Chairman and Members The Personnel Board for Mobile County, Alabama Dear Members, 2012 began with the implementation of the online application system which was a major

undertaking for our department. As I review the implementation start-up which occurred in

February 2012 and use onward to year’s end, some statistics are revealing with respect to use

of the system. We posted 244 job announcements which received 225,041 hits or viewing

inquiries, resulting in 7,042 applications. Additionally 10,840 job interest cards were submitted.

While overall activities within the Department reflect a decrease in the number of

requests from the jurisdictions we serve, we undertook extensive efforts to provide training on

use of the on-line system. Seventy-one (71) Human Resource Users identified by each

jurisdiction have been trained and are using the system. As a result, approved personnel in

each jurisdiction now have the capability to submit an array of job requests, and receive referral

lists electronically. Applicants can create a user account, store their employment data in their

account and apply with ease electronically.

This is another milestone as we advance technology to improve our service offerings.

We are focused on expanding the capabilities of the system to address our response times and

add additional value to all our customers. We welcome your suggestions.

I thank the Board Members for their continued support. The employees in the

Department work hard and diligently to provide the service required of all our customers. Our

goal is to continue to foster an environment of collaboration (merit system employees, public

officials, support of community groups, interested individuals,) in order to deliver the services

expected of us by the citizenry.

PERSONNEL BOARD

At the annual meeting of the Supervisory Committee held June 20, 2012, the Committee

re-elected Mr. Frank C. Sullivan, Jr. as Board Member Number One to represent Personnel

Board District One.

Mr. Sydney Raine currently serves as Chairman and Mr. Frank Sullivan serves as Vice-

Chairman of the Personnel Board.

The Board held 12 regular meetings and 12 special meetings during 2012, including 20

meetings at which public hearings were held, for a total of 24 meetings. The Board also held 39

public hearings on disciplinary matters.

HEARINGS ON APPEALS

During the year 2012 the Board held eighteen hearings on appeals from dismissal. The

Appointing Authority was upheld completely in nine cases. Six hearings convened and

settlement agreements were read into the record. At two hearings the employee did not appear

so the appeals were dismissed for want of prosecution. In one case the dismissal was altered

to a suspension and the employees was reinstated. Five decisions were appealed to Circuit

Court.

There were twelve suspension hearings held by the Board. The Appointing Authority

was upheld completely in seven cases and three appeals were settled during the hearings. The

length of the suspensions were altered in two cases. Two decisions of the Board were

appealed to Circuit Court.

Two hearings held by the Board were for appeals from demotion. In one case the

demotion was set aside and one case was settled after the hearing convened.

The Board convened one hearing that involved three issues for one employee: an

appeal from demotion, an appeal from suspension and an appeal from dismissal. The

Personnel Board upheld the demotion, suspension and dismissal.

Two hearing were held that includes a demotion and suspension for both employees. In

one case the demotion and suspension were set aside. The second case was settled after the

hearing convened.

The Board held four hearings that were appeals to step three of the grievance

procedure. The Appointing Authority was upheld in all four cases; however, three of these

decisions were appealed to Circuit Court.

GRIEVANCES

During the year 2012, there were twenty-nine grievances filed. A total of twelve were

settled at the first step hearing, and three were withdrawn. Of the fourteen grievances that were

taken to the second step hearing, two were won by the grievant, four were upheld in favor of the

department, three were withdrawn, and five were denied. Of these grievances, three were

processed to the third step before the Personnel Board – the department was upheld in all three

grievances. One grievance that began in November, 2011, had its step three hearing in

January 2012, in which the Board denied the grievance.

LEGAL Listed below is a summary of all court cases filed or continuing in 2012. The Attorney and

Assistant Attorney for the Board also rendered legal opinions on the application of laws, rules

and regulations, and conducted hearings on appeals from dismissal, demotion, suspension, and

grievances.

MOBILE COUNTY PERSONNEL BOARD v. WATER WORKS & SEWER BOARD OF THE CITY OF PRICHARD (Case No. CV-09-902154) This is a complaint for Declaratory and Injunctive Relief brought by the Mobile County

Personnel Board seeking a declaration that The Water Works and Sewer Board of the City of

Prichard cannot terminate or otherwise impair the civil service status of its employees by

transferring the operation and management of the utility to a private company.

The hearing on the Motion for Preliminary Injunction was heard and denied by the

Honorable John Lockett on November 25, 2009. While the matter was pending a hearing date

on the merits, Mr. Paul David, former Superintendent for the Sewer Board filed a motion to

intervene which was granted by the Court. The Court heard additional oral argument, and

denied David's Motion for Preliminary Injunction as well. The Court heard the Motion for Partial

Summary Judgment on August 4, 2011. On February 22, 2012, the Court ruled on the central

issue as to whether the Water Works and Sewer Board of the City of Prichard remained under

the jurisdiction of the Mobile County Personnel Board. The Court concluded that it did, subject

to its Rules and Regulations regarding the layoff of its employees within the classified service.

The Court held hearings on April 13 and 16, 2012, to determine damages and the

Honorable John Lockett entered an Order on May 21, 2012, enforcing the Personnel Board

Order dated May 24, 2010, ordering the Water Board to immediately reinstate Paul David to his

former position with all back pay plus interest, accrued comp time, vacation time and sick leave

plus interest, accrued, unreimbursed out-of-pocket insurance premiums plus interest from

March 5, 2010 through date of reinstatement. On July 16, 2012, David filed a Motion to Compel

against the Water Board for failure to reinstate his employment as ordered by the Court.

Honorable John Locket entered an Order and Final Judgment dated July 17, 2012, reaffirming

the Court’s Order of May 21, 2012.

MITCHELL A. BRYARS, JR. v. MOBILE COUNTY PERSONNEL BOARD & THE MOBILE COUNTY SHERIFF’S OFFICE (Case No. CV-10-1670) The former Deputy Sheriff with the Mobile County Sheriff’s Office was terminated from

his employment on September 15, 2010, for physical incapacity to perform essential job

functions. The termination was appealed to the Board and heard on October 19, 2010. On

November 2, 2010, the Board entered an Order affirming the termination and instructed the

Personnel Director to place Mr. Bryars’ name on the layoff re-employment list for a period of two

(2) years.

On November 3, 2010, Mr. Bryars appealed the Board’s decision to the Circuit Court,

and after several continuances, the matter was set for oral argument before Honorable James

C. Wood on February 24, 2012. On the said hearing date, the employee’s attorney filed a

Motion to Withdraw the Appeal of the Board’s Order which was granted by the Court.

CITY OF MOBILE POLICE DEPARTMENT v. MOBILE COUNTY PERSONNEL BOARD & CASSANDRA MATTHEWS (Case No. CV-11-1196)

The Public Safety Dispatcher II with the City of Mobile Police Department was

suspended from her employment for a period of 24 working hours without pay effective

February 21, 2011, for insubordination. On February 15, 2011, the employee appealed the

suspension to the Board. Subsequently, the employee was then terminated from her

employment effective May 2, 2011, for conduct unbecoming an employee in the public service,

incompetency, and violation of any lawful or reasonable regulations or order made and given by

a superior officer. On May 13, 2011, the employee appealed this termination to the Board, and

the matter was heard on July 12, 2011. The Board entered an Order dated July 26, 2011, which

modified the termination to a suspension and reinstated her employment effective July 30, 2011.

On July 28, 2011, the City of Mobile Police Department appealed the Board's Order of

July 26, 2011, which amended and modified the termination of Cassandra Matthews. The

certified transcript of the proceedings before the Board was filed in the Circuit Court on

September 8, 2011. The matter is pending before the Honorable James C. Wood for legal

argument.

RONALD WALLACE v. MOBILE COUNTY PERSONNEL BOARD, ET AL (Case No. CV-12-496) The Police Officer with the City of Mobile Police Department was suspended from his

employment for eighty (80) hours without pay effective March 19, 2012, for violation of any

lawful or reasonable regulations or order made and given by a superior officer and conduct

unbecoming an employee in the public service. On March 14, 2012, the employee appealed the

suspension to the Board. The matter was heard on June 14, 2012, and the Board entered an

Order dated June 28, 2012, affirming the suspension.

On June 18, 2012, the employee filed a Petition for Alternative Writ of Mandamus in

Circuit Court naming the Board and all its members individually. The Board filed a Motion to

Dismiss on July 19, 2012, which was granted. The Court ruled that all procedural issues would

be addressed in the appeal of the Board’s decision. On February 1, 2013, the Court heard oral

argument and took the matter under submission.

CASSANDRA MATTHEWS v. MOBILE COUNTY PERSONNEL BOARD AND THE CITY OF MOBILE POLICE DEPARTMENT (Case No. CV-12-844) The Public Safety Dispatcher II with the City of Mobile Police Department filed a Step III

Grievance against the MPD on March 15, 2012, regarding an unsatisfactory service rating. The

matter was heard on May 1, 2012, and the Board entered an Order dated June 5, 2012, denying

the employee’s Step III Grievance.

On June 15, 2011, the employee appealed the Board's Order of June 5, 2012, which

denied the employee’s Step III Grievance. The certified transcript of the proceedings before the

Honorable Sarah H. Stewart for legal argument.

DAVID WILLIAMS v. MOBILE COUNTY PERSONNEL BOARD AND CITY OF MOBILE PUBLIC WORKS DEPARTMENT The EO II worker in the Storm Drain & Heavy Equipment Division with the City of Mobile

Public Works Department, was terminated from his employment effective June 16, 2012, for

conduct unbecoming an employee in the public service, neglect of duty and violation of any

lawful or reasonable regulation or order made and given by a superior officer. On June 8, 2012,

the employee appealed the termination to the Board and the matter was heard on August 23,

2012. The Board entered an Order dated September 4, 2012 affirming the termination.

On September 14, 2012, the employee appealed the Board's Order of September 4,

2012, which affirmed the employee’s termination. The certified transcript of the proceedings

before the Board was filed in the Circuit Court on November 1, 2012. The employee failed to

pay the required filing fee to the court and the transcript was remanded back to the Board by

Order dated December 19, 2012.

HOLLINGSHEAD v. MOBILE COUNTY PERSONNEL BOARD (Case No. 12-0070) (United States District Court, Southern District of Alabama) Dorothy Hollingshead, an Equipment Operator II with the City of Mobile Parks and

Recreation Department, filed a complaint alleging race, sex, and age discrimination and

retaliation by the Personnel Board in the handling of steps two and three of a grievance she filed

concerning the 2010/11 annual service rating. The Board’s motion to dismiss the second

amended complaint was granted and the case was dismissed on December 21, 2012.

WINFRED JULY v. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-11-588) July appealed a 30 day suspension imposed by the Board in April, 2011. The Board’s

motion for judgment on the pleadings was heard on April 17, 2012, and was granted by order of

May 9, 2012. There was no appeal.

CITY OF MOBILE UNITED PUBLIC SERVICE WORKERS, INC. (Case No. CV-2011-000484) This case concerned the filling of the position of Public Service Supervisor I in the

dredge division of the City of Mobile Public Works Department. The action was voluntarily

dismissed by the plaintiff.

BARBARA JOHNSON v. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-11-447) Johnson, an Environmental Patrol Officer II with the City of Mobile, appealed the denial

of a step three grievance concerning an unsatisfactory service rating. The Circuit Court found

that the City of Mobile had failed to document counseling sessions supporting its rating and

ordered that the employee receive a service rating of not less than satisfactory.

MOBILE AREA WATER AND SEWER SYSTEM v. JEVON MILNER (Case No. 2012-000336)

The Mobile Area Water and Sewer System appealed to the Circuit Court from the

Board’s decision to modify the discipline imposed on Jevon Milner from termination to a

suspension. The employment action was based on Milner’s leaving the MAWSS yard without

permission and his questionable drawing of gasoline. The Board modified the action of the

appointing authority to a lengthy suspension. The Circuit Court reversed the Board’s action,

and the Board has appealed. The Personnel Board’s appeal is pending in the Court of Civil

Appeals, case no. 2120254.

LEO DUNN v. MOBILE COUNTY PERSONNEL BOARD (Case No. 2012-000781)

The former employee appealed the Board’s action upholding termination of his

employment as a Public Service Worker I with the City of Satsuma. The parties have briefed

the issues for the court. The matter is pending.

BEN HAWKINS v. MOBILE COUNTY PERSONNEL BOARD (Case No. 2012-000330)

The employee, a former firefighter for the Mobile Fire-Rescue Department, appealed the

Board’s decision upholding his termination, which was based on a positive drug screen. The

board, the City of Mobile, and the appellant have briefed the issues. The matter is pending.

AMENDMENTS TO THE RULES

There were no rules amended during 2012.

PROMOTIONS

There were 189 promotional appointments resulting from 110 promotional examinations

processed in 2012.

CLASSIFICATION AND PAY

The Personnel Board adopted specifications and salary grades for eight new classes in

2012. In addition, the Board approved amendments to the pay plan for already existing classes

and revisions to sixteen existing specifications. The Town of Mount Vernon granted a 5% cost

of living increase effective October 13, 2012. The following jurisdictions granted 2.5% cost of

living increases: the City of Saraland effective February 11, 2012; the City of Creola effective

February 11, 2012; the City of Satsuma effective October 6, 2012; Satsuma Water and Sewer

Service effective October 20, 2012; and the Mobile Area Water and Sewer System effective

January 12, 2013.

VETERANS A total of 599 employees received paid leave to participate in military training during

2012. At the beginning of the calendar year 2012, eighteen of our Merit System employees

were still on military leave and thirty-five additional employees were granted leave during the

year. Thirty-eight employees safely returned to their job during the year, and fourteen

employees were still out as of December 31, 2012.

Also, extra points were awarded to 239 veterans who applied for open competitive

examinations during 2012.

INFORMATION SYSTEMS

Our busy schedule at the end of 2011 rolled right into 2012. In February, not only did we

roll out our new on-line applications system, but we also posted a fresh new look to our website

and installed kiosks in our lobby.

We brought several years’ worth of information from our old database system into the

new online application system (called Insight) so that we could run parallel on both systems until

we had a good grasp of the new system. The staff in the Test Administration/Employee

Application section did an outstanding job in learning the ins and outs of the system, and

making our decades-old processes fit into the new structure. Although the major portion of

technical assistance in Insight is out of our control, we are able to assist staff and applicants

with the intricacies of the system.

The website refresh was long overdue, and we combined the launch of the new look with

the start of our on-line application system. Linking several pages to the on-line system and

reorganizing the site structure provided easy access to our information.

One of the major changes in our on-line application system is that we no longer accept

paper applications. Recognizing that not all applicants would have access to the internet, we

installed four kiosks in our front lobby. These kiosks are strictly for applicants’ use, and staff

members are on hand to assist the applicants by answering questions and providing guidance

through the application process. These kiosks have document scanners built into the keyboard

to allow the applicant to scan any documents they may want to attach to their application. We

included links to several email providers so the applicant can set up and check their email

account for notices sent regarding their application. Judging by the number of applicants using

the kiosks, this is a valuable service to our community.

We began an equipment upgrade in the latter part of 2012, replacing some PCs so that

all are running the same software. This provides improved security, communications and

maintenance. We began the process of upgrading our written test scanner to improve efficiency

and provide a more direct upload of data to Insight. We hope to have it up and running by early

2013.

We created a database system to replace our manual paperwork flow process that

required employee folders to travel from one office to another. The system allows entry of

employee actions that can be viewed and acted upon by any number of staff. This should

decrease the time it takes to distribute information in-house.

Overall, 2012 was a year of improvements and enhancements and we look forward to

more of the same in 2013.

TRAINING & RECRUITMENT

Mobile County Personnel Board’s Training and Recruitment area continues in its efforts

to provide a platform for employee learning and development. In 2012, the focus of this area

was on training. As always, we are concerned about providing instruction that develops new

skills and polishes old ones. In that endeavor, we offered both instructor-led and online

programs that concentrated in the following:

Recruitment in 2012, on the other hand, moved in a different direction with the

implementation of the new online application system. Traditional career and job fairs were

tabled in light of this new method of communicating with the public. As part of this change-over,

new publications and displays were prepared to inform the public about the system and how to

use it effectively.

In October 2012, the employee grievance process was transferred to the Training area.

This change now allows Training to see ways to help employees improve skills and develop

new ones. A report on employee grievances can be found in a different area of the annual

report.

Finally, proficiency testing for clerical positions requiring typing declined in 2012. The

need for such testing is often driven by the number and types of announcements opened

requiring this skill.
