Guidance Notes1. The placement of mobile apparatus in the public highway is regulated by

the Highways Act 1980, and must be authorised by Transport for London (TfL) if the mobile apparatus is placed out in a street where TfL is designated as the responsible highway authority.

2. This application relates to activity on the Transport for London Road Network (the Red Routes). If you are unsure whether the location is for a Red Route or a borough road, then please click HERE, or go to http://www.tfl.gov.uk/modes/driving/red-routes/red-route-maps to view a map.

3. This application, guidance notes and other relevant documentation can be located at:- http://www.tfl.gov.uk/info-for/urban-planning-and-construction/highway-licences

4. The processing periods for applications vary depending on the impact the activity will have on the road network. The following are the minimum advance notice periods required for giving approval to an application:

a. Activities that do not require a Traffic Order: 4 weeks before start date

b. Activities that require a site meeting and/or suspension: 6 weeks before start date

c. Activities that require a Traffic Order: 12 weeks before start date

5. In emergency situations, the Applicant is required to contact TfL by telephone for permission to undertake emergency works. An emergency consists of where the situation presents an immediate danger to the public.

7. To proceed with the application please provide us with below information (incomplete applications will not be processed):

Completed application form Copy of £10 million Public Liability Insurance Site drawing, Risk assessment and Traffic Management plan Non-refundable application fee made payable to Transport for London

by BACS with screenshot evidence. (Please note that invoices are not provided but a receipt can be sent once payment has been received).

All relevant documents requested within the application form must be submitted with the application. Failure to provide a fully satisfactory application may delay your application being considered within the processing periods stated above.

8. Traffic Management drawings should provide the following as a minimum:

a) Dimensions and residual carriageway running lane widthsb) Location details – Borough, Road Name and nearest Side Streetc) Current road-layout ensuring bus stops, parking/loading bays, road

markings are displayed d) Full area of occupation including lead and end taperse) Clear diversion drawings for banned turns and road closures, ideally

already route tested for normal vehicles and HGV’sf) Swept path analysis drawings at relevant locations – particularly

roundabouts, chicanesg) Proposed location of pedestrian marshalsh) Temporary signals – provide the proposed temp signal phasing

9. You are permitted up to 3 operations within a 3 month period per license. If additional operations are required then further applications will be required.

10. Applicants should refer to and be mindful of TfL’s Standard Conditions available from TfL’s licensing website as well as the conditions detailed in section 2 of this document. Transport for London will only consider complete applications.

13. Refused ApplicationsAn applicant may appeal to the magistrates’ court where TfL has:

a) Refused to grant a license to place mobile apparatus on the public highway; or

b) Refused to grant a license except on terms prohibiting its assignment

Standard Conditions of the Mobile Apparatus LicenseThe following conditions are applicable to all licenses. Supplementary conditions will also be applied at the discretion of Transport for London

2.1 The licence is issued subject to TfL’s standard conditions for highway licences available from TfL’s licensing website, in addition to the following and together with any site specific conditions detailed on the Licence.

2.2 A license may only be granted to the applicant and is not transferrable.

2.3 The license is only valid for period stated. Failure to comply with the dates specified within the license is guilty of an offence under the Highways Act 1980.

2.4 The site activity shall not exceed the dimensions in the application, or as specifically limited in the licence.

2.5 The applicant shall read, understand and comply with their obligations as described by ‘Safety at Street Works and Road Works’ the code of practice published by the Secretary of State and downloadable from:-

2.6 The licensee will be responsible for compliance with all statutory obligations, including, permitting, lane rental charges and CDM regulations when applicable.

2.7 The licensee will undertake desktop utility searches to ascertain the existence of known buried services and will undertake full safety precautions whether or not they reveal the presence of mains or cables.

2.8 The licensee will ensure the workforce is competent to undertake the licenced activities.

2.9 The applicant will submit a site specific risk assessment and traffic management plan to support the application.

2.10The owner of the equipment has a statutory duty to ensure it is properly maintained at all times.

2.11 If TfL’s contractors are called out to lamp or make the skip safe, the licence holder will be re-charged for this service.

2.12The Licensee and his employees or agents shall comply with any instructions given (whether in writing or otherwise) by TfL regarding the safety of highway users, or the provision of lighting and warning signs.

2.13The site shall not be used for the placement of advertisements.

2.14The license does not exempt the License holder from any parking or stopping controls. Appropriate management must be made for exemptions during the works.

2.15Any request for an extension to the period for which the licence has been granted must be requested in writing at least 7 working days prior to the expiry of the licence and is subject to a fee for consideration of such extension.

Failure to comply with the terms and conditions of the approved license is guilty of an offence and liable to prosecution in accordance with the provisions stated under the Highways Act 1980. It is incumbent on the applicant to ensure that the guidance and terms and conditions provided herein are fully understood before submitting an application.
