009 THAT, aware that the Kenya Nuclear Electricity Board (KNEB) was created and tasked with spearheading the development of nuclear energy in the country; deeply concerned that the construction and maintenance of a nuclear plant is a highly technical, expensive and risky undertaking that potentially exposes a country to the threat of nuclear radiation and the challenge of disposal of radioactive nuclear waste; further aware that due to these inherent risks in nuclear energy production, many of the developed countries like Germany, India, Japan and South Africa amongst others have increasingly embarked on the systematic shut-down of their nuclear plants and instead are promoting the development of clean renewable energy, especially wind and solar energy; noting that Austria which hosts the United Nations International Atomic Energy Agency, has terminated the development of any nuclear energy; this House resolves that the Government shifts its attention from the development of nuclear energy and instead invests in the development of renewable or green energy which is safe and abundant in the Country.

REMARKS

Nyeri counties, leaving out victims from Meru, Kirinyanga, Murang’a, Embu, Kajiado and other parts of Kenya; cognizant of the fact that the leaders from the two counties initiated a court process claim for compensation to the victims who were eventually compensated; noting that the struggle for independence in this country involved various communities and individuals like the followers of Dini ya Musambwa movement who took part in the uprising against the colonial government, and were also killed, tortured and detained and therefore also deserve equal compensation from the British Government; also aware that the British Government has accepted to release further compensation money, on condition that only the victims who are still alive and can prove that they were tortured will be compensated from these monies, this House resolves that the Government ensures that compensation from the British Government goes to all affected homes and families of victims who are still alive all over the country.

THAT, aware that Article 35 (1) (a) of the Constitution provides for the right of access to information held by the state; further aware that the education sector has recently been marred by confusion and unnecessary anxiety due to the abolishment of the ranking system in national examinations; concerned that this action by the Ministry of Education was arrived at without due consultation with all relevant stakeholders including KUPPET, KNUT, the parent associations, investors in the sector among

others, contrary to Article 118 of the Constitution; cognizant of the fact that the ranking system has been a long-held tradition in the sector both locally and internationally, and has been a source of positive competition, motivation, rewarding and an important guideline for resource allocation; this House resolves that the Government through the Ministry immediately reverts back to the ranking system for national examination and specifically the Kenya Certificate of Primary Education (KCPE) and the Kenya Certificate of Secondary Education (KCSE).

012 THAT, aware that devolution was meant to devolve governance and public services across the country, including access to basic services like acquisition of identity cards, passports, birth certificates, voters cards, among others; further noting that currently all registration of national identity cards only happens at one centre in Nairobi; cognizant of the fact that this delays the acquisition of identity cards, thus denying Kenyans their right to employment, ability to vote, access to public funds like Uwezo Fund and other crucial services, this House resolves that the Government decentralizes the registration of national identification cards to the county level to expedite the process and allow Kenyans to access public services in a timely manner.

013 THAT, aware that Article 26 of the Constitution guarantees the right of every person to life, and that no person shall be deprived of life intentionally; further aware that Article 35 provides for the right of access to all important information by all; cognizant of the fact that national leaders and their families form an integral part of national-being that builds and helps in forging unity; concerned that several national leaders and/or prominent personalities including the late Hon. Sen. Mutula Kilonzo, the late Hon. Sen. Otieno Kajwang’ and the late Fidel Castro Odinga have lost their lives in unclear circumstances in the last two years; further concerned that the causes of death of these prominent national leaders have been shrouded in mystery creating unnecessary anxiety among different groups of people; this House resolves to establish a Select Committee to comprehensively investigate and inquire into the causes of death of the three personalities, consider and review all related findings on the deaths and table its report within ninety (90) days, and approves the following Members to constitute the Committee:-

021 THAT, aware that there has been an increase of alcohol use and abuse in Kenya especially in urban areas; further aware that over 2.2 million Kenyans are addicted to alcohol; noting that improper disposal of alcoholic containers has been on the rise leading to unintended exposure and use of containers for vending illicit brew especially by school going children; deeply concerned that this is both an environmental and a health risk; this House urges the Government in conjunction with all relevant authorities, particularly, NACADA, to launch targeted campaigns in all constituencies towards safe disposal of these containers as well as recycling measures and enforce all existing laws relating to safe disposal of the said containers.

022 THAT, aware that, H.E. Jomo Kenyatta was the founding President of the Republic of Kenya and as such is an important historical figure; also aware that upon his death he was interred in a stone, glass and marble mausoleum on the grounds of Parliament; noting that unlike mausoleums of many other deceased Heads of state, President Jomo Kenyatta’s tomb, though situated in a most public place, has been off limits to the citizens for 37 years and only open to the public during the anniversaries of his death, and on rare occasions when visiting Heads of State pay their respects; concerned that despite the clamor over the years for the mausoleum to be opened to the public and possibly be a tourist attraction, no steps have been taken in this regard; further concerned that 70 percent of Kenya’s population is below the age of 40 years, to whom Jomo Kenyatta

remains a distant historical figure with whom they have little or no connection despite his importance in Kenya’s history, this House resolves that the Government creates the Jomo Kenyatta National Memorial at the current mausoleum similar to the one of the founding President of the USA, George Washington, where archival information of his life and his remains will be open to public viewing.

023 THAT, aware that the Marriage Act, 2014 was 17/2/2015 assented to by H.E the President on 29th April, 2014 and commenced on the 20th of May, 2014; noting that the act was by and large an amalgamation of the previous Acts, thus amendments relating to the regulations were minimal in effect; deeply concerned that there are only twelve offices for the registrar of marriages in the whole country, making it difficult for the hopefuls to issue notice of marriages; mindful of the fact that the upward revision of the marriage certificate acquisition fee is not affordable to many Kenyans, thus inhibiting them from registering marriages as envisaged by the new Act; this House urges the Government to review the procedure and the cost of marriage registration, and to decentralize the offices of the registrar of marriages to a minimum of all sub-counties so as to reduce bureaucracy and enhance accessibility.

024 THAT, aware that the Kenya Police Service spends considerable resources on training officers among the cadre of trainees; further aware that many of the police detectives are hired by other government and private institutions as soon as they acquire the necessary expertise and experience; deeply concerned that this results in delayed and botched investigations and failed conclusion of critical prosecutions plus a high number of acquittals due to perennial shortage of specialized officers in critical departments such as ballistics, forensics, document examinations, fraud detection, money laundering, transnational crime and cybercrime; cognizant of the fact that private employers are able to offer superior terms, this House urges the Government to ensure that any Regular Police, Administration Police officer and Prisons Officer who benefits from specialized training at the taxpayers’ expense should serve in the public sector for at least 10 years before leaving for the private sector or refund the public funds used in their training and further that the Government in turn considers proper remuneration, accommodation and welfare of all Police Officers.

046 THAT, aware that many innocent Kenyans have been victims of crime attributable to stolen and illegally acquired firearms; concerned that, despite the proliferation of small arms, there has not been efforts to track location, movement and use of firearms held by licensed persons and the disciplined forces; acknowledging the need to adopt a mechanism for providing real-time geophysical location and movement of firearms to facilitate recovery of stolen firearms and forensic identification of guns used in crime scenes; cognizant of the fact that a number of countries continue to implement modern technologies to regulate, monitor and track use of firearms; further aware that use of electronic tracking technologies, including the Global Positioning Systems (GPS) has been used to track and record location and movement of firearms; this House urges the Government to fit all guns held by licensed persons and the disciplined forces with electronic tracking devices and ensure the proper and comprehensive registration of all firearms in the country in order to curb insecurity.

072 THAT, aware that Article 7 (3) (b) of the Constitution provides that a State shall promote the development and use of indigenous language, Kenyan Sign language, braille and other communication formats and technologies accessible to persons with disabilities; further aware that Article 54 (d) provides that a person with disability is entitled to use sign language or other appropriate means of communication; noting that sign language for the deaf is the most important source of knowledge, access to national participation and of great importance to their school work; cognizant of the fact that Kenyan sign language is the medium of communication for the deaf with the community, this House urges that the Government introduces Kenyan sign language to be taught in schools as part of the primary school curriculum to enable Kenyans to acquire the basic skills to communicate with people that have a hearing impairment.

144 THAT, aware that Articles 35 of the Constitution entitles every citizen to access information required for enjoyment of their fundamental rights and freedoms; recognizing that advertising is an irreplaceable platform through which information is disseminated; recalling that the Government recently created a Government Advertisement Agency (GAA) vide Treasury Circular No. 09/2015 of 10th June 2015; noting that the agency is, inter alia mandated to authorize public sector advertising; implementing sectorial standards, procedures and guidelines and managing consolidated government advertising funds; concerned that the agency now requires all Government ministries, public institutions and agencies to be subservient to it in procuring advertising services; worried that this conflicts with the Public Procurement and Disposal Act, 2005 that allows ministries, public institutions and agencies to establish internal procurement structures; further concerned that the GAA introduces a bureaucratic red tape in the procurement process; this House:- (i) notes that the GAA is not entrenched in law,

officers lack the requisite capacity and equipment to detect and deter such occurrences; this House urges the Government to speedily implement a mechanism to improve security in all strategic Government and private installations including Parliament, Government offices, shopping malls, worship places and other public places, in tandem with enforcing already existing security systems; conduct training for all security agencies on modern techniques of dealing with the incessant threat of terrorism and put in place stricter access controls in the said areas; and make provisions for regular mandatory audit/ checks to confirm that all Government institutions are enforcing and implementing measures already in place to improve security in their facilities.

153 THAT, aware that tourism in Kenya, which is largely wildlife-based, generates approximately 12% of the Country’s Gross Domestic Product and creates over 18% of wage employment; further aware that poaching has brazenly continued to target Kenya’s wildlife and that elephants and rhinoceros are key flagship species facing threats of extinction; deeply concerned that Kenya has become a major hub for smuggling and exporting illegal ivory, rhino horn and other illicit wildlife products from the region to other regions particularly Far East countries; noting that, although the Government has employed various measures to protect wildlife, these measures have not borne much fruit in combating the poaching menace in this country;

THAT, aware that agriculture is the backbone of the Kenyan economy across the country; further aware that the agricultural sector is required to provide employment to more than thirty per cent of the citizens; cognizant of the fact that most of our neighbouring countries are also agriculture-driven economies and that free trade has become more pronounced especially in the East African region; Concerned that the cost of production in our neighboring countries is reported to be lesser as compared to the Kenyan cost of production; further concerned that this scenario will lead to loss of revenue due to importation of these cheaper products; alarmed that the long term impact is detrimental to the economic development of the state; further noting that there is no specific policy that cushions our farmers against losses caused by weather vagaries such as flood, drought, frost and hailstones which in turn affects produce returns; this House resolves that the Government immediately establishes a policy to ensure that minimum returns on local crop and animal products are safeguarded and to consider exemption of the Value Added Taxes(VAT) on the farm inputs and other materials used in production of animal feeds and fertilizers.

THAT, aware that cancer is a leading cause of death globally with more than 70% of all cancer deaths occurring in developing countries; further aware that in Kenya, the disease ranks third among the main causes of death after infections and cardiovascular diseases and accounts for up to 18,000 deaths annually, with over 82,000 new cases reported annually; noting that over one-third of cancer patients experience clinical anxiety and depression, profoundly affecting the families psychologically and economically; cognizant of the fact that some of the patients travel up to 600 kilometers to Kenyatta National Hospital (KNH), the only public hospital that hosts most of the oncologists in Kenya; further cognizant of the fact the remaining small number of oncologists are mainly based in Nairobi; deeply concerned that only a few patients get admission or outpatient treatment due to monetary constraints; this House resolves that the Government mitigates the situation by offering scholarships to at least one (1) Medical Masters student per County to study oncology, and signing contractual agreements with them to serve in designated cancer treatment and management centres; building partnerships with existing medical institutions in local public universities for provision of training opportunities; and emphasizing on the use of telemedicine and E-Medicine to eliminate distance barriers and improve access to medical services.
