Note that one or more of these documents may not apply to your case and as such, were not included in the package. In any case, please review all of the included documents and contact us with any questions. California law requires these documents be signed and returned to our office before we can legally represent your legal interest. Once we are in receipt of the original signed and dated documents, we will obtain all existing investigative reports, contact witnesses and initiate our own investigation. Please Note- The purpose of this agreement is to afford the patient access to needed medical care and treatment that the patient may not otherwise be in a financial position to receive. The patient appreciates the provider's expertise, medical care, and compassion by agreeing to enter into this agreement.

This agreement is entered into among the above-indicated

provider, patient, and Jackson & Wilson (J&W), a professional

law corporation, in consideration of the mutual obligations set

forth herein and establishes their responsibilities to each

other during the pendency of the patient's claim arising from

the above-referenced incident.

1. J&W hereby agrees that J&W is a party to this contract

and further recognizes that J&W and the patient are receiving

certain benefits from this agreement which constitute valid

consideration and as such, J&W is bound by the terms of this

contract.

2. Patient hereby gives a lien to provider against all

proceeds derived from this claim after attorney's fees and costs

(whether by settlement, judgment, or otherwise) to secure

payment of all reasonable fees owed to provider by patient for

treatment arising out of injuries sustained, as of the time such

proceeds are received. Patient hereby directs J&W to honor said

lien and to pay such sums as are secured hereby directly to

provider, as soon as possible after any proceeds are received.

3. Patient hereby expressly recognizes that even though

this lien has been given, patient still remains personally

responsible to provider for provider's fees and that payment of

said fees must be made by patient regardless of whether any

money is received through this claim.

4. Patient and provider hereby agree to submit any

disputes concerning provider's fees to a non-binding mediation

and arbitration conducted by JAMS, Judicate West, or any other

qualified person mutually agreeable by all parties. Until said

dispute is resolved, J&W agrees to hold in trust a sufficient

amount of patient's proceeds to satisfy provider's claimed fee.

5. Provider hereby agrees to await patient's personal

payment of fees until this claim is concluded (except to the

extent that payment is available from insurance which provides

health care benefits for patient) and to be available to J&W,

upon reasonable notice and for reasonable compensation (as

agreed upon between provider and J&W) for consultations,

depositions and court appearances. Outstanding balances shall

incur interest at the rate of 10% per annum.

6. J&W and patient hereby agree to notify provider,

immediately, should patient retain new legal counsel. Patient

agrees to direct new legal counsel to execute another copy of

this Claim Agreement and Lien when one is furnished by provider.

7. Before J&W distributes any monies received through

this claim, J&W agrees to request and provider shall communicate

a prompt and full disclosure to J&W in regards to the patient's

outstanding account balance, if any.

8. Should any party seek judicial enforcement of this

agreement, the prevailing party shall be entitled to reasonable

attorney's fees.

9. This Claim Agreement and Lien cannot be modified,

changed, or revoked by any party without the express written

consent of all parties.

ATTORNEY/CLIENT CONTINGENT FEE RETAINER AGREEMENT This document, agreement or retainer agreement (hereinafter “Agreement”) is the written fee contract that California law requires lawyers to have with their clients. Pursuant to the terms and conditions of this agreement, Jackson & Wilson, A Professional Law Corporation (“Attorney”) will provide legal services to you, the client (“Client”), as specifically referenced below, pursuant to the terms and conditions set forth herein. This agreement, including all attachments, is confidential and is legally privileged. Ev.C. §952, et seq.; CCP §2018.010, et seq.; see also Mitchell v. Sup.Ct. (Shell Oil Co.)(1984) 37 C3d 591, 601. Please note that this agreement is required by California Business and Professions Code section 6147 and is intended to fulfill the requirements of that section. It is modeled after the agreement(s) prepare by the California State Bar and as approved by the Board of Governors June 20, 1987; amended effective November 22, 1996; May 15, 2001; June 23, 2005; March 8, 2010. 1. CONDITIONS: This agreement will not take effect, and we will have no obligation to provide legal services, until the original fully signed and dated agreement is delivered to us together with payment of the initial retainer deposit, if any, as indicated below. 2. SCOPE OF SERVICES: You are retaining us as your attorneys to represent you in the following matter (to be completed by lawyer): _____________________________________________________________________ We will provide those legal services reasonably required to represent you. We will take reasonable steps to keep you informed of the progress of the matter, and to reasonably respond to your inquiries. This agreement does not apply to any other legal matters. If any such matters arise later, attorney and client will either negotiate a separate agreement if client and Attorney agree that Attorney will perform such additional legal work or client will engage separate counsel with respect to the additional legal work. Absent a separate retainer agreement, it is understood and agreed that we are not obligated to do any of the following: initiate or oppose any motion for a new trial, initiate or oppose any other post-trial motions on your behalf, represent you on an appeal and/or represent you in any proceedings designed to execute on the judgment. Unless we enter into a different agreement with you, in writing, this agreement will govern all services we may perform for you.

3. CLIENT’S DUTIES: You agree to be truthful with us, to cooperate, to keep us informed of developments, to abide by this agreement, to pay our bills for costs (if any) on time, and to keep us informed of your current address, telephone number and whereabouts. You agree to appear, if we so request, for all meetings and hearings including but not limited to all depositions and court appearances, and to generally cooperate fully with us in all matters related to the preparation and presentation of your claim. You understand that your failure to comply with any of the terms and conditions of this agreement may be detrimental to the outcome of your case and grounds for Attorney to unilaterally cancel this agreement without notice to you. 4. DEPOSIT: You agree to pay an initial deposit of $ _________, to be returned with this signed agreement. Regardless of whether or not an initial deposit is required and/or if your deposit is exhausted, we reserve the right to demand further deposits as we unilaterally deem needed and/or prior to or after actual expended costs. Once a litigation related date is set, including but not limited to arbitration, mediation and trial, at our sole discretion, we may require you to pay all sums then owing to us and, to deposit further funds including, but not limited to, the costs we estimate will be incurred in preparing for and completing the event, as well as the reporter, jury, arbitration or mediation fees likely to be assessed. Those sums may exceed the maximum deposit. If requested, you agree to pay all deposits or advances required under this agreement within 10 days of our demand. Any unused and unearned deposit at the conclusion of our services will be refunded.

5. LEGAL FEES, COSTS, AND BILLING PRACTICES: We will only be compensated for attorney fees related to legal services rendered in a contingency matter if a recovery is obtained for you. If no recovery is obtained, then no attorney fees will be charged and you will only

be obligated to pay for costs, disbursements and expenses, as described herein. The attorney fees to be paid to us will be a percentage of the gross recovery, depending on the stage at which the settlement or judgment is reached (the term “gross recovery” means the total of all amounts received [compensatory, special, general, and punitive damages] by settlement, mediation, arbitration, judgment or otherwise). If part or all of the recovery is to be deferred, such as in the case of an annuity, structured settlement or periodic payments, attorneys fees may, at the election of the attorneys, be computed on the present lump-sum value or payment plus, the present value, as of the time of settlement, arbitration, mediation, judgment or other case resolution, of the payments to be received thereafter. The same interest rates used by client’s attorneys or economist in making the settlement, judgment or award will be used. The rates set forth herein are not set by law, but are negotiable between an attorney and client.

General Personal Injury Matters (Adult Clients):

If settlement or judgment is reached before filing a lawsuit, then attorneys’ fees shall be 33.33% of the gross recovery. If settlement or judgment is reached after filing a lawsuit and up to thirty (30) days before an arbitration or mediation date or, prior to the date of the first court hearing including but not limited to a Case Management Hearing, Status Conference, Evaluation Conference, Mandatory Settlement Conference, or Trial Setting Conference, whichever is earlier, then attorneys’ fees shall be 35% of the gross recovery. If settlement or judgment is reached after the times set forth above, then attorneys’ fees shall be calculated at 40% of the gross recovery. Medical Malpractice Matters (All Clients- Set by Statute):

If settlement or judgment is reached, our attorneys’ fees shall be deducted from the gross amount as follows: 40% of the first $50,000.00 recovered by settlement, arbitration, mediation, judgment or otherwise; 33.33% of the next %50,000.00; 25% of the next $500,000.00; and 15% of the excess over $600,000.00. This fee is identical to that provided for in California Business and Professions Code Section 6146. Said fees are subject to increase via attorney motions and court orders.

Minor Client Matters (Minors- Set by Statute):

If settlement or judgment is reached while the client is a minor, attorneys’ fees shall be deducted at the rate of 25% of the gross recovery but, are subject to reasonable increase via motion and court order. Should the minor client reach legal age prior to a settlement or judgment being reached, it is agreed between the parties and their representatives that the minor shall be billed as an adult pursuant to the terms herein.

6. COSTS, LITIGATION, EXPERT FEES, AND EXPENSES: Costs and expenses are defined and include, but are not limited to, the following: All costs, expenses, disbursements and litigation expenses associated with this matter, including court filing fees, service of process charges, photocopy services, notary fees, computer-assisted legal research, long distance telephone charges, messenger and delivery fees, postage, in-office photocopying, facsimile charges, deposition costs, parking, mileage, investigation expenses, consultants’ fees, expert witness related fees and expenses, trial preparation and related exhibit expenses, jury fees, reporter fees, actual trial related expenses and other similar items. All costs and expenses will be charged at our cost. You understand that as indicated herein, you may be required to make a deposit for costs (estimated or realized) before the expenditure is made by attorney. While as a professional courtesy, attorney may advance certain costs on your behalf, on our demand, you agree to pay for all actual and/or estimated costs, disbursements, and expenses. You authorize attorney to incur all reasonable above-indicated costs at our sole good faith discretion. In the event that an award of costs is sought on your behalf in this action, you understand that the amount which the court may order as costs is the amount the court believes the party is entitled to recover, and does not necessarily determine or reflect what costs attorney is entitled to charge its clients or that only the costs which were allowed were reasonable. You agree that you remain responsible for the payment, in full, of all attorneys’ fees and costs in connection with this matter and subject to the terms and conditions herein.

7. BILLING STATEMENTS: Upon your written request, we will send you billing statements for costs, disbursements, and expenses incurred in connection with this matter. Please note that if an outstanding billing statement is not paid when due, interest will be charged on the principal balance (fees, costs, and disbursements) shown on the statement. Interest will be calculated by multiplying the unpaid balance by the periodic rate of .833% per month (TEN PERCENT [10%] ANNUAL PERCENTAGE RATE). The unpaid balance will bear interest until paid.

8. APPROVAL NECESSARY FOR SETTLEMENT: We will not make any settlement or compromise of any nature of any claim without your prior approval. You agree that while this agreement is in force and effect, you waive any rights and authority to independently make any settlement or compromise of any nature without written approval by attorney. Should you independently settle or compromise your claim contrary to the terms of this agreement, out of the gross amount, we are entitled to receive directly from the payor, the full payment of fees, costs and expenses, as set forth more fully herein. As indicated herein, you also grant us a legal and equitable attorney lien relative to said payments and reimbursements. 9. LIMITATION OF REPRESENTATION: We are representing you only on the matter described herein.

10. DISCHARGE AND WITHDRAWAL: You may discharge us at any time and, we may withdraw as your attorney at any time, upon written notice. Upon either instance, we will immediately cease to render additional services. Such a discharge or withdrawal does not, however, relieve you of the obligation to pay any fees or costs incurred prior to such termination, and we have the right to recover from you the reasonable value of our legal services rendered from the effective date of this agreement to the date of discharge. We may withdraw from representation of you (a) with your consent (b) upon court approval, or (c) upon reasonable notice to you. All lien provisions set forth below are incorporated herein. 11. CONCLUSION OF SERVICES AND MAINTENANCE OF FILE: When our services are terminated or conclude for any reason whatsoever, all unpaid fees and charges will immediately become due and payable. You authorize us to use any funds held in our trust or general business accounts as a deposit against unpaid fees and costs and to apply it to such unpaid balances. After our services are concluded, we will, upon your written request, make your original file reasonably available to you, along with any remaining funds or property of yours in our possession. Absent your written request, attorney agrees to maintain the case file in this matter in copied or digital scanned format, for a period of up to five (5) years after it is concluded either by settlement, mediation, arbitration, trial, appeal or dismissal. All original documents and photographs will be destroyed after the initial copy or scanning process. After five (5) years, the above-described copy or scanned file will be discarded, destroyed and/or recycled without notification to the client. If attorney wishes to discard, destroy and/or recycle the file before the expiration of the five (5) year period, attorney shall provide reasonable written notice of not less than thirty days to the client, and afford client an opportunity to retrieve the copies or scanned file. Client may also wish to maintain the copied or scanned file after the five (5) year period, and if so, client must notify attorney in writing of such intention, prior to the expiration of the five (5) year period. 12. LIEN: You hereby grant us an express and implied legal and equitable lien for any monies owed to attorney, under the terms of this agreement and, on any and all claims or causes of action that are the subject of our representation under this agreement. Our lien will be for any sums owed to us for any unpaid balances including but not limited to those related to costs, attorneys’ fees (contingency or otherwise), and expenses. The lien will attach to your right to receive monies relative to the litigation and/or conclusion of this matter including but not limited to any monies you may be entitled to from arbitration awards, judgments, settlements, or otherwise. Said lien allows for our name to be included on all disbursements. A lien acts as security for payment due to attorney by client. This lien could delay payments to client until any disputes over the amount to be paid to Attorney are resolved. As indicated herein, client hereby grants Attorney a lien for any sums due and owing to attorney for fees and costs at the conclusion of Attorney’s services. The lien will

attach to any and all real or personal property of client’s, including any recovery client may obtain, whether by arbitration award, judgment, settlement or otherwise, in this matter. Client may seek the advice of an independent lawyer of the client’s choice about this lien and this matter. By signing this agreement, client acknowledges that he/she/it has been so advised and given a reasonable opportunity to seek that advice. In the event of the termination of our professional relationship for any reason including but not limited to discharge, withdrawal, or a breach of this agreement, you agree that this firm has an express and implied legal and equitable lien relative to any sums you may be entitled to relative to this matter and, at our option, we shall be entitled to be immediately paid directly from the payor, without notice to you, which may include but is not limited to insurance companies, opposing parties, subsequent counsel, or you, our lien for any sums owing to us for any unpaid balances including but not limited to those related to costs, attorneys’ fees, and expenses. Such fee shall be determined by the intent, terms, and conditions of this agreement and by considering the following factors: (1) the actual number of hours expended by us in performing legal services for you; (2) our hourly rate of $500.00; (3) the extent to which our services have contributed to the result obtained; (4) the amount of the fee in proportion to the value of the services performed; (5) the amount of recovery obtained; (6) time limitations imposed on us by you or by the circumstances; and (7) the experience, reputation, and ability of our attorneys and staff performing the services. Please note that should it be necessary to institute legal proceedings against you for the collection of all or any part of our lien including said costs, attorneys’ fees, expenses and advances, you agree to pay all costs of collection and suit, interest at the legal rate on all outstanding balances, and reasonable attorneys’ fees related thereto. You also agree that the exclusive jurisdiction and venue for all legal proceedings shall be the County of Orange, State of California. 13. DISCLAIMER OF GUARANTY: Nothing in this agreement and nothing in our statements to you will be construed as a promise or guarantee about the outcome of this matter. We make no such promises or guarantees. There can be no assurance that you will recover any sum or sums in this matter. Our comments, if any, about the outcome of your matter are expressions of opinion only. We do promise to use our best efforts to provide you with professional legal representation.

14. ATTORNEY’S AUTHORITY: For your convenience and to assist attorney with its representation of you in connection with the matter covered by this agreement, you hereby give us full power, authority, and power of attorney to execute all pleadings, documents, claims, deposits, drafts, checks, releases, orders and contracts relative to this matter. You also provide us with express authority to communicate this authority to various third parties. If attorney is unable to locate client, client grants attorney authority to resolve client's case as attorney sees fit within attorney’s judgment and which is in the best interest of the client.

15. MEDIATION AND ARBITRATION AGREEMENT REGARDING DISPUTES: Any dispute between us arising out of or connected to our representation of you, including but not limited to all tort or contract causes of action, as well as claims based on claimed breach of contract, unjust enrichment, legal malpractice, breach of fiduciary duty, constructive fraud, negligent misrepresentation and fraud, shall be submitted to binding arbitration at Judicate West Arbitration and Mediation Service, in Orange County, California before a single neutral arbitrator who will apply applicable Judicate West arbitration rules. By so agreeing, you are waiving your right to submit any dispute or any cause of action you may have against us to a jury or court trial. Notwithstanding the binding arbitration agreement set forth in paragraph (a) above, in the event of a fee dispute between us, you are entitled to participate in fee arbitration through the Orange County Bar Association, pursuant to Business & Professions Code section 6200-6206. In the event you elect not to participate in fee arbitration pursuant to the Business & Professions Code, we will resolve the fee dispute pursuant to the binding arbitration agreement set forth in paragraph (a) above. If you do elect to participate in such a fee arbitration but reject an award issued therein by, among other things, requesting a trial de novo, the trial de novo will consist of a binding arbitration conducted pursuant to the agreement set forth in paragraph (a) above. If you waive fee arbitration through the Orange County Bar Association or request a trial de novo following such a fee arbitration, you are waiving your right to submit the fee dispute to a jury or court trial. We advise you that you have the right to review this arbitration provision with independent counsel of you choosing. Notice: By executing this retainer agreement, you are agreeing to arbitration as set forth above, and are giving up your right to a jury trial or court trial as to all claims covered by that arbitration agreement; and also acknowledging that you have been advised to and have had the opportunity to consult with independent counsel concerning this arbitration agreement. 16. DIVISION OF ATTORNEY FEES (Attorney To Attorney Referrals): In full compliance with California State Bar Rule 2-200, information was discussed and disclosed between attorney and client concerning the client's choice in retaining attorney. It is understood that the client was referred to and/or otherwise provided with our name, or the name of an attorney who is a member of this firm, by another attorney or law firm. That in this specific case, attorney intends to divide up to ( %) of its net attorney fees with ________________________ at the conclusion of this case. The legal fees charged to the client by attorney are not increased by reason of the above-indicated referral or anticipated division of attorney fees. After full disclosure of the intended division of attorney fees, and after being informed that the intended division of attorney fees will not increase the legal fees client will be charged and will not decrease or in any other way detrimentally affect the client's recovery in this case, the client hereby expressly consents to the division. The client also consents to attorney providing the referring attorney with responsible case status updates.

17. TAX ADVICE SPECIFICALLY EXCLUDED: Attorney has advised client that any settlement, award or judgment obtained as a result of the representation may be partly or wholly taxable. Attorney has informed client that tax advice is specifically excluded from the scope of the services attorney will provide under this agreement. Attorney has informed client that he/she is not an expert in tax law and has recommended that client obtain advice from a tax practitioner concerning the tax consequences of any recovery. 18. PROFESSIONAL LIABILITY INSURANCE DISCLOSURE: Pursuant to California Rule of Professional Conduct 3-410, we are informing you in writing that we do not have professional liability insurance. 19. ATTORNEYS’ FEES CLAUSE: The prevailing party in any action or proceeding arising out of or to enforce any provision of this agreement, with the exception of a fee arbitration or mediation under Business and Professions Code Sections 6200-6206, will be awarded reasonable attorneys’ fees and costs incurred in that action or proceeding, or in the enforcement of any judgment or award rendered. 20. ENTIRE AGREEMENT: This agreement contains the entire agreement of the parties. No other agreement, statement, or promise made before, during or subsequent to the effective date of this agreement will be binding on the parties unless in writing and signed by all parties. 21. SEVERABILITY IN EVENT OF PARTIAL INVALIDITY: If any provision of this agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and remain if effect. 22. MODIFICATION BY SUBSEQUENT AGREEMENT: This agreement may be modified by subsequent agreement of the parties only by an instrument in writing signed by all parties. 23. INDEPENDENT ATTORNEY REVIEW: You have the right to have an independent attorney review this agreement before you sign it. By executing this agreement, you acknowledge and agree that you have been given a reasonable opportunity to have an independent attorney review this document and have executed this document only after having done so, or, only after reviewing this agreement carefully and then intentionally waiving your right to do so. 24. EFFECTIVE DATE: The effective date of this agreement will be the date on which Attorney is in receipt of one copy of the agreement executed by client. The attorney-client relationship will commence on the effective date of this agreement. Attorney will not become client’s attorney nor will Attorney perform any legal services on behalf of client before the effective date of this agreement. The date below is for reference only. A copy, facsimile or other electronic reproduction of this agreement and/or signatures is deemed valid as originals.

What is a Contingency Fee? In most legal matters, we are proud to offer our services to you on a contingency fee basis. Having said that, many people are not aware of what exactly a contingency fee is. We hope this helps info helps. A contingent fee is a fee for services provided where the attorney fee is only payable if there is a favorable result. The law defines a contingent fee as "a fee charged for a lawyer's services only if the lawsuit is successful or is favorably settled out of court...contingent fees are usually calculated as a percentage of the client's net recovery." For many injured consumers, the contingent fee is their key to the courthouse doors. It makes it easier for people to protect and pursue their civil rights—especially in personal injury and wrongful death cases. If the right attorney is selected, a contingent fee is an excellent way to hire one of the best lawyers in your state without having to pay his or her up front retainer or hourly fee. Truly a win-win for the consumer. Because of the high risk involved, few attorneys will take cases on a contingency basis unless they feel the case has good merit. And when you think about it, that makes perfectly good sense. The Contingent Fee Structure- A client is not charged attorney fees if he or she loses the case. If the client recovers damages from settlement or a favorable verdict, the attorney receives a previously agreed to fee from the recovery. The attorney's permitted fee varies depending on the country, and even local jurisdictions. The percentage allowed is subject to the ethical rules of professional conduct, and in many circumstances, statutory limitations. Depending on the age of the client and type of case, this range is normally someplace between 25% to 40% in the State of California. The Advantages of a Contingent Fee Structure- A contingency fee arrangement provides access to the courts for those who cannot afford to pay the attorneys fees and costs of civil litigation. Contingency fees also provide a powerful motivation to the attorney to work diligently on the client's case. In other types of litigation where clients pay the attorney by the hour for their time, it makes little economic difference to the attorney whether the client has a successful outcome to the litigation. Finally, because lawyers assume the financial risk of litigation, the number of speculative or unmeritorious cases may be reduced. In the United States, contingency fees are the standard in personal injury cases and are less common in other types of litigation. Most jurisdictions in the United States prohibit working for a contingent fee in family law or criminal cases, as made clear in Rule 1.5(d) of the Model Rules of Professional Conduct of the American Bar Association. It’s interesting to note that in addition to the United States, contingent fees are also allowed in many other countries such as Australia,Brazil, Canada, the Dominican Republic, France, Greece, Ireland, Japan, New Zealand, the United Kingdom and the United States.

After we became involved, filed a Superior Court lawsuit and pushed the case to trial, we were eventually able to settle the case for $1,000,000.00 shortly before trial. The settlement funds were placed in to annuities providing the children with a substantial monthly income for the next 20-30 years. Food, shelter, clothing and a good education are now available to our three young clients. Of note is the fact that this settlement was obtained after the other side originally denied the claim.

[$3,347,000.00] A young man who sustained serious injuries and head trauma- Our young client was involved in a head-on collision. Two trucks had been racing and struck our client's vehicle. The two responsible drivers were inadequately insured and our client's own insurance company refused to pay his $30,000.00 underinsured motorist coverage limits. We demanded arbitration with the insurance company and ultimately received an arbitration award of $865,000.00. We then filed a first party bad faith lawsuit against our client's own insurance company and during a mediation prior to trial, settled the bad faith case for an additional $2,500,000.00. The same insurance company which refused to pay our client $30,000.00 eventually paid a total of $3,347,000.00. Of note is the fact that this settlement was obtained only after our client's own insurance company originally denied paying the small $30,000.00 claim. [$5,000,000.00] Woman attacks father and murders son- While sleeping, our well-known client was attacked in the middle of the night by a female acquaintance with a knife. With his face, throat, arms and upper torso deeply cut and slashed, our client fought for his life and was barely able to crawl outside of his home for help. During this time, the woman unbelievably and unpredictably grabbed another knife and murdered our client's son. This woman has since been convicted of murder and will spend the rest of her life in prison. Our civil case against the defendant was resolved by stipulated judgment for $5,000,000.00. [$2,000,000.00] After 2 years of litigation, Jon Mitchell Jackson of Jackson & Wilson, obtained a $2,000,000 judgment against a defendant driver who was operating his motor vehicle while under the influence of alcohol or drugs. The defendant was operating his motor vehicle on the winding Big Bear highway (SR 38) near Big Bear, California. He approached our client from the opposite direction and without warning,

swerved across the double yellow lines striking our client. As a result of the defendant’s wrongful conduct, our motorcycle riding client sustained major injuries which included left side injuries, minor head trauma and a severed left leg just below the hip. In addition to the $2,000,000 civil judgment, the defendant was prosecuted criminally and convicted of violating California Vehicle Code 23153(A) (driving a motor vehicle while under the influence of alcohol or drugs). As a result of his conviction, the defendant was also ordered to pay restitution to our client. [$1,200,000.00] Special forces retiree hit while riding motorcycle- Our wonderful client had recently retired from the military after 30 years of service in the special forces. While operating a motorcycle, he was struck by a teenage driver making an unsafe left-hand turn. We were able to mediate a settlement shortly before trial for $1,200,000.00. Prior to the mediation, no offer had been made by the defendant. [$900,000.00] High school track star drowns- Our clients were the parents of an 18 year old high school senior who drowned in Lake Mission Viejo while swimming with friends. This outstanding athlete had just received a scholarship to run track in college. We retained the top lifeguard expert in the United States and with his guidance and help, were able to settle the case before trial for $900,000.00. The defense attorneys originally took the position in open court and on the record that they did not feel their client was legally responsible for the death and as such, would not pay a penny to settle the case. [$1,250,000.00] Jet ski rider dies in head on watercraft crash- A 16 year old expert watercraft rider was struck by another adult jet ski operator at Lake Havasu, Arizona. We were retained by his parents when the original accident report indicated that the minor was at fault and had alcohol in his system. We were surprised with the findings in the official repot because we knew of at least two witnesses who observed the other rider cause the accident and, the minor did not drink alcohol or use drugs. Our investigation then established that the blood test results in our accident report were from another case and had nothing to do with our accident. Despite this fact, the defendant only offered $1.00 to settle the case (an insult to our family) and we were forced to take the case to trial in Federal court. After about a one week trial, a jury came back with a gross verdict for our parents in the amount of $1,250,000.00. Mr. Jackson was profiled in a full-page article in the California Daily Journal for his work and verdict relating to this case.

was attacked and bitten by a dog owned by their neighbor and who also happened to be a lawyer. At the time of the attack, the mother reached down to pull the dog off of her son. The dog turned, grabbed the mother by the throat and pulled her to the ground. The owners of the dog were not cooperative and the family was forced to litigate the case which resulted in a $500,000.00 settlement. [$2,759,852.00] Driver runs red light- A negligent driver was not paying attention, ran a red light and caused a serious accident. Our client was seriously injured and after the responsible driver's insurance company refused to make a settlement offer, we were able to obtain a judgment for $2,759,852.00. [$1,000,000.00] Two teenagers were killed in a head on collision- Our clients' teenage children both suffered fatal injuries after being involved in a head-on collision. The insurance company for the other party originally denied responsibility for the accident but to get the matter settled, offered what they claimed was their insurance policy limits of $100,000.00. We rejected the offer, filed a lawsuit and litigated the case. During the discovery process, we discovered that the other side had additional insurance coverage of $1,000,000.00 which was never disclosed to us during the settlement discussions. After multiple pre-trial settlement conferences, we were able to settle the case for $1,000,000.00. [$1,152,926.00] Legal malpractice case against a negligent attorney- Our client was a victim of medical negligence and hired an attorney to protect her and to represent her interest. He failed to do his job and her case was dismissed barring her from forever pursuing her claim against the negligent doctor. The client came to us and we immediately learned that this was not the first time this attorney had caused problems for a client. We filed a legal malpractice case against the negligent attorney and obtained a judgment against him which today, with interest, is valued at more than $1,152,926.00. [$400,000.00] Exploding gas tank causes fatal injuries- Our clients' mother was hit from behind while stopped on the freeway. Her car exploded and she died in the fire. After settling the case against the driver who rear-ended our client, we then filed a product liability case against the manufacture of the automobile our client was driving at the time of the accident. The product liability portion of this case settled for an additional $400,000.00. [$330,000.00] Dog bites part of finger off- While walking his dog, our client and dog were attacked by a pit bull being. Part of our client's finger was bitten off and he sustained other serious injuries. Our client's dog was also injured and required two surgeries. The owners of the pit bull refused to cooperate and we were forced to file a civil action against them resulting in a judgment of more than $330,000.00. Within weeks of the judgment being entered, the defendants delivered a personal check to our office to satisfy the judgment and interest. [$325,000.00] Driver reaching for cell phone runs red light- Our client was injured when her car was struck by a small truck which ran a red light when its driver was not paying attention and was reaching for his cell phone. The entire accident was captured on a video surveillance tape which happened to be running in a near by store. Despite all of this evidence, the insurance company for the other side did not make any settlement offers and instead forced us to arbitrate

the case. An arbitration award of $325,000.00 was rendered in our client's favor and rather than pay the award, the other side's insurance carrier appealed the judgment to the Second District Court of Appeals. Our client prevailed at the appellate level and the judgment was paid. [$20,000,000 Defense]- Client was sued for more $20,000,000.00- We were asked to defend a business which was being sued for more than $20,000,000.00 for an alleged improper use of software . There was only $1,000,000.00 in liability insurance coverage and so if we lost this case, our clients' would loose everything. Because of the plaintiff's wrongful conduct, we filed a cross-complaint alleging similar damages against the plaintiff and also obtained an immediate injunction shutting down the plaintiff's business, marketing and sales. Our aggressive defense resulted in the case ultimately settling for a nuisance value and resulting in one very happy client. [Criminal Defense- Not Guilty]- Client criminally charged with nine felonies- We provided legal criminal defense services to a world class surfer wrongfully accused of nine felony counts. If found guilty, he was looking at a mandatory sentence of 3-12 years in state prison, a strike and registration as a sex offender. The District Attorney's office did not make any acceptable settlement offers and we were forced to defend our client at trial. After a one week trial, the jury came back with a verdict of "not guilty" on all nine charges. After the trial, several of the jurors were in tears and asked, "why did they charge our wonderful client with these horrible crimes?" [$300,000.00 Business Defense]- Business woman sued for more than $300,000.00- We provided a defense to our client in a civil case where she was accused of breaching a written contract with her past employer. The plaintiff had alleged damages of more than $300,000.00. After a two week trial, the jury came back in favor of our client and award the plaintiff nothing. One juror commented after the trial that based upon the evidence we presented, our client was the "brains" of the operation and the plaintiff should have never let her go (we agree). [$300,000.00] Defendant writes personal check for $200,000.00- In this case our client was involved in an automobile accident with the defendant. The defendant only had a $100,000.00 liability policy. We aggressively litigated the case and at the pre-trial mandatory settlement conference, we were able to convince the defendant to add an additional $200,000.00 on top of the already offered $100,000.00 policy for a total settlement of $300,000.00. Many more cases resolved for $100,000.00 or more- The above cases represent only a small number of the total cases we've been able to help our clients with.
