PUBLIC HEARING:
1. Conduct a public hearing and consider approving the intent to undertake the followingproject to provide financial assistance to the City of Wilmer in the amount not toexceed $1,800,000.00 for sewer line repairs and remediation costs, authorizedpursuant to Sections 501.101, 501.103 and 5055.158 of the Texas Local GovernmentCode.
ACTION:
2. Discuss and consider authorizing the Notice of Intention for the issuance of Sales TaxRevenue Debt, Series 2021, for financial assistance to the City of Wilmer in theamount not to exceed $1,800,000.00 for sewer line repairs and remediation costs,authorizing distribution of a preliminary official statement relating to such certificates ofissuance and authorizing certain other matters relating thereto.

Agenda Caption:Conduct a public hearing and consider approving the intent to undertake the following project toprovide financial assistance to the City of Wilmer in the amount not to exceed $1,800,000.00 forsewer line repairs and remediation costs, authorized pursuant to Sections 501.101, 501.103 and5055.158 of the Texas Local Government Code.
Background:On Tuesday, October 6, 2020, the Public Works Department received a report from DallasWater Utilities (DWU) of a sewer main leak at the bank of the Trinity River, and contacted theTexas Commission on Environmental Quality Regional (TCEQ) Office in Ft. Worth. OnWednesday, October 7, 2020, after on-site observation of the reported location, Public Workspersonnel confirmed the City sewer force main pipe on the bank of the Trinity River was brokenand leaking into the River [attached]. Public Works immediately mobilized crews and a PipeContractor to begin emergency repairs. On Thursday, October 8, 2020, TCEQ directed the Cityto immediately halt pumping sewage through the damaged force main and to begin trucking andhauling all City of Wilmer sewage to the DWU Southside Wastewater Treatment Plant(WWTP).
On Thursday, October 8, 2020, the City of Wilmer authorized Cactus Reclamation Services toimmediately start emergency hauling of City sewage from Sewer Lift Station No. 1 (located nearthe intersection of Pleasant Run and Post Oak Roads). Cactus Reclamation Services mobilizedand began setup of pumps and tanks to contain and haul wastewater from the Lift Station wetwell on the evening of Thursday, October 8, 2020. Cactus Reclamation completed their initialpump and tank setup and commenced hauling tanker trucks of City of Wilmer sewage to theSouthside WWTP at about 5:00 a.m. on Friday, October 9, 2020. By October 10, 2020, CactusReclamation set up six fracking tanks at the Lift Station [Photos 2 - 6], then added another eighttanks by October 13, 2020 for a total of 14 tanks [Photo 7]. Cactus Reclamation used from 8-10tanker trucks to continuously haul City sewage from the fracking tanks at the Lift Station [Photo8] to the Southside WWTP for a total of 670 tanker truckloads loads at 4,500 gallons each.Cactus Reclamation and their subcontractors also set up a 400 ft. containment boom across theTrinity River and several aerators to contain and mitigate any sewage leaking into the River.
The City’s piping contractors completed emergency repairs to the broken sewer main on theriverbank on the evening of October 9, 2020 [Photos 9, 10]. Upon startup of the City Lift Stationpumps, multiple additional leaks in the sewer main crossing under the river channel wererevealed [Photos 11, 12], requiring installation of a new, temporary sewer main across the entireriver channel. On Saturday, October 10, 2020, at City direction, the pipe contractor began
river channel. On Saturday, October 10, 2020, at City direction, the pipe contractor beganemergency acquisition and installation of the temporary sewer main crossing consisting of 440feet of 16-inch diameter High Density Polyethylene Pipe (HDPE). The HDPE pipe materialarrived on-site on the morning of Thursday, October 15, 2020 [Photo 13]. The City’s pipecontractor immediately began fusing the pipe joints together to install the temporary maincrossing the river channel [Photo 14]. The HDPE pipe fusing operation was completed onSaturday, October 17, 2020. The pipe Contractor proceeded with installing the HDPE fusedpipe across the river channel [Photos 15, 16], and completed this phase on Sunday, October18, 2020. The pipe Contractor completed connection of the new HDPE pipe to the existing ironpipe sewer main on both banks on Monday, October 19, 2020 [Photos 17, 18]. The City liftstation pumps returned to service and began pumping sewage through the temporary forcemain pipe on the evening of Monday, October 19, 2020.
Cactus Reclamation Services continued hauling the remaining sewage from their fracking tanksto the DWU Southside WWTP on October 21, 22, and 23, 2020. Cactus Reclamationproceeded to clean, decontaminate, and demobilize their pumps, fracking tanks, and equipmentfrom October 24 through November 10, 2020.
On Thursday, December 3, 2020, the Council received a brief presentation from Staff related tothe expenses incurred from the wastewater hauling services from one of the representativeinvoice statements. Finance Consultant, Patrick Harvey, along with support from the FinancialAdvisor, Jim Sabonis advised that options for payment will be presented at a Special Meeting.
On Thursday, December 10, 2020, the Council provided staff direction to seek financial optionsfrom the Wilmer Community Development Corporation (WCDC), Type B related to the paymentand reimbursement of expenses related to costs incurred for the emergency repair, hauling, andadministration of the City sewer line break located near the intersection of Pleasant Run andPost Oak Road.
Operational Considerations:The purpose of this item is conduct a public hearing and seek approval from the WCDC, Type Bto provide financial assistance to the City of Wilmer for sewer line repairs and remediation cost.
Legal:Upon receiving direction from the WCDC, Type B, the legal consultant will prepare requisiedocuments for the transaction.
Public Information Considerations:Public notices will be published on December 13, 2020, in a daily publication of record, DallasMorning News.
This item is being considered at a meeting of the City Council noticed in accordance with theTexas Open Meetings Act.
Fiscal Impact:The WCDC, Type B has to authorize these expenditures, and direct staff.
Options/Alternatives:Wilmer Community Development Corporation (WCDC), Type B may approve the intent toprovide financial assistant to the City of Wilmer in an amount not to exceed $1,800,000.00.

Background:Operational Considerations:Approving this item authorizes the Wilmer Community Development Corporation (WCDC), TypeB to direct staff with funding of the project with Issuance of Sales Tax Revenue Debt, Series2021 to be utilized to provide financial assistance to the City of Wilmer for sewer line repairs andremediation costs pay off a portion of existing debt and provide capital for enhancement of cityassets and facilities.
Hilltop Security, the City’s Financial Advisors, will provide a financial plan analysis presentation.
