Tracy,

Would you please send me information on how and when Board members are chosen for the UBSGWMD. If you have a document outlining the requirements, terms, etc. that would be very helpful.

Thank you,

QUESTION:

PLANNING COMMISSIONER to Mr. Gil, Jan. 6:

“Were you trying to change the Board?”

PAYMENT TO EL PASO CO:$1.625 million, on June 27, 2014

•Critical parcel on elevated power line right of way before BOCC today, sold June 27, 2014

•Why Has Next Era Assumed, Since JUNE 27, 2014, That the 2015 Amended Zoning Overlay For the Elevated Power Line Was ALREADY APPROVED?

WHAT DOES A 679.5 FOOT ICE THROW SET BACK LOOK LIKE?

Ice Shedding and Ice Throw-Risk and Mitigation (GE 1.7)

(GE Safety Manual, pp 49-50)• Ice Throw Danger Radius = R

R = 1.5(hub elevation + Rotor dia)

R = 1.5(262.5 + 2x169) = 900 feet

• WHY IS THE ICE THROW SET BACK ONLY 679.5 feet ?

RISK MITIGATION(GE ENERGY GER 4262)

• GE: “Fences and Warning Signs…” ??– “In the event of falling ice, duck!”

– “If you don’t duck, not responsible for injuries”

• Detection of Ice by Sensors => 679.5’ ??– “With current sensor technology, ice detection is not

highly reliable” – GE Energy

– Falmouth, MA: Set Back of 646’ not safe

• Who will be liable for Ice Throw injuries? Land owner? El Paso County? Next Era?

Ms. Clark asked Golden West on Dec. 19, 2013: What happens if the PTC expires? Golden West did not answer the question…

Questioning by Planning Commission involved power, capacity factor, and other topics.

All statements made with respect to Next Era have been accurate and not misleading.

Recap: Unanswered Questions

1. Does Next Era plan to change, or influence, the (UBS) board?

2. Did Next Era assume that paying $1.625 million to EPC in June of 2014 would guarantee approval of the elevated power line?

3. What is the PUC C13-1267 Effective Load Carrying Capacity of the Next Era Windfarm? (Ans @ Item D.14 pp 4)

4. Considering GE’s “unreliable sensors” why did Next Era recommend an Ice Throw Danger Zone of only 680 feet?

5. Was the delayed public announcement of the elevated power line intended to deal with anticipated opposition from Falcon?

RECOMMENDATIONS:

•Preserve the property rights of Eastern El Paso County and Falcon residents in regards to clean drinking water, property values, and health and welfare.•First Choice: Repeal December 2013 approval of ZONING overlay based on critical new information impacting public health, safety, and welfare.• Second Choice: Deny amended Zoning Overlay based on same criteria as Planning Commission 6- 3 denial: “Public Health and Welfare”.
