2. Project Details

Project Influence Area (PIA)

The stretch of NH-2 from Delhi to Agra (179.5 Kms) is the part of Golden Quadrilateral and connects States of North India i.e. J&K, Himachal Pradesh, Punjab and Haryana, to Southern and Eastern part of the country. This portion of NH-2 also provides connectivity to East-West Corridor and North South Corridor of NHDP. This stretch from Delhi to Agra of NH-2 comes under NHDP Phase-V (Widening of National Highways from 4 to 6 Lanning)Project Background

The portion of NH-2 from Delhi to Agra is already having 4-lane divided carriageway configuration. The corridor has been identified as one of the fastest growing economic corridor. However, the experience of four lane stretch that have already been in use has brought into sharp focus the fact that mere improved riding quality is not enough and that value additions by way of reducing capacity constraints, additional facilities, particularly, those having a bearing on safety aspects, are much more important. Hence from safety point of view and growing traffic requirements, a smooth uninterrupted flow of traffic through this corridor was felt necessary. Accordingly capacity augmentation of the existing 4-lane divided highway to 6-lane divided highway under DBFO scheme was conceived and National Highways Authority of India (NHAI), has been entrusted by the Ministry of Road Transport & Highways, Government of India to implement the task.

Description of the Project Road

The project road starts from Km 20+500 of NH-2 and ends at Km 200+000 of NH-2, thus making a total length of about 179.5 km. The project road lies in State of Haryana and Uttar Pradesh, starts from Badarpur Delhi Border (Km 20.500) and passes through Faridabad industrial area, Ballabgarh, Palwal, Hodal, Koshi, Mathura and ends at Agra (Km.200.00). The project road lies between latitudes of 28 o2818 and 27 o1222.7 north and longitudes of 77 o1820.65 and 78 o0153 east.Project Corridor

The existing project corridor is a four-lane facility (7m carriageway on either side) with 1.5m paved shoulders, 1m-1.5m wide earthen shoulders and 1.0 to 26.0m wide median. The Right of Way (ROW) as observed on the ground varies between 24 m to 100m.

There are no failed sections along the project road. The horizontal and vertical alignment for most of the length of the project highway is satisfactory.

There are 230 structures (Cross drainage, flyover, ROBs and underpasses) exist in the entire project corridor. The overall condition of the structures in the entire project corridor is fair to good.

There are many cross roads having direct access with main highway and eight Rail Over Bridges (ROB) and one Rail Under Bridge (RUB) in the corridor

At present, intersections witness congestion during peak hours and also during the night when there is heavy movement of trucks on the highway. The construction of flyovers / Underpasses / Over Passes will not only ensure uninterrupted movement of traffic heading towards Agra / Delhi, but will also reduce the waiting time for vehicles on the crossing, so drive to Taj Mahal through NH 2 will become faster in the coming days by building flyovers or underpasses at many intersections on the route. All flyovers (except one in Agra) and underpasses on this 179.5 kms stretch will be 6-lane structures. Once the project is completed, it will reduce the travel time drastically between Delhi & Agra.

Utility Services

There are utilities like OFC, Transformer, Telephone, Electrical Pole, HT line, Gas Pipe line, Sewer line, Water pipe line running parallel and crossing the project road. And influence the development of the project area, need to be shifted. In addition, there is presence of Mosque, Temple, Historical Tomb and other important structures

10. Construction Constraints / Critical Issues

1. FOREST CLEARNCE:-

A. HARYANA.

Stage II Clearance letter was received from NHAI office on 16/04/2013. Tree cutting started in the Project corridor on 20th May 2013. 12051 Nos of trees were cut as on 31/3/2014. Tree cutting work is entrusted to Haryana Forest Department Corporation by NHAI. The Tree cutting work was suspended since 13/07/2013 due to some dispute in HFDC. Tree cutting was resumed on 06/09/2013. The Tree cutting work was again suspended since 07/02/2014 in Faridabad & 20/02/2014 in Palwal due to bain on tree cutting National Green Tribune which is not yet resolved. The progress of tree cutting is also very slow. HDFC is not removing the stumps. The Concessionaire is removing the stumps as additional items.

A. UTTAR PRADESH

Stage II Clearance letter was received from NHAI office on 27/08/2013. The letter was addressed to Principal Secretary / Forest Govt. of Uttar Pradesh. UP Govt has given the approval of tree cutting by letter No. 2609/14-2-2012 dated 11 Oct 2013. Tree cutting started in UP Section on 21.12.13 and till 30th April 2014, 3958 Nos of trees are cut. There is dispute between UP Forest Corporation and Forest Department on number of trees and volume. Forest Corporation has returned the lots (containing numbers). The progress of Tree Cutting is very slow. The stumps are not being removed by Forest Corporation. The Concessionaire is removing the stumps as additional work.

2. Taj Trapezium Zone (TTZ):-

The permission of forest clearance within TTZ (Km 115.00 to Km 200.00) in UP is obtained on 13th March 2013 from Honorable Supreme Court.

3. LAND ACQUISTION :-

The status is attached as - Land Acquisition Status in Chapter 24. The following issues are not yet resolved.

i. Without Cheques distribution / Compensation Land lords are not allowing us to work on ground in Haryana and UP.

ii. The compensation of existing buildings has not been paid to the owners causing hindrance to start the work on ground.

iii. The concessionaire have taken up the construction of the VUP at KM 63+180 and Flyover at KM 88+285 but unable to proceed on the LHS. Similar is the case of all the Flyovers, VUP and PUP which are in the habitated area as the compensation of existing building have not been paid to the owners.

iv. Land owners in two villages i.e. Mohammadpur and Lakhanpur in Agra went to Arbitration.

4. UTILITY SHIFTING:-

Electrical lines: - Approved estimates for Haryana and UP section are not yet provided by authority. In-principal approval of estimate of electrical line shifting of Torrent Power along NH-2 from Km 190+700 to Km 200+000 received on 18.9.13.

SEWAGE, DRAINAGE AND WATER SUPPLY LINE: -

HARYANA:-

i. NHAI approved the estimates of Sewer, Water Supply and storm water drain of MCF vide letter No NHAI/CMU/MTR/6-Laning/2013/D-33007 dated 03/08/2013.

ii. NHAI approved the estimates of Sewer, Water Supply and storm water drain of HUDA by letter No. 47072 dated 20.12.2013 of amount Rs.297.175 Lakhs & same is intimated by PD/NHAI dated 26.12.13..

iii. A 10% escalation has been deleted from the estimates prepared / submitted by the Respective Department whereas the estimates were prepared based on the rates of Nov-2011 of the Departments. The concerned department reiterated the validity of 10% escalation. The same has been recommended by IE & forwarded by PD, NHAI to NHAI, HQ. The approval of the same is awaited.

UTTAR PRADESH: - Approved estimates for UP yet to be provided by authority.

In view of the above, the Concessionaire cant take up the construction of major portion of road work and any structure on want of utility shifting which are causing hindrances at site.

5. Approved GAD of ROBs (8 Nos):-

As per condition Precedent of Concession Agreement, approved GADs have not yet been provided by NHAI.

As decided in the meeting dated 26/2/2013 in PD, NHAI office and MOM forwarded on 8th March 2013, the GAD of all the ROBs shall be prepared by Concessionaire under the provision of clause 16 of CA. 3 Lane, One side GAD of 8 ROBs (7 in UP & 1 in HR) are prepared by Concessionaire submitted to IC/NHAI and further submitted to Railway by NHAI. GADs for 7 ROBs of UP section and the cost of structures of Railway portion resubmitted after incorporating the Railway observations. Northern Central Railway Agra Division have asked for providing the vertical clearance of 8.43 m in case of 6 nos ROBs.

NHAI to issue Change of Scope (COS) notice as per clause 16.2.1. The same is awaited.

6. NOC FOR SOOR SARVOR BIRD SANTUARY:-

The Proposal is approved on 1/2/2013 by NATIONAL WILD LIFE BOARD (NBWL) of MoEF.

7. ARCHAEOLOGICAL SURVEY OF INDIA (ASI):-

NOC from ASI (Monument Authority of India) which was essential for Stage II Clearance was received on 05.07.2013.

8. RELOCATION OF RELIGIOUS STRUCTURES :-

There are many religious structures in the project within ROW which need to be relocated or demolished. The relocation or demolition of these structures is yet to commence. The list of structures is attached.

The concessionaire has further submitted the list of priority structures for immediate shifting which are hindrances to construction work.

9. METRO LINE IN FARIDABAD (Km 20.500 to Km 32.600):-

Metro line is progressing very fast within our existing / Proposed ROW between Km 20.500 to Km 32.600 on LHS of the project thus making encumbrances / hindrance to the construction. At a location where Metro line is extended from LHS to RHS the pillars are placed at the median and close to the outer side of both carriageways. The concessionaire has submitted the modified alignment plan of above chainages incorporating the Metro line which warrants change beyond the Scope of Concession Agreement.

The Independent Consultant has agreed In-Principle on the modified alignment with certain observations. The Concessionaire requested for issuing the Change of Scope (COS) notice as per clause 16.2.1 to proceed further. The same is awaited.

11 Issue of Change Of Scope (COS)

1. METRO in Faridabad

Metro line from km. 20.500 [Badarpur] to km. 32.600 [YMCA] is under construction within the existing / proposed ROW for 6 laning. DMRC have encroached the area proposed for 6 laning. The Concessionaire needs to adjust 6 laning by reducing median, shifting centre line, change in alignment, extra height of retaining wall and Additional Barrier in median etc.

All these additional works are beyond the scope of Concessionaire and would require Change of Scope Notice under clause-16.2.1.

The modified alignment is agreed In-Principle by the Independent Engineer. The Concessionaire shall submit the cost implication due to change in alignment & other modifications very shortly.

2. New Construction of ROBs

As per condition precedent under clause 4.2, NHAI has to provide the GADs of ROBs approved from Railways.

The Concession Agreement provides widening of all the ROBs from 4.0 to 4.5m of one lane on either side as per details attached.

As per Railways and NAHI/IE recommendation, the Concessionaire prepared the GADs for New three lane Bridge on one side to the Railways which is beyond the scope of Concession Agreement. The Railways has asked for preparation of GAD with a vertical clearance of 8.43m. The GADs have accordingly been submitted to Railways and are in the process of Approval.

As such, the Concessionaire requested for Change of Scope Notice as per clause-16.2.1 of Concession Agreement.

3. Change in Alignment Due to ASI Monuments

There are 7 Monuments falling within ROW for 6 laning for which the Concessionaire had to change the alignment and take mitigation measures to protect the monuments. A comprehensive plan was submitted to NHAI for taking NOC from Monument Authority of India.

Change in Alignment and other related works are beyond the Scope of Concession Agreement.

The Concessionaire thus request for issue of Change of Scope Notice as per clause 16.2.1.

4. Elevated Structure at Sikandra

As per Concession Agreement a viaduct from km. 190.66 to 192.100 is to be constructed in font of Sikandra Monument, the Tomb of Akbar.

ASI sanctioned permission of 6 laning at grade instead of Elevated Structure. As per Concession Agreement, the elevated structure has additional Toll rates for the Concession Period.

As such the Concessionaire requested for issue of Change of Scope Notice on revenue loss.

5. 6 Laning In Agra between km. 192+300 To 200+000

NHAI informed that No Land Acquisition is proposed in Agra City from km. 192+300 To 200+000 and instructed Concessionaire to submit the proposal under Change of Scope. The concessionaire submitted the modified alignment of Agra City on 30.11.13 The Independence Engineer reviewed the modified alignment and instructed Concessionaire number of proposals. The concessionaire requested for issue of Change of Scope (COS) notice as per clause 16.2.1.

6. Culverts / Minor Bridge Under Approaches of Flyover/VUP

As per Concession Agreement all culverts in the project are to be widened for 6 laning. The culverts / minor bridges falling under the approach of Flyover & VUP require reconstruction which is beyond the Scope of Concession Agreement.

As such the Concessionaire requested for issue of Change of Scope Notice as per clause 16.2.1 of Concession Agreement.

7. Additional Culverts

The Concessionaire found certain Additional culverts on the project highway which are not mentioned in the Concession Agreement. The Independent Engineer was requested for verification at site.

The construction of Additional Culverts is beyond the Scope of Concessionaire and requested for issue of change of scope Notice as per clause 16.2.1 of Concession Agreement.

8. Elevated Structure in Faridabad

NHAI directed Concessionaire to submit the cost implication for providing the Elevated Structure from km. 20.500 to km. 32.600 instead of 5 no of Flyovers in this stretch.

The Concessionaire submitted cost implication of the Elevated Structure which is beyond the scope of Concessionaire.

Decision on the Issue is awaited from NHAI.

9. Conditions in NOC of Wild Life

While granting permission/NOC, the National Wild Life Board under MoEF placed certain condition like construction of 7 ft high wall from km. 179 to km. 183, a thematic entry gate and green belts.

NHAI instructed Concessionaire to take action on the conditions. As construction of above items are beyond the Scope of Concession Agreement, the Concessionaire requests for issue of Change of Scope Notice.

10. Rehabilitation of Existing VUP at KM 103+160

The Independent Engineer /NHAI instructed Concessionaire to take up the Rehabilitation of existing VUP at Km 103+160. As per the Concession Agreement The existing Underpass at Km 103+160 shall be retained and widened to Six Lane.

The Concessionaire requested IE/NHAI to issue Change of Scope Notice for Rehabilitation of in the form of Major Repair of Super Structure under Clause 16.2.1

11. Rehabilitation of Major Bridge at Km 91+900

As per the Concession Agreement existing Major Bridge at Km 91+900 requires only Major Repair

The Concessionaire intimated to Independent Engineer that as per the site condition and specified agencys recommendation it required MAJOR REPAIR & REHABILATION which is beyond the scope of concessionaire.

The concessionaire their requested IE/NHAI for issue of change of scope Notice under Clause 16.2.1.

12. Removal of stumps in HR & UP

Forest Department in HARYANA & UP have entrusted the cutting of trees in project corridor to Haryana Forest Department Corporation & UP Forest Corporation respectively. The Corporation are only cutting the trees and not removing the Stumps / roots. As per the MORTH specifications, the stumps/roots are to be removed by the agency cutting the trees. Moreover the removal of stumps / roots is part of the rate provided by NHAI to Forest Corporation.

As per instruction by NHAI, the Concessionaire has started removal of trees which is beyond the scope of Concession Agreement. The concessionaire requested for issue of change of scope Notice under Clause 16.2.1.

In-principal approval of estimate of electrical line shifting of Torrent Power along NH-2 from Km 190+700 to Km 200+000 was communicated vide letter No NHAI/CMU/MTR/Six laning/2013/D-33322 dated 18/09/2013.
