The prisoners in Guantanamo Bay who are suspected terrorists, predominantly apprehended in Afghanistan and Iraq, were being held under military prisoner status, which meant they were not granted due process, which is a right belonging to all citizens of the USA, a recent Supreme Court decision decided that the prisoners were on American soil (although in Cuba, it is property of the USA‐therefore considered our soil), so they were in fact, entitled to due process, it won by the narrow 5‐4 decision (Justice Kennedy was the determining vote)

1. What events in the United States or other nations can you identify in which one or more of the rights in the Magna Carta have either been upheld or violated? Explain.
2. Should “due process of law be granted to all individuals” (Magna Article 39), even those that the United States classifies as “an immediate terrorist threat” (those in Guantanamo Bay). Why/why not?
