Foreword More than 100 years have elapsed since the signature of the Áurea Law and our country is still living with the signs left from the exploitation of slave labor. In Brazil, contemporary slavery is expressed in clandestineness and is marked by authoritarianism, corruption, social segregation, racism, favoritism and disrespect of human rights. According to the Pastoral Land Commission (CPT)’s numbers, there are in Brazil 25 thousand persons submitted to conditions similar to those of forced labor. This data reflects the reality of a serious violation of human rights, which disgraces not only Brazilians but the whole international community. Being aware that the eradication of forced labor is a basic condition for the Democratic Rule of Law, the new Government has made one of it’s main priorities the eradication of all contemporary forms of slavery. Facing such a challenge requires political willingness, articulation, action planning and the definition of objective goals.

We have, therefore, launched the National Plan for Eradication of Forced Labor, which presents measures to be taken by several bodies of the Executive, legislative and Judiciary Branches, the Prosecution Office and entities of the Brazilian civil society. The updating of the proposals already articulated on previous years, the document considers actions and achievements carried out by the different bodies faced with such challenges during recent years. In this context, it is worth mentioning the Special Mobile Inspection Group of the Ministry of Labor and Employment, whose performance has been fundamental to combat contemporary forms of slavery. The present document has been elaborated by the Special Commission of the Council for the Defense of the Rights of the Human Person (CDDPH), established by Resolution number 05/2002 d to the theme.

The National Plan for Eradication of Forced Labor satisfies the determinations of the National Plan of Human Rights and expresses a continuing public policy to be inspected by a national body or forum dedicated to the repression of forced labor. Integration shall be the mark of our work. With the actual Plan, the commitment of the government bodies and of the civil society, it will be possible to make this Government a milestone in respect to the definitive eradication of all forms of forced and degrading work in

10 - To establish and maintain an integrated database to gather diversified information collected from the main agents involved in the combat against forced labor; to identify employers and employees, places of incitement and occurrence of crime; to enable the identification of the nature of the properties (if they are on a public or private area and they are productive or unproductive), to monitor ongoing cases, the work resulting from the performance of MTE, IBAMA, SRF and also the inquiries, actions and respective judicial decisions in the labor and penal area.

• 60 agents and 12 Chiefs of Police in the State of Pará

CHANGES IN THE LEGISLATION

Proposal 1 Responsible entity: Presidency of the Republic Deadline for Execution: Short-Term

Bill It gives new wording to articles 1 and 8 of Law number 8072, of July 25, 1990, making provisions on heinous crimes, pursuant to art. 5 , item XLII of the Federal Constitution, and addresses other matters THE PRESIDENT OF THE REPUBLIC. I make it known that the Congress decrees and I sign the following Law: Art. 1 Art. 1 of Law No. 8072, of July 25, 1990, shall now enter into effect with the addition of items VIII and IX, with the following wording: “VIII - reduction to the condition similar to that of a slave (art. 149); IX - incitement of movement of workers from a place to another within the national territory (art. 207 and 1st and 2nd paragraphs); Art. 2 The first paragraph is inserted in art. 8 of Law number 8072, of July 25, 1990, and is renumbered, which shall read as follows: “First paragraph. The penalty doubled if the gang or band is carrying guns. Second paragraph. The participant and the associate who denounces the gang or band to the authority, thus enabling its dismantling, shall have his/her penalty reduced by one to two thirds. “ Art. 3 Articles 149 and 207 of the Penal Code shall have the following wording: “Art. 149 - Penalty incarceration from four to eighth years, plus a fine.” “Art. 207 - ….. Penalty incarceration from four to eight years, plus a fine.” Art. 5 The present law shall enter into force on the date of its publication. Art. 6 - Any provision in contrary shall be revoked.

Proposal 2 Responsible entity: Presidency of the Republic Deadline for execution: Short-Term Bill PROVISIONAL REMEDY OR BILL It gives new wording to Law number 5889, of June 8, 1973, which provides for the regulating norms of the rural worker, changing fourth paragraph of Art. 18, and addresses other matters THE PRESIDENT OF THE REPUBLIC, pursuant to powers granted to him by art. 62 of the Constitution, adopts the following Provisional Remedy, with force of law: Or THE PRESIDENT OF THE REPUBLIC. I make it known that the National Congress decrees and I sign the following Law: Art. 1 Art. 18 of Law number 5889, of June 8, 1973, shall enter into effect with the following changes: “Art. 18 - …. First paragraph: …. Second paragraph: …. Third paragraph: ….. Fourth paragraph. A fine in the amount of two thousand and five hundred Reais (R$2,500.00), per worker, without prejudice to the other pertinent penalties, the rural employer who, directly or indirectly: I - Reduces someone to a condition similar to that of a slave. a) through mistake, fraudulent action, simulation, coercion or fraud, trick or stratagem, with the objective of subtracting him/her the free manifestation of will as regards the effective work conditions proposed to him/her; or b) through threat, violence or deprivation of the individual or social rights or of any other means which make it difficult for the individual to get free of the situation in which he/she is; or c) shall not assure the conditions for his/her return to the place of origin; or d) by selling to his employees, goods or services not complying with third paragraph of art. 462 of the CLT, and also coercing or inducing them to use his grocery store or services with the intent of obtaining profits or keeping them under debt; or

e) by making discounts not predicted by law, not making the payment of labor debts within the legal period or holding documents, with the purpose of maintaining the worker on the place of execution of the services; or f) through the imputation of degrading maltreatments or suffering to the worker; or g) by linking the working contract, even an informal one, to the payment of a sum, directly or indirectly to the employer, through mistake, fraudulent action, simulation, coercion or fraud, trick or stratagem or lack of subsistence alternative; or h) through the imposition of painful or insalubrious working conditions, by denying them the minimum life, health and safety protection; or i) through the omission, dissimulation or denial of information about the location of means of access to the place where the worker is; or j) by restricting in any way the free relocation of the worker; or l) by maintaining surveillance over the worker with the use of violence or threat. II – to incite workers from a place to another within the national territory; III – to recruit workers outside the working place, through fraud or collection of any debt from the worker; Fifth paragraph. Upon the exhaustion of the administrative way, the sanctioned employer, in any of the previous paragraph hypothesis, shall not receive and will immediately lose, the right to fiscal or credit benefits or incentives granted by the government, directly or through financial agents. Sixth paragraph. The assumptions in fourth paragraph, also subject the offender to the effects of a direct rescission of the working contract, thus implying in the payment of rescission appropriations occurring on a fiscal procedure of the Ministry of Labor and Employment, under the penalty of payment of fines provided for in the eight paragraph of art. 477 of CLT. Seventh paragraph. The fines established in the fourth paragraph shall be applied by the Regional Labor Delegate who shall forward, within ten (10) days from its receipt, copies of the tax assessment notice and the inspection report to the Regional Labor Attorney’s Office and the Federal Attorney’s Office, under the penalty of responsibility. Eighth paragraph. In the event of contumacy, embarrassment, resistance to inspection, disrespect of the authority, use of stratagem or simulation with the purpose of breaching the law, or in the event of child labor or illegal or irregular adolescent labor, the fine shall be imputed in double, without prejudice to the pertinent penal sanction.”

Art. 2. This law shall come into force on the date of its publication. Art. 3. Any provision in contrary shall be revoked.
