ORDINANCE NOXVIII O 1999

An Ordinance to provide for the setting up of a National Accountability Bureau so as to eradicate corruption and corrupt

practices and hold accountable all those persons accused of

such practices and matters ancillary thereto;

@EREA$ it is expedient and necessary to provide for eectivemeasures for the detection, investigation, prosecution andspeedy disposal of cases involving corruption, corruptpractices,1[misuse or abuse of po!er 2[or authority,misappropriation of property, ta"ing of "ic"bac"s, commissionsand for matters connected and ancillary or incidental thereto;

AND @EREA$ there is an emergent need for the recovery ofoutstanding amounts from those persons !ho have committeddefault in the repayment of amounts to #an"s, $inancia

%nstitutions,

[&overnmental agencies and other agencies;AND @EREA$ there is a grave and urgent need for therecovery of state money and other assets from those persons!ho have misappropriated or removed such 2[money or assetsthrough corruption, corrupt practices and misuse of po!er'( orauthority;

AND @EREA$ the President is satised that circumstancesexist !hich 1[render it necessary to ta"e immediate action;

NO@ TEREORE, in pursuance of the aforesaid Proclamation

and Provisional onstitutional /rder as !ell as /rder o 0 of1000, and in exercise of all po!ers enabling him in that behalf,the President of the %slamic 4epublic of Pa"istan is pleased toma"e and promulgate the follo!ing /rdinance5+

7ii: 6he Prosecutor &eneral -ccountability shall holdindependent oJce on !hole time basis and shall not hold anyother oJce concurrently

7iii: 6he Prosecutor &eneral -ccountability shall hold oJce fora 3[non+extendable period of three years

7iv: 6he Prosecutor &eneral -ccountability shall not beremoved from oJce except on the grounds of removal of a udge of .upreme ourt of Pa"istan

7v: 6he Prosecutor &eneral -ccountability may, by !ritingunder his hand addressed to the President of Pa"istan, resign hisoJce

(5) 6he Prosecutor &eneral 3[-ccountability shall giveadvice to the hairman -# upon such legal matters andperform such other duties of a legal character as may bereferred or assigned to him by the hairman -# and in theperformance of his duties, he shall have the right of audience inall ([ourts established under this /rdinance and all otherourts 3[including the .upreme ourt and a Figh ourt and
