1. Introduction This report is a document produced by Cornwall Council’s Natural Resources Team. It relates to a site visit to monitor compliance with a planning permission and legal agreement for a minerals / waste site under relevant requirements of the Planning and Compulsory Purchase Act 2004. 1 Disclaimer It should be noted that apparent compliance with any condition at the time of a site monitoring visit by this Authority does not preclude the Authority from instigating enforcement action where any activity being undertaken is subsequently considered to be in breach of a condition or presents a risk of damage or disturbance to the environment or amenity. Any additional site monitoring visit required as a result of non-compliance with a planning condition may result in an additional site monitoring fee being levied.

2. Details of Site Monitoring Visit Site Name and Address: Gold Diggings Quarry, Minions, Liskeard. Existing Planning Permission(s): There are no extant planning permissions for winning and working at this quarry. The last mineral permission expired on 31st July 1987 as further detailed below. Previously the Council had issued a Direction under Article 7 to have the Permitted Development Rights removed. However it was later concluded that the Direction had not been properly effected and as letter dated 26th September 1997 the Council confirmed that the Operator could exercise their Permitted Development Rights to remove deposits of mineral waste. Other Planning History: 5/75/0492 dated 10th August 1976. Winning and working of granite stone. Expired on 31st July 1986. 5/75/0493 dated 10th August 1976. Working and winning of existing granite deposits. Expired on 31st July 1986. 5/86/0987/FR dated 25th March 1987. Winning and working of existing granite deposits. Expired on 31st March 1997. 5/86/0666/FR dated 25th March 1987. Winning and working of stone. Expired on 31st March 1997. NR/94/00062/MIN –application submitted 12.10.1993. Variation to condition 10 of permission 5/86/0666/FR dated 25th March, 1987, (concerned with the quarrying of "in situ" granite) to extend the time period up to 2012. Application refused. Legal Agreement(s): A Section 52 Agreement dated 31st August 1976 was entered

into between County Council and the Roseland Plan Hire Company Limited, in respect of lorry routes, the construction of three passing places and the accumulation of scrap materials.

Summary Gold Diggings Quarry is located in a remote position to the northwest of the hamlet of Minions, directly west of the former historic Cheesewring Quarry. It is accessed by an open sided single track which leads from the public car park at Minions, passing the Hurlers standing stones and crossing the open moorland. There are no extant planning permissions for the winning and working at this quarry. The last mineral permission, decision notice No. 5/86/0666/FR, expired on 31st July 1987. Previously, the Council had issued a Direction under Article 7 to have Permitted Development Rights removed. However it was later concluded that the Direction had not been properly effected and as letter dated 26th September 1997 the Council confirmed that the Operator could exercise their Permitted Development Rights to remove deposits of mineral waste. As email dated 12th June 2013 and as further identified during this visit, no deposits have been removed in the last 12 months and there were no changes on site.
