COURSE DESCRIPTIONSA BASIC GUIDE FOR PARALEGALS: ETHICS; CONFIDENTIALITY; AND PRIVILEGEInstructor: Thomas E. SpahnCourse Level: Basic This program will cover topics that are important to every paralegal, including: the source of ethics guidance for paralegals; how to avoid the unauthorized practice of law; the importance of preserving confidentiality, and the risks of disclosure; how the attorney-client privilege and work-product doctrine apply in special ways to paralegals (including practical tips for maximizing the protections for paralegals and their employers); conflicts of interest principles applicable to paralegals (including paralegals switching jobs); and other issues.

ADVANCED LEGAL ASPECTS OF A FEATURE FILMInstructor: John W. Mashni, AttorneyCourse Level: IntermediateThis session will cover the major legal issues when producing a feature film. We will start with a discussion of advanced intellectual property issues in entertainment. It will also cover the legal issues that arise in a film production including production issues, unions, post-production, marketing, distribution, and monitoring performance. A case study will be used, where the topics will be discussed in the context of a hypothetical feature film.

AFFILIATE PRESENTATION: HOW TO PUT ON FANTASTIC SEMINARS Instructors: Laurie Vik, ACP and Mindy Ware, ACP Nebraska Paralegal AssociationCourse Level: BasicNo CLEThis presentation focuses on the key components of putting on a fantastic seminar that is both well attended and well received. The goal is to provide attendees with the materials they need to hold seminars of their own or to revamp their current offerings to increase attendance and get rave reviews.

Laurie Vik, ACP and Mindy Ware, ACP will discuss strategies the Nebraska Paralegal Association (“NePA”) uses to plan its two seminars each year. Some key factors that will be discussed are the importance of a seminar committee, using checklists, getting quality speakers, relevant and interesting topics, planning the details, and following through on feedback. This presentation targets all members of NALA affiliated associations who will benefit from the review and get great tips and tricks to use to plan a seminar that runs smoothly and efficiently.

ATTORNEY-CLIENT PRIVILEGE BOOT CAMP FOR PARALEGALSInstructor: Thomas E. Spahn Course Level: IntermediateThis program will provide an intensive overview of the attorney-client privilege protection, and the related work product doctrine. The program will focus on paralegals’ role in creating, preserving and asserting those protections. The program is appropriate for both transactional and litigation paralegals, and will include an opportunity to ask questions throughout the session.

ANTI-MONEY LAUNDERINGInstructor: Kacy Drury , Senior Vice President, AML Compliance & Payments OperationsCourse Level: BasicThis session will provide an overview of FinCEN (US Department of Treasury Financial Crimes Enforcement Network) and their enforcement of the Bank Secrecy Act (BSA) as it relates to Anti-Money Laundering (AML), focusing on current events in the gaming industry. It will provide you with a basic understanding of AML, state and government oversight and gaming regulatory oversight. You will learn how extensive the penalties can be for non-compliance and the extremes regulators are going to, to ensure strict adherence to the laws, rules and regulations. This session will discuss Title 31 requirements including the filing of Currency Transaction Reports (CTRs) as well as Suspicious Activity Reports (SARs) and how the casinos manage their compliance efforts. We will also discuss the need for a Culture of Compliance and individual accountability in this new day and age of AML compliance.

COMMUNICATING WITH CHARISMAInstructor: Cynthia L. Patterson, ACP, MOLCourse Level: BasicSome people have the ability to get your attention and hold it. Why is that? It isn’t a matter of physical beauty (Abraham Lincoln), it’s not a matter of formal command (Robin Williams), nor is it that they have a great speech writer (Meg Whitman). Rather it is a set of behaviors that you can learn and apply in everyday life. This session will teach you a way of actively engaging with others – colleagues, friends, family, and even strangers (think first impressions with clients or at a job interview).

Building on the 2014 Communication Styles presentation, Cindy Patterson, paralegal by day and corporate/nonprofit trainer by night, will (hopefully!) inspire you to try new communication techniques.

COPYRIGHT LAW AND THE INTERNETInstructor: Richard Hahn, CPCourse Level: BasicWe live in an age where digital information is constantly in front of us or at our fingertips and where the laws governing the use of this information develop slower than the equipment used to transmit it. Two consequences of this instant access to information and slow development of regulations is that piracy of intellectual property has increased and the rights holders and online service providers are constantly battling each other over how to protect the rights of intellectual property owners while trying not to diminish the right of free access to information.

This presentation will focus on the Digital Millennium Copyright Act (DMCA) and how rights holders can use it to protect their intellectual property and how, if followed correctly, it provides “Safe Harbors” (limits the liability) for online service providers from suits for contributory copyright infringement.

DISSECTING PROVISIONS OF PURCHASE AND SALE AGREEMENTS FOR REAL PROPERTY; LEASES AND LEASE ABSTRACTS – NOT JUST ANOTHER BILLABLE HOURInstructor: Susanne ZabloudilCourse Level: IntermediateThis session will cover a broad range of real estate transactions including elements of a purchase and sale agreement for commercial real property and the related ancillary documents, i.e., deeds, assignments of contracts, assignments of leases, and transfer tax filings. It also covers elements of a commercial lease and preparation of a lease abstract, and when an estoppel or subordination agreement is appropriate.

The discussion will entail the provisions important to buyers, sellers, and lenders and why, in purchase agreements and leases.

FINDING CLUES AND SOLVING MYSTERIES IN REAL ESTATE DUE DILIGENCEInstructor: Douglas ChampionCourse Level: BasicWhether you are representing the buyer, seller, tenant, or mortgage lender for a piece of real property, or you are trying to better understand a piece of property that is the subject of litigation, this session will help you identify the correct resources and spot the key issues for conducting legal due diligence. This presentation will lay out a clear and comprehensive road map to ensure that you ask the right questions and understand the property diligence materials presented. The presentation also will utilize real life examples to identify common issues that you may encounter.

ESSENTIAL SKILLS: JUDGMENT AND LEGAL ANALYSISInstructor: Virginia Koerselman Newman, Attorney Course Level: BasicJudgment and legal analysis will cover techniques to categorize facts and evidence, to analyze the relevant ones, and to organize them into a final product. These subjects are helpful for everyone, especially those studying for the Certified Paralegal Examination.

ESSENTIAL SKILLS: LEGAL RESEARCHInstructor: Virginia Koerselman Newman, Attorney Course Level: Basic During legal research, you will learn a simple research procedure that can be used in any law library. These subjects are helpful for everyone, especially those studying for the Certified Paralegal Examination.

ESSENTIAL SKILLS: WRITTEN COMMUNICATIONSInstructor: Virginia Koerselman Newman, Attorney Course Level: Basic Written communication will cover the most difficult areas of writing for most people in the legal environment. It is suggested that you review the rules of grammar and style in The Elements of Style by Strunk & White to prepare.

INTRODUCTION TO LEGAL ASPECTS OF A FEATURE FILMInstructor: John W. Mashni, AttorneyCourse Level: BasicThis session will cover the major legal issues when producing a feature film starting with the idea for a story and ending with cameras rolling for production. Legal issues that arise in a film production include: setting up a film company, chain of title for intellectual property, building the professional team, financing the project, and pre-production. This session will also feature a detailed case study tracking a hypothetical feature film.

LEGAL PROJECT MANAGEMENT – SHOWCASING THE VALUE OF A PARALEGALInstructors: Alicia Mitchell-Mercer, ACP and Susan G. Randolph, ACP, NCCP Course Level: BasicThe legal profession is beginning to recognize the value of project management for improving the quality of legal services. Legal project management (LPM) assists attorneys and paralegals in developing processes that can more efficiently deliver legal services within the established constraints of scope, schedule, and cost. LPM has been defined as “a disciplined, rational, task management approach to any project, based on clear prioritization, effective communication, and systematic implementation.”“Scrum” and “Agile” are terms that will be identified as

they relate to planning, communicating and collaborating on legal projects. A firm or legal department’s use of these methodologies can be critical to successful completion of legal projects and avoidance of legal malpractice. Paralegals, an integral part of the legal team, can add value to their positions by learning the principles of LPM. LPM can also prepare paralegals to obtain newly emerging jobs that exist at the intersection of law and technology, including positions involving e-discovery, legal process engineering, and legal analytics.

Our presentation will describe the five phases of project management—defining, planning, executing, monitoring/measuring, and post-project review—and discuss the term “Scope Creep” which can occur frequently in legal service delivery when the scope of a legal project is not properly defined, documented, or controlled.

NEGOTIATING PROVISIONS OF FINANCING DOCUMENTS; DEMYSTIFYING TITLE POLICIES AND ENDORSEMENTSInstructor: Susanne ZabloudilCourse Level: IntermediateThis session will cover a broad range of real estate transactions including elements of financing documents for commercial properties, deeds of trust, assignments of leases and rents, subordination agreements, and financing statements. It also covers title insurance policies for buyer and lender, analyzing the title commitment and exception documents, along with the available protections/coverages in each case.

The discussion will entail the provisions important to buyers, sellers, and lenders and why, in loan documents.

TECHNOLOGY AND ETHICS: MAKING SURE WHAT HAPPENS IN THE CLOUD, STAYS IN THE CLOUDInstructor: Kenneth BergerCourse Level:: BasicOn land, sea, and air, our client’s data now goes where we go and beyond. This session will address ways we can safeguard that data and uphold our ethical obligations.

THE LAW OF MUSICInstructor: John W. Mashni, AttorneyCourse Level: BasicThis course will provide a general overview of the law related to music by covering intellectual property related to music, public domain issues, and the multiple copyrights in a single song. Additionally, the course will cover sound recordings, music publishing, the exclusive rights for music copyright holders, and the digital transmission of music. All of these issues will be given context with a detailed case study that will provide practical relevance.

TOP 10 APPS FOR PARALEGALSInstructor: Kenneth BergerCourse Level: BasicWant a better work life? There’s at least 10 apps for that. This session is designed to highlight apps that help legal assistants and paralegals with everything from time management to trial prep.

USING TECHNOLOGY TO IMPLEMENT SYSTEMS, ELIMINATE DISRUPTIONS, AND MAXIMIZE QUALITY WORK-PRODUCTInstructor: Kenneth BergerCourse Level: BasicTechnology can be friend or foe, depending on how we use it. This session focuses on how technology can be utilized to streamline work, amaze your boss, and make yourself an indispensable team member.

WINNING CASES WITH DIGITAL FORENSICS – FROM DISCOVERY TO VERDICTInstructor: Doug CarnerCourse Level: IntermediateWhen your case depends upon digital evidence, can you trust that it tells the whole truth? Did you receive all of the relevant, best, and trustworthy evidence? Attendees will learn how evidence can be recovered, analyzed, restored, enhanced, managed, and presented to best exonerate the innocent and identify the guilty. This includes testing obvious, hidden and meta data, to the known case facts. This session will detail how a finite set of digital evidence can be used to produce a very large quantity of supportive case facts. Attendees will also learn how digital forensics can identify people through a combination of voice, facial, tattoo, stride, writings and other characteristics that are often inadequate when analyzed alone.

The presenter will explain the science, best practices, practical application, ethics, and admissibility of digital forensics using examples and case studies. Topics will span the history, current state, emerging status, and future of digital forensics. They will explain how jury expectations and misconceptions have evolved. Attendees will learn how to detect altered discovery, junk science, and common errors made by expert witnesses. Capabilities, pricing, options, and limitations of experts and their methods will be explained. Due to the scope, depth and pace of this lecture, topic transitions will include Q&A sessions.
