Concern No. 42813 Demolition/renovation at the county courthouse. This building contains asbestos on the flooring, pipes, and walls. All of this is being removed without first having a certified asbestos inspector review, test, and file a report. The county has been sued for failing to comply with Missouri Deptartment of Natural Resources, EPA, and OSHA regulations in a previous renovation/demolition resulting in an asbestos-related death. I have written letters to the county and the presiding judge regarding my concerns. I am a circuit judge working in this courthouse and am on one of the floors undergoing such demolition. As of yesterday, these workers are currently removing flooring, which I believe contains asbestos, in the common area I must walk through. While I am wearing a mask due to COVID-19, none of these workers are. I used to represent asbestos workers and other trades who helped construct this courthouse. I am very worried about exposure. Please inspect this immediately.

Concern No. 42830 neighbor tore down house and now there is mud flowing down into her yard because there is nothing there anymore. Gotten so bad, that when it rains, its just mud and water running down into her yard. He also had mold in the house and it was torn down but she wasn't sure how they disposed of the mold. There was a guy that bought the house to tear it down and he burnt it and left the ashes in the ground there. He also got rid of all the grass and took out all the trees so it’s a big mud pit. She spoke with him a couple days ago and he said he would try to dig a ditch to make it not as bad for her, but he never did it.

Concern No. 42970 My concern is that the QT distribution facility just installed a new generator set that does not meet the requirements of 40 CFR parts 60 and 1039. In speaking with Robert Weber at the EPA region 7 office, I asked him about the need to have this new diesel engine meet the requirements of the EPA Tier IV final level and whether or not the unit had to be a Certified package from the factory or could be a compliant package. He indicated that it would need to be Certified. I filled a complaint with the region 7 office this week and referred to your office. The owner decided to save money and purchase a compliant engine instead of a Certified engine.

Concern No. 42997 Called to smoke in the area. E3 and M1 responded to the call. E3 found a pile of what looked to be trash burning next to a pull behind camper that was being stripped down. The pile was on the edge of the street. There was heavy black smoke coming from the pile that contained fiberglass insulation, plastic, wiring, tile, aluminum siding, plywood, and other building materials. The home owner took off running when we pulled up and the other male there talked to us and said the other male was the owner and had asked him to help burn the trailer. I advised the male that DNR would be called and to let his friend know. Also to not burn anything. The Cass County Sheriff was on scene also. We put the fire out with the booster reel and used about 50 gallons of water. E3 was command and M1 assisted.

Concern No. 42958 This morning in to this afternoon there is a strong chemical burning smell in the air around the downtown area of Skidmore. Smells as though rubber is on fire. It is strong enough that my dogs do not want to go outside. This has occurred before over the winter, but I did not know how to submit my concerns until now. We have squatters that are living in a mobile home next to the river inside town. I figure that they were burning whatever they could find to stay warm. Upon further investigation I have discovered that they have also rigged up car batteries to the trailer to provide them with some sort of power. They are not plumbed in, nor do they have a septic tank that can be seen. As far as I know they are using the water source next to the trailer as their bathroom. Because it has been cold the last few nights I can only assume that they may be burning again. there is also another individual in town that considers himself the town "Junker" he has been seen burning items (tires, mattresses, pallets, etc) in the past as well. Mr. Rick Stanton lives at 101 S. Chestnut St. The squatters are located on Elm St. next to the cities museum. I am still unsure as to who is burning in town today, but it is very offensive to the senses, and certainly unwanted

Concern No. 43028 Driving down Al Gossett Rd to visit family, my family and I began to smell this absolutely rancid, putrid, foul & absolutely disgusting smell. It was so foul we had to roll our windows up, but not only from the smell! From the shear amount of flies that came with the stench. This was a stench so bad you could practically taste it. So me, being the curious individual I am decided to detour, attempting to find the location of what I thought was going to be a pile of dead bodies, animals, something. Nooooope, turns out it was Valley Oaks. The fact that there are homes within the vicinity and you can smell this from the highway is just wrong. I usually don't complain about stuff like this, but holy shit! Wtf is going on at that place!? It smelled like a pile a rotting whales that were rolled in dog crap. Then the millions of flies all over the area was insane. We ended up not staying at our families home very long because of the intolerable stench. It's asinine places like this operate around residential properties. No way in hell they're following EPA guidelines, not with that stench. I grew up on a farm and I can tell you right now they're dumping waste where they shouldn't be

Concern No. 43052 A company is burning demolition debris at a former gas station and it is emitting petroleum and other noxious odors. The location is the intersection of A Highway and outer road, across from the Fishing Dock business in Archie Mo. He said the local fire department was on scene there yesterday but they have a relationship with the owner, another first responder, and they didn’t ask him to stop the burning.

Caller also left a message on KCRO's main line. Caller states the guy responsible is a ranking officer with the Grandview MO Fire Department, and he bullies up on and badgers our little volunteer fire department and they all leave. He is doing it again today. This has been going on for about 2 weeks.

Concern No. 43054 Captain Derrick Llewellyn from the Central Jackson County Fire Protection District sent an email to the Unit Chief of the Air Pollution Section Mike Cunningham and provided the fire report.

The fire report stated:"Responded to an illegal burn. Upon arrival found a pile of trash, clothes, carpet, furniture burning. I requested a brush truck to extinguish. I made contact with Richard Helm and Connie Thomas who own property and live next door at 29503. They did not have an active burn permit and I advise them that due to the numerous responses to this location for illegal burning their rights for a burn permit are revoked for 6 months.I also took photos and told them I would turn over the information to the Missouri Department of Natural Resources."

Concern No. 43148 I live in Lone Jack, Mo. , very near to Valley Oaks cattle operation. Things had seemed to quiet down for a bit but as I have stated in May the stench coming from that operation has gotten increasingly worse. I have lived here for over 20 years, always enjoying country life until Valley oaks was opened. There were many times before the date I have shown that the stench was so bad going outside was not possible, stench and flies horrible. This seemed to get better after we thought Valley oaks was stopped. Now it seems it has been leased to another group who are slaughtering cattle, the stench again being horrible. I love to work outside and enjoy just relaxing on the porch. This is now impossible again, these people should be investigated and monitored for their practices. If you had this to put up with you would not be happy either. I live on road 1911, Valley oaks is south of me

Concern No. 43192 My concern is the nuisance fires and air pollution created on the property at 34812 E Neil Chiles Rd. This property is directly north of my residence. The current resident of this property is Jeremy D Gist. Since the summer of 2019 a company called Mackey Tree Service of 18925 E 6th Street N. Independence, MO has been dumping and burning the remnants of the brush they have cut on an approximately bi-weekly basis. This includes not only large brush but also the ground up particles from their truck. The smoke from these fires can be dense and creates headache and trouble breathing inside my residence if any widows are open. I have documented the smoke from these frequent fires with time stamped photographs

I have contacted the Holt County Sheriff Dept many times about this . They just came out and spoke with the neighbor doing this .. I am under the impression that tire burning is illegal. My husband is on oxygen and breathing treatments and this must be stopped. The person several months ago also tried to tap in to my private well and when stopped he made the statement that if I didn't let him tap in to it he would poison it so now I'm afraid to drink the water and have to pay Culligan to bring drinking water to my house.

Concern No. 42825 I've made a complaint with Missouri Attorney General's office against Ron Felker (due to him installing a furnace that is less efficient and not the one we agreed upon) and just found out that I can make a complaint with your agency (EPA) and that's why I'm making a late complaint. Ron Felker, owner and operator of Ron's Heating and Air Conditioning (1802 Stuart St Hannibal Mo. 63401) had an employee scrape off asbestos insulation from the HVAC duct work at my residence (1228 Hill St Hannibal Mo. 63401). Ron left while this employee started scraping away at the asbestos. The employee wasn't given a respirator and I immediately opened up the only two windows we could to try to air out the basement, sprayed the asbestos with water to prevent more particulate matter going into the air. Ron didn't bring any filters, no isolation of the asbestos and certainly did not remove it properly. Ron said that he could remove the asbestos when we were discussing the work, made my down payment for the furnace, air conditioner and duct work, but never did he say that doing so would put my household at risk of horrendous health issues and I don't believe he's qualified to do such work.

The second concern he has regarding this neighbor. The neighbor has two huge metal grates in his yard for water drainage. The way the neighborhood is laid out, the rain water runoff is supposed to run through a pipe from several houses to this one metal grate to drain. The RP, however, has removed the above ground piping preventing the water to drain in the metal grates. This is causing flooding in the yards of the neighboring houses from RP. There is water standing in the yards for months, causing increased mosquito activity and rotting of the privacy fences. The RP has removed addition pipes that were put in by neighbors to drain to those grates.

At the time of the investigation, Bradley Osborn had allowed contractors to dump approximately 9,600 cubic yards of regulated waste on his property for a fee. Concern No. 42936 Caller reports a concern of grain dust in the air and says he can see black mold which he knows has rat poison/pesticides in it.

On 5-6-20, I (Beth Kroes) spoke to Mark Snyder with the Macon Health Dept (660-395-4711) who said the caller left a voicemail with the concern information. I told Mr. Snyder that we would file the concern for investigation and contact the concerned party. I also attempted to call the concerned party and left a voicemail regarding the filed concern asking for additional details. At this time it is assumed that this is for the former ADM/current Danny Smithson elevator but this has not yet been confirmed with the concerned party. Later on 5-6-20, I spoke to the concerned party who confirmed the location as the former ADM elevator located near the senior housing and diagonal of the city park. The concerned party provided his contact information (updated on this form) and says the dust comes out of the top of the elevator when grain is dumped into or removed from the bins. Regarding the mold, the caller said that there is black mold on the corn on the ground and he assumes this is also in the air/dust. I asked if there were certain times of the day or week that activity at the elevator occurs and the caller said there are not any particular patterns of time. The caller said he has seen chemicals stored in some portions of the elevator and assumes those could be in the grain dust as well. The caller also said he is concerned about open electrical panels where kids could get to and also discussed that he can't get into his driveway sometimes due to the trucks/equipment used at the elevator parked in his way. The caller also suggested that our office contact local law enforcement so that they could take pictures of the dust if needed. I explained the fugitive dust rule and our agency's jurisdictional authority with the rule. The caller asked if the city could also do anything and I told him that he could contact his city officials regarding if any local ordinances are in place/could be proposed. I explained that our office's staff would tentatively be in the area next week to investigate the concern.

Caller reports that workers at the site have been using a skid steer to clean out the bins which causes dust, and that other processes occur causing dust to come out of the top of the elevator and coat vehicles offsite. Caller also reports being able to smell the mold in the air. Caller said the workers were there this afternoon when he first called (around 1:30 p.m.) and that they left the door open but weren't sure if they would be back, but said they always are leaving the door open and they expressed their concerns about safety if kids ever went into the area and were able to access the open electrical panels, etc.

Concern No. 43162 From online contact form, with incident date of 6-4-20: This morning I heard and observed a venting of a natural gas (?) pipeline to the north of my property at 12801 W. Hwy EE, Rocheport, MO 65279. Based on the county line at this location, I would place the pipeline location in Howard County. I am not sure who owns this pipeline, possibly Panhandle Eastern. They have not that long ago (a few years?) had a pipeline break to the west of us along Hwy 240. I did call and report this morning's incident to Howard County Sheriff's Dept. (Mindy). She indicated that pipelines periodically vent their lines, but she had not been advised in advance in this instance, and would investigate. There was a white pickup in the vicinity of the vent, which was plainly visible. I did not approach, but was half a mile away just off Hwy EE at the first road north after crossing the creek bridge into Howard Co. I did speak with my neighbor to the northwest, Mr. McDannold, about my observations, as he also could hear the noise, which sounded like a jet engine in close proximity. It vented for approximately 20 minutes (approx. 11:00 a.m. to 11:20). It has now stopped. We should be notified when this kind of thing takes place, if it is legal. I am questioning the latter, as I did not observe a fenced enclosure, or other safety measures to limit access to the location. Venting gases were clearly visible and very audible. I would like a report regarding this activity and the product of your inquiry (and mine). Thanks for your attention to this request.

I telephoned the Crawford County Assessor's Office and I was told that the address was 507 East cedar Avenue and that the owner was Lacey Medlock of Rolla. I sent a copy of the regulation 10 Code of State Regulations 10-6.045 Open Burning Requirements and the fact sheet Facts on Open Burning Under Missouri Regulations (PUB02047) to the property owner. I could not obtain a correct and active telephone number for the property owner.

She lives next door to the Iron County Recycling and stated there is an oily liquid running onto their property that is killing their grass. There is also a strong odor coming from the recycling business. She said it is located off Hwy 21 N in Ironton.

On May 12, 2020 I visited the site after contacting the CP at the number provided. No evidence of an oily substance was observed at the time. A corner of the yard did have sparse vegetation. No odor was present at the time of the investigation. The CP verified that it comes and goes.

Following the site visit, I contacted Iron County Recycling and was put in contact with Jim Black (573) 631-4820.

Mr. Black stated that their facility will only accept equipment which has already had all fluids drained from it.

On May 21, 2020, fact sheets regarding spill response and oil handling were emailed to Mr. Black for reference if an issue arises in the future.

Mr. Black was aware of a stormwater related issue with a neighboring property which he stated he would try to address by attempting to divert water and prevent stormwater from flowing onto neighboring properties. Later the same day he called back to let me know that he dug a ditch to hopefully address the source of the concern.

I travelled to this area on May 7, 2020. I did not witness any open burning or evidence of open burning. I did not find the exact brush pile with tires that was described by the concerned party. I did note numerous brush piles and I noted numerous apparent equipment tires being used to provide for animals (food or water). This area is used for ranching cattle, horses, mules, etc. The brush piles mostly appeared to be quite old suggesting that they are not routinely open burned. I believe that the trees in the area may now be reducing visibility of the brush pile of particular interest to the concerned party.

I contacted the Texas County Assessor's Office for assistance in finding ownership information for this property.

I sent a copy of the regulation 10 Code of State Regulations 10-6.045 Open burning Requirements and the fact sheet: Facts on Open Burning Under Missouri Regulations (PUB02047) to Vandivort Farms, LLC. at 3222 Hwy. I travelled to this location in Ste. Genevieve on May 6, 2020. The location is very near the Ste. Genevieve-Modoc River Ferry along the Mississippi River north of town. I was present from 10:36 a.m. to 11:55 a.m. The temperature ranged from 53 to 56 degrees Fahrenheit and the wind was from the north of northwest at 10 miles per hour. There was no barge loading taking place and no observable lime dust in the area. There were railcars parked at the Mississippi Lime Company's Little Rock Barge Loadout Terminal, but no loading activity was noted.

I spoke with Jonathan Kennedy, Environmental and Regulatory Affairs Manager with Mississippi Lime Company, by telephone on May 11, 2020. He stated that the loading of barges was at about 50% of the monthly normal due to the economic slow down. He was unaware of any upset or malfunction of equipment at the Little Rock Barge Loadout Terminal at or around the date this environmental concern was received.

Cody Reed stated that he had only been open burning limbs. A copy of the air open burning regulation, 10 Code of State Regulations10-6.045 Open Burning Requirements and the fact sheet, Facts on Open Burning Under Missouri Regulations (PUB02047) were sent to David and Deborah Kirkwood at the address on file at the Dent County Assessor's Office.

I spoke with Deborah Kirkwood on 6-02-2020 she stated that she had not been open burning at the location described for about a month. I briefly explained the open burning regulation and confirmed her mailing address.

At the time of this investigation I noted that a residence had been demolished and was on site in piles. A brush pile is also on site. No evidence of open burning was noted. No likely asbestos-containing building material debris was noted.

A copy of the open burning regulation, 10 Code of State Regulations 10-6.045 Open Burning Requirements, and a copy of the fact sheet, Facts on Open Burning Under Missouri Regulations (PUB02047) were mailed to the property owner on file at the Stoddard County Assessor's Office. Per the Assessor's Office this building had been demolished for at least two years.

On June 11, 2020, I spoke with Wendy Perrin by telephone. She stated that she had 200 plus yards to the nearest structure that does not belong to her. She will burn only untreated wood waste and vegetative yard wastes such as storm debris. I discussed the air regulation (10 CSR 10-6.045) with her. She stated that she had received the copy of the air regulation and fact sheet mailed to her by this office.

Someone has been burning large amounts of vegetation and demolition debris in the middle of town at Parma.

At one site a large amount of vegetation was burned.

At a second site an old concrete garage (shingles and all) was knocked down, burned, pushed into a holed and buried.

CP also has concerns of a similar process occurring at the One-Stop in town.

The second site is located Along East Main Street directly across from Mulberry Street in Parma, Mo.

Elaine Bay notified our office of her concern on May 19, 2020 late. Due to this and next day plans submission for entry was not complete until May 21, 2020.

After speaking with Elaine Bay on May 19, 2020 I stopped by Parma to look into these concerns on May 20, 2020. At that time no open burning was taking place. Areas of freshly disturbed soil and possible demolition were identified. Based on these observations the City of Parma via Lora Otto, Clerk and the New Madrid Assessor's Office via Jerica Branum were contacted in an attempt to identify the owner. Assessor's records indicated the properties in question belonged to Mr. Simon Wofford.

On May 29, 2020, I contacted Lee to inform him that I would be in their area June 1. I contacted Lee earlier than usual because of Covid-19 concerns and wanting to make sure he was okay with me being present. I used a face mask as well, doing my best to maintain at least a 6 foot minimum distance from Lee and his wife during my visit. I arrived around noon on June 1, 2020. I spoke with Lee upon arrival and I asked him to show me where they open burn. I took a few pictures (attached below) of the burn barrel while we discussed open burning regulations. We went over what could and couldn't be open burned from a contractor's point of view as well as regular household trash. I also informed Lee again that any trade waste must be 200 yards away from any structure that is not owned by him. This rule alone makes it so that he could not burn any trade waste at his home because he has neighbors within 200 yards. Before I left I gave Lee another copy of the open burning regulation and the open burning fact sheet. I let him know that if he had any questions moving forward that he could email or call me.

On June 2, 2020 I contacted Todd Durham who is the concerned party. I discussed the open burning regulation with Todd and informed him of what we could and couldn't do. I asked Todd if he knew how to find our open burning regulation and fact sheet, with which he replied that he had copies of both. I let him know that if he had any questions going forward that he could email or call me.

At the time of my investigation, I did not observe any demolition activities in the residential area around Industrial Drive. I did observe storm debris that had been placed along the street in front of houses. The City of Caruthersville maintains an open burning area for such yard wastes that it collects after storm events, The location is behind the Animal Shelter and just up East Industrial Drive from the Water Treatment Plant. I spoke with Barry Gilmore by telephone and he stated that the City of Caruthersville had been involved in storm debris pick up and open burning as a result of some of the recent storm events. I discussed the open burning regulation, 10 Code of State Regulations 10-6.045 Open Burning Requirements and Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos. I sent him an e-mail with the three fact sheets listed below and 10 CSR 10-6.045 Open Burning Requirements attached. I observed an open top roll-off dumpster for trash at the City's open burn location as well as one for scrap metal. The gate was locked and there was no one apparent on site. There are No Dumping signs up at the site.

Property was posted for No Trespassing. No open burning was apparent as far as smoke during my investigation. I spoke to Edward Birnel by telephone on June 11, 2020. He stated that he lives in Illinois and that he had discovered this accidental fire when he had returned to check his property, Edward Birnel further stated that he had done what he could to contain the fire using heavy equipment to push up dirt so that it could burn out safely. The fire mostly involved logs and untreated lumber but possibly also some residential trash. He had not intended that the material be opened burned but instead was intending for it to rot.

A copy of the regulation and at 10 Code of State Regulations 10-6.045 Open Burning Requirements and the fact sheet about open burning were mailed June 2, 2020.

No violations observed.

On June 3rd I arrive at the Rock Ridge Meat Shop around 11:00 A.M. After driving around the front of the property I took an alternate entrance into the neighborhood located behind the property as the main entrance was closed for road work. I parked on the road directly behind the property and sat there for ~5-10 minutes with the windows down to see if I could detect an odor. It was 87 degrees and the humidity index was at 62%. There was a wind blowing southwest at ~8mph. During my time at the property there was no odor detected.

I called and spoke with Russell on June 8th about the odor concern. Russell stated that the trash from the facility was not picked up from the prior week. This waste would be sitting in their dumpster in the hot weather emitting, causing a fairly strong odor. Since this occurrence, they have moved their waste to another part of the property and have changed the pickup routine so that the waste is picked up more often. They do keep livestock there, sometimes 5/6 days before they are processed. I discussed 10 CSR 10-6.165 Restriction of emission of odors with Russell and he acknowledged the concern.

Ridge Rock Meat Shop was not in violation of 10 CSR 10-6.165 Restriction of Emission of Odors from what was discussed at this time.

Concern No. 43387 There is a residence on highway 160 east of West Plains that is allowing trash services to dump their collected trash on his property. The trash pile is growing and only gets burned once in a while. This is occurs a few times per week. Trash trucks pull in, dump their loads in the pile and leave. Then you will see people in the trash looking through it for anything they think is vaulable, then after a few days they try to burn it. The pile of garbage is quickly growing because obviously not everything will burn. I know this has to be illegal and for all neighbors and surrounding property owners it is a HUGE concern and disgrace.

At the time of my investigation there was no open burning taking place. The site is a combination of a metal shop and residential property. Robert Threlkeld stated that some residential trash that is generated on site is open burned for disposal but mostly old unpainted wooden pallets are burned for disposal.

Facility does repair work on trash trucks that are sometimes parked on site for that reason. I gave Robert Threlkeld my business card, a copy of 10 Code of State Regulations 10-6.045 Open Burning Requirements and the fact sheet Facts on Open Burning Under Missouri regulations (PUB02047). I briefly discusses the fact that the open burning of tires or trash from off site (i.e. from a trash service) are prohibited activities under the air regulation.

I spoke with Steve Drake by telephone on June 10, 2020. On June 11, 2020, it was observed that saw dust was crossing the four lanes of US Highway 60 from Patterson Wood Products.

Both of these two sawmills are located to the north of US Hwy. 60 along Shannon County Road 456 near Birch Tree. These incidents of sawdust crossing property lines are violations of 10 Code of State Regulations 10-6.170 Restriction of Particulate Matter to the Ambient Air Beyond the Premises of Origin.

An investigation was performed on two sawmills located in Birch Tree, Mo. The source of the complaint was anonymous, and claimed the saw mills had sawdust blowing onto highway 60, further polluted water was leaving the sites. The first sawmill that was investigated on 6/3/2020 was B & A Lumber. This operation builds pallets and produce 4-6 truckloads of sawdust a day. Mr. Bruce Asplin is the owner operator of B & A Lumber, and provided the information. He further advised that he tries to remove all saw dust daily, but the saw dust market can be limited at times. Josh Wilkerson and I informed Mr. Aspin about the Missouri clean water act and provided all the information and requirements for Mr. Asplin to obtain a MSOP. After Mr. Asplin provided us permission to observe the property. The southern perimeter runs parallel to highway 60 and is at a slightly lower elevation, causing stormwater to flow to the south. As we made our way to southern side of the site, I observed large sawdust and wood waste piles being stored on site. The stormwater runoff from this area leads to a small ditch at the very southern end of the property. As we made our way down to the ditch, we observed discolored, dark water flowing into the ditch from the storage piles located to the north. The sediment pond at the time of the inspection had a dark color in appearance. The sediment pond was discharging water on the southern end, at which was leaving the site and flowing to a drainage ditch that leads under highway 60. Samples were collected pertaining to the benchmarks listed in the MSOP. After we discussed are findings with Mr. Asplin. We told him to contact the Southeast Regional Office if they had any questions or concerns related to the permit requirements. A follow up visit was conducted on 6/9/2020. This visit was performed to provide information on potential BMP's to help with Leachete. In addition I offered further assistance to Mr. Asplin retaining to the application process. The second investigation was performed on 6/9/2020 of the Patterson Lumber. Upon arrival I met with Mr. Donald Bland and discussed the purpose of the visit. Mr. Bland informed me he is the operator of the site, but is not the owner. Mr. Bland further advised that he will meet with the owner to discuss the recent investigation. I provided a template for an operating permit, SWPPP, and application to start the process. I further discussed the requirements and standards of the presented permit. After Mr. Bland provided permission to inspect the site. The western perimeter is at a slightly lower elevation, causing stormwater to flow to the west. This is my second trip to this site. At the time of this investigation I noted that a residence had been demolished and was still on site in piles. No evidence of open burning was noted. No likely asbestos debris was noted.

A copy of the open burning regulation, 10 Code of State Regulations 10-6.045 Open Burning Requirements, and a copy of the fact sheet, Facts on Open Burning Under Missouri Regulations (PUB02047) were mailed to the property owner on file at the Stoddard County Assessor's Office. Per the Assessor's Office this building had been demolished for at least two years.

On June 11, 2020, I spoke with Wendy Perrin by telephone. She stated that she had 200 plus yards to the nearest structure that does not belong to her. She will burn only untreated wood waste and vegetative yard wastes such as storm debris. I discussed the air regulation (10 CSR 10-6.045) with her. She stated that she had received the copy of the air regulation and fact sheet mailed to her by this office. She stated that nothing was being pushed into the nearby river. However, some clean fill materials from the demolition including concrete and cinder blocks would be used to reinforce areas subject to erosion due to flooding of the river. No violations observed

Concern No. 43385 From the CP:Hello, my neighbor has a dump in the left section of his property just beyond the beginning of the tree line where he buries and burns trash that either he produces or moves from his job sites. I am concerned that the waste is affecting the water and air in our neighborhood. This has gone on for a long time, but I was not sure what to do. I wrote above that I first noticed this in 2019, but I believe it has gone on for at least two years.

I spoke with Walter Korte by telephone on June 17, 2020. He stated that he burns household trash, brush from the farm or yard wastes, and vegetative wastes from his son's landscape business. He burns much less than 80 cubic yards weekly, does have 200 yards to the nearest structure, can burn between sunrise and sunset, etc. None of these things are prohibited activity under 10 Code of State Regulations 10-6.045 Open Burning Requirements.

We are sending a copy of the air regulation (10 CSR 10-6.045) along with the fact sheet: Facts on Open Burning Under Missouri Regulations (PUB02047) by mail to Walter Korte. He stated that he would also like to request a copy of this report.

A check of the internet found that Tower Tee had shut down circa 2017. Per 5-21-19 Post Dispatch article, the facility was sold to JH Berra/McBride for a 180-home development and there was much local resistance for the development. The site was then resold to the current owner to instead redevelop as golfing and recreational complex similar to what it was before. Per email: To: Mike Shamia [email protected] We received an online odor complaint yesterday, regarding a manure-like odor from the site at 6727 Heege Road, St. Louis, MO 63123. The report indicated that MSD responded and stated it had nothing to do with sewage. Are you aware of any activity going on at the site that may be causing such an odor concern? I would like to get back to complainant with information on the cause. Might be a new resident unaware of the history and near miss of the site being developed a subdivision. A home building contractor is burning waste weekly that includes pvc piping, plastics, shingles and other toxic non-wood waste.

There is a construction dumpster but it has not been emptied in a long time, it is almost a prop as burning goes on a couple times a week.

I arrived at the concern location at 11:00 am on May 20, 2020. I observed a large active burn pile in the front yard of a house being built on the south side of Linder Drive, near the intersection of Linder Drive and Jamison Connor Drive. I observed chipboard, two by fours, plastic sheets and bags, paper, and various trash including cigarette packs and chip bags being burned in the pile. The yard signs in the nearby lots indicated that the property was being developed by Myers Select Homes.

I called Myers Select Homes and spoke with Keith Myers, CEO. I outlined the purpose and scope of the investigation and described the anonymous concern that we received. I told him that I did see the materials being burned and asked if he was aware of this taking place. Keith Myers told me that he did not realize these materials could not be burned. I explained that under 10 CSR 10-6.045 Open Burning Requirements, construction and demolition waste other than untreated wood cannot be disposed of by open burning. Additionally, only household waste originating from the property where the burning takes place can be disposed of by open burning. In the burn pile, I observed plastic construction waste and wood used for construction that is likely to have been chemically treated, as well as household waste that was brought in by workers. I explained that the company should ensure that the burn pile is extinguished as soon as possible, and that they would be receiving a Letter of Warning.

LOW Issued May 29, 2020. Signed Open Burning agreement was received on June 8, 2020. Facility was returned to compliance.

Concern No. 43275 Forward from USEPA: "Kirk with USEPA passed on the following complaint. Melissa (314-280-1806) a private citizen says that a nearby petroleum storage terminal is emitting really bad odors, more than usual. She lives nearby at South Broadway and Bates Street in St. Louis City, MO near the facility and says she can smell the odors for a long way up and down South Broadway."

I drove through the area mentioned at 11:00 am on 5/22/2020 and did not notice any strong odors.

I called and left a voicemail for the concerned party. Later in the day, she returned my call. She told me that the facility responsible for the odors is Blue Knight Energy Products at 201 E. Nagel Street. The concerned party works at a recording studio right next to the facility. She said that the odor is almost always noticeable, but for the past few weeks the odor has been incredibly strong, especially in the morning. The concerned party claims that the strong odors have been causing respiratory issues.

The facility ID is 510-2662. I am forwarding this concern to the inspector assigned to the facility, Lemma Zewdie.

File review shows that a concern related to asphalt odor was received from the public residing in the area by this office in April 2015. In response, the facility installed numerous vents on tanks and mist eliminators in the middle of the tank farm and near the truck loading racks to reduce odors. The mist eliminators are designed to filter fumes from tanks (all tank vents are ducted to the mist eliminator) and from loading trucks at the loading racks. The residue from the filtration process is collected in drums connected to the mist eliminators and disposed of (Heritage transports the west of site for proper disposal) when full. The relatively cleaner mist/fume is emitted to the ambient air. At the time of the visit, I did not smell odor near by the facility.

I called concerned party (Melissa 314-280-1806) on 6/3/2020 to let her know my findings. She agreed that the odor is not there now. She said she is glad that we do go out and investigate and care to call her back to let her know what we found.

Concern No. 43474 Tom Winters called about an land distubance near his place of business. He said that it has started up within the last couple months. He said that Midwest Shingle Recycling is disturbing the land in the flood plain of the Meramec River. He stated they are disturbing well over 2 acres. They are placing mounds of used shingles in this area. They are then grinding the shingles which fills the air with a dust. He is worried about asbestos from the shingles and breathing it in. He has contacted the City of Pacific to see if they could stop them, but Pacific said it is just outside of city limits. He has not contacted Franklin county. I have not had time to see if they have an industrial or land disturbance permit.

Joe Trunko with the Solid Waste Management Unit investigated the facility. He found that the operation has not fully started and that the owner, Larry Kutun, is just stockpiling shingles on site. Mr. Trunko confirmed that the site is not taking in any asbestos shingles and that the shingles are being screened before acceptance. Mr. Trunko also confirmed that the owner has disturbed around 2 acres of land.

Due to the nature of the operation Eric Gilstrap of the Engineering and Compliance unit determined the owner would need a MOG49 permit for the facility.

Under the MOG49 permit, the site would not require a Land Disturbance permit, as the MOG49 permit includes requirements for sediment and erosion control.

Mr. Trunko then sent Mr. Kutun an email that detailed the required actions for the Solid Waste Management Unit, the Water Pollution Control Unit, and the Air Pollution Control Unit.

Mr. Trunko is going to remain in contact with the owner to follow-up. I had him include my contact information in the email in case Mr. Kutun required any assistance with the MOG49 permit and its requirements.

I then looked to see if MoDNR Air Program had that company or address as a regulated facility. It was not. Then I started to look through Chapter 5 and 6 regulations. The facility would not be categorized as a permit by rule, qualify by size for the odor regulation and though there is not a specific permit exemption, the small size of the facility would produce below de minimus levels of air pollutants.

I left Ms. Dennis a message with this information along with providing a website where she may contact the company and the phone number to Lincoln County government office 636-528-6300 to see if they have any ordinances about running a business close to residential property (though the parcel identifies the property as residential/agricultural). I left her my direct desk phone if she would like to discuss my research results, but have not heard back.

I drove back on ecology drive and parked my car at the parked lot of the stores located at the north outer road. I walked at the front and back side of the stores. I did not see any dust in the air at the time of my visit.

He is not only worried for the guys wellbeing as he has living quarters in that hanger (1st of the right) but he is concerned that the hangar does not have explosion protection. He doesn't believe there are exhaust fans and doubts that a filter is being used. His name is Carl Peyton and his Address where this is happening is ( I think it is 544?? Crazy Horse Road with a Sunrise Beach city and zip code but we are right outside of Laurie. He has several large boats in his yard, a tall gas tank on poles in the air (he often burns next to it) and his bon fires from burning the piles of rubbish he brings here are so big they are bigger than his buildings. He has other junk in his yard as well. He also has a new pile in which he is building and will burn soon... when that happens he has a whole bunch of people there and they get drunk and play loud music all night.

This guy can be a big jerk...or has been to the other neighbors and they are scared of him or to turn him in for they fear retaliation and the threatening and harassment or damage to their property he will do. Don't get me wrong, he can also be a nice young man when he wants something... but then a snake and turns belligerent so we wish to have anonymity. I am alone here and I am elderly and have no way to protect myself from him.

They are in a subdivision on lots less than ½ acre. She says they are burning less than 50 yards from her home and closer to other houses. She has health issues that are exacerbated by smoke and because she is having to work from home now, she is not able to go outside. She said the burning is frequent and mostly smells like vegetation. She does not know where they would be getting enough vegetation to frequently burn at least 9 months of the year, so thinks they might be hauling it in from a business, but is unable to see the gate they would use to get to the burn area.

Concern No. 43038 1. Septic tank issueThe residence at 53 Cottonwood Road had septage surfacing in March. The septic tank was pumped. Caller mentioned that the person living on the property has also eliminate waste into buckets that were then dumped onto the ground. Caller alleges that the septage has contaminated the well that is shared with three homes. Caller reports that the well is positive for total coliforms, and that a well expert is advising. The well has been shocked (April 2), flushed, and a filter purchased to alleviate the issue. Caller also stated that at least three other neighbors have had mysterious illnesses. Caller is concerned that the septage is reaching the lake. Caller may have photographs related to this issue.

2. BurningThe caller is also concerned about the material that the resident at 53 Cottonwood Road has burned. The burning was done on or about March 9-10. Caller alleges that tires, plastic, treated lumber, and other “toxic waste” have been burned. Caller claims the resident has since buried the remains, and is concerned about leaching chemicals. Resident may have buried the burnt remains on or near the septic system lateral lines. Caller is concerned that chemicals are leaching and reaching the lake. Concern No. 42989 The CP called in with strong odor issues he believes originate from Protein Solutions. The CP has been experiencing overwhelimgly strong odors at his home for the last week or more. He compared the smell to that of a deer's stomach.

His home is south of Protein Solutions and he has contacted both Mike Livingston and Eric Ricky from the business. Eric came to the home today (5/18) and walked around with the CP yesterday, trying to trace the smell. During the visit Eric Ricky speculated the odor was coming from the sewers and blamed Joplin Solutions for putting something strong smelling into the sewers. The CP disagreed, citing wind direction, and held to his conjecture that the origin was Protein Solutions.

The smell has been so strong that it has interfered with the CP's sleep and has brought him close to vomitting. He is concerned the scrubber on the vent for the business' waster water holding tank is not being properly maintained/is not in working order.

He would like the DNR to become involved but would also like guidance on how to proceed with community action against the business, if possible

Concern No. 43039 FROM EPA: The issue at hand is there is water boiling from the ground and releasing white in color steam from near the sidewalk where employees walk causing us to walk through it. My concern is the steam may have unknown harmful substances in it as we breath and walk through the steam. This has been going on for approximately 10 months and the area that is boiling is getting wider. I'm not sure if this is affecting the ground water or what the source is or the impact this has on the environment or if it is a pipe that has ruptured, so for the health and safety to workers I thought this should be looked into and to also insure the environment is not being affected. This facility is also a state prison and is not in an area where inmates are at. This information is true and accurate to the best of my knowledge.

Concern No. 43222 Caller states they have driven on 32nd to Duquesne Road to the north. Caller contacted the Department at 14:56. Caller stated that the smell is bad and smells like death. Odor is at least blocks away from Protein Solutions. Caller would like to know what is happing about the odor issues. Caller stated that odors occur every day, that odors are bad on Saturdays and in the evening. Odors were bad last night (6/11) approximately one to two miles away. Caller is building a home and concerned that they won't be able to enjoy the backyard. Caller also stated that the smell gets impacts interior air quality. Caller states that a daughter lives to the south and gets the smell in the winter and the caller gets the smell in the summer.
