Registration of the applied-for mark is refused in International Class 009 because of a likelihood ofconfusion with the marks in U.S. Registration Nos. 2450445 and 3365819. Trademark Act Section 2(d),15 U.S.C. §1052(d); see TMEP §§1207.01 et seq. See the enclosed registrations. Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered markthat it is likely that a potential consumer would be confused or mistaken or deceived as to the source of thegoods and/or services of the applicant and registrant. See 15 U.S.C. §1052(d). The court in In re E. I. duPont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to beconsidered when determining whether there is a likelihood of confusion under Section 2(d). See TMEP§1207.01. However, not all of the factors are necessarily relevant or of equal weight, and any one factormay be dominant in a given case, depending upon the evidence of record. In re Majestic Distilling Co.,315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at 567. In this case, the following factors are the most relevant: similarity of the marks, similarity of the goodsand/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc. , 59 USPQ2d 1593 (TTAB 1999); In reAzteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq. For the following reasons, the examining attorney concludes that there exists a likelihood of confusionbetween applicant’s proposed mark, SSC (w/ design), for, in pertinent part, “Satellites; satellites forscientific purposes; satellite navigation equipment; apparatus and instruments for surveillance, remotecontrol, control and measuring of electricity and consumption of energy; surveillance programs (computerprograms); apparatus and instruments for control (supervision); radio transmitters (telecommunications);
base transceiver stations (telecommunications); telecommunication systems; transmitters(telecommunication); simulators for the steering and control of vehicles and craft; automatic steeringapparatus for vehicles and craft,” in International Class 009, and registrants’ marks,
SSC (Reg. No. 2450445 -- typed drawing/standard character), for “Computer software for1.communications over existing power lines and over RF links within buildings and vehicles, namely,embedded computer software or firmware for use in establishing and maintaining a protocol forcommunications over RF links and existing power lines; computer hardware for communicationsover existing power lines and over RF links within buildings and vehicles, namely computerhardware whose functions are packet assembly, channel access, modulation and demodulation.”

A. Similarity of the Marks In a likelihood of confusion determination, the marks are compared for similarities in their appearance,sound, meaning or connotation and commercial impression. In re E. I. du Pont de Nemours & Co., 476F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b). Similarity in any one ofthese elements may be sufficient to find a likelihood of confusion. In re White Swan Ltd., 8 USPQ2d1534, 1535 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP§1207.01(b). When a mark consists of a word portion and a design portion, the word portion is more likely to beimpressed upon a purchaser’s memory and to be used in calling for the goods and/or services; therefore,the word portion is normally accorded greater weight in determining whether marks are confusinglysimilar. In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1596 (TTAB 1999); TMEP §1207.01(c)(ii);see CBS Inc. v. Morrow, 708 F. 2d 1579, 1581-82, 218 USPQ 198, 200 (Fed. Cir 1983); In re Kysela Pereet Fils, Ltd., 98 USPQ2d 1261, 1267-68 (TTAB 2011). Thus, the wording SSC in the applied-for mark and in Reg. No. 3365819 are appropriately viewed as thedominant portion of the respective marks in assessing likelihood of confusion. Consequently, thedominant portion of the applied for mark and Reg. No. 3365819 are comprised of the same three lettersSSC, which sound the same when spoken. Similarity in sound alone may be sufficient to support a findingthat the marks are confusingly similar. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); seeIn re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv). With respect to Reg. No. 2450445, the examining attorney notes that registrant’s mark consists solely ofthe wording SSC in typed drawing form. A mark in typed or standard characters may be displayed in anylettering style; the rights reside in the wording or other literal element and not in any particular display. TMEP §1207.01(c)(iii); see 37 C.F.R. §2.52(a). Thus, a mark presented in stylized characters orotherwise in special form generally will not avoid likelihood of confusion with a mark in typed or standardcharacters because the marks could be presented in the same manner of display. See, e.g., Squirtco v.Tomy Corp., 697 F.2d 1038, 1041, 216 USPQ 937, 939 (Fed. Cir. 1983) (stating that “the argumentconcerning a difference in type style is not viable where one party asserts rights in no particular display”);In re Melville Corp., 18 USPQ2d 1386, 1387-88 (TTAB 1991); In re Pollio Dairy Prods. Corp., 8USPQ2d 2012, 2015 (TTAB 1988). Thus, because registrant may choose to present its wording in asimilar manner of display to that in the applied-for mark, applicant’s presentation of its mark in specialform does not obviate a likelihood of confusion. As the mark in Reg. No. 2450445 may be presented in amanner substantially similar to that of applicant’s mark, the mark is viewed as being effectively identical
to the dominant portion of applicant’s mark, namely, the wording SSC. B. Relatedness of the Goods/Services The goods and/or services of the parties need not be identical or directly competitive to find a likelihoodof confusion. See Safety-Kleen Corp. v. Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480(C.C.P.A. 1975); TMEP §1207.01(a)(i). Rather, it is sufficient that the goods and/or services are related insome manner and/or the conditions surrounding their marketing are such that they would be encounteredby the same purchasers under circumstances that would give rise to the mistaken belief that the goodsand/or services come from a common source. In re Total Quality Group, Inc., 51 USPQ2d 1474, 1476(TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080,1086-87, 56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed. Cir. 1984). In a likelihood of confusion analysis, the comparison of the parties’ goods and/or services is based on thegoods and/or services as they are identified in the application and registration, without limitations orrestrictions that are not reflected therein. In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1595 (TTAB1999); see Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 1267-68, 62 USPQ2d 1001, 1004-05 (Fed. Cir. 2002); In re Thor Tech, Inc., 90 USPQ2d 1634, 1638-39 (TTAB 2009); TMEP§1207.01(a)(iii). In this case, applicant’s goods and/or services are identified broadly as including “apparatus andinstruments for surveillance, remote control, control and measuring of electricity and consumption ofenergy” and “apparatus and instruments for control (supervision).” Therefore, it is presumed that theapplication encompasses all goods and/or services of the type described, including those in theregistrant’s more specific identification, namely, “computer hardware for communications over existingpower lines and over RF links within buildings and vehicles, namely computer hardware whose functionsare packet assembly, channel access, modulation and demodulation,” and “Electric current switches;Electric switches; Electrical controllers; Electrical controlling devices; Electronic speed controllers.” It isfurther presumed that the goods and/or services move in all normal channels of trade, and that they areavailable to all potential customers. Citigroup Inc. v. Capital City Bank Grp., Inc., ___ F.3d ___, 98USPQ2d 1253, 1261 (Fed. Cir. 2011); In re La Peregrina Ltd., 86 USPQ2d 1645, 1646 (TTAB 2008); Inre Jump Designs LLC, 80 USPQ2d 1370, 1374 (TTAB 2006); TMEP §1207.01(a)(iii). As explained above, applicant’s identification of goods in International Class 009 includes languagebroad enough to encompass the more particular goods identified in registrants’ more specificidentifications. Consequently, applicant’s identification is viewed as including goods legally identical tothose in the cited registrations. If the goods and/or services of the respective parties are “similar in kind and/or closely related,” as is thecase here, then the degree of similarity between the marks required to support a finding of likelihood ofconfusion is not as great as would be required with diverse goods and/or services. In re J.M. OriginalsInc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b). In light of the above, the trademark examining attorney concludes that potential purchasers of theapplicant’s and registrant’s goods/services are likely to erroneously believe that they emanate from acommon source.
Any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant. Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re HyperShoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP §§1207.01(d)(i). Accordingly, registration is REFUSED under Trademark Act Section 2(d), 15 U.S.C. §1052(d) Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) bysubmitting evidence and arguments in support of registration. II. ADDITIONAL SEARCH RESULTS – ONE PRIOR PENDING APPLICATION The filing date of pending Application Serial No. 85134986 precedes applicant’s filing date. See attachedreferenced application. If the mark in the referenced application registers, applicant’s mark may berefused registration under Trademark Act Section 2(d) because of a likelihood of confusion between thetwo marks. See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq. Therefore, upon receipt ofapplicant’s response to this Office action, action on this application may be suspended pending finaldisposition of the earlier-filed referenced application. The above-bolded in the identification of goods and/or services is indefinite and must be clarified becauseit does not adequately specify the types of goods and nature of the services in the particular indicatedclasses. See TMEP §§1402.01, 1402.03. Further, the identification of goods and/or services contains parentheses. Generally, parentheses andbrackets should not be used in identifications. Parenthetical information is permitted in identificationsonly if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such away that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).” TMEP §1402.12. Therefore, applicant must remove the parentheses from the identification of goods and/or services andincorporate the parenthetical information into the description. I. PARTIAL SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION – CLASS009 ONLY
Registration of the applied-for mark is refused in International Class 009 because of a likelihood ofconfusion with the marks in U.S. Registration Nos. 2450445 and 3365819. Trademark Act Section 2(d),15 U.S.C. §1052(d); see TMEP §§1207.01 et seq. See the enclosed registrations. Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered markthat it is likely that a potential consumer would be confused or mistaken or deceived as to the source of thegoods and/or services of the applicant and registrant. See 15 U.S.C. §1052(d). The court in In re E. I. duPont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to beconsidered when determining whether there is a likelihood of confusion under Section 2(d). See TMEP§1207.01. However, not all of the factors are necessarily relevant or of equal weight, and any one factormay be dominant in a given case, depending upon the evidence of record. In re Majestic Distilling Co.,315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at 567. In this case, the following factors are the most relevant: similarity of the marks, similarity of the goodsand/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc. , 59 USPQ2d 1593 (TTAB 1999); In reAzteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq. For the following reasons, the examining attorney concludes that there exists a likelihood of confusionbetween applicant’s proposed mark, SSC (w/ design), for, in pertinent part, “Satellites; satellites forscientific purposes; satellite navigation equipment; apparatus and instruments for surveillance, remotecontrol, control and measuring of electricity and consumption of energy; surveillance programs (computerprograms); apparatus and instruments for control (supervision); radio transmitters (telecommunications);
base transceiver stations (telecommunications); telecommunication systems; transmitters(telecommunication); simulators for the steering and control of vehicles and craft; automatic steeringapparatus for vehicles and craft,” in International Class 009, and registrants’ marks,
SSC (Reg. No. 2450445 -- typed drawing/standard character), for “Computer software for1.communications over existing power lines and over RF links within buildings and vehicles, namely,embedded computer software or firmware for use in establishing and maintaining a protocol forcommunications over RF links and existing power lines; computer hardware for communicationsover existing power lines and over RF links within buildings and vehicles, namely computerhardware whose functions are packet assembly, channel access, modulation and demodulation.”
SSC (Reg. No. 3365819 – wording w/ design), for “Electric current switches; Electric switches;2.Electrical controllers; Electrical controlling devices; Electronic speed controllers.
A. Similarity of the Marks In a likelihood of confusion determination, the marks are compared for similarities in their appearance,sound, meaning or connotation and commercial impression. In re E. I. du Pont de Nemours & Co., 476F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b). Similarity in any one ofthese elements may be sufficient to find a likelihood of confusion. In re White Swan Ltd., 8 USPQ2d1534, 1535 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP§1207.01(b). When a mark consists of a word portion and a design portion, the word portion is more likely to beimpressed upon a purchaser’s memory and to be used in calling for the goods and/or services; therefore,the word portion is normally accorded greater weight in determining whether marks are confusinglysimilar. In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1596 (TTAB 1999); TMEP §1207.01(c)(ii);see CBS Inc. v. Morrow, 708 F. 2d 1579, 1581-82, 218 USPQ 198, 200 (Fed. Cir 1983); In re Kysela Pereet Fils, Ltd., 98 USPQ2d 1261, 1267-68 (TTAB 2011). Thus, the wording SSC in the applied-for mark and in Reg. No. 3365819 are appropriately viewed as thedominant portion of the respective marks in assessing likelihood of confusion. Consequently, thedominant portion of the applied for mark and Reg. No. 3365819 are comprised of the same three lettersSSC, which sound the same when spoken. Similarity in sound alone may be sufficient to support a findingthat the marks are confusingly similar. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); seeIn re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv). With respect to Reg. No. 2450445, the examining attorney notes that registrant’s mark consists solely ofthe wording SSC in typed drawing form. A mark in typed or standard characters may be displayed in anylettering style; the rights reside in the wording or other literal element and not in any particular display. TMEP §1207.01(c)(iii); see 37 C.F.R. §2.52(a). Thus, a mark presented in stylized characters orotherwise in special form generally will not avoid likelihood of confusion with a mark in typed or standardcharacters because the marks could be presented in the same manner of display. See, e.g., Squirtco v.Tomy Corp., 697 F.2d 1038, 1041, 216 USPQ 937, 939 (Fed. Cir. 1983) (stating that “the argumentconcerning a difference in type style is not viable where one party asserts rights in no particular display”);In re Melville Corp., 18 USPQ2d 1386, 1387-88 (TTAB 1991); In re Pollio Dairy Prods. Corp., 8USPQ2d 2012, 2015 (TTAB 1988). Thus, because registrant may choose to present its wording in asimilar manner of display to that in the applied-for mark, applicant’s presentation of its mark in specialform does not obviate a likelihood of confusion. As the mark in Reg. No. 2450445 may be presented in amanner substantially similar to that of applicant’s mark, the mark is viewed as being effectively identical
to the dominant portion of applicant’s mark, namely, the wording SSC. B. Relatedness of the Goods/Services The goods and/or services of the parties need not be identical or directly competitive to find a likelihoodof confusion. See Safety-Kleen Corp. v. Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480(C.C.P.A. 1975); TMEP §1207.01(a)(i). Rather, it is sufficient that the goods and/or services are related insome manner and/or the conditions surrounding their marketing are such that they would be encounteredby the same purchasers under circumstances that would give rise to the mistaken belief that the goodsand/or services come from a common source. In re Total Quality Group, Inc., 51 USPQ2d 1474, 1476(TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080,1086-87, 56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed. Cir. 1984). In a likelihood of confusion analysis, the comparison of the parties’ goods and/or services is based on thegoods and/or services as they are identified in the application and registration, without limitations orrestrictions that are not reflected therein. In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1595 (TTAB1999); see Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 1267-68, 62 USPQ2d 1001, 1004-05 (Fed. Cir. 2002); In re Thor Tech, Inc., 90 USPQ2d 1634, 1638-39 (TTAB 2009); TMEP§1207.01(a)(iii). In this case, applicant’s goods and/or services are identified broadly as including “apparatus andinstruments for surveillance, remote control, control and measuring of electricity and consumption ofenergy” and “apparatus and instruments for control (supervision).” Therefore, it is presumed that theapplication encompasses all goods and/or services of the type described, including those in theregistrant’s more specific identification, namely, “computer hardware for communications over existingpower lines and over RF links within buildings and vehicles, namely computer hardware whose functionsare packet assembly, channel access, modulation and demodulation,” and “Electric current switches;Electric switches; Electrical controllers; Electrical controlling devices; Electronic speed controllers.” It isfurther presumed that the goods and/or services move in all normal channels of trade, and that they areavailable to all potential customers. Citigroup Inc. v. Capital City Bank Grp., Inc., ___ F.3d ___, 98USPQ2d 1253, 1261 (Fed. Cir. 2011); In re La Peregrina Ltd., 86 USPQ2d 1645, 1646 (TTAB 2008); Inre Jump Designs LLC, 80 USPQ2d 1370, 1374 (TTAB 2006); TMEP §1207.01(a)(iii). As explained above, applicant’s identification of goods in International Class 009 includes languagebroad enough to encompass the more particular goods identified in registrants’ more specificidentifications. Consequently, applicant’s identification is viewed as including goods legally identical tothose in the cited registrations. If the goods and/or services of the respective parties are “similar in kind and/or closely related,” as is thecase here, then the degree of similarity between the marks required to support a finding of likelihood ofconfusion is not as great as would be required with diverse goods and/or services. In re J.M. OriginalsInc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b). In light of the above, the trademark examining attorney concludes that potential purchasers of theapplicant’s and registrant’s goods/services are likely to erroneously believe that they emanate from acommon source.
Any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant. Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re HyperShoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP §§1207.01(d)(i). Accordingly, registration is REFUSED under Trademark Act Section 2(d), 15 U.S.C. §1052(d) Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) bysubmitting evidence and arguments in support of registration. II. ADDITIONAL SEARCH RESULTS – ONE PRIOR PENDING APPLICATION The filing date of pending Application Serial No. 85134986 precedes applicant’s filing date. See attachedreferenced application. If the mark in the referenced application registers, applicant’s mark may berefused registration under Trademark Act Section 2(d) because of a likelihood of confusion between thetwo marks. See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq. Therefore, upon receipt ofapplicant’s response to this Office action, action on this application may be suspended pending finaldisposition of the earlier-filed referenced application. In response to this Office action, applicant may present arguments in support of registration by addressingthe issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address thisissue later if a refusal under Section 2(d) issues. III. The above-bolded in the identification of goods and/or services is indefinite and must be clarified becauseit does not adequately specify the types of goods and nature of the services in the particular indicatedclasses. See TMEP §§1402.01, 1402.03. Further, the identification of goods and/or services contains parentheses. Generally, parentheses andbrackets should not be used in identifications. Parenthetical information is permitted in identificationsonly if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such away that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).” TMEP §1402.12. Therefore, applicant must remove the parentheses from the identification of goods and/or services andincorporate the parenthetical information into the description. In an application filed under Trademark Act Section 66(a), an applicant may not change the classificationof goods and/or services from that assigned by the International Bureau in the corresponding internationalregistration. 37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).
