Resolution No. 2
Considered. Vice President Shri Abhishek Chouksey took objection that how Shri
A.K. Nema, officiating CEO without taking oath, prepared and circulate this agenda with
his own signatures as Member Secretary. Board also noted that reply of the complaint
submitted by Vice President in this regard has already been sent to PDDE, CC for further
action.
3. Noting of sanction of President Cantonment Board Jabalpur u/s 26(2) (a) of
Cantonments Act, 2006.
Noting of sanction of PCB dated 27-04-2019 for dismantling of 45 nos. of
gumtees at Narmada Road, Katanga Naka, Jabalpur.

4. Annual Administration Report : 2018-19
To consider, note and approve the Annual Administration Report for the year
2018-19.

6. Revision of Remuneration of Legal Advisor Reference Resolution by Circular agenda dated 1 dated 10-03-2018.
The Board vide Resolution by Circular Agenda mentioned under reference has
renewed the contract period of Shri Vijay Singh, Legal Advisor of Cantonment Board
Jabalpur for 11 months w.e.f. 01-03-2019, although he has also requested for revision
of his remuneration in his request application for renewal.
Board is now requested to consider the revision of his remuneration also from Rs.
25,000/- p.m. to Rs. 30,000/- pm.
Relevant documents are placed before the Board for consideration.
Resolution No. 6
Considered and approved. It was resolved that remuneration of Shri Vijay Singh,
Legal Advisor of Cantonment Board Jabalpur be enhanced from Rs. 25,000/- per
month to Rs. 30,000/- per month w.e.f. 01-06-2019.
7. Renewal of Period of Engagement of Panel Advocates in Cantonment Board
Jabalpur
Ref:- CBR 6 dated 05-12-2016.
The Board vide above referred CBR has constituted fresh panel of advocates for
High Court and District Court cases for period of one year i.e. from 05-12-2016 to 04-12-
2017. Panel Advocates are duly engaged and continuously defending the cases on behalf
of Board. Hence it requires the renewal of their engagement period w.e.f. 05-12-2017 to
05-12-2019.

Resolution No. 7
Considered. It was resolved that period of engagement of Panel Advocates be
renewed till 30-06-2019. After that Panel of the advocates will be revised by inviting
fresh applications. During the revision process of Panel Advocates, this Panel shall
remain in effect.
8. Revision of amount of fees payable to Sr. Standing Counsel
Reference CBR No. 23 dated 08-06-2017.
To consider letter dtd 24-04-2019 received from Senior Advocate Smt. Indira Nair
regarding revision of fees amount from Rs. 18,000/- to Rs. 25,000/-.
Presently the senior Advocate Smt. Indira Nair is engaged as standing counsel in
High Court of M.P. for defending important cases in High Court etc. Currently the
Board is paying her Rs. 19,500/- (18,000/- fees + 1,500/- Misc expenditure) on
disposal of each case as per authority CBR under reference since last 2 years.
Application alongwith relevant office file is placed before the Board for perusal.
Resolution No. 8
Considered and it was resolved to revise the fees from Rs. 18,000/- to Rs. 25,000/-
for Sr. Standing Counsel. Amount of misc expenditure shall remain the same.
9. Special engagement of Senior Advocate Shri R N Singh in PIL (WP) Nos.
19212/18, 27521/18 and 28880/18
03 PIL Cases No. 19212/18, 27521/18 and 28880/18 are pending before the
Hon’ble High Court of MP regarding installation and allotment of 45 iron gumtees
at Narmada Road, Katanga Naka. Smt. Indira Nair, Senior Advocate is appointed
for defending the Board but it is seen in order sheets dated 22-04-2019 and 14-05-
2019 passed in these cases, that the Hon’ble High Court ordered to place action
taken report before the Court not only for Station Commander (PCB) but also for
GOC-in-C, CC Luknow, DGDE, Delhi and PDDE, Lucknow against irregularities
raised in committee reports mentioned in order dated 14-05-2019.

Due to involvement of strict directions for the above mentioned higher
authorities, it is highly needed to engage senior most advocate for defending the
Board Members as well as higher authorities and to avoid any legal lacuna in
representation before the Hon’ble High Court.
The CEO has consulted with Senior Advocate and former Advocate General
Shri R N Singh regarding these PILs and the Senior Advocate has provided his fee
schedule vide letter dated 18-05-2019, which is as below:-

Considered in detail. It was resolved that due to higher fee structure which is for
per hearing basis, special engagement could not be approved.
10. Reimbursement of Medical bill
Jabalpur Hospital & Research Centre, City Hospital & Research Centre and
employees of Cantonment Board has submitted their medical bills. The details of

The bills had been forwarded to RMO, Motilal Nehru Hospital for scrutinization
and checking the rates as per CSMA rules of Govt. of India with restrictions of
admissibility.

Considered and approved. It was resolved that in future for passing medical bills,
rate comparison with CGHS rates must be done.
11. Regarding grant of Two Advance Increment for teachers who has completed
(B.Ed/B.T.C/D.Ed) before 16.06.1993
To consider the Government of Madhya Pradesh, Education Department letter No.
F 07-44/1996/bees-4 dated 14th
September 2011 regarding grant of two advance
increment for teachers who has completed (B.Ed/B.T.C/D.Ed) before 16.06.1993. As per
memorandum of settlement Cantonment Board employees are equated with State
Government employees.

Resolution No. 11
Considered and approved. All civil and military members raised the point to appoint the
temporary teachers through the Board instead through agency. It was resolved that this
matter shall be put up in next Board Meeting.
12. Reply of Dr. (Mrs) Rupa Sarkar, RMO, Motilal Nehru Hospital on the
complaint made by the Board Members addressed by them to the PCB.
Reference CBR No. 18 (i) dated 03-10-2018
To consider the detailed reply of Dr (Mrs) Rupa Sarkar, RMO Motilal Nehru
Hospital vide her letter no. MNH/Misc/Corres/2018/401 dtd 12-10-2018 on the serious
objections raised by the Board Members that no normal deliveries are taking place in the
Hospital.
Board is requested to take note of the reply. Relevant reply is placed on the table.
Resolution No. 12
Considered and noted. It was further resolved that one permanent male Doctor
shall be deputed in night shift in the hospital, for which RMO will be directed
accordingly.
13. Extension of engagement of D.M.O.
Ref: CBR No.4(B&HCR No.4 dated 23.04.2018) dated 26.04.2018 and office note
dated 28.03.2019.
To consider extension of engagement of following DMOs for further 11 months
with effect from 2nd
July 2019 to 30th
April, 2020 at the already approved rate of
Rs.2000/- per day.
Vide above cited CBR following DMOs were engaged for 11 months on purely
contractual basis at Rs.2000/- per day for 8 hours duty from 01.05.2018 to 31.03.2019.
Further the period of engagement was extended by three months till 30th June 2019 vide
office note dated 28.03.2019.

It was further resolved that engagment period of DMO Dr.Asit Kumar Das shall
not be extended, as he is a 65+ doctor and Board has earlier resolved not to engage
doctors above 65 years of age.
14. Age Relaxation of D.M.O.
Reference CBR No.6 dated 19.01.2018.
To reconsider the upper age limit of 65 yrs for selection of DMO in Motilal
Nehru Hospital for the following reasons :-
(A) Though the performance of present DMOs are found to be good, it is felt
that the young doctors are unstable and looking for higher studies and jobs
elsewhere. Hence the Board may kindly reconsider the age bar of 65 years as it
is very difficult to find dedicated experienced doctors before they retire from
Govt. job.
(B) The State Govt. of M.P. is also hiring retired doctors after the age of 65 yrs.
on contractual basis to meet the shortage of doctors
(C)Shortage of DMOs will affect round the clock availability of DMOs to
provide services in the Casualty, Indoor, OPDs and distant dispensaries.

(D) Out of 8 DMOs selected in the year 2018, 03 young doctors have resigned.
Recently 02 Lady DMOs have resigned for better job/higher studies. It is also
felt that the presently existing young doctors may also leave the job any time.
Resolution No. 14
Considered and it was resolved not to approve the same. It was further resolved
that fresh applications shall be invited for engagement of DMOs in Motilal Nehru
Hospital having age below than 65 years of age.
15. Extension of engagement of Hospital Administrator
Ref: CBR No .4(B&HCR No.4 dated 23.04.2018) dated 26.04.2018 and
Circular Resolutiion No.2 dated 07 March, 2019.
Vide Circular Resolution No.2 dated 7th March, 2019, extension of
engagement of Shri Ajay Kumar Rajoriya, Hospital Administrator was approved
till 30th June, 2019.
Hence to consider further extension of services of Mr.Ajay Kumar
Rajoriya, Hospital Administrator for 11 months with effect from 2nd
July 2019 to
31st May, 2020.
Shri Ajay Kumar Rajoriya was engaged at a fixed monthly salary of
Rs.25,000/- only. He is well qualified i.e. MBA in Hospital Administration and
experienced in hospital management. His performance is quite satisfactory and
upto the mark. He is an asset to the hospital. Enhancement of his salary is
recommended as the salary is much less compared to his qualification and
experience
Resolution No. 15
Considered and resolved to extend the contract period of Hospital Administrator
for the period of 11 months w.e.f 02.07.2019 to 31st May 2020 with enhanced salary of
@ Rs. 30,000/- pm fixed on existing terms and conditions.
16. Extension of engagement of Hon. Consultants
Ref: CBR No.1(FCR No.2 dated 13./07/2018) dated 19/07/2018.
To consider extension of engagement of following OPD Consultants,
Counselors, Radiologist for further 11 months with effect from 08.07.2019 to

07.06.2020 as their term will expire on 06 July, 2019. Their performance is found
to be satisfactory.

Dr.Sharad Shrivastava (MD, Medicine) Consultant Physician is a competent &
punctual specialist but his behavior with all patients (Cantt Board Employees and
General Public) as well as with staff and colleagues is objectionable and rude hence
not suitable for this setup as lots of complaints are being received regarding his attitude
and behavior.
Dr. R.K. Nema (MD, Medicine) Consultant physician- his OPD days may be
reduced if more competent Physician are found in the interview.
If any of the above Consultants leave the job or proceeds on long leave, R.M.O.
may be authorized to engage qualified Consultants against them with prior approval of
CEO.
RMO may be authorized to utilize the services of qualified specialist doctors from
outside for OT services.
Resolution No. 16
Considered and resolved that engagement of following OPD Consultants,
Counselors, Radiologist shall be extended for further 11 months w.e.f. 08.07.2019 to
31.05.2020.

It was further resolved not to extend the engagment period of Dr. Sharad
Shrivastava (MD Medicine), as reported by RMO that his behavior is not good with
patients, staff and colleagues, which is highly objectionable. In respect of Dr. R.K.
Nema, MD, it was resolved that his OPD days may be reduced, subject to availability of
new Hony. Consultants (Medicine), after interview.
It was also resolved that RMO shall be authorised to engage the qualified
Consultants if any of the existing consultant leave the job, with prior permission of the
CEO.
17. Renewal of Agreement for Physiotherapy services in Motilal Nehru Hospital
Ref: CBR No.2(FCR No.1 dated 08/06/2018) dated 19/07/2018.
Vide CBR cited under reference renewal of agreement for Physiotherapy services
in Cantonment Board Motilal Nehru Hospital was granted for a period of 11 months with
effect from 23.07.2018 to 22.06.2019.
The term of present agreement will expire on 22.06.2019. Hence to consider and
approve further extension/renewal of term of agreement between Cantonment Board and
Dr.Gaurav Kochhar of Triveni Physiotherapy and Rehabilitation Centre, Jabalpur for a
further period of 11 months with effect from 24.06.2019 to 23.05.2020.

Kochhar dated 03.05.19 is placed on the table.
Resolution No. 17
Resolved that the term of agreement between Cantt Board and Dr.Gaurav Kochhar
of Triveni Physiotherapy and Rehabilitation Centre, Jabalpur for providing physiotherapy

services in Cantonment Hospital be extended for 11 months with effect from 24.06.2019
to 23.05.2020.
It was further resolved that necessary agreement be made as per existing terms.
18. Provision of concessional rates for all senior citizens
Board has been providing many concessional services to the senior citizens
of Cantonment area who register themselves under the Senior Citizen Yojana.
However, other senior citizen of Cantonment area and Municipal Corporation area
have also demanded such facilities in Motilal Nehru Hospital, Jabalpur.
Hence Board may consider and approve the same.
Resolution No. 18
Considered in detail. It was resolved that senior citizens who are visiting
Motilal Nehru Hospital and demanding concessional services be asked to register
themselves under Senior Citizen Yojana and avail the services. RMO shall take
suitable initiatives in this regard.
19. Transfer of Right of Collection of Parking Fees: Motilal Nehru Hospital,
Cantt Jabalpur
Ref: This office Tender dated 04-02-2019.
Cantonment Board, Jabalpur invited tenders for Transfer of Right of
Collection of Parking Fees Motilal Nehru Hospital, Cantt Jabalpur different parties
vide tender notice No.6520/MNH/Cycle Stand/RS/2019 dated 16-01-2019, for the
period of One Year i.e. from 01-01-2019 to 31-12-2020, which was published in
daily Newspaper ‘Dabang Duniya” & “Patrika” on 16-01-2019 , pasted on all
public notice boards, distributed to all Cantt Board Members, all previous
contractors and also uploaded on Cantonment Board website for wide publicity.
In response of the same tender notice, only 06 tender forms were sold and received
on 05.02.2019. The comparative statement of the same is as under:-

2019 to 31-03-2020, which was published in daily Newspaper ‘Dabang Duniya” &
“Patrika” on 05-01-2019 , pasted on all public notice boards, distributed to all Cantt
Board Members, all previous contractors and also uploaded on Cantonment Board
website for wide publicity.

21. Aadhar Center in the premises of Cantonment Board Jabalpur.
To consider an application received from Shri Vijay Kumar Verma resident of
Modibada Sadar Jabalpur who is running a private Aadhar Center requesting to allot him
space to set up Aadhar Center in the premises of Cantonment Board, Jabalpur. As per the
directions of Supreme Court order dated 09-06-2017 and CEO, UIDAI New Delhi letter
dated 28-06-2017 in which Aadhar Center have to be shifted from private places and
these centers have to be shifted in the premises of Govt. organizations.

Considered and it was resolved to not to approve the same. It was further resolved
that Revenue Section shall make correspondence with local post offices and nationalized
banks to tie-up for registration of Aadhar numbers on behalf of Cantonment Board office
Jabalpur.
22. Amendment in formation of Inquiry Committee constituted for disciplinary
action against Shri C K Kharate , Cantt Engineer
Reference CBR No. 32 dated 19-09-2018 and Resolution by Circular Agenda No.
1 dated 27-09-2018.
With reference to above, a Committee has been constituted for initiating
disciplinary inquiry against Shri CK Kharate, Cantt Engineer comprising Members of
Board Dr. Fating Rahul Haridas ADM, Col B S Koyrah SM and Major Pushpendra
Singh GE (E). But before serving charge sheet, one of the Committee Member Major
Pushpendra Singh, GE (E) got transferred in January 2019. Subsequently general
meeting could not be held due to administrative reasons and implementation of code of
conduct for general Lok Sabha Elections 2019.
Board is requested to amend formation of Inquiry Committee by substituting name
of Major Pushpendra Singh GE (E) with suitable existing army members of the Board.
Resolution No. 22
Considered. It was resolved that Committee constituted for disciplinary Inquiry
against Shri CK Kharate, Cantt Engineer shall be reconstituted comprising of Col
Rajesh Kanojia, Adm Comdt, Shri Rajeet Yadav and Shri Amit Agrawal as members
of the Committee. The Committee will submit fact finding report within 07 days
before the Board.
It was further resolved that suspension of Shri CK Kharate shall be revoked w.e.f.
01-06-2019 and Shri CK Kharate shall be directed to attend the office regularly. CEO
shall take the custody of the records of work in which irregularities committed by
Cantt Engineer Shri CK Kharate.

Zone
Reference Resolution by Circular Agenda No. 4 dated 24-01-2019.
In CBR under reference, the Board has approved locations of Fruit Market near
Vegetable market, Street No. 1 Sadar, Flower Market near Sadar Choupati and
Mechanic Zone at Lover’s Lane between Theatre Road to Sheela Talkies Road. Due to

Supreme Court of India regarding claiming of GST share from State Govt.
Reference Cantonment Board Pune letter no. GST/2018-19 dtd 14-02-2019.
Vide above referred letter, Cantonment Board Pune has circulated a proposal to all
62 Cantonments of India for seeking consent of each Board for filing of an appropriate
Writ Petition before Hon’ble Supreme Court of India regarding claiming of GST share
from State Govt to Cantonment Boards.
The State Authorities concerned in the country are collecting GST/revenue from
all commercial establishment located in the Cantonment areas as well but the share
thereof is not being allotted to the Cantonment Boards. At the same time other local
bodies and Municipalities are being allotted funds from the respective State Govt but the

Cantonment Boards are deprived of the same. The GST Compensation Act has been
enacted with the object of providing compensation to the Local Authorities to whom loss
of revenue has been occasioned as a result of enactment of GST. The Cantonment
Boards in the Country squarely fall within the category of such Local Authorities and
their non-inclusion is discriminatory and out to be remedied.
Board is requested to consider the same. Relevant letter is placed on the table.

A tender for Uniform for all employees working in Cantonment Board was
published in the Year 2015 under which M/s Vaishali Collection,79/7, Sadar Bazar
quoted his lowest rates due to which he received the tender for the supply of the same.
(CBR No. 10 Dated 12/01/2016) is enclosed.
As per the rate list quoted by Khadi Gram Udiyog for the supply of Khadi items to
the Government Department for the year 2018-19 (Copy enclosed) the rates are higher
than our old tender rates. But M/s Vashali Collection is interested to supply the uniform
as per old rates. It has forwarded his consent letter to this office regarding the same
(Copy of consent letter Enclosed).
For Blazer, Gents Sweaters and Ladies Sweaters, M/s Shivani Traders has
forwarded his consent letter to this office to supply sweaters at present as per the old
tender rates.(Copy of consent letter Enclosed).
For Employees Leather shoes both Ladies and Gents and Canvas Shoes, M/s
Shivani Traders has forwarded his consent letter to this office to supply the same at

With reference to above, services of Shri Amit Patel H.No.-456/362, NH-7, Katni
Road, Behind Super Dharmkanta Gohalpur, Jabalpur were re-hired for smooth
functioning of ABAS for the period of 03 months (02 Jan’ 2019- 31 March 2019). His
contract period is expired and his services are still required for smooth functioning of
ABAS in his assigned cluster/serving areas i.e. CBs:- Agra, A’bad, Danapur, Jabalpur,
Mathura, Mhow, Pachmarhi, Ramgarh and Varanasi. Since his services are recommended
from Director, PMG, CC, Lucknow the Board is requested to re-engage him on a
honorarium of Rs. 18,000/- per month for the period of 02 Apr’ 2019 - 30 June 2019 on
purely temporary basis. The expenditure incurred for his pay shall be shared by above
CBs equally.
On specific request he will be send to Tour Duty to the respective Cantonment
Board and the charge so incurred shall be borne by the requesting Board solely.

The repairing/reconstruction/cleaning works sanctioned by this Board vide CBR’s
under reference has been stopped by the In-charge CEO by passing office order no 110
dated 30/01/2019 by referring various letter of PDDE CC Lucknow/Station Cell HQ M B
Area/ DEO Jabalpur under which guidelines for executing construction work on land
other then Class-C was mentioned. But it is note worthy that the PDDE, CC, Lucknow
being a competent authority did not turn down the above mentioned CBRs, hence, these
CBRs are still effective and need to be executed to maintain public health and hygiene.

It is mandatory duty of the Board to provide basic civic amenities in cantonment
area as provided under Sec 62 (VI)(xii) (xiii) (xiv) and (xv) of Cantonment Act 2006 it is
also provided U/s 64 (iii) of Cantonment Act 2006 that reclaiming unhealthy locality is
one of the discretionary function of the Board. The Cantonment Board being a municipal
body U/s 10 of the Cantonment Act 2006 is duty bound and empowered to provide civic
amenities in various wards under the pathetic condition only to insure improvement in
health, hygine which directly influence the health and hygiene of the forces/troops living
in Cantonment Area. It is also noteworthy that armed forces are not residing in isolation;
therefore any un hygienic condition in some area due to inaction by the cantonment board
may lead to any epidemic for the forces of the troops.
The Cantonment Board Jabalpur by passing resolutions under reference and
various sanctions issued by the Board, passed the decisions, only to repair/
renovate/cleaning etc for pre-existing drains/roads/PGL etc for ensuring maintenance of
health and hygiene.
Stopping of these pending works by the In-charge CEO, the maintenance work has
come to a standstill which needs to be started again, otherwise it will result serious
financial complications and the Board will also fail to perform its statutory obligations.
The Supreme Court Of India in the following cases, also held that
(i) In the case of Sudama Singh & others v/s Government of Delhi & another,
the Hon’ble Supreme Court has ruled that – “The Government will be
failing in its statutory and constitutional obligation if it fails to identify
spaces equipped infrastructurally with the civic amenities that can ensure
a decent living to those being relocated prior to initiating the moves for
evictions.”
(ii) In Municipal Council Ratlam (MP) v/s Vadhchand and ors AIR 1980 SC
1622 the Hon’ble Supreme Court through Justice Krishna Iyer, upheld the
order of High Court and directed the Municipality to take immediate
action within its statutory powers to construct sufficient number of public
latrines, provide water supply and scavenging services, to construct
drain, cesspools and to provide basic amenities to the public.

Resolution No. 31
Considered in detail. It was resolved that clear instructions / directions shall be
obtained from PDDE, CC regarding public works on category of lands other than Class
“C” land. Civil Members of the Board are of considered opinion that the public works
passed by the Board mentioned in reference of above agenda shall be executed. But
President and CEO are of the opinion that till receiving of instructions / directions from
higher authorities, works shall be kept pending which are mentioned in above referred
agenda. Member of Ward No. 8 Shri Amit Agrawal raised objection to either provide
services in his ward or give written reply of his letter. PCB agreed to give him suitable
reply but stop the works.

32. Starting of NCC in Cantonment Model Higher Secondary School, Katanga
To consider letter no. 1053 dated 23-05-2019 of Headmistress Cantonment Model
Higher Secondary School, Katanga informing the Board that Office of the 1 MP Batalian
NCC Jabalpur vide their letter no. 1ch@,u@209@,@,ulhlh@izrh{kk fnukad 17-05-2019 has
given consent for starting of NCC in the school and requested to fulfill the formalities.
The approx expenditure of the same is approx Rs. 3,00,000/- per annum.

33. Payment of remaining amount in Arbitration Execution Case no. 549/2017
M/s Gayatri Constructions v/s Cantonment Board Jabalpur pending before
Hon’ble Commercial Judge District Court Jabalpur
Reference Court Notice in Arbitration Execution case no. 549/2017 dated 05-07-
2018 for appearance on behalf of Board on 10-10-2018, order dated 13-12-2018
passed in the same case and Resolution by Circular Agenda No. 1 dated 17-12-
2018.
The Board has filed an Arbitration Appeal (MJC No. 39/2015) before the District
Judge Jabalpur on 18-06-2012 for challenging Arbitrattion Award dated 31-03-
2012 passed in Arbitration Case No. 6/2009. This Arbitration Appeal (MJC No.
39/2015) has been dismissed by the Hon’ble Third Additional District Judge
Jabalpur vide final order dated 18-08-2017 and sustained the original Arbitration
Award dated 31-03-2012. The Board has preferred further Arbitration Appeal
No. 53/2017 before the Hon’ble High Court for challenging of order dated 18-08-
2017 but till date no relief of stay has been granted by the Hon’ble High due to
huge recovery amount is involved in the matter.
During pendency of Arbitration Appeal No. 53/2017 in the Hon’ble High Court,
the respondent Shri Narayan Prasad Yadav as proprietor of M/s Gayatri
Constructions has filed an Arbitration Execution case No. 549/2017 in which the
executing court issued notice dated 05-07-2018 for recovery of total amount of Rs.
2,75,00,000/-. Subsequently by order dated 13-12-2018, the Executing Court
ordered to deposit Rs. 1,00,00,000/- minimum as part payment of total recovery
amount. In compliance of order dtd 13-12-2018, the Board passed the resolution
by Circular Agenda under reference and paid total amount of Rs. 1.00 crore vide
Demand Draft No. 645306 dtd 19-12-2018 for Rs. 10,00,000/- and Demand Draft

No. 645307 dtd 19-12-2018 for Rs. 90,00,000/- to M/s Gayatri Constructions as
part payment.
Subsequently the Decree Holder M/s Gayatri Constructions vide its letter dtd
07-03-2019 demanded remaining amount against total outstanding by
acknowledging receipt of payment of Rs. 1.00 crore to them by the Board as part
payment. Further the PDDE, CC, Lucknow vide letter No. 57708/Misc/JBP dtd
19-02-3-2019 also advised to take necessary action in the matter.
Board is requested to consider the payment of remaining outstanding amount to be
deposited in the Court.
Resolution No. 33
Considered in detail. It was resolved that CEO shall be authorized to release part
payment as per availability of Cantt Fund and without affecting necessary expenditures of
the Board.

35. Renewal of lease of CF 03 nos of Shops standing on survey No.127 (Part)
Jabalpur Cantt, to M/s Rajani Sales and Service Private Ltd. Jabalpur
Ref: This office CBR No.40 dated 05-12-2016
It is seen from the record of rental shops that 03 shops situated survey no.127
(Part) M/s Rajani Sales and Services Pvt. Ltd. Jabalpur were renew by the board through
CBR under reference for the period from 01-01-2015 to 31-12-2017 with revision by
enhanced rent by the rate 20%.
As per clause X of original agreement dated 31-12-2005 the period of lease will be
renewed for further period of 03 years alongwith enhancement of monthly rent by 20%.
It is observed that last approved tenancy period has expired on 31-12-2017 and it
had to be renew from 01-01-2018. Further period of 03 years but this matter was not put
up before the board for considering renewal of lease period. Despite that the Rev. Supdt.
vide CEO note 29-01-2018 revised the monthly lease rent 17,328/-to 20,793/-. And now
the board is recovering Rs. 20,793/- per shop as monthly rent plus GST as applicable
w.e.f. 01-01-2018 till today.
The Board is requested to renew the period of lease w.e.f.01-01-2018 to 31-12-
2021 on same rent which has been recovering from 01-01-2018.

Resolution No. 35
Considered in detail. It was resolved to not to extend the lease term of M/s Rajani
Sales and Service Private Ltd. It was further resolved that report of Revenue Section
shall be obtained about violation of terms and conditions of lease agreement and the
matter shall be put up again before the next Board.
36. Renewal of lease of CF Building standing on survey No.127 (Part) Jabalpur
Cantt, to State Bank of India for ATM purpose.

With reference to above the Board renew the tenure the allotment for further
period of 3 years with revision of monthly rent 20% at present the board is recovering
201794/- plus GST as monthly rent which also required to revise by enhancing 20% in
rent amount.
The Board meeting could not held due to implementation Model Code of Conduct.
The Board is requested to renew the tenancy period w.e.f. 01-01-2019 to 31-12-
2021.

Considered and it was resolved that lease of State Bank of India ATM,Cantt
Branch be renewed for further period of 03 years w.e.f. 01-01-2019 to 31-12-2021 by
enhancing 20% rent which comes to Rs 24,952/- p.m. plus GST Rs. 4,491/-, Total
payable amount is Rs. 29,443/-. It is also resolved that necessary agreements be executed
with State Bank of India and arrears of rent be recovered from them.

With reference to above the Board renew the tenure the allotment for further
period of 5 years with revision of monthly rent 25% at present the board is recovering
21,688/- plus GST as monthly rent which also required to revise by enhancing 25% in
rent amount.
The Board meeting could not held due to implementation Model Code of Conduct.
The Board is requested to renew the tenancy period w.e.f. 28-04-2019 to 27-04-
2024.

Considered and it was resolved that lease of State Bank of India, Cantt Branch be

Rs. 31,990/-. It is also resolved that necessary agreements be executed with State Bank

38. Composition/ Sanction of Building plan application u/s 235 read with Sec 248
of the Cantonment Act, 2006 regarding construction of Shopping Complex

With reference to above CBR, after getting detailed discussion on subject issue,
the passed following resolution.
“Considered. After detailed discussion and perusal of entire record it was
resolved that the applicants /HORs malafidely violated terms of original building

sanction as well as did not disclose complete facts of the case in their composition
application, hence the composition / sanction application of HORs be returned with the
remarks that they may file fresh application for composition / sanction, subject to the
finalization of Waqf case no. 6,7,8,9 of the 2009 pending before District and Session
Court, NAGPUR (Maharashtra).”
The decision of the Board has been communicated to applicants / HORs vide this
office letter no. CBJ/CE/Bldg/APP/N.No.33/2018/845 dtd 28-08-2018. In response to
this communication the applicants/HORs through their attorney holder submitted a
detailed representation along with documents for reconsidering their original composition
application mentioned in CBR under reference contended therein that composition /
sanctioned applicant should have been considered setting aside the issue of title over
property of B.No. 33 because in any case the owner of property is Govt. of India,
Ministry of Defence. but in compliance of CBR under reference the applicants / HORs
have not enclosed any copy of interim/final orders passed in Waqf case no. 6,7,8,9 of the
2009.

mentioned as under:-
(a) The number and area of authorized buildings are not mentioned in proposed

existing building, however in plan the same is not mentioned.
(c) Facts in respect of Case No. 20A/2010 sub-judice befroe VIII ADJ, Jabalpur as
mentioned in application dated 29-02-2016, received alongwith building plan,
are not known.
(d) Though the applicant is one of legal heir of the property but there are several
other legal heirs in the subject property and mutation of the property in
question is pending due to want of certain requisite documents from legal
heirs, which are still awaited in this office till date. A copy of this office letter
No. ts-bZ-@12@,p@[kaM 9@36 fnukad 04-05-2017 is enclosed as Annexure-B. Is
there any sub division recognized by Cantonment Board Jabalpur in the subject
property? If so, details be furnished.
(e) Neither Form “B” signed by the competent authority nor date is mentioned
thereon.
(f) The report of Engineering Section of Cantonment Board Jabalpur to the effect
that building plan is correct in all respect and is in conformity to existing
building bye laws not found enclosed.
In view of the above, the building plan is returned back un-actioned without given
NOC from land point of view.
The plan along-with all documents are placed on the table.

Resolution No. 41
Considered. The Defence Estates Officer has raised certain objections mentioned
in agenda side on ground of which he denied to issue NOC. Hence, it is resolved to
returned the building plan unactioned under section 238 of the Cantonments Act, 2006.

applicant notice under section 235 of Cantonment Act 2006 is not valid as there is
violation of section 234 and 236 of Cantonment Act 2006, therefore this office not
offered comments from land point of view. In view of the above the building plan,
received vide letter under reference may be returned unactioned.

Resolution No. 42
Considered in detail. It is observed that land on which the building plan is
proposed is not belonged to DEO, Jabalpur Circle. Hence, the observation of the DEO is
not considerable. So far as concerned with the provisions of sanctioning of building plan
under the Cantonments Act, 2006, the delay is caused due to sending the case to DEO,
Jabalpur Circle for seeking NOC which is not correct due to non-involvement of defence
land. It was further resolved that the applicant will be asked to submit compounding
application under proviso of sub section 1 of Section 248 of Cantonments Act 2006 if the
applicant has initiated any construction work during pendency of present building
application and thereafter the matter shall be put up before next Board for sanctioning
and composition, if involved.

Sy.No. 53, classified as B-4 land, H.No.25, MP Housing Board Colony, near Kerala

The plan had been referred to DEO Jabalpur Circle, Jabalpur for obtaining ‘NOC’
from land point of view as required U/s-238 (3) of Cantonments Act, 2006, for the

construction /alteration falls on defence land comprising GLR Sy.No.53, Classified as B-
4 land described as VACANT LAND and placed under the management of the DEO,
Jabalpur circle Jabalpur, therefore NOC can not be given by this office land point of
view. No sanction/permission for constructions on defence land comprising GLR Survey
no.53 of Jabalpur cantonment is given by the Cantonment Board Jabalpur.

Resolution No. 43
Considered. The Defence Estates Officer has intimated that the questioned land
falls on Sy. No. 53, Jabalpur Cantonment which is B-4 defence land, hence NOC cannot
be given by that office on behalf of Govt. of India under section 238(3) of the
Cantonments Act, 2006. Considering the definite objections on behalf of Govt. of India
and proposed building plan being on the B-4 defence land, it was resolved to reject the
building plan under section 238 of the Cantonments Act, 2006. It was further resolved
that the Registrar of Properties and MP Housing Board be instructed to cancel the said
registry and allotment respectively which have been done on the defence land
unauthorisedly.

Out of above 3 locations centre No.62 is complete but at Centre No.60 site is not
clear since the Class IV Cantt. employees are residing at the said premises.
Similarly, at Centre No.57 there were old CF IV Quarters that were demolished.
Therefore, the Board is requested to give decision about location of construction
sites of Anganbadi Kendra No.60 and No.57.

Resolution No. 46
Considered in detail. It was resolved that 03 members Committee shall be
constituted to find out suitable locations for Anganbadis. It was further resolved to
cancelled the above referred CBR. It was also resolved to demolish the dilapilated
structure of quarters. Proposal for construction of quarters shall be submitted to the
higher authorities at the proposed site.
47. Report of dismantled material collected from dismantling of all 45 Nos
Gumti, Narmada road, Jabalpur Cantt.

With reference to above the Board decided to dismantle entire structure of all 45
Nos iron Gumtis from Narmada road Katanga Naka. It was further resolved by
Board that after dismantling process all the iron material shall be kept in custody
of Engineering Department, which will also prepare records and put this before
Board alongwith valuation.

After dismantling work, whole iron material has been kept in Katanga
School and proper records regarding quantity has been prepared.
Dismantled material mainly consists of rolling shutters including ball
bearing, Shutter cap, sheet (Tin), side panel, MS fabricated doors. Since the
dismantled material is in good condition with primer paint over them, therefore the
same shall be utilized at other CF civil works as and when decided by the Board.

Resolution No. 47
Considered in detail. It was resolved that a committee consisting of Shri Abhishek
Chouksey, Vice President, Smt. Kiran Thakur and Shri Amit Agrawal, members
Cantonment Board Jabalpur be constituted for locating any class ‘C’ land where the
above mentioned dismantled material can be re-used for reconstruction of gumtees. The
committee shall put its report in next Board Meeting.
48. Extension of Contract for Conservancy Services at Karondi and Gora Bazar
To consider the extension of period of contract of Conservancy Services at
Karondi and Gora Bazar for 03 months, as the current contract period has been expired
on 31-05-2019 and the new tender process is on going.

Considered. It was resolved to extend the period of Contract for Conservancy
Services at Karondi and Gora Bazar for three months w.e.f. 01-06-2019.
49. Additional construction of Swimming pool in part of Sy. No.108, Narbada
Club, Jabalpur Cantt.
To consider building plan and application dated 27-11-2018 submitted by
‘Narbada Club’ through Secretary Narbada Club, Jabalpur, for additional
construction of Swimming pool, changing room and toilets etc. in the premises of
‘Narbada Club’, part of Sy.No.108, Jabalpur Cantt.
The detail information are mentioned as under:-
(a) The land of Narbada Club:- It is comprising survey number 108, is held on lease
in form ‘B’ Cantt. Code Lease 1899, in-perpetuity on payment of yearly rent of Rs
30/-. The land is classified as ‘B-3’land under the management of DEO Jabalpur
Circle, Jabalpur and is situated outside Civil area.

(b) The building plan for construction of Swimming pool was forwarded to DEO
Jabalpur to accord ‘NOC’ from land point of view on behalf of GOI for the
proposed construction as required under section 238(3) of Cantonment Act,2006.
The DEO, Jabalpur Circle, Jabalpur vide their letter No. ueZnk Dyc@losZ la[;k
108@Hkkx&III/ fnukad 23 tuojh 2019] has intimated that there is no objection on behalf
of Govt. for the proposed construction of Swimming Pool in “Narbada Club” of
Sy. No.108, Jabalpur Cantt. The same building plan of Swimming pool has
forwarded with following observation are mentioned as under:-
(a) Government of India, Ministry of Defence vide letter No.10(98)2001/D/
Q&C dated 25-6-2002 accorded sanction for additions by way of
construction of a swimming pool, changing room and toilet blocks in the
premises of Narbada Club.
(b) On the basis of Govt. sanction, this office vide letter No. Narbada Club /
Sy.No.108/DEO/JBP/43 dated 04-02-2004 issued NOC on behalf of Govt.
of India for proposed construction.
(c) The Station Cell, HQ MB Area, Jabalpur vide letter No.900/27/NC/Q1
dated 04-02-2004 conveyed their “NOC” as per Government of India,
Ministry of Defence sanction dated 25-6-2002 ibid.
(d) Thereafter, Cantonment Board Jabalpur sanctioned the construction of
Swimming Pool and released the Building Plan on 26-02-2004. However,
the Club authorities could not commence the work within stipulated time
and building sanction lapsed.
(e) The Club authorities again submitted the building plan to this office
through Cantonment Board Jabalpur in the year 2006 and the same was
forwarded to LMA for their views. The HQ, Central Command, Lucknow
not recommended the construction of building plan due to shortage of A-1
defence land at Jabalpur vide their letter No. PC-261602/ B&H/336/Q3B
dated 05-04-2016.
(f) The Dte DE CC Lucknow vide their letter No.23191/LC-2 dated 08-11-
2018 in a report to DG DE Delhi recommended that the permission of
Government of India, Ministry of Defence dated 25-06-2002 is still in
force and the Cantonment Board Jabalpur may consider granting the
building permission in accordance with Government sanction dated 25-
06-2002. The letter of Dte DE CC Lucknow is endorsed to CEO & DEO
Jabalpur.
(g) The Narbada Club comprising GLR Survey No.108 of Jabalpur
Cantonment is held on Cantt Code Lease in Form “B” of 1899 which is a
resumable tenure.
In the light of above fact, the DEO, Jabalpur Circle, Jabalpur is view of that
mentioned as under:

(a) That, Government of India, Ministry of Defence vide letter No
10(98)2001/D/Q&C dated 25-06-2002 accorded sanction to the proposed
addition by way of construction of swimming pool on certain terms and
conditions as stated therein. The said sanction of Government of India,
Ministry of Defence neither withdrawn nor cancelled and also do not contain
the time limit for which it is applicable, thus the sanction dated 25-06-2002
of Government of India, Ministry of Defence is in force, as also affirmed by
Dte DE CC Lucknow.
(b) In Government of India, Ministry of Defence sanction dated 25-6-2002 ibid, it
is also stated that any un-authorized construction or material,
addition/alteration, should not be an impediment in releasing the building plan
of constructions sanctioned by them in para(a) of the said sanction.
(c) The building plan received for proposed construction is found same as was
sanctioned by Cantonment Board Jabalpur in the year 2004, on the authority
of Government of India, Ministry of Defence sanction dated 25-06-2002.
(d) On the authority of Government sanction this office amended the GLR in
respect of Survey No. 108, Narbada Club and the Secretary, Narbada Club is
paying the enhanced rate i.e. Rs 213,640/- per annum which was reflected in
Government of India, Ministry of Defence sanction dated 25-06-2002 and
payment of rent is upto date.
(e) Since, the Government of India, Ministry of Defence has already accorded
sanction in the year 2002 which is still in force, this office has “NO
OBJECTION” from land point of view for the proposed construction as per
plan received under cover of your letter under reference.
The proposed additions by way of construction of a Swimming pool, changing
room and toilet blocks in the ‘Narbada Club’ premises Sy.No. 108, permission may be
given subject to the following conditions:-
(a) The construction of swimming pool, changing rooms and toilet block
should not exceed 4925.50 sq.ft. i.e.
(b) (i) Swimming pool - 2887.50 Sq.ft.
(ii) Changing Room/ Toilet - 2038.00 Sq.ft.
Total 4925.50 Sq.ft.
(c) The additional constructions referred to (a) above is in accordance with
building byelaws framed by the Cantonment Board concerned.
(d) The annual rental of the Club premises on Form ‘B’ under Cantonment
Code 1899 be revised to Rs 23,640/- per annum.
(e) Any unauthorized construction on material addition/ alterations attracting
the provisions of Sec. 179 of Cantonments Act, 1924 (as amended) are
detected, the same may be regularized on levy of suitable composition fee
provided the same are within the building bye-laws of the Cantonment
Board. However, this should not be an impediment in releasing the
building plan of the constructions sanctioned at (a) above.

The report of the Engineering Section is as under:
(i) The proposed construction confirms to the building byelaws made by the
Cantonment Board.
(ii) The area of plan submitted by club for Swimming pool, Changing room,
toilet blocks etc is the same as sanctioned by the Govt. of India, Ministry of
Defence.

The Station Cell, HQ MB Area has written a letter vide 900/27/1 NC/Q1/47 dated
01-05-2019 remark of number of illegal construction in site premises of Sy.No.108,
namely mentioned as under:-
a) Construction of Squash Court.
b) Construction of Dance floor in the ground in front of main building of the club.
c) Construction of Pathways (Jogging track).
d) Temporary construction of Pathway leading to toilets.
e) Increase in the height of boundary walls upto approx 205mtr with Jallis
(cement grilles).
f) Existing Verandah of Card room has been enclosed by cement Jallis and the
same has been converted to addl bar.
g) Construction of Pathway from main gate of Mall road to club building.
The Station Cell has also requested to regularize all above illegal Govt. as per
order on the subject to enable the Station Commander to process the case for
‘NOC’ for construction of Swimming pool. After that the Cantonment Board
has written a letter No. CBJ/Misc/ Admn/2019/384 dated 10-05-2019 address
to the Secretary Nerbudda Club, with remark that your building application
regarding construction of swimming pool is pending for consideration of the
Board. It is further intimated that Station Cell HQ MB Area vide letter under
reference has raised objections under (para 2 (a) to (g) regarding some small
unauthorized constructions.
In view of clause (d) of previous sanction of Govt. of India, Min. of
Defence vide letter No. 10(98)/2001/D(Q&C) dated 25-6-2002 issued regarding
No Objection against construction of swimming pool, changing room and toilet

block in Nerbudda Club, you are directed to ensure submission of appropriate
composition application regarding small unauthorized construction mentioned
under reference, if desired to do so.
Pending building application for consideration of swimming pool, changing
room and toilet block will be proceeded further after ensuring above
mentioned.
The plan alongwith report of Engineering Section are placed on the table.
Resolution No. 49
Considered in detail. It was found that some small unauthorized constructions
mentioned in agenda side are involved in premises of Nurbudda Club which is in
violation of terms of lease, hence the applicant shall be asked to submit suitable
application under proviso of sub section 1 of section 248 of the Cantonment Act 2006 for
compounding of unauthorized constructions. The building application for construction of
swimming pool, changing room, toilet blocks etc. shall be kept pending till receiving of
composition application as mentioned above. The applicant shall be informed not to
initiate construction of swimming pool, changing room, toilet blocks etc.
50. Considering work completion of various application software by M/s Satoop
Media.
Ref: CBR No. 03 dated 08/01/2019, this office letter No. CBJ/Gen Adm/Legal/2019/1824
dated 16/01/2019, this office letter No. CBJ/Gen Adm/Legal/2019/1979 dated
06/02/2019 and this office letter No. CBJ/Gen Adm/Legal/2019/416 dated
23/05/2019.
The Board vide CBR under reference has considered representation of M/s Satoop
Media for granting additional time limit of 30 days for completion of contract work. The
Board while passing CBR under reference specifically mentioned that the firm M/s
Satoop Media will under coordination with the section heads of all departments execute
rectification of errors and addition of missing features.
M/s Satoop Media vide their communication email dated 11/03/2019, letter dated
27/03/2019 and lastly on 04/05/2019 handed over essential deliverables alongwith source
code and security audit certificates on ground of which the concerned departmental heads
also released completion certificate in favour of M/s Satoop Media. On ground of
completion report issued by head of the departments the Programmer also submitted its
report dated 31/05/2019 under which it is mentioned that satisfaction completion report
from account section regarding HRMS software is awaited. M/s Satoop Media also vide
their communication email dated 01/06/2019 confirmed that due to running of audit
process in Accounts department the final satisfaction report of HRMS software couldn’t

complete. The firm also undertakes that any support or help required will be available
within a responsive time.
On ground of above mentioned completion of work and handing over of essential
deliverables the firm has also requested to release payment against contract work.
The Board is requested to consider completion of work and take decision of
releasing of payment.
Resolution No. 50
Considered in detail. It was resolved that part payment shall be released to M/s
Satoop Media on producing fresh bill against the work which has been completed.
Remaining payment shall be made after obtaining completion certificate from Accounts
Dept.
51. Application for free hold at Sy. No. 148, B.No. 45, Bajpai Compound,
Jabalpur Cantt
To consider an application dtd 02-08-2018 received from Shri Abhilekh Chouksey
for freehold of part of Sy. No. 148 (600 sq. ft), B.No. 45 for residential use.
Board is requested to consider the same. Relevant file is placed on the table.
Resolution No. 51
Considered. It was resolved that Engineering Dept shall proceed for free hold process as
per rules and then send a suitable proposal if considered correct to the higher authorities,
within one month.
52. Submitting of Final Report of Inquiry Committee constituted by the Board
for fixing liabilities of responsible staff against irregularity in construction /
installation and allotment of gumtees at Narmada Road, Katanga Naka.
Reference CBR No. 1 dated 17-05-2019
The Inquiry Committee constituted under reference has put up its final report
before the Board under which the Cantt Engineer Shri CK Kharate held responsible for
not initiating any step for obtaining NOC in compliance of CBR No. 27 dated 10-03-
2017 and Smt. Charanpreet Khanna, Revenue Supdt held responsible for calculating
monthly rent of each gumtee at low price. Apart from recommendation for taking proper
action against the erring officials, the Committee also recommended following recourse
for future:-
a. Standard Operating Procedure to be made for tendering process and
documentation to be carried out for work execution.

b. Certain allocation of fund under repair head be authorized to Cantonment
Board for undertaking new work.
c. Auction should be done through e-portal.
Resolution No. 52
Considered and it was found that the post of Cantt Engineer and Revenue Supdt
are classified as Supervisory Posts for which the Board is competent authority to initiate
disciplinary action against officials serving on these posts. The Board is of considered
opinion that Shri CK Kharate, Cantt Engineer and Smt. Charanpreet Khanna, Revenue
Supdt are to be charge sheeted and disciplinary inquiry are to be initiated against
irregularities found by Committee.
It was further resolved that for conducting disciplinary inquiry against above
officials, Col Rajesh Kanojia, Adm Comdt is hereby appointed as Inquiry Officer and
Smt. Saroj Vishwakarma, Office Supdt is hereby appointed as Presenting Officer on
behalf of Cantonment Board Jabalpur.
Keeping in view the order dated 14-05-2019, passed by the Hon’ble High Court in
WP (PIL) No. 19212/18, 27521/18 and 28880/18 the Inquiry Officer is advised to
complete the disciplinary inquiry before 17-06-2019 and put up final outcome of
disciplinary inquiry before the Board.
