EXECUTIVE SUMMARY:
This report presents the recommendations of the last meeting of the Traffic Committee held
on 18 March 2016, for Council adoption. The minutes are attached for information.

RECOMMENDATION:
1. THAT the information regarding Delegated Authority items be received (4.1).
2. THAT a report be submitted to the next Traffic Committee detailing parking restrictions in
the area surrounding Bridgeview Avenue, Cammeray (4.2).
3. THAT a report be submitted to the next Traffic Committee addressing the issues at the
bend in Bridgeview Avenue, Cammeray and the issues with garbage truck access (Monday to
Friday) (4.2).
4. THAT the No Stopping sign 3.30pm-6.30pm Mon-Fri parking restrictions on the southern
side of Chandos Street and Alexander Street remain (4.2).

16. (4.4) Hamilton Lane - Kerb Adjustment and Associated Works
Report of Sustainable Transport Project Coordinator, Lindsay Menday Concept plans for proposed changes to traffic management in Hamilton Lane were considered at the 491st (06/02/15), 493rd (01/05/2015) and 497th
Further consideration of the matters raised has informed a new design concept for the site. The revised concept (“option 1”) includes adjustments to the intersection between Hamilton Lane and Marks Street, new signage and cycle route pavement marking. A second option (“option 2”) incorporating a mountable median island in addition to the above works was investigated and is also attached to this report. The median concept was in response to a customer request for this type of infrastructure as a means to enhance cycling safety. Discussion with Bike User Groups (BUGs) identified a level of concern that a median may create and additional cycling hazard.
(08/10/15) North Sydney Traffic Committee meetings. The changes proposed were in response to a cycle crash that had been reported at the site. At all of the meetings, it was determined by Traffic Committee that additional matters/feedback should be considered as part of a final design in response to matters raised by members of the public.
This report recommends construction of Option 1 subject to concurrence from Willoughby Council and the availability of funds. Recommending: 1. THAT the attached plan be forward to Willoughby Council for consideration by their traffic committee. 2. THAT subject to relevant approvals being received from Willoughby Council, that line-marking, signage, pavement markings, kerb realignment and associated landscaping as shown on the attached plan (Option 1) be installed in Hamilton Lane. Resolved to recommend: 1. THAT the attached plan be forward to Willoughby Council for consideration by their traffic committee. 2. THAT subject to relevant approvals being received from Willoughby Council, that line-marking, signage, pavement markings, kerb realignment and associated landscaping as shown on the attached plan (Option 1) be installed in Hamilton Lane. 17. (4.5) Line marking - West Street, Palmer Street and Ridge Street, Crows Nest
and Cammeray
Report of Sustainable Transport Projects Coordinator, Lindsay Menday Attached to this report is a line marking plan for West Street and Palmer Street. Both streets are part of the existing marked cycle network and popular routes for both local and regional cycling trips. West Street in particular is a key cycling route carrying up to 700 cycle trips per day. West Street was previously line marked with “shoulder” cycle lanes, which are being progressively removed and replaced in North Sydney as they potentially increase the chance of ‘dooring’ crashes (crashes between moving cyclists and the opening door of parked cars). This report recommended a new line marking layout be installed which is designed to reduce the likelihood of dooring crashes by encouraging cyclists to leave a gap to opening doors, it includes: • PS2’ bicycle pavement markings away from the ‘door zone’ • Edge lines to define the parking zone • A short section of marked on road cycle lane between Palmer Street and Amherst
Street • Sections of line marked chevrons to alert both riders and drivers of the door zone
high traffic areas and areas with high parking turn over Fully separated cycle lanes have been identified as the long term treatment for West Street, the line marking works are intended to enhance road safety and cycle route legibility in the interim period. Line marking is also proposed along Palmer Street to maintain cycle route legibility, and shoulder lane removal. It is also recommended in this report that the exiting shoulder lanes in Ridge Street be removed as part of these works and replaced with parking lane edge marking and “PS2” logos. The existing lanes on Ridge Street are narrower that current standards, thereby increasing the potential of ‘dooring’. Recommending: 1. THAT the proposed line marking/pavement markings be installed on West Street and Palmer Street. 2. THAT shoulder cycle lanes be removed from Ridge Street and replaced with parking lane edge marking and PS2 logos consistent with the guidelines set out in the NSW Bicycle Guidelines. Resolved to recommend: 1. THAT the proposed line marking/pavement markings be installed on West Street and Palmer Street. 2. 20. (7.1) Temporary Road Closure - Alfred Street South
Council’s Traffic & Transport Engineer informed the Committee of an application received for a temporary road closure in Alfred Street South for Saturday 2 April 2016 from 3am to 11pm to erect a tower crane. It was noted that Council has not previously approved a full closure of Alfred Street for this length of time and such closures have significant impacts on traffic flow, bus services and access to Milsons Point. The submitted traffic management plan was inadequate. Council’s Traffic & Transport Operations Manager advised staff would contact the applicant to provide a more comprehensive plan and to develop a plan that would minimise the impact on

No Parking restrictions allow motorists to stop for up to 2 minutes whilst remaining within 3 metres of their vehicle. Council Rangers have observed that whilst most motorists adhere to the Road Rules, it only takes one vehicle to stop to disrupt the flow of traffic.

The State Member for Willoughby has made representations on behalf of a resident of Bridgeview Avenue who has raised concerns about parking availability.
A recent inspection of Bridgeview Avenue found an average occupancy of 72%. Council generally aims for an average occupancy of between 80-90% to best make use of the parking resource whilst still ensuring motorists are able to find a parking space. The observed parking occupancy rates in Bridgeview Avenue are within Council’s targets.

Council has received a request from Cremorne Radiology Clinic for a disabled parking space or short-term parking to enable dropping off and picking up of mobility impaired patients and for emergency vehicles.
Parking in Cabramatta Road is generally restricted to 1 Hour and ½ Hour Parking. The parking is generally in high demand due to the surrounding commercial land uses. The parking directly adjacent to the Clinic is 1 Hour Parking. Past experience has found that disabled parking spaces in commercial areas are of little benefit to the person/persons who initially request them as mobility permit holders can park for an unlimited period of time. Where parking is limited to greater than 30 minutes a mobility permit holder can park for an unlimited period of time. Where parking is limited to 30 minutes a mobility permit holder

On inspection it was noted that there is approximately 12 metres of No Stopping on departure of the intersection of Spofforth Street. There are kerb extensions at the intersection which would increase sight distance and the No Stopping zone may be redundant.

A resident of Chandos Street has made a number of suggestions to improve parking availability in Chandos Street: • Change some 2 Hour
Parking spaces to ½ Hour Parking spaces
• Replace most of the unrestricted parking spaces with resident permit exempt parking restrictions
• Review the current No Stopping 3.30pm-6.30pm Mon-Fri heading west on Chandos Street
• Remove the motorbike parking spaces on Chandos Street due to underutilisation.
Council’s Traffic Engineers have investigated each of the suggestions. Chandos Street between Brook Street and Alexander Street has No Stopping 3.30pm-6.30pm Mon-Fri restructions on the southern side of the road. Brook Street has only on south-bound traffic lane. Chandos Street between Alexander Street and Willoughby Road has No Parking restrictions in the PM peak (southern side) and AM & PM peak (northern side). East of Brook Street there is a mix of unrestricted and 2 Hour Parking which has a combined average occupancy of 96%. This is a high occupancy and warrants a review. The PM peak west-bound traffic flows on Chandos Street are comparable to the AM peak west-bound traffic flows (around 1000 vehicles per hour). It may be possible to trial the removal of the PM No Stopping zone between Alexander Street and Brook Street. There is approximately 10 metres of

It may be possible that the motorbike parking was installed to improve sight distance at the intersection. However the conditions at the intersection are similar to many intersections throughout North Sydney where general parking has been maintained.

Council has received representations from St Thomas Anglican Church to replace 2 metered parking spaces on Church Street with No Parking Wedding and Funeral Vehicles Excepted. The Church states that an increasing number of buses are being used to transport guests to weddings and funerals.
Council has not supported on-street parking provisions for churches for many years. The reason being that the spaces would only be used occasionally by the Church and further reduces the limited parking resource that could otherwise be used by the general public. The Church as stated that buses are unable to be accommodated on-site, however there is an abundance of off-street parking at the Church and it is reasonable for mini buses to use these off-street areas for parking. There is an existing No Parking zone in front of the Church which can be used for short term parking, as well as a loading zone around the corner in West Street which can be used to drop off passengers.
1. THAT no further action be taken with regard to the request for a No Parking Wedding and Funeral Vehicles Excepted adjacent to St Thomas Anglican Church in Church Street.

Since the existing available parking space between the two driveways of No.1/31 and 2/31 is 9 metres and, when marked, is only suitable for one (1) parking space it is proposed to install parking for one car and to designate the remainder of parking for motorbikes only between the two driveways.

A resident has raised concerns with pedestrian safety at the intersection of Middlemiss Street and Arthur Street, North Sydney due to vehicles passing through the blind corner at an inappropriate speed. The resident has requested to install a Stop sign at the intersection.
Middlemiss Street and Arthur Street form a T-intersection at the railway underpass connecting to Pacific Highway. Middlemiss is one-way southbound with No Entry and One Way signs installed on the northern leg of the intersection. A GIVE WAY sign with TB holding lines currently exist on Arthur Street on approach to Middlemiss Street to warn motorists to slow down and give way to vehicles and pedestrians. However, it is alleged that there were near misses due to vehicles turning left from Arthur Street onto Middlemiss Street without slowing. A review of the RMS crash data for the most recent 5 years revealed no recorded accident at this location. As Middlemiss Street is one-way and has a low traffic volume, some motorists may tend to only check vehicles approaching from the right without slowing down to give way to pedestrians who may cross the road around the blind corner on the left. Changing the existing GIVE WAY control to a STOP control may improve driver’s awareness and reduce vehicle speed as they must stop the vehicle before negotiating the corner.
THAT the existing GIVEWAY Control at the intersection of Middlemiss Street and Arthur Street be converted to a STOP control.

Australian Standards 1742.2-2009, Clause 2.5.4, suggests that: “A STOP sign shall be used when, for minor road traffic, the sight distance, Y, in either direction along the major or uncontrolled road as shown in Figure 2.2 less than the distance given for the corresponding major road speed.” The RMS supplement for AS1742. 2 Figure 2.2, suggest that a STOP sign is used where a GIVE WAY sign is warranted and the sight distance is less than 90 metres for a major road speed of 50km/h. It is found that sight distance from Arthur Street left into Middlemiss Street is restricted to approximately 10m due to the limited offset from the kerb line to the underpass wall. The AS1742.2 further suggests that, “Where these conditions are met a STOP sign shall be used, regardless of whether a GIVE WAY sign would have otherwise been installed.” Accordingly, it is recommended that the existing GIVE WAY Control at the intersection of Middlemiss Street and Arthur Street be changed to a STOP control to improve pedestrian safety.

Concept plans for proposed changes to traffic management in Hamilton Lane were
considered at the 491st (06/02/15), 493
rd (01/05/2015) and 497
th (08/10/15) North Sydney
Traffic Committee meetings. The changes proposed were in response to a cycle crash that
had been reported at the site. At all of the meetings, it was determined by Traffic Committee
that additional matters/feedback should be considered as part of a final design in response to
matters raised by members of the public.
Further consideration of the matters raised has informed a new design concept for the site.
The revised concept (“option 1”) includes adjustments to the intersection between Hamilton
Lane and Marks Street, new signage and cycle route pavement marking. A second option
(“option 2”) incorporating a mountable median island in addition to the above works was
investigated and is also attached to this report. The median concept was in response to a
customer request for this type of infrastructure as a means to enhance cycling safety.
Discussion with Bike User Groups (BUGs) identified a level of concern that a median may
create and additional cycling hazard.
This report recommends construction of Option 1 subject to concurrence from Willoughby
Council and the availability of funds.
RECOMMENDATION:
1. THAT the attached plan be forward to Willoughby Council for consideration by their
traffic committee.
2. THAT subject to relevant approvals being received from Willoughby Council, that line-
marking, signage, pavement markings, kerb realignment and associated landscaping as shown
on the attached plan (Option 1) be installed in Hamilton Lane.

Background
Item 4.4 “Hamilton Lane, Safety Improvements” at the 491st Traffic Committee held on
06/02/15 related to a reported bicycle crash in Hamilton Lane, Cammeray. The bicycle crash
was reportedly a result of a vehicle „cutting the corner‟ while traveling southbound on the
section of Hamilton Lane immediately south of the intersection with Marks Street, causing
the rider to take evasive action which led to the crash.
A review of the site noted that traffic volumes and speeds were generally low in Hamilton
Lane, but that sightlines around the corner to the immediate south of Marks Street were
obscured and that some vehicles traveling southbound crossed into the northbound lane at
this corner.
It was recommended in the report on the item that additional centre line marking and RPPMs
be installed to improve lane delineation and reduce the risk of a similar crash. At the Traffic
Committee meeting on 06/02/15 it was resolved with respect to this item:
THAT the matter is deferred until the following Traffic Committee (20/03/15).
THAT Council conduct an investigation into all possible solutions including those
raised by the speaker John Whiteing. Areas for investigation to include but not limited
to:
Removal or trimming of vegetation
Car parking
Threshold
Humps
Signage
THAT a letter is sent to Willoughby City Council to invite Council to work on the
investigation together and to improve cycle safety between neighbouring Councils.
THAT Council wish John Whiteing all the very best in his recovery.
At a Traffic Committee meeting on 01/05/2015 further options were considered in response
to the above resolution and stakeholder feedback, including a concept design proposing that a
raised threshold, concrete median separator and additional line marking be considered on
Hamilton Lane close to the intersection with Marks Street. At the meeting, Traffic
Committee resolved:
THAT Council further investigate raised threshold and concrete median island
design(s) for intersection at Hamilton Lane/Mark Street in liaison with Willoughby
Council.
THAT advance warning signage/ markings be installed in Hamilton Lane on
approach to the raised threshold.
THAT local residents and local bicycle user groups are consulted on design(s).
THAT Council write to Mr Whiteing on the outcome and Council resolution with
regard to this matter.

In response to the above resolution, a further site meeting was held with local Bike User
Groups and a North Sydney LGA resident who had recently contacted Council about the
matter. At the meeting there were varied levels of support and some opposition to the
threshold, and mixed views regarding the benefits in terms of cycling safety. Based on
feedback received at the meeting it was determined to further investigate additional options
including:
1. Adjustments to the south west kerb of the intersection between Hamilton Lane and
Marks Street, to encourage drivers exiting Marks Street to make the turn from further
north, to lower over all speeds through the intersection, and better delineate
intersection priority.
2. The threshold as shown in the concept considered at the 493rd
Traffic Committee
meeting.
3. A threshold further south on Hamilton Lane to encourage slower traffic (inc. cycling)
speeds particularly in the northbound direction.
4. Further line marking to delineate vehicle movements exiting Mark Street.
5. The placement/layout of the proposed separator median concept considered at the
493rd
Traffic Committee meeting, which some identified as a possible cycle.
A revised design was prepared which proposed a combination of a line marked kerb
adjustment, short concrete separator median and additional line marking, pavement marking
and signage. At the 497th
Traffic Committee meeting it was further resolved that:
THAT the possibility of extending the kerb and using low planting to improve
cyclists’ visibility at the intersection between Mark Street and Hamilton Lane be
investigated.
THAT the proposed median island in Hamilton Lane be eliminated if vehicle
turning paths are affected (4.6).
The amended design concept (“Option 1”) responds to the above resolution. It includes a
kerb build out on the south west corner of Hamilton Lane, designed to slow traffic and
improve sight lines through the intersection by increasing the distance to the bend in
Hamilton Lane to the south.
Swept path analysis of the intersection confirmed that service vehicles (i.e. removalists and
garbage collection trucks) will not be able to access Hamilton Lane if both the kerb built out
and a median island is installed.
The kerb build out will require that large service vehicles cross the proposed line marked
centre lines to access Marks Street from Hamilton Lane. This is considered acceptable given
the very low traffic levels (average of 195 vehicles per day) in the street, the street has no
through access, and that service vehicle movement are likely to largely comprise waste
vehicle movements. Council‟s waste contractor has confirmed that the proposed layout will
provide satisfactory access for their purposes.
A second design option (“option 2”) was also prepared which includes a mountable concrete
separator island in addition to the above treatment. This design was prepared in response to
requests made by a member of the community for this measure to be implemented to
encourage vehicles to keep left when travelling south on Hamilton Lane and therefore
improve safety for northbound cyclists. Consultation with Bike User Groups (BUGs) and
other local cyclists during an on-site meeting highlighted concerns with the installation of a
central meeting on the grounds that it may create an additional hazard for cyclists. Based on

this feedback as such this report recommends against the installation of the median.
The works proposed also include the construction of a new pram ramp on the west side of
Hamilton Lane as none is currently provided opposite the exit of the public path way through
open space to the east of Hamilton Lane.
Line marking is proposed to compliment the new kerb works including new centre line
marking to encourage vehicles to keep left and PS2 cycle route pavement markings to
increase awareness and legibility of the cycle route.
Conclusion
It is recommended that the line marking/cycleway pavement markings, signage, kerb build
out and associated landscaping as shown on the attached „Option 1‟ plan be installed subject
to funding availability and support from Willoughby Council.

DESCRIPTION/SUBJECT MATTER:
Attached to this report is a line marking plan for West Street and Palmer Street.
Both streets are part of the existing marked cycle network and popular routes for both local
and regional cycling trips. West Street in particular is a key cycling route carrying up to 700
cycle trips per day.
West Street was previously line marked with “shoulder” cycle lanes, which are being
progressively removed and replaced in North Sydney as they potentially increase the chance
of „dooring‟ crashes (crashes between moving cyclists and the opening door of parked cars).
This report recommended a new line marking layout be installed which is designed to reduce
the likelihood of dooring crashes by encouraging cyclists to leave a gap to opening doors, it
includes:
PS2‟ bicycle pavement markings away from the „door zone‟
Edge lines to define the parking zone
A short section of marked on road cycle lane between Palmer Street and Amherst
Street
Sections of line marked chevrons to alert both riders and drivers of the door zone high
traffic areas and areas with high parking turn over
Fully separated cycle lanes have been identified as the long term treatment for West Street,
the line marking works are intended to enhance road safety and cycle route legibility in the
interim period.
Line marking is also proposed along Palmer Street to maintain cycle route legibility, and
shoulder lane removal.
It is also recommended in this report that the exiting shoulder lanes in Ridge Street be
removed as part of these works and replaced with parking lane edge marking and “PS2”
logos. The existing lanes on Ridge Street are narrower that current standards, thereby
increasing the potential of „dooring‟.
RECOMMENDATION:
1. THAT the proposed line marking/pavement markings be installed on West Street and
Palmer Street.

Figure 1 provides a map of these streets and connections to other parts of the cycling
network.

Both streets are part of the existing marked cycle network. West Street in particular is a
crucial north/south link for both local and regional cycling trips. Counts indicate that
sections of this route receive up to 700 cycle trips per day (equates to in excess of 200,000
trips per year).
West Street was previously line marked “shoulder” cycle lanes (refer fig 2.). This style cycle
lane line marking is now considered to increase the potential for collisions between moving

cyclists and the opening door of parked cars („dooring‟), as it encourages cyclists to ride in
the space immediately adjacent to parked cars. „Dooring‟ is identified as significant cause of
serious injury for cyclists particularly in busier urban areas. For this reason, Council is
progressively removing shoulder lanes from the North Sydney cycling network. Dooring
incidents along West Street have been reported to Council and in response to this shoulder
lanes were removed from sections of West Street during re-sheeting works in 2015. The
removal of remaining lanes is part of the works proposed in the attached plans.

It is proposed to replace shoulder lanes with a new line marking layout that will encourage
cyclists to ride a safe distance from parked cars, these line marking measures include:
Marking “PS2” cycle route pavement markings away from the „door zone‟, this
approach is now commonly use for mixed traffic cycle routes in North Sydney and
other parts of Sydney and has been recommended to Council by staff from the RMS.
In contrast to the previous shoulder lanes, these PS2 pavement markings will be on
the travel lane side of new parking edge lines. The parking edge lines will allow for
travel lanes of 3.25m which is appropriate for a mixed traffic cycling treatment
according to the NSW Bicycle Guidelines and will cater for the local bus routes and
school specials which use West Street
Line-marked chevrons to emphasise the „door zone‟ in areas with higher traffic
volumes and parking turn over
A line-marked dedicated bicycle lane is also proposed for southbound (uphill) travel
along West Street between Palmer Street and Amherst Street, the dimensions and
layout of which is consistent with similar facilities installed in North Sydney over the
last two years. The dedicated uphill lane will provide separation and protection for
cyclists in the uphill direction where they are most vulnerable due to slower speeds
and lower stability, and make it easier and safer for vehicles to pass slow moving
cyclists. A buffer is provided between the lane and parked cars to minimise the
likelihood of cyclist collisions with the opening door of parked cars. In the downhill
direction, bicycle speeds are more closely matched to vehicle speeds, making it easier
for cyclists to safely and comfortably travel with other vehicles and thus mixed traffic
is proposed in this direction

PS2 bike logo markings are also proposed along Palmer Street to maintain the legibility of
the cycling route.
An extract of the design concept showing typical treatments is provided in figure 3. An
image showing the uphill lane treatment proposed between Palmer Street and Amherst Street
is provided in Figure 4.

This report also recommends that these works also include the removal of shoulder lanes on
Ridge Street, North Sydney. The existing shoulder lanes on this street are narrower than the
current minimum standard, and „dooring‟ incidents have also been reported in this street. It is
recommended that these lanes be replaced by new parking edge lines delineating 3.25m lanes
and „PS2‟ pavement markings spaces in accordance with the standards set out in the NSW
Bicycle Guidelines.
All designs have been prepared in accordance with relevant Australian Standards, AustRoads
Guidelines, NSW Bicycle Manual, and RMS technical directions.
Conclusion
It is recommended that the proposed line marking and pavement markings be installed on
West Street, Palmer Street and Ridge Street.

This report provides details of current Car Share membership and usage data, and proposed

Impact on Parking: The recommendations propose the use of two (2) existing on-street
parking spaces as dedicated car share spaces.
DISCUSSION
Council supports Car Share schemes as they are identified in the North Sydney Community
Plan 2013-2023 as a way to encourage sustainable transport. Car Share schemes provide
potential benefits to the community as a whole, not just scheme members as they can:
Reduce the level of private vehicle ownership
Reduce pressure on parking, as one car/space can cater for many residents
Reduce traffic congestion caused by drivers ‘cruising’ to find parking
Car share schemes also provide a transport option for residents and community members who
don't or can't own their own car.
Membership and Usage
Membership and usage data from October 2014 to September 2015 is shown in the table
below. The membership figures indicate that resident and corporate membership increased
over last 12 months and that the demand and usage of car share cars is steadily increasing.
Membership surveys conducted by 'Go Get' have indicated that the schemes currently reduces
the demand for on-street parking by 1159 spaces across the LGA.
Goget conducted a member survey for 2014, and highlighted the following key findings for
North Sydney members:
75% do not own a car, and 65% would need to buy one (or more) if car share was not
available
63% take public transport to work and 18% walk to work
40% typically do grocery shopping locally and walk/carry their groceries home

Note: Off-street spaces are located on private land but accessible to all GoGet members.
Consultation Process
Council, at its meeting held on 5 August 2013, resolved to adopt a new process for notifying
the community of proposed Car Share installations prior to the matter being referred to the
Traffic Committee.
Each location is assessed by Council’s Traffic & Transport Operations staff to determine if it
is an appropriate location or not. If it is deemed appropriate, a temporary sign is placed next
to the proposed location as a notification that the location is being considered for a car share
parking space, the matter will be considered by the North Sydney Traffic Committee and
further information is available by contacting Council or via Council’s website. The signs are
installed at each location for a minimum of 2 weeks. An example of the sign is provided
below.
Recommended New Car Share Installations
A summary of consultation outcomes and recommendations relating to three (3) proposed car
share spaces is provided in Attachment 1.

16 January 2016 TO 26 February 2016.
Year to date (2016) Council had investigated 75 reports of abandoned vehicles.

ABANDONED VEHICLES PROCEDURE
The legislation covering this procedure is the “Impounding Act 1993”.
1 NOTIFICATION
1.1 Council can be advised of an alleged abandoned vehicle by any person. Details of the
allegation, including name and contact number of the notifier and the location of the
vehicle, are forwarded to the Administrative Officer, Abandoned Vehicles for action.
1.2 The Administrative Officer, Abandoned Vehicles will request a Ranger investigate an
alleged abandoned vehicle and report back in writing with an assessment of the
allegation and the condition of the vehicle.
1.3 A Ranger will determine, on the evidence available, if the vehicle is likely to be
abandoned and the Administrative Officer, Abandoned Vehicles will source the name
and address of the last registered owner through RTA vehicle records.
1.4 The Administrative Officer, Abandoned Vehicles will make a best effort to contact the
last registered owner by registered mail at the address provided by the RTA.
1.5 The advice given to the last registered owner in the registered letter is that the vehicle
has been reported as abandoned and that North Sydney Council requires
acknowledgement from the owner of this vehicle in accordance with points 1.6; 1.7; 1.8
and 1.9.
1.6 If the vehicle is unregistered, it should be removed from public roads to private property
or reregistered.
1.7 If the vehicle is registered, advice and acknowledgement that the vehicle is not
abandoned is required.
1.8 The owner of an unregistered vehicle shall be given a minimum of seven (7) calendar
days and a maximum of thirteen (13) calendar days from the date on the registered letter
to contact Council and acknowledge ownership and rebut the allegation of
abandonment.
1.9 The owner of a registered vehicle shall be given fourteen (14) calendar days from the
date on the registered letter to contact Council and acknowledge ownership and rebut
the alleged abandonment.
1.10 Movement of the vehicle at any stage after the notification at point 1.1 would indicate
usage and ownership and it would no longer be considered to be abandoned and
processing would cease.
1.11 If however, the vehicle has moved or has been claimed by its owner as not abandoned
yet remains unregistered, the Administrative Officer, Abandoned Vehicles will notify
the NSW Police that an unregistered vehicle is being used on public roads and provide
the details of the vehicle and its ownership so that enforcement action can be taken by

the Police.
2. IMPOUNDING
2.1 When a registered or unregistered vehicle’s last registered owner has not responded as
requested to Council’s registered letter within the timeframe stated at point 1.8 or 1.9,
the Administrative Officer, Abandoned Vehicles will commence procedures to
impound the vehicle
2.2 Prior to impounding the vehicle, the Administrative Officer, Abandoned Vehicles will
notify the Harbourside Police Area Command of the details and location of the vehicle
to be impounded.
2.3 The Administrative Officer, Abandoned Vehicles will notify the towing / storage
contractor of the details and location of the vehicle to be impounded and that contractor
will impound the vehicle as soon as practicable after that notification and deliver the
vehicle to their holding yard for storage.
2.4 Once impounded, the vehicle will remain at the contractor’s holding yard for a
minimum period of 28 days until Council advises the Contractor that it can be released
or sold at auction.
3. PENALTIES AND FEES
3.1 A penalty notice will be issued to the vehicle for the offence Abandon motor vehicle in
a public place. Offence Code 10661 LEU. (Impounding Act 1993 Section 632 (1))
3.2 If the registered owner wishes to recover an impounded vehicle, the abandoned vehicle
release fee as stated in North Sydney Council’s Fees and Charges, must be paid at which
time the location of the vehicle will be provided to the registered owner.
3.3 Before the Contractor will release an impounded vehicle to the registered owner, the
registered owner must pay to the Contractor any outstanding towing charges and
storage fees, which accrue daily.
4 DISPOSAL OF UNCLAIMED VEHICLES
4.1 When Council has held an impounded vehicle in storage for a period exceeding 28 days
without any contact or claim for the vehicle from the registered owner, Council will sell
the vehicle at auction with clear title.
4.2 If a registered owner makes claim for a vehicle that has been sold at auction, Council
will pay to the registered owner the amount at which the vehicle was sold less the
accrued total of the abovementioned penalties and fees attracted by the vehicle during
the period that it was held by Council.
