Superfund Site, pursuant to the U.S. Environmental Protection Agency (EPA) Administrative Order on Consent (AOC) under Section 106(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (EPA Docket No. CERCLA-7-99-0001). The. progress report has been prepared in accordance with the requirements identified in Section VII.20 of the AOC. The progress report is split into three tables. Table 1 presents the progress report for removal and disposal of the existing treatment system, and fence repairs, pursuant to Sections VII. 14.B and VII. 14.C of the AOC. Table 2 presents the progress report for the first quarterly clewatering event, pursuant to Section VII. 14.A of the AOC. Table 3 presents the progress report for post-removal site control, pursuant to Section VII. 19 of the AOC. Dear Mr. Morrison:

On behalf of the Respondents, the November Monthly Progress Report presents an updateof activities at the Chemical Commodities, Inc. Superfund Site, pursuant to the U.S.Environmental Protection Agency (EPA) Adminis t ra t ive Order on Consent (AOC) underSection 106(a) of the Comprehensive Environmental Response, Compensation, andLiability Act of 1980 (EPA Docket No. CERCLA-7-99-0001). The. progress report hasbeen prepared in accordance wi th the requirements ident if ied in Section VII.20 of the AOC.The progress report is split into three tables. Table 1 presents the progress report forremoval and disposal of the existing treatment system, and fence repairs, pursuant toSections VII. 14.B and VII. 14.C of the AOC. Description of Work Performed or Scheduled

1. Pursuant to Section VI I . 14. B of the AOC, the exis t ing treatment system was drained, waste therefrom was drummed fordisposal, and the treatment system was dismantled and removed from the bu i ld ing .

• Liquids drained from (he system were treated by granular activated carbon (GAC) uni t s temporarily set up at the site, anddisposed via the sanitary sewer connection at the site. A total of 1,755 gallons of treatment room liquids were treated anddisposed via the sanitary sewer. Untreated l iquids were drummed with ihc wastes from the treatment system. A permit todispose of the treated water was obtained from the City ol Olathe (Attachment F).

Waste removed from EPA's e x i s t i n g t reatment system were placed into three drums and labeled as a hazardous waste(D039 and D040). The drums were placed in the large room of the building, awaiting manifesting and disposal(Photograph 1; the photographic log is included as Attachment A).

• Dismantled treatment equipment was cut up as necessary, t r ip le rinsed, placed in a roll-off container, and disposed of at apermitted l a n d f i l l . Equipment from the sump (pump, air l ines, etc.) were removed (Photograph 2), t r ip le rinsed, placed in arolloff container, and disposed at a permitted landfill. Equipment requested by EPA was triple rinsed and staged in thelarge room of the b u i l d i n g for EPA retrieval (Photograph 3).

The supply l ine from the sump to the t reatment room was secured wi th a threaded steel cap at its entry point to thetreatment room (Photograph 4).

Analy t i ca l results received dur ing thereporting period.

The laboratory analytical report for a sample of the drummed waste (two drums of sludge and one drum of untreated l i q u i d fromthe treatment system) is included as Attachment B. Toxicily characteristic leaching procedure (TCLP) tests foundtrichlorocthylene (TCE) at 23.7 milligrams per l i ter (mg/L), and tetrachloroelhylcne (PCE) at 5.32 mg/L. These results exceedthe regulatory limits and indicate the waste is a D039 and D040 hazardous waste.

1. The three drums of hazardous waste are expected to be manifested, transported, and disposed at a permitted fac i l i ty .

Anticipated problems, and plannedresolutions of past or anticipatedproblems.

An issue to be resolved is the signature on the manifest , since EPA VII generated and stored the waste as part of its previousremoval action activities.

Pursuant to Section VI I . 14.A of the AOC and the approved Removal Action Work Plan, groundwaler from the interceptor trenchwas pumped, treated and disposed. Groundwaler pumped from the trench was treated by two granular activated carbon (GAC)uni ts temporarily set up at the site, and disposed via the sanitary scwcr connection at the site. A total of 28,180 gallons weretreated and disposed via the sanitary sewer. Untreated liquids were drained from the hoses back into the sump. A permit todispose of the treated water was obtained from the City of Olathe (Attachment F).

The two GAC units were staged for disposal inside the north door of the bu i ld ing . Other equipment was rinsed and taken off siteu n t i l the next quarterly event.______________________________________ ____________________

Laboratory analytical results for one i n f l u e n t , three intermediate (i.e., sampled between the two GAC uni ts) , and four eff luentsamples received du r ing the reporting period are included as Attachment C. A summary of volat i le organic compound (VOC)detections for eff luent samples collected each day is included below along wi th the respective City of Olathe discharge l imi t s .

Pursuant to Section VII. 19 of the AOC and the approved Removal Action Work Plan, monthly fence inspections will be completedto verify the fencing remains intact, gate and lock are in good condition, and access to the site is reasonably secure. The Novembermonthly inspection was conducted on Friday, December 4, 1998. A copy of the inspection report is included as Attachment E.

Removal Action Work PlanFormer Chemical Commodities, Inc. (CCI)

PURPOSE

The purpose of this Post-Removal Site Control Plan is to ensure access to the Site is reasonablysecure.

SITE DESCRIPTION

The CCI facility is located at 300-320 South Blake Street (on the southwest quarter of thenortheast quarter of Section 36, Range 23 East, Township 13 South), in the city of Olathe,Johnson County, Kansas (Figure 1-1). Olathe is a city of approximately 63,000 people and is thecounty seat of Johnson County. The facility occupies approximately 1.5 acres in the southeastportion of the city. Surrounding properties include the Burlington Northern Railroad to the east,with light industry and residences beyond the railroad; a vacant lot to the south; Keeler Streetand residential areas to the west; and residences to the north. A warehouse measuring 100 feetlong and 50 feet wide is the only building remaining on site. A site map is presented inFigure 1-2.

IMPLEMENTATION

Monthly inspections will be conducted to verify the fencing remains in tact, gate and lock are ingood condition, and access to the site is reasonably secure. A Monthly Inspection Form isincluded on the following page for use during the inspection. Following the inspection, a writ tentrip report wil l be prepared documenting the findings.

SECTION B - WASTEWATER SAMPLING AND FLOW MEASUREMENT REQUIREMENTS;

1. Sampling Location and Procedure

Samples shall be obtained from the effluent of the treatment system at the effluent sampling port.

2. Sampling and Analysis Frequency:

Once per quarter.

3. Sampling Facility Requirements:

Sampling port shall be maintained in a safe and accessible location.

4. Flow Measurement Requirements:

Measure average daily and maximum daily flow for: All process wastewater

5. Analyses shall be performed in accordance with the techniques prescribed in 4 CFR, Part 136 and amendmentsthereto. The laboratory performing the analyses shall be certified by the Kansas Department of Health andEnvironment for the regulated parameters listed in this permit.

6. Samples shall be collected in such a way that they are representative of the permittee's wastewater dischargeduring normal work hours.

SECTION C - PRETREATMENT REQUIREMENTS:

The user shall maintain a best available technology (BAT) pretreatment system in good working conditions to complywith the specifications of this permit.

SECTION D - SCHEDULE OF COMPLIANCE:

None

SECTION E - PERIODIC COMPLIANCE REPORTS:

The Industrial User shall submit periodic compliance reports according to the following schedule:

Twice per year, due dates: January 1 and July 1. A fifteen day grace period is allowed after the due date to allow forcollection of laboratory results and mailing time.

These reports shall include:

1. All wastewater chemical analyses performed since the last report. Analyses performed more frequently thanrequired by this permit shall also be included. At a minimum, the report shall include the chemical analysesfor parameters regulated by this permit at the frequency specified in SECTION C - WASTEWATERSAMPLING AND FLOW MEASUREMENT REQUIREMENTS.

2. Measured flows for the reporting period. These flows data shall include regulated process flow rates,estimated unregulated stream flow rates and dilution stream flow rates, where applicable.

3. Signature of authorized representative of the Industrial User as defined by 40 CFR, Part 403.12(i).

4. Documentation of all sludge removal from batch pretreatment efforts of wastewater.

SECTION F - GENERAL PERMIT CONDITIONS AND REQUIREMENTS:

1. PERMIT MODIFICATION: The conditions of this permit may be modified at any time to comply withfederal and/or state requirements, as a result of process changes and/or when discovery or submission of newinformation would warrant such a change. In addition, permit conditions may be changed if the permittee'swastewater discharge causes excessive operation and/or maintenance problems in the wastewater collectionsystem and/or wastewater treatment plant. The permittee shall be notified regarding any changes in the permitwithin thirty (30) days of the change.

2. PERMIT TRANSFERS: The permit is issued to a specific user for a specific operation and shall not bereassigned, transferred or sold to a new or changed operation without the approval of the Director.

3. SLUG DISCHARGES: The Director shall be notified upon the introduction of any slug discharge into themunicipal sewer system.

4. CHANGE IN CHARACTER OF WASTEWATER DISCHARGE: The Director shall be notified, in writing,within thirty (30) days upon the proposed introduction of any new wastewater constituents being introducedinto the municipal sewer system, modification of waste collection or pretreatment system, elimination of adischarge, or any other factors which would significantly alter the nature and frequency of discharge.

5. RECORD KEEPING: The permittee shall maintain records of all information resulting from any monitoringactivities required in SECTION C. Such records shall include for all samples:

a) The date, exact place, method and time of sampling and the names of the persons taking the samples.b) The dates analyses were performed.c) The laboratory who performed the analyses.d) The results of such analyses.

6. ACCESS TO AND RETENTION OF RECORDS: All records and information resulting from monitoringactivities, such as flow measurement and chemical analysis required by this permit, shall be retained by thepermittee for a minimum of three (3) years and shall be accessible to the Director as well as the state andfederal representatives.

7 DUTY TO APPLY: The permittee shall be notified ninety (90) days prior to permit expiration. Within forty -five (45) days of notification, the permittee shall apply for reissuing of the permit on a form provided by thecity.

8. REVOCATION OF PERMIT: This permit may be revoked when inspection and/or chemical analysis revealsthat the regulated wastewater discharge to the sanitary is in violation of federal, state, or local laws orordinances. In addition, falsification or intentional misrepresentation of data or statements pertaining to thepermit application or any other required reporting form, may be cause for revocation.

9. RIGHT OF ENTRY: The Industrial User shall allow the city or its representatives, exhibiting propercredentials and identification, to enter upon the premises of the user, at all reasonable hours, for the purpose ofinspection and sampling includes any time the Industrial User is operating a process which could result in awastewater discharge to the city sewer system.

10. ACCIDENTAL DISCHARGE NOTIFICATION: Each discharger shall provide protection from accidentaldischarge of prohibited materials or other wastes regulated by city ordinances. Users shall notify theDepartment immediately following accidental discharge of wastes in violation of these ordinances so thatcountermeasures may be taken by the Department to minimize damages to the wastewater collection system,treatment processes and receiving waters. This notification shall be followed within five (5) days of the dateof occurrence, by a detailed written statement describing the causes of the accidental discharge and themeasures being taken to prevent future occurrence.

Notification referred to in the previous paragraph will not relieve users of liability for any expense, loss ordamage to the sewer system, treatment plant, or treatment process, or for any fines imposed on account thereofby any public, state, or federal agency.

11. DILUTION: No Industrial User shall increase the use of potable or process water, or, in any way, attempt todilute a discharge as a partial or complete substitute for adequate pretreatment to achieve compliance with thelimitations contained in this permit.

12. NOTIFICATION OF NONCOMPLIANCE: If, for any reason, the permittee does not comply with, or will beunable to comply with, the pretreatment standards specified in this permit, the permittee shall provide theDepartment with the following information within twenty-four (24) hours of becoming aware of the violation.The permittee shall repeat the sampling and analyses and submit the results of the repeat analyses to theDepartment within thirty (30) days after becoming aware of the violation.

a. A description of the discharge and cause of noncompliance.b. The period of noncompliance, including dates and times, or, if not corrected, the anticipated time the

noncompliance is expected to continue, and steps being taken to reduce, eliminate and preventrecurrence of the noncomplying discharge.

13. Nothing in this permit shall be construed to modify, in any way, the requirements of the Federal Clean WaterAct, 33 U.S.C., Section 1251 et. Seg., pertaining to the pretreatment of discharges into Publicly OwnedTreatment Works, including the General Pretreatment Standards, 40 CFR Chapter 1, Subchapter N nor shallthis permit be construed to effect in any way, the liability of the permittee for any failure to comply with suchrequirements.

14. PENALTIES: The Sewer Use Ordinance provides that a violation of a permit condition is subject to a civil orcriminal penalty of up to one thousand dollars (51,000) for each offense. A separate offense shall be deemedcommitted on each day during or on which a violation occurs or continues.

SECTION A - DEFINITIONS:

1. "Daily maximum" - the total discharge by mass or average concen- tration during a 24-hour period.

2. "Monthly average" - the arithmetic mean of the mass or concentration valves for effluent samples collected ina period of 30 consecutive days.

3. "Four day average" - the arithmetic average concentration value for four consecutive monitoring days.

4. "Grab sample" - an individual sample collected over a period of time not exceeding fifteen minutes.

5. "Grab-composite sample" - a combination of discrete grab samples collected at periodic intervals over aspecified period of time.

6. "Time-proportional composite sample" - a combination of individual equal volume samples collected over apredetermined time interval during an operating day.

7. "Flow-proportional composite sample" - a combination of individual samples in which the volume of eachindividual sample is proportional to discharge flow, or the sample frequency is proportional to the flow rateover the sample period.

8. "Director" - the Director of Municipal Services or his delegated representative.

9. "Department" - the city of Olathe Municipal Services Department.

10. "Shall" or "Must" - mandatory.

11. "May" - permission.

12. "pH" - the logarithm of the reciprocal of the hydrogen ion concen- trarion in moles per liter.

13. "mg/1" - milligrams per liter.

14. "Slug" - any discharge of sanitary or industrial wastewaters having a concentration of any constituentsufficiently above the average and for a period to be considered by the Director as harmful to the collectionsystem or the performance of the treatment works.

15. "Biochemical Oxygen Demand" - the quantity of oxygen expressed in mg/1 utilized in the biochemicaloxidation of organic matter during incubation at 20 degrees Centigrade for a period of five days. The test shallbe made in accordance with procedures described in the latest edition of Standard Methods for theExamination of Water and Wastewater (Standard Methods).

16. "Total Suspended Solids" (TSS) - for this permit, means the laboratory determination of the dry weightexpressed in mg/1 of solids that either float on the surface or are in suspension and which can be removed fromthe wastewater in accordance with procedures given in "Standard Methods".

17. "Total toxic organics (TTO)" - the summation of all quantifiable values greater than 0.01 milligrams per literof the organic compounds listed in Chapter 40 of the code of Federal Regulations (40 CFR), Part 433.1 l(e).
