I, saroj Kumar Mandal, son of shri B.c. Mandal, aged about 55 years ,

resident of C-1105, Amrapali Eden Park, Sector-5O, Noida, U.p.-201301 do

solemnly affirm and state as under:

That I am the Additional General Manager (Commercial) in Applicant

Corporation, NTPC Ltd. and am well conversant with the facts of the case

and am competent to swear the present affidavit.

That I have read the contents of the accompanying application filed by

NTPC f,oi'-Grant of license for inter-state trading in electricity and have

understood the contents of the same.

That the contents of the said application being filed by NTPC are based on

information available with the applicant in the normal course of business

and believed by the deponent to be true.

The Petitioner humbly states that:

The Petitioner herein NTPC Ltd. (Formerly National Thermal Power

Corporation Ltd.), hereinafter called 'NTPC', is a Government

Company within the meaning of the Companies Act, 1956. It is

presently engaged in the business of Generation and sale of Electricity.

MNRE vide letter ref no. 32l8l2Ol3-14AISM dtd. 05.03 .2015 has

conveyed the sanction of the President of India for implementation of a

scheme for setting up of 15000 MW grid connected solar PV Power

plants through NTPC irnder National Solar Mission (NSM) in a span of5 years from 2014-15 to 2018-19 in three tranches as mentioned below.

3) NTPC's overall role in the MNRE scheme shall be limited to selection

of SPDs for the targeted capacity, trading of solar power etc. and would

not involve any investment in the solar power projects.

4) The 3000 MW capacity Solar PV plants under Tranche-I will be set up

based on model of bundling of Solar Power at fixed Levelised tariff

with unallocated thermal power at CERC determined tariff. The

required unallocated 1500 MW of thermal power will be allocated to

various benefi ciary states.

5) The Solar Power generated from the selected plants shall be purchased

directly by NTPC at the tariff determined for each respective SPD

through the e-bidding process. NTPC will bundle this Solar Power with

unallocated thermal power from coal based stations of NTPC and sell

the bundled power to Beneficiary States at weighted average tariff ofthe solar & thermal components along with the trading margin on the

bundled power as per MNRE guidelines.

6) The Hon'ble Commission has notified the Central Electricity

Regulatory Commission (Procedure, Terms & Conditions for grant oftrading license & other related matters) Regulations, 2009 (hereinafter

'Trading T.icense Regulations 2009') The Petitioner is filing the present

petition for grant of trading license as per Trading License Regulations

2009.

7) In terms of the Trading License Regulations 2009, the NTPC has filled

the application (Fonn-I) to be submitted to Hon'ble Commission along

with requisite documents.

8) It is hereby submitted that NTPC owns Dadri Loni Transmission Line

and is billing transmission charges to beneficiaries. The same is being

considered part of the project as per CERC order dtd.2o.o4.2ol5.

9) It is submitted that the Petitioner has paid the requisite Miscellaneous

application filing fee of Rs. 3 lakhs only vide UTR No.

SBHY9 I 534827 430 I on 14.12.2015.

10) After the grant of license, the license fees for the first year shall be paid

within 30 days after grant of license & for the subsequent years shall be

paid as per the provisions of the CERC (Payment of Fees) Regulations,

2012.

Prayer

In the light of above submissions, the Petitioner, therefore, prays that

the Hon'ble Commission may be pleased to:

i) Grant trading license to NTPC in terms of the License TariffRegulations 2009.

ii) Pass any other order as it may deem fit in the circumstances

mentioned above.
