I Dear Glenn,

I

I I can only give you the information about this well that I have which has already been provided to you in the WCR I. This is accurate to the best of my knowledge.

I can offer you other local knowledge of this property which may be of help. During periods of calm or Kona winds and no ocean swell you can see a large spring

oiling about 100 meters offshore which probably produces millions of gallons per day. We drilled directly Mauka of this spring.

p. 1

We also driJJed the we]) for Betsill Brothers Mauka of this well at the 700 ft elevation and I ncountered substantial water (200 gpm) , 300 ft. above sea level. I

Nahiku, as you know is very wet and prone to flash flooding because of the steep terrain. I It was constantly raining when we were working there. There are times you cannot go across the .\: tream bed to get to Harlow's because of the high water. .

! The more wells I drill it seems I find more and more unusual phenomenon, especially in I steep areas such as Ukumehame where one well produced 90.6 degree water with 350 ppm i chlorides, then we drilled another well at about half the elevation (65 ft) and the water was 70 : .!degrees with 30 ppm chlorides. I

I Go figure. I don't know, I can only speCUlate. I If you have any further questions J will be happy to discuss them with you by phone or in rerson jfyou are coming to Mauj or the Big Island at a future time.

I ~~ Michael Robertson

After reviewing the data submitted to us in the WCR Part I from Wailani Drilling several questions arise: 1) The location of this well is near the ocean, and with the static water level of 0.37 ft., msl, why is the chloride concentration of5 mg!L? and 2) At a pumping rate of only 25 gpm, why does the water level rise over 1.4± ft. above the static head during the test? Is a source of water being developed?

The geologic/driller's log indicates cinder as the bottom formation. Cinder is usually very permeable and would cause underlying seawater to cause the chlorides to rise during testing. This according to the driller did not happen, and in fact, remained constant throughout the test. We need better documentation from Wailani Drilling to explain these anomalies.

Mr. Harlow Tadaro P.O. Box 74 Paia, HI 96779

Dear Mr. Tadaro:

Well Construction Permit Nahiku-Harlow Well (Well No. 4904-01)

Enclosed are two (2) copies of your approved Well Construction Permit for the captioned well(s) that authorize well construction activities but excludes installation work for your permanent pump. As part of the Chairperson's approval, the following special conditions were added and are part of your permit under Permit Condition 13:

Special Conditions

1. Attached for your information is a copy of the Department of Health's (DOH) review comments. Please note DOH's requirements related to discharge of effluent from well drilling and testing activities.

This permit does not authorize work for your permanent pump installation. Approval and issuance of your pump installation permit is contingent upon completed application and information provided to and accepted by Commission staff as required in the Well Construction & Pump Installation Standards (1/23/97) and any special conditions performed under this permit. However, a permanent pump may be installed prior to the permanent pump installation permit issuance in accordance with the Commission's April 15, 1998 Declaratory Ruling No. DEC-ADM98-G5, which states that:

"Permanent pump installation for capacities between 0-70 gpm and where the proposed use is for private individual needs in non-ground-water management areas may be allowed prior to the final pump installation permit issuance. When required as a condition of the well construction permit, subsequent pumping tests shall validate the acceptability of the permanent pump. The permanent pump installed prior to final pump installation permit issuance is subject to removal if the testing shows that a smaller pump is required to reduce the potential of affecting neighboring wells and localized upconing at the applicant's well .•

If you qualify and wish to take advantage of this ruling, please include a written request to install the permanent pump prior to final pump installation permit issuance when you return to us your signed well construction permit.

Please sign and have the contractor sign both permit originals and return one for our files. Also, copies of the aquifer pump test worksheet and the well completion report form are enclosed for your use.

IMPORTANT - Drilling work shall not commence until a fully signed permit is returned to the Commission. Please provide all the information in this packet to your well drilling contractor. The permittee, well operator, and/or well owner are responsible for all conditions of the permit. This includes ensuring that the well construction contractor, or other party who constructs the well(s), submits a completed Part I of the Well Completion Report form (enclosed) within sixty (60) days after the well construction work is completed. Be advised that you may be subject to fines of up to $1000 per day for any violations of your permit conditions starting from the permit approval date.

If you have any questions, please call Charley Ice of the Commission staff at 587-0251 or toll-free at 984-2400, extension 70251.

;;~;;;o;;;:~;:::-e~ Chapter 6E-42 Historic Preservation Review Pertaining to the Well Construction/Pump Installation Permit Application for the Proposed Nahiko - Harlow Well Site (Well No.: 4904-01) N ahiku Ahupua' a, Hana District, Island of Maui TMK: (2) 1-2-003:020

Thank you for the opportunity to review and comment on the Well ConstructionlPump Installation Permit Application for the Proposed Nahiko - Harlow Well Site, which was received by this office on March 13, 2002. Our review is based on reports, maps, and aerial photographs maintained at the State Historic Preservation Division; no field inspection was conducted of the subject parcel.

A search of our records indicates an archaeological inventory survey has not been conducted of the subject area. The general area seems likely to have once been the location of pre-Contact farming, perhaps with scattered houses. An archaeological inventory survey has recently been conducted of the property immediately adjacent to the subject property on the west side. During the survey, two historic sites were identified: a small heiau (State Site 50-50-12-5056) and a lithic scatter (State Site 50-50-12-5057). In addition, our records indicate Poho'ula Heiau (State Site 50-50-12-99) is located nearby, further attesting the importance of this area during the pre-Contact period. Given the close proximity of the two recently identified historic sites, we believe it is likely that historic sites are present on the subject property, as well.

Therefore, in order to determine the effects of the proposed undertaking on historic sites, we recommend that no action be taken on the subject permit application until an archaeological inventory survey has been conducted of the proposed project area to determine whether significant historic sites are present prior to the commencement of any ground-altering activities. An acceptable report documenting the findings of the survey will need to be submitted to this office for review. If significant historic sites are identified, a mitigation plan may need to be developed, in consultation with this office, and executed.

In addition, we would like to note that our standard review period is 30 days, rather than the two week period you note on the submitted permit application form.

Please call Cathleen Dagher at 692-8023 if you have any questions.

The Department of Health. Safe Drinking Water Branch has the following additional comments fOT the Well Construction I Pump Installation Pennit Application for the Nahiko-Harlow Well (Well No. 6-4904-01 Maui):

Please be advised that the Department of Health has experienced drinking wateT and groundwater contamination by submersible pumps containing mercury. Specifically, the failure of the seals of the pumps allowed mercury to leak out into the well shaft resulting in contamination of the well and the water served by the well. Please review your pump specifications to be sure that the submersible pump(s) you are proposing to use do not contain materials which could result in either groundwater contamination Of drinking water contamination.
