John Alexander Lemon Gibson, QC, (1936-2009) outside of his legal profession had a number of interests which gave him much pleasure. He was born in Malaya and before Singapore fell to the invading Japanese forces early in 1942 he and his mother left to settle near family in New Zealand. His surveyor father, also a volunteer solider, however remained and spent the war in Changi as a prisoner of war. John’s interest in soldiers and ships appears to date from this period. He read books about the stirring deeds of soldiers and sailors in various parts of the then British Empire and this passion remained with him all his life.

He was educated at St Peter’s in Cambridge, Wanganui Collegiate, and Victoria University of Wellington, from which he graduated with law degree.

His collecting, initially, was military badges which progressed into decorations and medals, including military and commemorative medals, and in the early 1960’s model soldiers and later ships, both naval and merchant. To some his collecting may appear somewhat random but that was far from the case. There was his fascination with Scottish Regiments, in particular the Black Watch (42nd Highlanders) and the exploits of these regiments in various parts of the Empire; a passion for naval history, and a love of New Zealand military history. Inevitably, his collecting strayed into areas about which he had read or enjoyed and occasionally perhaps what may be referred to as unusual or ‘the quirky’ which appealed to his delightful sense of humour.

He acquired models from both within New Zealand and overseas and enjoyed friendships with some of the leading authorities and collectors. He established a reputation as a connoisseur and assembled a fine collection and associated library of reference material. He studied books on uniforms and often spent many happy hours painting or repainting figures and other models.

John’s wife, two sons and daughters, and in later years grandchildren, did not share his love of and passion for collecting but were content that the father they much loved was happy. They all, however, enjoyed John’s other passion for sports especially cricket which he played during school days and later in several Wellington teams. In 1994 he was manager of the New Zealand Cricket Team and during 2001-03 was President of Wellington Cricket.

It was normal for John to display in his office objects which reflected his collecting and associated interests. On his office walls there were prints of model soldiers examples of which also appeared on his desk among the model ships, medallions, and a cricket ball.

This extensive collection now being sold reflects John’s interests. There is a model of a Barrister in ‘court dress’, several sporting figures but alas none reflecting his interest in cricket!

5.PAYMENT. Paymentforall itemspurchasedisdueonthedayofsaleimmediatelyfollowingcompletionofthesale.

If full payment cannot be made on the day of sale adepositof10%ofthetotalsumduemustbemadeonthedayofsaleandthebalancemustbepaidwithin5workingdays.

Payment isbycash,bankchequeorEftpos.Personaland private cheques will be accepted but must becleared before goods will be released. Credit cardsarenotaccepted.

6. LOTS SOLD AS VIEWED. All lots are sold asviewed and with all erros in description, faults andimperfections whether visible or not. Neither Webb’snoritsvendorareresponsibleforerrorsindescriptionorforthegenuinenessorauthenticityofanylotorforany fault or defect in it. No warranty whatsoever ismade.Buyersproceedupontheirownjudgement.

Buyersshallbedeemedtohaveinspectedthelots,ortohavemadeenquiriestotheircompletesatisfaction,priortosaleandbytheactofbiddingshallbedeemedtobesatisfiedwiththelotsinallrespects.

7.WEBB’SACTASAGENTS.Theyhavefulldiscretiontoconductallaspectsofthesaleandtowithdrawanylotfromthesalewithoutgivinganyreason.

9. LICENCES. Buyers who purchase an item whichfallswithintheprovisionsoftheProtectedObjectsAct1975or theArmsAct1958cannot takepossessionofthat item until they have shown to Webb’s a licenseundertheappropriateAct.

10.FAILURETOMAKEPAYMENT.Ifapurchaserfailseither to pay for or take away any lot, Webb’s shallwithoutfurthernoticetothepurchaser,atitsabsolutediscretionandwithoutprejudicetoanyotherrightsorremedies it may have, be entitled to exercise one ormoreofthefollowingrightsorremedies:

A. To issue proceeding against the purchaser fordamagesforbreachofcontract.

B. Torescindthesaleofthatoranyotherlotsoldtothepurchaseratthesameoranyotherauction.

C. To resell the lot by public or private sale. Anydeficiency resulting from such resale, after givingcredittothepurchaserforanypartpayment,togetherwithallcostsincurredinconnectionwiththelotshallbepaidtoWebb’sbythepurchaser.Anysurplusover

theproceedsofsaleshallbelongto thesellerand inthiscondition theexpression ‘proceedsof sale’ shallhavethesamemeaninginrelationtoasalebyprivatetreatyasithasinrelationtoasalebyauction.

D.TostorethelotwhetheratWebb’sownpremisesorelsewhereatthesoleexpenseofthepurchaserandtoreleasethelotonlyafterthepurchasepricehasbeenpaid in full plus the accrued cost of removal storageandallothercostsconnectedtothelot.

E. To charge interest on the purchase price at arate2%aboveWebb’sbankers’ thencurrent rate forcommercialoverdraft facilities, to theextent that theprice or any part of it remains unpaid for more thansevendaysfromthedateofthesale.

F. To retain possession of that or any other lotpurchased by the purchaser at that or any otherauctionandtoreleasethesameonlyafterpaymentofmoneydue.

G. To apply the proceeds of sale of any lot then orsubsequentlyduetothepurchasertowardssettlementofmoneyduetoWebb’soritsvendor.Webb’sshallbeentitled to a possessory lien on any property of thepurchaser for any purpose while any monies remainunpaidunderthiscontract.

H. To apply any payment made by the purchaser toWebb’stowardsanymoneyowingtoWebb’sinrespectofany thingwhatsoever irrespectiveofanydirectivegiven in respect of, or restriction placed upon, suchpayment by the purchaser whether expressed orimplied.

I. Title and right of disposal of the goods shall notpass to the purchaser until payment has been madein full by cleared funds. Where any lot purchased isheld by Webb’s pending i. clearance of funds by thepurchaser or ii. completion of payment after receiptofadeposit, the lotwillbeheldbyWebb’sasbaileeforthevendor,riskandtitlepassingtothepurchaserimmediately upon notification of clearance of fundsor upon completion of purchase. In the event that alot is lost, stolen, damaged or destroyed before titleis transferred to the purchaser, the purchaser shallbe entitled to a refund of all monies paid to Webb’sin respect of that lot, but shall not be entitled to anycompensation for any consequent losses howsoeverarising.

11.BIDDERSDEEMEDPRINCIPALS. Allbiddersshallbeheldpersonallyandsolelyliableforallobligationsarising from any bid, including both ‘telephone’ and‘absentee’bids.AnypersonwishingtobidasagentforathirdpartymustobtainwrittenauthoritytodosofromWebb’spriortobidding.

12. ‘SUBJECTBIDS’. Wherethehighestbid isbelowthereserveand theauctioneerdeclaresasale tobe‘subject to vendor’s consent’ or words to that effect,thehighestbid remainsbindingupon thebidderuntilthevendoracceptsorrejectsit.Ifthebidisacceptedthereisacontractualobligationuponthebiddertopayforthelot.

13. SALES POST AUCTION OR BY PRIVATE TREATY.TheaboveconditionsshallapplytoallbuyersofgoodsfromWebb’s irrespectiveof thecircumstancesunderwhichthesaleisnegotiated.
