MVP is requesting the use of the proposed area as a laydown/contractor yard for uses including parking, construction trailer(s), equipment/pipe storage, fuel storage, and equipment maintenance. The approximate location of the 20,000 gallon fuel tank is shown in Attachment 1. The tank will be kept in secondary containment and surrounded by jersey barriers to ensure their safety.

Laydown yards MVP-LY-045 & MVP-LY-046 are necessary for construction staging. Per permit conditions from the VADEQ no grubbing or other soil disturbing activities will be conducted, topsoil stripping will not occur. The site will be covered with geotextile and gravel placed over the geotextile. No gravel will remain on the site after the site is utilized. No streams or wetlands or cultural resources were identified within the proposed limits-of-disturbance. Approximately 0.053 acres of trees will be cut to allow access between yards 45 and 46. On January 29, 2018 the USFWS concurred with MVP's proposed process for reviewing variances that require tree clearing. In this instance, MVP is requesting to clear approximately 0.053 acres of trees. Attachment 2 includes a table that shows Mountain Valley’s acreage “banks” will remain net positive following approval of this variance request. MVP will utilize the existing access from State Route 1019. Construction safety fence will be placed along the western boundary of laydown yard 045 in the vicinity of the existing business.

State and federal agencies identified areas where plant surveys were required. This yard does not occur in any of those areas. There are no impacts to aquatic resources associated with this yard and thus no impacts to listed aquatic species. The only avian species-specific presence-absence surveys required for the project are scrub-shrub habitat-specific in the state of Virginia. That habitat type is not present at this location. MVP intends to remove certain trees for access between LY 45 and 45. Detailed Habitat Assessments ranked all of the trees within this area as having no potential for roosting Indiana bats based on physical tree characteristics. In addition, under the Final 4(d) Rule, there is no prohibition for removal of even low quality northern long eared bat habitat unless it is currently occupied and within the months of June or July.

On 12/14/2017, Environmental Solutions and Innovations, Inc. (ESI) conducted field surveys to search for portal openings (winter bat habitat). Surveys were conducted in accordance with agency approved protocols for the project. No portal openings were observed in the variance area.

On December 18, 2017, Tetra Tech, Inc. (Tetra Tech) surveyed approximately nine acres at the proposed MVP-LY-045 site and five acres at the proposed MVP-LY-046 site in Franklin Co., VA for wetlands and streams. Wetland delineations were conducted utilizing the Routine On-Site Determination Methodology presented in the US Army Corps of Engineers (USACE) Wetland Delineation Manual (Technical Report Y-87-1) and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: EasternMountains and Piedmont Region (Version 2.0).During field surveys, Tetra Tech did not identify any wetlands or streams in the survey area as shown on the attached figure.
