The Unified Registration System (URS) is a new electronic on-line registration system that will streamline and sim-plify the Federal Motor Carrier Safety Administration’s (FMCSA) registration process and serve as a clearinghouse and depository of information on all entities regulated by the Agency, including motor carriers, brokers, freight for-warders, intermodal equipment providers (IEPs), hazardous materials safety permit (HMSP) applicants/holders, and cargo tank manufacturing and repair facilities. The URS will combine multiple registration processes, information technology systems and forms into a single, electronic on-line registration process. FMCSA undertook this rulemaking to simplify and reduce the amount of time entities must spend filling out paper-work as part of the registration process as well as enable the Agency to maintain more accurate information on the entities subject to FMCSA’s jurisdiction. This rule applies to all interstate motor carriers (private and for-hire motor carriers of passengers and freight), freight forwarders, brokers, IEPs, HMSP applicants/holders, and cargo tank manufacturing and repair facilities under FMC-SA jurisdiction. There are two effective dates for this rule. On November 1, 2013, (1) the new enforcement provisions for failing to file biennial updates according to the schedule in 49 CFR 390.19(b)(2), and (2) a prohibition on operating with an inactive USDOT Number will take effect. On October 23, 2015, the Agency will require all entities registering or providing information to the Agency to do so through the URS electronic online registration process. FMCSA set November 1, 2013 as the compliance date for the biennial update requirements because motor carriers are already required to update their registration informa-tion biennially under 49 CFR 390.19 and the information

“Truck-crASh DeAThS riSe”Any time I read those headlines it causes me concern, but it also makes me pause to think about why we do the things we do. No one ever wants to read those headlines -- for business purposes and most certainly for humanitarian concerns. We don’t want our employees injured nor do we want oth-ers to be injured. The article in Transport Topics displaying that headline goes on to note the potentially misleading statistics when determining exactly what is included

in the “large truck” category vs. a “commercial vehicle.” None-the-less, it is always a good reminder to all of us on the importance of safety.

Fortunately for our association, there are a number of things we do to con-tinually promote safety in our industry and they represent some of the best things we do. As South Dakotans, we know full well that this time of year can bring on additional challenges. It is a good time to brush off our safety efforts, re-commit our own efforts, and re-communicate safety expectations with our drivers and staff. In addition to one of our more important goals of providing a safe working environment for our employees, we also are mind-ful of public perception. The press traditionally likes to take industry infor-mation and sensationalize a bit shall we say. We have fortunately made progress in that area over the years. Truck Driving Championships, Safety Management Council, Drivers of the Month and Driver of the Year, America’s Road Team, Fleet Safety Awards, Truckers Against Trafficking, etc. are all examples of how we continually try to build up our industry and professional-ism. But at the end of the day, those things also help promote safety within our industry and that is key.

I realize safety is nearly always at the top of our minds. We have a strong membership and a group that continually displays their efforts in promot-ing safety and our industry as a whole. During this Thanksgiving season, I want to challenge all of our members to make sure you rekindle those safety efforts. Winter season has already made its presence known and we know much more is around the corner.

Let’s make this a SAFE winter season for our families and our employees. Happy Thanksgiving!

The SDTA Membership may be unaware that I am currently the President of the NORPASS Board of Directors. NORPASS is one of the bypass systems in this country that allows safe carriers to bypass enforcement scales around the country. It is re-ally quite simple for users; trucks equipped with a transponder that meet certain bypass criteria are allowed to bypass scales. I applaud the NORPASS Board for partnering with a new enhanced bypass program called DriveWyze.

In July of this year, the Federal Motor Carrier Safety Administration (FMCSA) began allowing states to use wireless mobile data devices such as smart-

phones, tablets and onboard computers to also serve as transponders in electronic truck inspection and weigh station bypass systems. The pioneer and leader in this wireless mobile data service is called DriveWyze.

One way the DriveWyze technology works is to install an app on a mobile device. The GPS-enabled app triggers a message that automatically identifies the motor carrier in the screening software system used by enforcement officers. DriveWyze’s mobile app does not contain any information that identifies the carrier; that data is stored on the company’s back-end servers. The app only sends a unique security token to the servers, an approach that ensures the data transmitted is secure and fast. Now you might ask, what do I do when I am in my personal vehicle and am carrying my smartphone? Well, drivers can turn off the DriveWyze app while in a personal vehicle.

A FMCSA study showed that a weigh station stop, made for as little as 5 minutes, costs the truck $8.68 in fuel and lost time. There are currently 4.5 million trucks operating in North America that report to weigh stations and only about 15 percent of those are currently using a bypass system. DriveWyze provides simple visual and audible instructions for drivers to either bypass weigh stations and inspection sites, or to safely pull in. The application is automated, hands-free and uses simple visual and tone-based auditory signaling to the driver. Once the app is activated at the start of a trip, the DriveWyze application requires no further interaction; making it strongly aligned with distracted driver initiatives.

Here is the great news. Since South Dakota is a NORPASS state and because of the DriveWyze/NORPASS partnership, all NORPASS subscribers get 60 days of DriveWyze service at no charge, plus a 50 percent discount for the next two months after that. With the combined service that NORPASS and DriveWyze offers, weigh and inspec-tion sites in 22 states and two provinces are available for bypass.

Jim Henrichsen, Lloyd Wheeler’s wife Kari and I were among the group to attend the seminar in Rapid City on Hours-of-Service on October 29th. It was a very good seminar. This is the first in

two years that I can honestly say I have a confident understanding of the new Hours-of-Service regulations. As loggers, I believe it is still the time card and 12 hour shifts that will give us the most benefit. It is simple and we are not required to take a 30 minute break after 8 hours. Note that once you have gone over the 12 hour limit you will need to start a log book. I personally don’t want to go to the log book, considering the time needed to maintain them, along with the requirement to include two breaks needed between 1:00 a.m. and 5:00 a.m. I just do not see the advantage as loggers to use this method. I want to thank Kari Wheeler for taking excellent notes and agreeing to give a report at the next log haulers meeting. Thanks again Kari!

Myron and I have discussed the annual log haulers seminar held in April. Our plan is to have a representative from the Federal Motor Carrier Safety Administration at that meeting, along with a representative from the US Forest Service. This will be an excellent seminar -- let’s just hope we will not have to deal with the same weather as last year!

On a very sad note when I sat down to do this newsletter I received a text that Hugo Stender passed away on November 17, 2013 from a logging related accident. When I think of Hugo I think of one of the old timers that will always be missed and never forgotten. Please take a moment in remembrance of him. I know I will never forget him.

Willie Leduc, Blachowske Truck Line, Inc., Brandon, SD, has been selected as the November 2013 Driver of the Month by the South Dakota Safety Management Council.

Mr. Leduc has logged over 5 million miles in a career spanning nearly five decades. In 46 years Willie has had only one accident in 2002.

Willie is the perfect example of what every trucking company is looking for! He always puts safety first. His safety record speaks volumes. He is a true asset to Blachowske Truck Lines. Customers are always requesting Willie’s services.

Willie is a widowed parent of five adult children. He resides in Graettinger, Iowa.

SDTA joins the Safety Management Council in congratulating Willie Leduc for being selected as the November 2013 Driver of the Month.

5 Things Drivers never Should Do at the Scene of an AccidentNovember 2013, TruckingInfo.com - WebXclusiveby Don Jerrell, Associate VP, HNI

The time to plan how you’re going to respond at the scene of an accident is before you are involved in an accident. How a truck driver responds on the scene has a major impact on the outcome of any claims that may follow.

Here’s a list of five things drivers should never, ever do at the scene of an accident:

1. Do not leave the scene: Drivers should stay on the scene of an accident until police and emergency responders arrive and tell them they can leave. Sounds like common sense, but it happens.

2. Do not get argumentative or physical: Picking a fight — verbal or physical — is a surefire way to make a bad situ-ation worse. How the driver conducts himself on the scene can have a major impact on whether the bystanders become a witness for or against a motor carrier. The emotional re-sponse of those involved in the situation will have an impact on how they remember the “facts” — it’s just human nature.

3. Do not discuss facts regarding the accident with any-one other than your company and the police: There will be people who show up on the scene and start asking questions. Some may be innocent bystanders, some may be ambulance chasers sniffing for a big dollar verdict. We’ve run into situ-ations where people working for attorneys have approached a driver saying “I’m from your insurance company, can you explain what happened?” The only people a driver should discuss the situation with is his or her own company and the police.

4. Do not admit to liability at the scene or volunteer to make payments — allow your company to make that deci-sion after full investigation: It’s human nature to want to say “sorry” when something goes awry — but even saying “I’m sorry this happened” can be twisted by a prosecutor into an admission of guilt. While your driver will certainly feel bad, reinforce that who’s at fault and who has liability will be determined following a full investigation.

5. Do not delay reporting an accident, no matter how mi-nor it may seem: The quicker a driver reports an accident, the quicker you can be prepared to respond. Days, hours, and minutes matter when it comes to collecting evidence and gathering witness testimony. Even a fender bender that seems minor needs to be reported right away — we have

IMPROVING THE HUMAN CONDITION

Paul Yanzick had struggled with weight gain since junior high. The 36-year-old Sioux Falls man had tried several methods to lose weight, but nothing seemed to get him lasting results.

Both of his parents had issues with their weight and had diabetes. In fact, both have died of complications related to dia-betes within the last decade.

With that family history, it wasn’t a surprise to Paul when he too was diagnosed with diabetes several years ago. Soon he was on oral medication to try to control his blood sugar and medicine for high blood pressure and cholesterol levels, and nothing seemed to help.

“Soon the pills weren’t handling it and I had to take insulin shots,” says Paul. “The amount just kept creeping up and up.”

The software developer said he could see the writing on the wall. If he didn’t do something soon, he might not be around to see his boys, ages 2 and 5, grow up. And he wanted a different kind of life for them right now.

“There were so many times when I didn’t have the energy to do things, when I’d watch instead of play,” says Paul, who weighed 380 pounds at his heaviest. “I knew it was time to do something. I needed a tool to help me lose the weight.”

Looking for change: Paul asked his endocrinologist if weight loss surgery might be a good option. He got an enthusiastic referral to weight loss surgeon, Dr. Dennis Glatt, at the Sanford Metabolic and Bariatric Surgery Program.

Together they decided the best option for Paul would be laparoscopic bypass surgery, a procedure that would reduce the size of his stomach and bypass part of the small intestine. Not only would the minimally invasive surgery help Paul lose weight, but also studies have shown it could also end his diabetes almost immediately.

“I would walk out of the hospital with no more diabetes,” says Paul. “No more insulin shots, no more pills.”

In December 2011, Paul had the surgery and soon was back to his normal schedule. His eating habits, however, were drasti-cally different and the weight dropped quickly.

his commitment: When his weight loss plateaued at about 100 pounds, Paul added exercise to his lifestyle and soon felt and looked even better. He also quit taking his blood pressure and high cholesterol medication because his body no longer needed it. “I felt better and I had a self confidence that I had never experienced before,” says Paul.

The surgery wasn’t the solution to his problems. It was the tool he used to get the results he needed. He has been able to maintain his weight loss through hard work and a commitment to change, he says.

Paul says he hopes to teach his children through example how important healthy eating and exercise can be. He hopes to end the cycle of weight gain and diabetes that has hurt his family in the past.

“I hope they never have to go through what I had to go through,” says Paul. “It’s something you keep working at because it’s so important.”

IRP Adopts Full Reciprocity and Rental AmendmentsVoting closed on this year's proposals to amend the International Registration Plan. A change to the Plan requires a three-quarters vote of the states and provinces, and when the ballots were counted, the Full Reciprocity Plan (FRP) was adopted by a vote of 50 to 6, and an important change to leased truck registration was adopted by 44 to 13. The FRP is the biggest change to come to the IRP since all the states were required to join the Plan under federal law some twenty years ago. When Full Reciprocity takes effect in 2015, it will mean that every vehicle registered under the IRP will be automatically quali-fied every year for registration purposes to operate in all the 48 states, the District of Columbia, and the ten Canadian provinces. There will be no more trip permits for IRP vehicles, no estimated miles, and no fee for adding a new state in the middle of a year. The FRP will provide greater flexibility for thousands of trucking companies nationwide, especially small-er companies, and save both industry and govern-ment time and money now wasted on administra-tive hassle. The ballot on leased vehicles, effective in July 2016, means that truck lessors will be able to consolidate their fleets of leased vehicles instead of having dozens or even hundreds of IRP fleets tied to where their lessees are located. We thank all the ATA members who urged their IRP administrators to vote for these two critical changes, and we particu-larly thank the state trucking association executives, who worked hard to ensure that both proposals were adopted. ATA: Trucking Short of Nearly 100,000 Drivers AnnuallyOctober 22, 2013 / ORLANDO, FL. -- On Tuesday American Trucking Associations Chief Economist Bob Costello said fleets are adjusting to continued tightness in the driver market by increasing pay and hiring newer drivers.

“While the driver shortage is generally confined to only certain segments of the trucking industry, it is having real impacts in how fleets recruit and retain their drivers.” Costello said during the “All About the Driver” general session during the ATA Man-agement Conference and Exhibition taking place in Orlando, Fla.

Costello was joined by Jeff Flackler, vice president of transportation, Wal-Mart Stores Inc.; Derek Leath-ers, president & COO of Werner Enterprises and Steve Gordon, COO of Gordon Trucking Inc. for a panel discussion on driver issues moderated by Dave Osiecki, ATA senior vice president of policy and reg-ulatory affairs.

“Fleets in all segments of trucking have told us they are having a more difficult time finding qualified drivers than they were a year ago,” Costello said. “As a result, more fleets are considering hiring drivers straight out of driver training programs and nearly three-quarters of those we surveyed plan to increase pay or have already done so.”

The industry needs to find an average of roughly 96,000 new drivers annually to keep pace with de-mand. If freight demand grows as it is projected to, the driver shortage could balloon to nearly 240,000 drivers by 2022, according to ATA data.

Medical Examiner Registry Final Rule PublishedThe Federal Motor Carrier Safety Administration has published its final rule requiring medical examiners to register and be certified in order to perform Department of Transportation driver physicals. Starting May 21, 2014, only certified, registered examiners will be acceptable for Department of Transportation driver physicals.

The agency says it will post its uniform training and testing standards for medical examiners on the National Registry website (https://nationalregistry.fmcsa.dot.gov). FMCSA must approve the curricula that will be used by individual training centers before actual training can begin. However, healthcare professionals seeking to become certified examiners can begin registering on the National Registry website already. One component of the medical examiner master plan is not included in this rule making. Certified medical examiners will not be required to transmit a driver’s medical certificate to a state’s department of motor vehicles. FMCSA says it plans to address that component in a separate rule making. Medical certificates issued before May 21, 2014, will be valid until the expiration date.

SDTA members, without your doctor’s cooperation, medical exams will be hard to come by in South Dakota after May 1, 2014. Currently there are only 25 locations signed up in the entire state of South Dakota.

Don Jerke peacefully passed away at the age of 79 on October 24, 2013 at his home surrounded by his loving family.

In 1960, Don and his wife Phyllis opened Jerke Construction Co., in Sioux Falls, SD. Jerke Construction has been a member of SDTA for years.

A comfort to Don during his time of illness was the knowledge that his faith-ful, hard-working employees were carrying on the work that mattered so much to him.

Keep his family in your thoughts and in your prayers as they mourn their loss!

• FmcSA is actively pursuing a course to insure that carriers register and update their registration on-line. On October 23, 2015, the Agency will require all entities registering or providing information to the Agency to do so through the urS electronic on-line registration process.

• FmcSA will not be deactivating any uSDOT#s on november 1, 2013. in november, the Agency will send out warning letters to carriers due to update in January 2014 with update instructions and their Pin.

• The biennial update requirement in urS is completely separate and not related to the states’ ucr - (unified carrier Registration)

• For ucr questions: carriers whose base State is South Dakota should contact the South Dakota Department of revenue at 605-773-4595 -- additional ucr information can be found at: www.ucr.in.gov

• Brokers, Freight Forwarders, and cargo Tank Facilities are not subject to the Biennial update until October 23, 2015.

******************************************************************************************There have been several recent reports of misleading email messages related to the URS biennial update and the UCR filing fees and deadlines. Some of these recent emails look like legitimate ones that were sent from FMCSA on behalf of the FMCSA Office of Registration and Safety Information on October 3rd and 7th. However, more recent messages did not come from our office or any other part of FMCSA. In some cases, these emails have links that look like FMCSA-sponsored links, but in reality are re-directed to private-sector compliance companies. The agency’s security team has been alerted and is investigat-ing. For any questions or issues with FMCSA registration requirements, always use the FMCSA registration and licensing webpage at http://www.fmcsa.dot.gov/registration-licensing/registration-licensing.htm or call 1-800-832-5660 for questions about URS and biennial update.

In some cases, drug testing may be required following an accident, either by the DOT or your insurance company. Controlled Sub-stance Tests must be conducted within 32 hours and alcohol tests must be conducted within two hours. If the test is not performed within these time frames, you must provide documents stating the reason.

Ensuring that your drivers are well trained on how to respond at the scene of an accident is vitally important — but we’ve found that most companies offer little to no training on this. Training typically focuses on preventing accidents (which is clearly important), but stopping there leaves out a critical component.

The SDTA Board of Direc-tors met in Huron, SD, at the Crossroads, on November 14th. The following items were discussed:

• Review of the first quarter financial statements for SDTA

• Review of the SDTA Foun-dation scholarship program through the SD Community Foundation

• Myron discussed a list of federal issues and updated the Boaard on potential leg-islation for the 2014 session

• Updates From the Safety Management Council & Asso-ciates Conference Chairper-sons

• SDTA’s Political Action Com-mittee (PAC) report update

• Myron led a discussion of fund shortages and reviewed some of the areas where spending can be reduced

• The new ATA image pro-gram was reviewed
