2012 DUES

You will need your license number and the last four digits of your social security number to sign in.

Credit card payments must be for the full amount

Payment deadline is: December 31, 2011. A $100 late fee will be assessed on dues paid

or postmarked after January 15, 2012.

I took the grandkids to the movie theater just last week to see one of those comic book mov-ies. Wow, movie technology has gotten a lot better over the years. I was impressed. The ticket price was a small fortune, higher than I would have ever imagined. When I was younger, it didn’t cost that much to go to the movies. Of course, I really don’t have a lot to base that opinion on, since I only went to the movies once in a blue moon. I decided we would probably not be going to the theater very often in the future, it was just too expensive. That 2-1/2 hour activity cost me over $50 dollars! I informed the grandkids that we would-n’t be going to the movies in the future unless we go Dutch, and that we will just wait until the movie comes out on DVD; then, we would have a movie night at my house.

Well, the ghosts and goblins are gone. We can all move forward to the day of thanks. Do me a favor as you sit around that table; let’s remember all those people we have had contact with over the years, especially our friends and family. And while you’re at it, remember all those individuals that made us what we are today and those that keep us safe and protect our freedom each and every day. Always remember, we are all truly blessed! Now, on with this month’s story.

Bonny Frost and her husband, Rex, bought a vacant lot off a business intersection years ago as an investment. They had been discussing selling the property over the past couple of years, mainly because they didn’t want to keep paying the annual taxes and upkeep of the land. On a neighbors recommendation Bonny contacted Randy Meisner, the broker owner of M & M Realty to sell their property. Randy recommended that before they consider selling the property, they should get a couple of independent appraisals on the property. Whether they use his firm to list the property or not, whoever lists it would need to know the value of the vacant lot to list it in the MLS sys-tem. He then stated that if they decided to list the property with his firm, he would pay for one of the appraisals himself. While Bonny was telling him about the property, he looked in up in the tax records and told her that the property was zoned for commercial development.

Bonny conveyed that they were considering selling their home and the lot sometime in the next couple of years. Bonny decided to list the vacant lot with Randy at M & M Realty and the appraisals were done. The appraisals indicated the price to be between $122,900 and $128,000, so Bonny decided to set the listing price at $125,900. Randy listed the lot in the MLS at that price. Shortly thereafter, Randy received an offer of $120,000 which he submitted to Bonny, who rejected it. After the passage of four months, during which no further offers were re-ceived, Bonny asked Randy if he would be willing to buy the lot himself. Randy, on his own behalf, made an offer of $119,500, which Bonny accepted. Randy then insisted that Bonny and Rex get their personal attorney to review the contract before he would agree to purchase the property, and he also stated at that time that, if they accepted his contract to purchase, he would waive his commission on the transaction. Their attorney reviewed the contract and approved the transaction, the vacant lot closed shortly thereafter. Months later, Bonny, on a return visit to the city, discovered that Randy had sold the lot for $126,000 only three weeks after he had purchased it for $119,500. Bonny Frost complained to the Association of REALTORS® charging that Randy had taken advantage of her; that she had sought Randy’s professional guidance and had depended on it; that she could not understand Randy’s in-ability to obtain an offer of more than $120,000 during a period of four months, in view of his obvious ability to obtain one at $126,000 only three weeks after he became the owner of the lot; that possibly Randy had the $126,000 offer at the time he bought the lot himself at $119,500. At the hearing, Randy introduced several letters from prospects that had been written while the property was listed with him, all expressing the opinion that the lot was overpriced. The buyer who purchased the lot for $126,000 appeared at the hearing as a witness and affirmed that he never met Randy or discussed the lot with him prior to the date of Randy’s purchase of the lot from Bonny Frost. Questioning by members of the Hearing Panel estab-lished that Randy had made it clear that his offer of $119,500 in response to his client’s proposal was entirely on his own account.

Well, it seems like Randy had all the answers during the hearing. I would think the seller would see that Randy took every precaution he could, he paid for one of the appraisals, he waived his commission and he insisted that Bonny and Rex Frost have their attorney review and approve the contract prior to purchasing the property. What more could he have done, what do you think?
