The SDTA wants to send a special thank you to Stan Kopfmann, Stan’s, Inc, in Aplena, SD, for taking such good care of our group of SDTA hunters year after year.

After 50 years in business Stan has decided to slow down (a bit) and maybe hunt once in a while himself instead of guiding groups day after day through an entire season.

Stan took a group SDTA hunters out for one last guided hunt on his land on Wednesday, No-vember 12th. The wind was howling and the weather was frigid but the hunters managed to shoot down 33 pheasants.

Greetings,I hope everyone is doing well. As I sit down to write on this November 12th morning, the air temperature is 1 degree and the wind chill is much colder. It was 64 degrees here on Sunday. You have to love western South Dakota. Well, election day has come and gone. If you voted Republican, you are probably happy right now and if you voted Democrat, you

kind of got beat up. Statewide and nationally the GOP did very well. It is going to be very interesting to see if the country can move forward now that the Republicans control the Senate and the House. In the U.S. Senate, Republicans increased the seats they hold from 45 to 53 with two races still pending. In the U.S. House of Representatives, Republicans expanded their current majority by 14 seats with 7 races still undecided. There will be over 240 seats in the House of Representatives for the 114th Congress. The Repub-licans also did very well in the Gubernatorial races across the nation. Some of the impacts of the mid-term elections in the Transportation Committees include the continuation of Chairman Bill Shuster (R-PA) steering the full committee. The Senate Commerce Committee will be chaired by Senator John Thune (R-SD). ATA’s Truck Pac had a great return of their investment as well with 94% wins on the House and Senate candidates they supported. ATA Truck Pac also exceeded their fund raising goal of $1,000,000 for the year 2014. Congratulations to that team!According to ATRI the top five issues for the year 2015 in our industry in order of importance are HOS, driver shortage, CSA, driver retention, and last but not least electronic logging devices. Please do your part to become involved with these issues as we all know the impacts they have on our own businesses. I will be paying close attention.I am distraught with the statistics in South Dakota on voter turnout for this election. Did you know that only 30% of registered voters actually voted this year. This is shocking!! The population of South Dakota is about 850,000. There are about 510,000 registered voters and 30% of them voted. Figure that all out and of the 850,000 people residing in our state, only 150,000 voted. That sure is a shame. Next time you hear someone complaining about government affairs, ask them if they voted. If they say no, tell them they have no right to complain. Come on people, get out there and VOTE!Remember, winter is approaching and kids are in school. So please use extra caution. Here we are again, in the fall of the year. It is time to put the summer toys away and prepare for a cold weather. So far, we have been quite lucky and liv-ing on borrowed time. Temperatures have been very mild, giving city folks time to do fall trimming of their yards and giving farmers time to harvest their crops. Unfortunately, there is a winter storm sched-uled for the near future; snow and cold - I am not ready for that!

The mid-term elections are finally in the past. Hopefully those that were elected will now focus on getting things done instead of arguing about who

has the best idea. As you know, the South Dakota Trucking Association has a politi-cal action fund that is called Truck PAC. I am happy to inform the membership that 86% of those campaigns we helped fund resulted in the candidate being elected. We elected or re-elected our entire 105 member state legislature, a Governor and all other constitutional officers. It appears that on a state level we are in very good shape!

It was obvious that the citizens of this country are extremely tired of the US Presi-dent and the US Congress being dysfunctional in their activity. Now that the man-date has been resoundingly delivered, I hope they can get something done. There are so many federal issues that need attention and are not getting handled. Those issues include several federal agencies that are drunk with power and as such, deliver mandates that have no Congressional oversight or input. Hopefully, things will change.

By the time you read this column, the SDTA Board of Directors fall meeting will be history. During this meeting we traditionally discuss the agenda and outlook for the upcoming legislative session. Please stay tuned, I am quite sure there will again be a long list of legislative issues that we will need to be at the table to discuss.

By now every SDTA Member should have received a memo from me regarding Project 600 Horsepower in 2015. With over 550 members, it should not be that difficult to recruit a few more. Please share the successes of the South Dakota Trucking Industry with people that you know in this great industry. There is a great value in membership for very little cost. You are the best ambassador for the SDTA; let's strengthen our horsepower by getting a larger membership footprint.

As the holiday season approaches, please take time to thankfully reflect on all of the people in our lives and the comforts we have. Other parts of the world are not so fortunate!

On December 7th, from 1:30 to 4:00, we will be holding a Black Hills Log Haulers meeting at the Deadwood Mountain Grand. We will be discussing the upcoming 2014 survey and the pertinent changes that need to be made to make the survey even more accurate and creditable. SDTA President Rau will be in attendance to help with the discussion of the upcoming

2015 legislative session and the bills that will be introduced that have an effect on us. Additional items that are on the agenda are: the April Seminar, regular and associate membership and any other issues that may come up from now until then. We are going to extend a “no commitment” invitation to all nonmembers with hope that they will see what we have to offer and the value in joining. I believe we will have no problem getting anyone to join if we can just get them to attend one time. So, please spread the word and convince a friend to attend. I am confident that we can be instrumental in pushing the SDTA membership over 600.

Occasionally someone will ask what constitutes hours of service. The FMCSA rule for reporting hours accurately are defined in the Compliance Safety and Accountability hand book. Here is a quote, “Did you do some paid work over the weekend? Do you have an evening job or part time business of your own? Any type of work that results in compensation for you must be reported to your motor carrier employer(s) as on duty time.” Reporting hours inaccurately is 7 points on your CSA score.

It is certainly obvious that we are barely maintaining enough log inventory in the mill yards for a week or two, much less increasing it for the spring shut down. Hopefully everyone has a goal to maximize hours of service the best they can, or at the very least trying to work enough hours to make the bonus each month. Logging contractors are already being shut down for too much inventory in the woods. We must do everything we can, within reason, to make sure all mills have an adequate inventory for spring. We cannot be the reason for lack of inventory because we did not utilize our hours of service in the best we were capable of. Always remember, for those of us that haul logs - this isn’t just what we do this is who we are.

ATRI RESEARCH IDENTIFIES TOP TEN STATES THAT DEMONSTRATE SUPERIOR SAFETY AND ENFORCEMENT PERFORMANCE Arlington, VA – The American Transportation Research Institute (ATRI), the trucking industry’s not-for-profit re-search organization, today released a follow-up technical report to its previously released Enforcement Disparities study. In the new technical report, Commercial Motor Vehicle Enforcement – Top 10 High-Performance States, ATRI researchers identified the top 10 states that demonstrate superior safety and enforcement performance. In this comparative analysis, ATRI researchers developed a weighted formula for identifying the “Top 10” high-performance states across 11 metrics highlighted in the Enforcement Disparities study. This analysis highlights the Best Practices of leading safety innovators in the enforcement community — providing direct benefits to both industry and enforcement partners. ATRI’s analysis identified and rank-ordered the following states as the “Top 10” High-Performers:

1. Maryland 6. Connecticut2. Washington 7. New Mexico3. Nevada 8. California4. Rhode Island 9. SOUTH DAkOTA5. Montana 10. Iowa

In addition, several of the “Top 10” states were also recognized as Top Tier states in ATRI’s 2005 and 2011 Crash Predictor studies. In the Crash Predictor studies, states were evaluated and ranked based on effective enforcement countermeasures relative to crash rate outcomes. The overlap of six states across the three lists not only validates the findings, but provides further evidence that certain states exemplify superior safety and enforcement perfor-mance. “These 10 states epitomize what we would like to see in all 50 states in terms of commercial motor vehicle enforce-ment – a balanced approach that recognizes the importance of traffic enforcement and a focus on driver behav-iors that have a relationship to truck crashes,” commented Annette Sandberg, former FMCSA Administrator and former Chief of the Washington State Patrol. Ms. Sandberg currently serves as a member of the ATRI Board of Directors. “The industry applauds these state enforcement agencies who, in partnership with their respective state trucking associations and members, have made highway safety and reduced truck crashes their top priority,” remarked Bill Graves, President and CEO of the American Trucking Associations. SAN DIEGO -- Since its public launch at the Mid-America Trucking Show in March, the Trucking Moves America Forward program has made great strides toward its goal of showcas-ing the positive side of trucking for the public and law and regulation makers.

The TMAF campaign seeks to raise $1 million by the end of 2014 to fund education and outreach. It's well on its way, with more than $850,000 to date, organizers said in a status update for the trucking press during the American Trucking Associations' Management Conference and Exhibition this week.

The money will largely be used in an advertising and PR cam-paign in consumer publications aimed at the general public, inside-the-beltway publications aimed at lawmakers, city newspapers, radio talk shows, etc.

"We are shaping the way the public views the trucking in-dustry and the ways we view ourselves," said Kevin Burch, president of Jet Express and vice chairman of Trucking Moves America Forward. "Public opinion changes public policy. We want better laws and better regulations that affect our busi-nesses and our workforce. TMAF is reenergizing us and re-minding us we should take pride in what we do."

Burch said that in addition to the funding, those involved in the campaign have had the opportunity to tell trucking's story to the media and to lawmakers, and trucking compa-nies, suppliers and trucking associations are incorporating the movement into their daily businesses.

The movement has been working to spread the word via social media, with a Facebook page at www.facebook.com/

TruckingFWD and Twitter feed @TruckingFWD. Videos on its website are now on state trucking association websites and others such as Truckinginfo.com.

To help the organization function effectively, three committees have been formed to handle different aspects of its mission:

Advocacy (to deliver the message in Washington, D.C. as well as state legislatures)Engagement (getting other trucking associations, including state trucking associations, involved)Internal (building the movement within the trucking industry)

"TMAF has been overwhelmed with the support we've re-ceived from all corners of the industry and look to continue this momentum this year and beyond," said Mike Card, chair-man, TMAF Fundraising Committee, and president, Combined Transport.

At the MC&E, the Allied Committee for the Trucking Indus-try (ACT1) announced a $100,000 donation, and Meritor an-nounced a contribution of $10,000. In August, ATA announced it was donating $100,000 to the campaign.

The largest donation to date was $1 million commitment over five years from Pilot Flying J.

TMAF also has been bolstered by significant financial contri-butions from, Old Dominion Freight Lines, Great West Casu-alty Company, Pilot Flying J, Trucking Associations Executive Council and Jack Cooper Transport. TMAF has also received support from industry leaders such as National Tank Truck Carriers, National Auto Dealers Association, the Owner-Op-erator Independent Drivers Association and Truckload Carri-ers Association, plus in-kind donations from Randall-Reilly, Love’s Travel Stops (which is putting the logo on its Nascar race car), Transport Topics, Maxim, Overdrive Magazine, Com-mercial Carrier Journal and Heavy Duty Trucking.

Dot: electronic Logging Device Mandate rule expected september 2015, action on speed Limiters expected next MonthA Final Rule mandating the use of electronic logging devices by drivers and fleets is expected to be pub-lished Sept. 30, 2015, according to a recent Depart-ment of Transportation report, meaning enforcement of the mandate would begin Sept. 30, 2017.

That publication date is a projection, included in the DOT’s monthly regulatory update.

The report also says a projected rule to mandate the use of speed limiters will be sent from the DOT to the White Houses’ Office of Management and Budget next month, in line for a March 16 publication date.

That projected rule’s action dates, however, have been pushed back several times this year already.

Still projected for publication this month is an Ad-vanced Notice of Proposed Rulemaking regarding the minimum amount of liability insurance that motor carriers must have. The ANPRM will likely be simply a questionnaire for carriers that will be used as a data gathering tool for the agency and not a rule intended to raise the current minimum.

The agency still would have to produce a Notice of Pro-posed Rulemaking and accept public comment before crafting a Final Rule.

The DOT also projects in its report that FMCSA’s long-awaited Safety Fitness Determination rule will be pub-lished in April as a NPRM. The rule, once final, will al-low the agency to use the data at its disposal to create absolute scores for carriers, which would be used to target them for intervention.

The DOT projects a publication date of March 24. The rule will be sent to the OMB Dec. 23, according to the projection, and clear the OMB March 24.

Other rules in the DOT update include the CDL Drug and Alcohol Clearinghouse rule, scheduled to be published as a Final Rule Oct. 30, 2015, and the rule prohibit-ing coercion of drivers by carriers and brokers, which is scheduled to be published as a final rule Sept. 10, 2015.

Every man has one. While it’s only the size of a walnut, this gland can cause serious health concerns – even cancer – if it’s not healthy.

So what exactly is the prostate? This gland sits just below the bladder, between the root of the penis and the anus. It makes seminal fluid, which is mixed with sperm to make semen.

is your prostate healthy? A good way to keep tabs on your prostate health is to pay attention to your urine flow. Men with prostate problems may have their prostate swell to approximately the size of a plum, restricting urine flow.

So if your urine stream has dwindled to a trickle, you are getting up more at night to urinate, or you notice dribbling before or after urinating, you could be experiencing a problem with your prostate. Less common signs include testicular pain, erectile difficulties, pain with ejaculating or blood in the urine.

If you are experiencing any of these symptoms, you need to schedule an appointment with your physician. The sooner problems are detected, the better the outcome for you.

Life-saving test: Once you’ve spoken wth your physician, a prostate specific antigen (PSA) test may be ordered to rule out prostate cancer. Your age and family history may also influence your physician’s actions, as you could be at an increased risk for prostate cancer.

Prostate cancer typically affects men age 50 and older, and approximately half of this age group also shows signs of prostate enlargement. And if your father, grandfather, uncle or brother had prostate cancer, you are more likely to develop the disease yourself.

But with a simple test, you can provide yourself peace of mind or potentially save your life. PSA is produced in the prostate gland and found in small amounts in your blood. A raised PSA level can mean there is a presence of prostate cancer.

It can also indicate other problems besides cancer – three out of four men with a raised PSA level do not have prostate cancer. However, the higher the PSA level, the greater the likelihood of a cancer being present.

It’s important to tell your doctor of any family history, so you can be given routine blood tests to monitor your PSA levels. And if you suspect a problem with your prostate, schedule an appointment today.
