienation proposal was already submitted to CCLA with recommendation of District collector. Further, he recommended for alienation of 38.14 acres of Govt. land to the unit.

The GM,DIC furnished the details of land Survey number wise on 11.07.2016 along with the Audit reports for the FY 2013-14 and 2014-15. It is reported that the proposed lands to an extent of 38.14 Acres is lying amidst the Company’s lands. Due to they are unable to compact their lands. These lands are required to make dump yards for Coke & Iron Ore plants. It is reported that they have already invested about Rs.1585 Crores on construction of Sintering plant and proposed to invest Rs.1690.80 Crores for construction of Coke & Iron Ore plants. The 15th Sub-Committee has deferred the case for want of detailed study of all supporting documents received from the GM,DIC. Hence, the sub-committee may take a view on the proposed lands for alienation.

2. Proposal of Dr. Illapogu Azaraiah, Lolur (V), Singanamala (M), Anantapur Dist.

The Government while furnishing the Letter Rc.No.E3/4721/2015 dated 01.04.2016 of the District Collector, Anantapur District requested to examined the proposal of Dr. Illapogu Azaraiah, Lolur (V), Singanamala (M), Anantapur District for establishment of Cold Storage

The Sub-Committee deferred the case for want of report from the GM, DIC, As the Govt. insisting of issuing all necessary clearances within 21

M/s. Sri Krishna Explosives & Accessories is an existing unit in Kayam (V), Vadamalapet (M), Chittoor District and requested to alienate Govt. lands to an extent of 18.72 Acres. The unit is manufacturing the ZZ category of Explosives with Class -2 Compounds (Mass explosion risk and Minor Missile effect) with a capacity of 7500 MTPA and providing employment to 29 persons. The GM,DIC, Chittoor vide his Roc.No.667/A2/2014 dated 12.04.2016, while furnishing the Annexure XI, Copies of EM Part-II, CFO, FMB sketch, approval of Chief Controller & Director of Factories and plan, recommended for alienation of the land to an extent of 18.72 Acres. It is informed that the unit was inspected on 17.05.2013 and 12.05.2016 and found working. In addition to the existing 4.36 acres of own land, it require 18.72 acres of additional land as the Chief Controller of Explosives, Nagpur had approved the plans duly considering the total area. He informed that the unit should be located at a minimum distance of 300 meters away from Road/ Railway and 601 meters away from the dwelling houses / offices / factories. The unit was established 30 years back and only 10% of the land is being utilised for factory buildings and the remaining 90% is for green belt.

The Inspector of Factories, Chittoor District in his Lr.No.C/1009/2013 dated 05.07.2013 addressed to the District Collector, had informed that as per the plans approved by the Director of Factories, the Company has to maintain 177 meters of internal safety distance from the magazine, hence as per the calculation it require 98,462.5 Sq,Mts (24.33 Acres) of land to run the factory.

The 15th Sub Committee deferred the case as the land issue is

The Government while furnishing the copy of Ref.E1/647/2016 dated 20.04.2016 of the District Collector, Kadapa requested the DOI to examine the Land alienation proposal for 5 Acres of Govt. Land of M/s.R.R.Stone Crushers, Bandapalli (V), Pampauram (M), Kadapa District and furnish report in provisions with GO Ms.No.571 on 30.04.2016.

The GM,DIC, Kadapa District furnished the Project report, FMB sketch, Certified copy of statement of means of the promoter and recommended for allotment of 5.00 acres of land to M/s.RR Stone Crushers.

The cost of the project is Rs.322.50 Lakhs and anticipated to provide employment to 30 persons. Its installed capacity is 2,00,000

MTs per Annum. The GM,DIC reported that the site is located adjacent to the mining quarries, at a distance more than 500 metres away from State Highway/MDR roads and there is no human habitation within 1 Km from the site. He reported that about 3 to 5.50 acres of land is

required for establishment of a stone crusher as per the APPCB norms. Hence, the sub-committee may take a view for land alienation of the Company.

11. Specific Report on recommendation on the proposal of M/s. The Ramco Cements Limited, Kurnool District ::

The Government, vide Memo No. 1112/Infra/2013 dated 07.05.2016, informed that the recommendation of Sub-Committee on the proposal of M/s. Ramco Cements Limited for the establishment of a major cement plant suffers from lack of specificity and is unacceptable to Government. Further it is requested to furnish a specific

recommendation regarding the extent of land to be allotted to the unit to the Government immediately. In this connection, it is informed that this Office had forwarded the proposal of M/s. The Ramco Cements Limited, Kurnool District to the Government basing on the decision of 12th Sub Committee on Land Alienation wherein it was decided to forward the proposal of Land to the Government for taking a view to alienate land in between from 280 to 500

Acres. The salient features of the proposal are as indicated below::

The Company intends to establish a Cement Plant with 5 MinTPA capacity and 50 MW power Generation plant.

The investment of the project is about Rs.1000 crores and provide employment to 300 persons directly and 2000 persons indirectly.

The GM,DIC, Kurnool while furnishing the Annexure XI, Agenda and other supporting documents, recommended the proposal for alienation of 280 Acres of land.

NCBM opined that land requirement for setting up a 1.00 MnTPA varies in the range of 100 Acres 150 Acres including the land for railway sliding and captive power plant and excluding staff colony, alternative fuel handling system etc.

As per the data of 10 Cement plants furnished by NCBM, the average land extend in use by 5 units which have Railway sliding and Captive power plant is 77.35 Acres per 1 MnPA.

The Sub-Committee re-examined the proposal in detail. After long deliberations, the Sub Committee opined that the earlier recommendation was holds good due to the following: (i) the existing

Cement plants in AP are located in a wide range of area in between from 35.73 Acres to 749.05 Acres per 1 MinTPA capacity;

(ii) As per the GO Ms No. 571, 280 Acres of land is sufficient in view of the availability of sophisticated machinery which require lesser area

In proportion, the land required for 5 MnPA is works out to be 386.75 acres.

The President of the Company attended the meeting and represented that the MoEF which was insisting for earmarking of 10% earlier is now insisting for 33% area. They are also planning to construct a Town ship colony, Buildings for Post office, Police Station etc. Hence, the Company require 525 Acres of land.

The APPCB has furnished the details of 22 Cement Plants existing in A.P.

As per the data furnished by the APPCB, the minimum,

maximum and average values of land extent per 1 MnTPA of existing Cement Plants are 35.53, 749.05 and 158.60 Acres respectively.

The 15th Sub Committee has re-examined the proposal of the unit and deferred for want of tentative layout plan for the proposal of 525

Acres duly demarking the spaces of unit /section wise specifications. Further it is opined that a representative from Factories department may be invited to attend the next ensuing meeting for offering their remarks.

The Company has furnished the tentative Layout plans of the proposed factory and this Office has requested the Factories department to attend the meeting. In view of the above, the sub-committee may take a view on recommendation of specific extent of land to the Company.

12. M/s. M.G. Brothers Automobiles Private Limited, Padugupadu (V), Kovur (M), SPSR Nellore District

The Government while furnishing the proposal for Land alienation to an extent of 0.33 Acres of M/s. M.G. Brothers Automobiles Private Limited, Padugupadu (V), Kovur (M), SPSR Nellore District requested to examine and furnish report in provisions with Land Allotment Policy on 16.07.2016. The GM,DIC was requested to examine the proposal and furnish compliance report on 27.07.2016 and reply is awaited. Hence, the sub-committee may take a view for land alienation of the Company.

During the reconciliation and verification of Land Alienation proposals with the Government it is noticed that the proposal of M/s.Gold Star Alloys Limited (GSAL) for alienation of 18.17 Acres of land for its expansion of Integrated Steel Plant was sent on 04.04.2013 and the same was not traced in the DOI. Hence a copy was collected from the Government on 18.04.2016 and requested the GM,DIC, Vizianagaram District to examine and furnish report in provisions with Land allotment policy on 25.04.2016. Reminded on 5th July by e-mail. Reply from the GM,DIC is awaited. Hence, the sub-committee may take a view for land alienation of the Company.

The GM,DIC, Nellore, through his Lr.No.898/B/2016 dated 23.06.2016, has furnished the DPR, Balance Sheets, ITR returns for the FY 2012-13, 2013-14, 2014-15 and 2015-16, Copy of registration certificate issued by R&B, Solvency certificate, VAT registration, Experience certificate etc and recommended for allotment of 2.34 Acres of land. It is informed that the promoter has established a Hot Mixing plant in Sy.No.2089//3 and 2089/4, Pothupalem (V), Gudur (M), Nellore District in the year 2012 with an investment of Rs.102.95 Lakhs and providing employment to 26 persons. The unit has obtained GP approval and VAT registration. CFE is pending for want of land ownership documents. The installed capacity of the plant is 360 MTs per day. The GM,DIC reported that a hot mix plant require about 3 acres of

land including land for development of green belt (10%). The 15th Sub Committee has examined the proposal and observed the following:

The lands are assigned lands which were resumed to the Govt. for violation of D -form patta conditions.

The original allottees sold the assigned lands and the purchasers had again sold the lands to the applicant.

The GP had issued NOC.
