Article II Organization

Section 4

Each Chapter chartered in accordance with and under the provisions of these Bylaws will be subject to the provisions of the governing documents, rules and policies of this Organization, and shall:

a) adopt a set of bylaws, which must not conflict with the Articles of Incorporation, or Bylaws of the National Organization (Any amendments to the Bylaws of the National Organization, which pertain to Chapters, shall automatically become a part of the Bylaws of each Chapter);

Article V

Duties of the National Executive Board

Section 1

The National Executive Board shall have full power and authority over the affairs of the Organization within policies established by the annual National Convention and when the convention is not in session.

1. Does this mean the Executive Board can change or alter the Bylaws to suit the organization on when they must be submitted in order to accomplish its goals?

2. If not what does it really mean?

Article VI Conventions

Section 1

The governing body of the Organization shall be its annual National Convention. This National Convention shall be for the purpose of establishing organizational policy, for receiving and reviewing reports, for electing officers and for the consideration of other business.

1. Don’t the State Chapters who vote at their state convention on National Bylaws violate the National Bylaws Article VI Conventions Section 1?

Section 6

Each Chapter shall be entitled in a National Convention assembled to one (1) vote for each ten (10) active members, or major fraction thereof. Five (5) active members shall constitute a major fraction.

a) On any voice vote, each active member registered and reported in good standing by the respective Chapters shall be entitled to vote.

1.(a) Does this mean only those that are present in the room can vote when the vote is taking place or all that are registered for the convention can cast their vote somehow even if some have left?

b) On any roll call vote, the vote shall be cast in accordance with each Chapter’s own decision as to method.

I’ve asked our National Executive Board to ask questions during the National Parliamentarian Review. The questions are as follows:

1.(b) What does “On any roll call vote, the vote shall be cast in accordance with each Chapter’s own decision as to method” mean? Does it mean you can vote at National or State?

2. Does it also mean you can block vote or percentage vote?

3. Does it mean both?

Article VIII Committees

Section 3

There shall be a committee on Articles and Bylaws. This committee shall continuously review the governing documents and recommend proposed changes, which shall be placed on the agenda of the National Convention for consideration.

1. How are States available to vote on National items at their Chapter Conventions when they take place prior to the submitted changes being added to the National Convention agenda by the committee as Article VIII Committees Section 3 states where they should be considered?

Article X Amendments

Section 1

All proposed amendments to these Bylaws must be submitted in writing to the National Office at least sixty (60) days prior to the opening of the annual National Convention of the Organization. The proposed amendment or amendments to the Bylaws shall be published prior to the National Convention at which they are to be considered.

1. How are State Chapters able to vote on proposed amendment changes when Article X Section 1 states “The proposed amendment or amendments to the Bylaws shall be published prior to the National Convention at which they are to be considered?

Section 2

All proposed amendments to these Bylaws must be considered by a Committee on Articles and Bylaws, which shall make a recommendation to adopt or reject the proposed amendment.

How can the Executive Board create a policy where the Executive Board has the authority to recommend to adopt or reject the proposed amendment without the approval of the governing body at the National Convention or change the date of when proposed amendments have to be submitted by?

Section 3

All amendments shall be read at one session of the convention and acted upon at a subsequent session. No amendment to the Bylaws shall be deemed to be adopted unless supported by two-thirds vote of those having voting privileges.

Does this mean of those in the room that have voting privileges at the time of the vote or those that are registered for the convention where the vote is taken?

Section 4

Unless otherwise specified, the effective date of an amendment so adopted shall be immediately upon the adjournment of the convention.

ADDITIONAL QUESTIONS

At the National Convention end when the convention was adjourned, does that mean whether the findings of this review find proper or not, that all the Bylaws will have to be resubmitted again?

When the criteria is set for proposed amendment submissions, can the criteria violate the Bylaws currently in place?

What is the proper criteria to follow for changes to be considered and shouldn’t the example given replicate the literature describing it?

Block Voting - Growing Pains or Death Knoll?Will block voting be a growing pain that UPMA

resolves or will it be the beginning of the end?

So, what is block voting. Block voting is taking the majority vote and casting all the earned electoral votes for that state toward the majority winning candidate. While this may seem a simple majority rules democratic tradition, I believe I will show that this is far from the truth and is a method being used to corrupt our voting rights and disenfranchise the minority opinion and will most likely lead to less participation at meetings engendering less membership i.e. death knoll of UPMA. For without membership and the participation of the membership this organization will cease to exist.

First the rules: Robert’s Rules of Order Article VIII Voting has no reference to block voting. UPMA National Election Policy has no reference to block voting. In fact, none of the posted UPMA National Policies and Procedures at UnitedPMA.org even has the word “block” in it. Some states Bylaws specifically allow block voting. Some states have voted in session to allow block voting for a particular election even though their Bylaws state they must vote by percentage. This has been allowed and certified legitimate by the National Board representative at the State Convention.

Block voting has been used to sway the total electoral vote in larger states all to one candidate. Thus, in the national election totals, even though the winning candidate may not have the representative vote to win, they had the electoral count to win. While this may be exactly what someone wants, or may be what a state wants to have more than their fair share of voice in deciding an election or a constitutional issue, by corrupting the process it can have dire effects. Without elimination of block voting, eventually all states will have to block vote just so their winning candidate has any chance at being elected. This eliminates all minority votes from the national electoral totals.

How does this work? Take a fictional state with 38 electoral votes (based on total membership). In the election at the state convention, 47 percent cast their vote for candidate A and 53 percent cast their vote for candidate B. In a block voting system, because Candidate B won the raw vote, he receives all 37 electoral votes for that state, while Candidate A receives 0. In a percentage vote, Candidate B gets 20.14 votes and Candidate A receives 17.86. Every vote that was cast actually gets

counted in the state electoral total and in turn gets counted in the national electoral total.

Expand block voting across 3 large electoral count states all with a majority for one candidate and the marginally winning candidate now has 100 or more votes while the slightly loosing candidate has 0 (zero). When elections are only 25 states or so, overcoming a 100-vote head start with non-block voting states is almost impossible as the difference is generally a close vote as it was in the 3 block voting states. If the average spread is just 3 votes as in the above example, it would take 34 states all voting the same way to overcome the 100-vote head start. There are no longer 34 states voting in East or West elections.

When the minority voice is not counted and in fact their earned electoral votes (by their membership in UPMA) are actually cast diametrically opposed to how they voted, their motivation to continue to participate and maintain membership will be reduced. Over time this will mean fewer attendees, less diversity and fewer members as minority opinion member’s voice is not counted. With another management organization suing in federal court for the right to represent Postmasters and Manager members of that organization that they currently cannot do, UPMA may no longer be the only representative Association in town.

UPMA is better served in the long run to embrace diversity, to make every vote count, to hear every members’ voice and to demonstrate integrity in the decentralized voting process at state level. Integrity requires the best of all us every day, including our elected officials. Lust for power over elections will lead to rampant block voting across most states just to be heard as much as possible. This will lead to a homogeneous organization bereft of diversity and new ideas, with declining participation and membership.

I am therefore going to pursue a National Bylaw prohibiting block voting in any state.

When it is your turn to vote, make sure your vote will always count.

Dave Cook, Frank Kouba, Cathy Winnie and myself attended the New England Conference, as NY was invited this year to be part of it. We aren’t members as of yet but should be voted in at this year’s Legislative Session. There was training provided. We heard from the Northeast Area VP on how the NE is performing and how they considerably raised the amount of our members who will receive raises or payouts compared

to last year. We heard from our National President, Dan Heins, on current concerns and addressed some National concerns. We heard from our legislative representatives on those concerns and where we are with any bills. The Maine Chapter hosted a good conference and I want to thank them for inviting us to participate. We shared many concerns about our organization; where we intend to go and how we are to get there.

We had a productive Fall Conference in Cazenovia, NY. The site of this coming years convention is a nice area, provides for a free breakfast every morning and the staff seems very friendly. We will be looking at setting up some training on various subjects, having a reception and trying something a little different this year. Information will be coming out as soon as solidified. We renewed several incentives that will be in another article. We should be looking at Thursday afternoon for Convention free time to see the area with training Friday and Saturday afternoons.

As both the Northeast Area Coordinator and as the 1st District Coordinator for New York, I get calls just about every day about some type of Postmaster issue. If they are members, I try to do all I can to get a resolution to their issue, and if the caller is not a member, I will help, but I also get them to join our great organization.

I also get calls from members wanting me to notify the national President or national office of some wrong that is happening to Postmasters in a certain area. UPMA has a protocol for those issues, for a good reason. Just as you would not want one of your employees to go to your POOM about a problem without giving you a chance to resolve it, your POOM or District Manager would feel the same way.

When you have an issue with your POOM or DM, the proper way to deal with that issue is to meet with your boss yourself and try to resolve the issue. Many times, the POOM may not realize what is happening, and will fix the problem without any delay. There are also times that he or she may be the problem, but they don’t see it that way.

In those cases, that is where either your UPMA District Coordinator(DC) or your State President comes in. Refer the issue to them, along with all data and copies of emails, letters, and etc. to show where the problem exists. Also send the results of your prior contact on the issue with the POOM or DM. Sometimes, there may only be a problem in perception on the part of the Postmaster, and the DC or President will try to show the Postmaster what can resolve the issue.

If the problem can be validated, the DC or President will take it to the POOM or DM for you, but they will expect to see that you have already tried to resolve it at the lowest level. Once the DC or President has met with

upper management, they will report back to you on the results. If the results are not sufficient to resolve the problem, the DC or President will escalate the problem to your Area Coordinator. UPMA uses an issue tracking form, and that needs to be completed by either the DC or President and is referred to the Area Coordinator for action.

The Area Coordinator will then meet with staff at the Area level to try and resolve the issue not only for that District, but hopefully will set a precedent for all Districts in that Area. If successful at that level, the issue is reported to the national office as being resolved, and the tracking form will be noted at UPMA HQ.

However, if the issue cannot be resolved at the Area level, then and only then will President Dan and the national office work on the issue with Postal Headquarters. Again, Dan does not want to bring issues that only apply to one district to HQ unless we have exhausted all attempts locally to resolve the problem. The reason for that is that the President and national office want to maintain a reasonably positive relationship with Postal Headquarters, and bringing small local issues to the table will hinder our attempts to get the larger issues, such as dignity and respect for postmasters heard at the national level.

Please remember this article and take heed of it as you ask your State and Area officers to resolve issues for you as a member. Take it to your boss first, document all responses, and then refer it to your District Coordinator or State President with full data and documentation. They will take the ball from there and will see that it gets to the proper channels until it is resolved, hopefully to your satisfaction. Remember though, the issue has to be something reasonable.

2020 Elections—Three positions will be open—Executive VP, Chapter Member Rep VP and Secretary/Treasurer. All are a 2 year term.

Budget—Motion made by Cathy W. 2nd by Rachel R. that the Sec/Treas position receive a payment of 3% of monthly dues, on a quarterly basis, beginning Jan 1, 2020. When a new Sec/Treas takes office, payment is prorated based on time of service. Discussion. 1 opposed. Carried.

As I sit here working on this article, the Northeast as well as other parts of the country are experiencing an early winter weather scenario.

Just like this cold blast, it seems peak season sneaks up on us all. I don’t understand why we aren’t prepared at times, Thanksgiving comes each November, but it’s late this year. I have heard my holiday shopping season is now too short. Christmas has been December 25th each year of my life.

It’s all in preparation. There will always be intangibles but if you have a plan at least you’re ahead of the game. Your plan should have allowance for unexpected events. I know, much easier said than done.

The Postal Service works on narrow margins of profit and we don’t have a bullpen of replacements. Staffing in some areas is near impossible at times just to cover. Each AO operation is unique in some way, but ultimately we do the same job of delivering.

I have said this, I don’t know how many times, but for new managers, network with your surrounding offices. It doesn’t always work, but it is one of the most effective ways of succeeding. Reach out to other facilities and try to partner when you can. It may be loaning an employee, even a vehicle.

I have heard and seen too many times, an office or manager, “hiding” their help. Their employee dictates to them what hours and where they will work. The district can run the reports to see when this happens. Please don’t operate like this. We all take turns being the one in need.

Especially during peak season, we need to partner and assist each other where we can.

I hope that each of you finds a way to enjoy the season a little even with all the demands on us.

Earlier this fall I attended the 4th district meeting and was pleased to see the involvement of our District Manager, Henry Dynka and his staff. Apparently other districts had them in attendance as well. This is encouraging. It allows us to put a face to a name and hear firsthand what they feel we need to focus on. It also opens up channels for feedback to the district.

Can you believe it? Where did the year, the last ten years, the last 20 years go? Some days in the PO now seem so long with all the added tasks and directives, then in the blink of an eye, you’re in for 20 years.

Most of us are saying, it’s a good thing we’re at the end of our career instead of just starting out, but why? Why have things changed so much? Why have we gotten away from the simple ways of doing business? Why does it feel like there are a million eyes on everything we do, and we are questioned at every turn?

Lately we have been given directives for different parts of our daily operation that would have always been under the category “manage the business”, or in other words be a Postmaster. Without a good explanation of why, these directives come across as demeaning and frankly uneducated. Who knows our offices better than we do? Who knows the quirks that can make a day go well, or quickly bad? Who knows how to juggle last minute staffing shortages, broken down vehicles, late mail trucks, weather issues, and cram it all in before you open your window!

PLEASE, could we get back to a little dignity and respect?

Moral can sink SO fast when there is not a mutual dignity and respect at every level…we tell small children “you get what you give”…you give respect, you get respect..you give rudeness you’ll probably get rudeness…

It doesn’t have to be this way, we are all problem solvers….

LET US BE PART OF A WAVE OF CHANGE FOR THE BETTER!

We should not hear at meetings that some of us are looking for new employment outside of Post Office, especially nearing the end of a good career. Does that not tell our upper management or organization that something is extremely wrong? We’re willing to give up committed employees that easily, and not try to fix the problems? Come on!

So, what are we to tell the new folks that are coming up behind us? How, or will they stay 20 years…. change is the answer, change….

Everything is changing so fast, and the focus seems to be changing from taking care of our own, to taking care of DATA….and the up and comers are much more used to a DATA driven world.

Let’s remember though…DATA isn’t wonderful to customers at the counter, DATA doesn’t mentor new employees, and DATA surely doesn’t care about a post office crew. And that’s what drives good performance?

Let’s hope that in 2020, we can drive CHANGE, CHANGE for the better for every Postmaster. We ALL deserve it.

When the last three slides of the telecom are about you, it can’t be a good day or can it? It was a great day for Accord, New York Postmaster Cathy Winnie since it was her retirement day and those last three slides were congratulations and best wishes. That kind of tribute tells you how valuable Cathy was to her MPOO. The sign on her lawn said, “The Legend has retired” and over 100 attendees were there the following day for a huge retirement party, to show how valuable Cathy is to her peers, her community, her family, friends and UPMA.

The huge cake in the shape of a post card celebrated the 40 years of service and summed up much of the Cathy Winnie story.

Life is too short to wake-up with regrets so love the people who treat you right, forgive the ones who don’t and believe that everything happens for a reason. If you get a chance, take it! If it changes your life, let it. Nobody said it would be easy, they just promised it would be worth it. Dr. Seuss

Cathy started her career on Long Island as a clerk at Glenwood Landing. Her Dad was a New York Detective, perhaps that’s where her passion for advocacy begins. Cathy moved to a city carrier position and then a clerk position in upstate New York at Kingston. She settled into marriage, a family and a Postmaster position. She became active in the League and brought her daughter, Katie, to a meeting when she was only a few weeks old. Jamie, her daughter, came along and followed in the convention adventures. Unfortunately, her husband Butch passed away while the girls were still teenagers. As a young widow, with two daughters, it would have been easy for Cathy to focus all of her time and energy close to home but she chose to set the example of how family and faith can allow you to become a positive role model through your work ethic, community service and organizational involvement. Today both daughters have graduated from college and are pursuing careers of their own.

Cathy’s postal career includes Postmaster positions in Esopus, Shokan, Ulster Park and Accord. Almost

immediately after becoming a Postmaster, Cathy’s role as an Adverse Action Counselor began. She was trained by NLPM Attorney, John DiFalco and for over three decades, she has been considered an accomplished advocate for members. One goal of great leaders is to replace themselves. Mentor those to carry on in your footsteps. Cathy has worked toward that goal for years teaching adverse action classes across the nation. Those trainees have been representing members too, so her legacy of advocating for members has assisted hundreds of members and saved jobs.

In the New York Chapter she has served as Secretary/Treasurer and Vice President. She was honored with New York’s Postmaster of the Year award and named to Jim Merritt’s New York Iron Maidens. Cathy served as National Vice President for both NLPM and UPMA.

Cathy’s community service includes a long list of school and athletic organizations as her daughters, Katie and Jamie were growing up. She has just finished her tenure as Lion’s Club President to coincide with her retirement.

Attendees came from across the nation to celebrate because Cathy Winnie has been more than just a co-worker. Comments from the retiree party included, “You could always call on Cathy to step up”; “You couldn’t find a better friend”, “ You can always count on Cathy to help” and “She always had a Pat story” referring to her Mom. Rarely do you find someone that in every way exceeds expectations, Cathy is that kind of friend and mentor. While it will be New York’s loss that she plans to travel during her retirement, the great news is she is always just a phone call away. For UPMA members, she is only moving from the Active membership to the Retirees and she will continue to do what she has always done.

If you have ever received an email from Cathy, at the bottom you would have seen her motto. When you have been blessed with knowing the real Cathy Winnie, you may believe that often one is all you need!

The Frank & Helen Burger Scholarship has awarded 85 scholarships since 1994.

The Edwin D. Jennison Sr. Memorial Scholarship is established in memory of Ed Jennison, long time Postmaster of Milton NY.

Help a young person achieve his/her goal of obtaining an academic certification or college degree. Make copies of the application and pass them on to your children or grandchildren. Remember to tell them that the scholarships are possible because of active and retired UPMA members like you!

This is to inform you of the upcoming Legislative Summit 2020. The dates of the Legislative Summit are Sunday February 23 thru Wednesday February 26. The New York delegation along with the rest of the country will be visiting Capitol Hill on Tuesday February 25. President Dan, at a recent executive board meeting has approved a $500.00 incentive for all members that arrive on Sunday and attend the 5:00 pm UPMA NYS information meeting. You must also attend the Monday morning meeting scheduled to be held at the Renaissance Hotel and the afternoon briefing scheduled to be held at the Capitol Visitors Center. After attending these meeting, you will be fully prepared to meet your representatives. You will be able to intelligently discuss the issues that affect the Postal Service and all Postal

employees. Most of all, attending the Legislative Summit you will experience a great time. You will return home with a new enthusiasm and a better outlook on your job. I have been making the trip to Washington D.C. for many years and I look forward to making the trip for many years to come. So, get your registration in now ($30.00 until January 15), and make your reservations at the Renaissance Arlington Capital View Hotel, 2800 South Potomac Avenue, Arlington Virginia (703) 412 1300 (room rate $169.00/night for three nights). The Downstate Perspective

Well, we just came through our series of district swings. I was able to attend 4th and 5th District swings and was very impressed by the organization, speakers attending, and the great showing by our membership. There was a lot of info shared both by the presenters and by the attendees back to management. I owe 3rd District an apology- I was scheduled to attend but got stuck overnight in Pennsylvania (an unplanned stay-AAARRRGH!!!) for my part-time retirement job. At any rate, it was great to network and visit with my UPMA brothers and sisters at the swings.

This does seem to be the season for gathering. As I write this message, today is Veteran’s Day. Not only did I take advantage of specials for veterans (my wife was especially fond of the free carwash LOL!:-)) but I also had a chance to visit with some fellow veterans in a couple of shops I visited. Thank you again to all of our veterans for your service to our country. It seems that wherever you go, you can always find a chance gathering of veterans who don’t know each other but share a moment of

friendship and comradeship with each other. We are truly blessed to have an organization like UPMA with so many veteran members.

Finally, before long the holiday season will be upon us. The Thanksgiving meal will hardly be cool before the USPS kicks off the holiday season with the traditional Black Friday rush, millions of holiday cards, and the last-minute shippers who want it there the next day but don’t want to pay for Express Mail.

After a brief week’s respite between Christmas and New Year, the 2nd Quarter gets into full swing and Legislative is just around the corner.

Whatever you do this holiday season, make some time to gather with friends. If you can’t meet, try a phone call or, better yet, a real letter or holiday card. You might just brighten the day of someone in need of a friendly smile, story or thoughtful gesture. May you all have a Blessed Holiday Season and a Happy, Healthy New Year. The 2020 UPMA Legislative Summit will take place February 23rd – February 25th in Washington, DC. The accommodations are at the Renaissance Capitol View Hotel in Arlington, VA.

I just want to highlight what happens at this Summit.Sunday evening, the NY state delegation will meet

and discuss the plan to speak with our representatives, Senators and Congressmen, on the Hill. That means you meet with your own representatives or their aides. You will also have the opportunity to go with others to their representative meetings.

On Monday morning, after a 5-star breakfast at the hotel, we will take the Metro to a meeting room which UPMA organizes. There speakers which support Postal Bills will inform us on the issues. This prepares us to speak to our Representatives on Tuesday.

Monday evening, we are on our own. Sometimes we go out together for dinner to one of the excellent restaurants in DC or Arlington. There is also time to enjoy

the many sites such as Arlington National Cemetery, the many museums and monuments or any other attractions in the DC area. Arlington Cemetery is very interesting. There is a lot of history there, including John F. Kennedy and many more war heroes that are buried there.

Traveling to DC is always a fun adventure. In the past we have driven down, but this year my friends and I have made plans to take the train from Penn Station to Union Station. It is very affordable and you don’t have to worry about driving conditions. You can also sleep on the train since you are not driving. I know Frank Kouba can sleep just about anywhere!

On Tuesday, we again will take the Metro into DC and meet with our representatives to tell them about our concerns on Postal issues Don’t forget to bring a camera so that you can take a picture with your representatives. That evening is again “free” time where you can visit the many sites or just hang out with UPMA friends from around the country.

I feel great after attending this event and feel a very real and satisfied feeling of accomplishment!
