a public hearing as part of its regular business meeting on December16, 2010, in Aberdeen, Md. At the public hearing, the Commissionwill consider: 1) action on certain water resources projects; 2) compli-ance matters involving two projects; and 3) the rescission of a docketapproval. Pursuant to 42 CFR Section 447.205, the Department of Healthhereby gives public notice of the following:

The Department of Health proposes to amend the Title XIX(Medicaid) State Plan for institutional services to comply withproposed regulatory changes. The following significant changes areproposed:

Institutional ServicesD The Commissioner may grant approval of a temporary adjustment

to general hospital inpatient rates, as calculated pursuant to a proposedamended 10 NYCRR 86-1.31(b), for hospitals subject to mergers,acquisitions or consolidations that took place prior to the base year thehospital’s current inpatient Medicaid rate is based on, provided suchhospitals demonstrate through submission of a written proposal thatthe merger, acquisition or consolidation will result in an improvementto (i) cost effectiveness of service delivery, (ii) quality of care, and(iii) other factors deemed appropriate by the Commissioner. Suchwritten proposal shall be submitted to the Department 60 days prior tothe requested effective date of the temporary rate adjustment. Thetemporary rate adjustment shall consist of the various operating ratecomponents of that portion of the hospital originally associated withthe surviving hospital provider number and shall be in effect for aspecified period of time as approved by the Commissioner. At the endof the specified timeframe, the hospital will be reimbursed in accor-dance with the statewide methodology set forth in regulation. TheCommissioner may establish, as a condition of receiving such atemporary rate adjustment, benchmarks and goals to be achieved as aresult of the ongoing consolidation efforts and may also require thatthe hospital submit such periodic reports concerning the achievementof such benchmarks and goals as the Commissioner deems necessary.Failure to achieve satisfactory progress, as determined by the Com-missioner, in accomplishing such benchmarks and goals shall be abasis for ending the hospital’s temporary rate adjustment prior to theend of the specified timeframe.

The estimated annual net aggregate increase in gross Medicaidexpenditures attributable to this proposed initiative for state fiscalyear 2010/2011 is $2.6 million.
