During last spring’s membershipdrives, National LICA CEO JerryBiuso agreed to pay Missouri LICA$100 if Mont Gilbert would put on askirt ... and “Grandma Gilbert” wasborn. Not to be out done, Jim Bledsoeused his powers of persuasion andthe “LICA Shooter Girls” wereorganized to add some “zip” to ourLICA Auction. Four Lawsuits Allege “One Call” Violations(DES MOINES ) Attorney General Tom Miller todayannounced Iowa One Call law enforcement actions in fourcounties. Four separate lawsuits involve excavationsconducted in the vicinity of natural gas or hazardous liquidspipelines, without first providing required notice of the plannedexcavations and having the pipelines located and marked.
“We allege that these defendants did not do what the lawrequired of them before excavating. That threatened theintegrity of gas or hazardous materials pipelines, it could havejeopardized the safety of these crews, and it could have been
an expensive and inconvenient service disruption to thepublic,” Miller said. “Iowa’s One Call law is simple. You callbefore you dig.”
Iowa law requires that any person, homeowner, professional,public or private entity, planning to engage in any form ofexcavation within the state of Iowa, must notify the Iowa OneCall notification system, at 1-800-292-8989 or 811, at least 48hours prior to excavating.

For the past year and a half, Missouri LICA has served, alongwith many other industry groups, on a Stakeholder’s Groupfor the Missouri Public Service Commission (PSC). The PSCplanned to propose some legislation which would put theenforcement component of the Underground DamagePrevention Act (One Call) under the PSC, instead of theAttorney General’s office, as it is now. After much discussion,the PSC has not presented that proposed legislation as this
newsletter goes to print. However, we have heard that theAttorney General’s office will be stepping up its enforcementefforts.
The following press release was issued by the Iowa StateAttorney General’s office in November, 2010. It is a goodexample of what could happen right here in Missouri. Themoral of the story? Call Before You Dig ... or it may cost you!!

The One Call law authorizes civil penalties of up to $10,000per day of violation, plus injunctive relief. Miller’s office hasresolved the suits with each of the defendants, subject to courtapproval of the proposed consent decrees.
Mills County - David Dreyer d/b/a Dreyer AGOn October 27, 2009, David Dreyer d/b/a Dreyer AGconducted an excavation with a bulldozer and trenchingequipment to install terraces and drainage tile withoutproviding 48-hours notice of the planned excavation andhaving underground facilities located and marked. Thedefendant’s trenching equipment crossed over a 26-inchdiameter natural gas pipeline and a 36-inch diameternatural gas pipeline, both under 425 psi pressure, hittingand gouging the latter pipeline requiring repairs. Under theconsent decree issued Monday, Dreyer will pay a $7,000civil penalty and be enjoined against further violations.
Buchanan County - David W. Recker Excavating, L.L.C.On December 1, 2009, David W. Recker Excavating, L.L.C.conducted an excavation with a bulldozer to reshape awaterway without providing 48-hours notice of the plannedexcavation and having underground facilities located andmarked. The defendant’s bulldozer crossed directly over a36-inch diameter natural gas pipeline under 1926 psipressure and within 50 feet of a 12-inch diameter
hazardous liquids pipeline under 600 psi pressure. Underthe proposed consent decree, Recker will pay a $5,000 civilpenalty and be enjoined against further violations.
Sioux County - Dan FeddersOn June 30, 2009, Dan Fedders conducted an excavationto install new fencing without providing 48-hours notice ofthe planned excavation and having underground facilitieslocated and marked. The defendant’s equipment came towithin nine inches of a 12-inch diameter hazardous liquidspipeline under several hundred pounds of pressure persquare inch. Under the consent decree issued Monday,Fedders will pay a $3,000 civil penalty and be enjoinedagainst further violations.
Winnebago County - Ron RedeniusOn April 27, 2010, Ron Redenius conducted an excavationwith a backhoe to repair tile lines without providing 48-hours notice of the planned excavation and havingunderground facilities located and marked. The defendant’sbackhoe came to within 50 inches of a three-inch diameternatural gas pipeline and within 25 feet of another three-inchdiameter natural gas pipeline, both under 475 psi pressure.Under the proposed consent decree, Redenius will pay a$3,000 civil penalty and be enjoined against furtherviolations.

NATIONAL REPORT - Steve Miller, National
LICA Region IV Vice President
Steve reported that the LICA Contractor magazine was stillgrowing. National LICA is looking for articles, so ifmembers have an interesting job or story idea, pleasecontact Jerry Biuso, Steve Miller, and/or Debbie with adescription of the project and pictures. Steve reviewed thelist of member benefits available through National LICA,including the “Beyond Perks” card, Safety Manual,National Equipment Registry and Petrocon. He alsoinformed the membership that Steve King, IowaCongressman and former LICA member, will be thekeynote speaker at the National LICA Winter Conventionin Las Vegas. The National LICA Summer Meeting will beheld in Rochester, MN and the Iowa Field Day isscheduled for July 27 & 28, 2011. Members areencouraged to attend all of these meetings.

PRESIDENT REPORT
President Jim Bledsoe reported that since the 2010Summer Meeting, he had attended the Kansas CityBuilders Show in September with Jerry Biuso. Althoughthe show was not well attended, Jim believed we madesome good contacts. In November, Missouri LICAparticipated in a Joint Illinois/Missouri LICA MembershipMeeting in Palmyra, MO. We had lots of attendees andmade some good contacts. This spring, Missouri LICA willbe hosting five 2-day OSHA training sessions inMontgomery City, Warsaw, Savannah, Jefferson City, andWarrensburg. This training will be free for LICA contractormembers and up to four of their employees to attend. Alsoin February, Missouri LICA will be co-hosting a DrainageWorkshop in Chillicothe, MO. The other sponsors of thisworkshop are the University of Missouri Extension -Greenley Research Center, Missouri Department ofNatural Resources, and the Natural ResourcesConservation Service. The Workshop will be funded by agrant, so the registration will be very inexpensive.
TREASURER/SECRETARY REPORT
Chris Brauer reviewed the financial statements, the 2010-2011 budget, District accounts, the Auxiliary account, andmembership counts for the first three months of fiscal
2011. A motion was made by Greg Muenks and secondedby Melvin Beckemeyer to accept the Treasurer/Secretary’sreport. The motion carried.
EXECUTIVE DIRECTOR REPORT
The Executive Director reviewed District officers andmeeting dates with those present. (See New Businessbelow.) The Missouri LICA Necrology report was alsoreviewed so it could be submitted to National LICA, alongwith a list of our delegates.
COMMITTEE REPORTS
Budget/By-Laws
Chris Brauer reported that the Committee had reviewedthe current budget and begun work on next year’s budget.
Convention/Education
Ken Balkenbusch, Chairman, reported that the Committeehad decided to hold the 2011 Summer Meeting in Warsawon either July 30 or August 6. Details will be presented tothe Board in March. Discussion was held about movingthe dates of the Winter Convention to later in the month ofJanuary for 2012. The Committee asked the Executive

Director to get bids for the 2012 Winter Convention fromthe Country Club Hotel, Tan-Tar-A, and the Holiday InnSelect. These bids will be reviewed by the Committee atthe March Committee/Board meetings.
Field Day/Drainage
Jim Bledsoe, Chairman, reported that Dr. Kelly Nelson’sgrant will be funding the 2011 Drainage Workshop. Thereis still no report of a field day to help Dr. Allen Thompson.
Governmental Relations
Jeff Lance, Chairman, reported that he has attended allbut two of the DNR Soil and Water Commission meetings.With the new DNR Soil and Water Director and theGovernor’s appointment of two new Commissionmembers, the focus of the Commission is shifting. Theyare concentrating on improving the relationship theCommission has with employees. A Task Force is beingassembled to provide guidance to the Commission andstaff on a variety of issues. Jeff will serve as LICA’srepresentative on that Task Force and provide reports tothe membership.
Ladies Auxiliary
Mona Bledsoe reported that nine women attended the teaetiquette presentation, Gothic House tour, and Ladies
Auxiliary meeting. Rhonda Schnitker will serve asSecretary/Treasurer for the Auxiliary.
After discussing the time and effort involved in providingentertainment for the Winter Convention, the LadiesAuxliary has decided to let the Convention hotel providedecorations and possibly use local talent for entertainers;i.e., theater groups, local college drama groups, etc.
The 2010 recipient of the LICA Scholarship through LinnState Technical College did not respond to repeatedinvitations to attend this Convention. As a result, theLadies Auxiliary has voted to change the guidelines for thescholarship. In the future, half the scholarship ($500) willbe distributed during the first semester and, after therecipient has attended the Winter Convention, the secondhalf of the scholarship ($500) will be distributed during thesecond semester. If the recipient does not attend theWinter Convention, the second half of the scholarship willnot be distributed, unless lack of attendance was due toweather or health issues. The LICA members inattendance agreed, by consensus, to distribute some ofthe auction proceeds to the LICA Scholarship Program.The exact amount will be determined at the March BoardMeeting.

Legislative Committee
Gerald Bauer, Chair, reported that the Committeereviewed the list of pre-filed bills for the Missouri 96thGeneral Assembly. For the past 1 ½ years, Missouri LICAhas served on a Task Force for the Public ServiceCommission (PSC) to address the enforcementcomponent of the Underground Damage Prevention Act.Since the State Attorney General’s office has taken stepsto begin enforcing the Underground Damage PreventionAct, it appears that the PSC has decided not to file anyproposals. The Legislative Committee will continue tomonitor legislative issues and present them at the MarchBoard meeting. If any member learns of an issue theCommittee needs to address, please contact Gerald orDebbie.
Membership Committee
Chris Brauer reported that the NRCS and Missouri OneCall will be holding contractor meetings this spring. If LICAmembers attend these meetings, they are encouraged toask for a few minutes to present the benefits of being aMissouri LICA member. The Committee will also beassembling information packets for prospective membersand will distribute them at the March Board meeting. JimBledsoe reported that Murphy Tractor is opening a newfacility in Kansas City and he believes we might be ableto host a Kansas/Missouri LICA Joint MembershipMeeting. He will work with Jerry Biuso and Murphy Tractor,to see if this is a possibility.
A motion was made by Melvin Beckemeyer and seconded byGreg Muenks to accept the Committee Reports. The motioncarried.

A. 2010 Membership Drives - See the President’s Report
B. April 2011 Bobcat Rodeo - Due to the OSHA Training Sessions and the Drainage Workshop, it was decided to postpone the 2011 Bobcat Rodeo until 2012.
C. 2011 OSHA 10-Hour Training - Times, locations, and dates for the OSHA training sessions were reviewed. Members were encouraged to attend and send their employees.

F. LICA Safety Insurance Program - The Executive Director reported on a meeting she had with Continental Western’s (CW) representatives, including Missouri’s CW Marketing Director Jim Skeel, to discuss the LICA Insurance Safety Program and the pilot program which started in Missouri on January 1, 2011.

CW has committed to promoting the benefits of membership in Missouri LICA, along with the LICA Insurance Safety Program to its Missouri agents. The Executive Director will continue discussions with CW’s Bob Dowd and Jim Skeel, as well as Bruce Mosier with Prins Insurance to ensure that everything possible is being done to promote the program.
G. Common Ground Alliance - Larry LaFollette has agreed to serve as Missouri LICA’s representative to the Common Ground Alliance. Ozzie Wallace, Jeff Lance, Mont Gilbert, and Chris Brauer have agreed to serve as alternates.
H. 2011 Membership Directory - In order to save funds, a motion was made by Jeff Lance and seconded by Charlie Boyer to not produce a 2011 Membership Directory. The motion carried.
