Interest Litigation (Suo Motu) No. 1 of 2017,

regarding Translation of the Portuguese Code of

Civil Procedure, 1939, the Government of Goa has

complied with the above directives and translated

Portuguese Code of Civil Procedure, 1939 into

English.

Now, therefore, the said translated Portuguese

Code of Civil Procedure, 1939 into English version

is hereby published in the Official Gazette and

Booklet form for the information of the general

public.

Provisional Declaration

Whereas, the applicant specified in column No. (2) have applied for grant of land in pursuance of

Sections 4(a) and 8(2) of the said Act vide his application received in this office as per dates indicated

in column No. (3).

by her in accordance with the Goa (Abolition of Proprietorships, Titles and Grants of Lands) Rules, 2015,

and has also been examined independently based on the report received from the concerned Mamlatdar

and Custodian of Evacuee Property in respect of the lands which were vested in the Custodian of Evacuee

Property as “Evacuee Property” under the Goa, Daman and Diu (Administration of Evacuee Property) Act,

1964.

And whereas, the applicant mentioned below has paid the land revenue amounting to Rs. 25/- as

assessed in terms of Section 6 of the Goa (Abolition of Proprietorships, Titles and Grants of Lands) Act,

2014 and has duly submitted the payment receipt vide No. 13/84 dated 18-09-2017.

And whereas, in reply to this office letter dated 23-06-2017, the Custodian of Evacuee Property vide

its letter dated 29-06-2017, had not raised any objection in issuing Provisional Declaration to the above

applicant.

And whereas, the undersigned being satisfied that the following applicant fulfills all the essential

conditions/criteria laid down under the Goa (Abolition of Proprietorships, Titles and Grants of Lands) Act,

2014 and rules framed thereunder, hereby provisionally declare the applicant as “Occupant

Class-II” under the Goa Land Revenue Code, 1968 subject to the following conditions:

(1) The land granted shall be used only for the purpose of dwelling house within the area as mentioned

hereinabove.

(2) The grantee, or his/her heirs, assigns and legal representatives shall not mortgage, sell, assign or

otherwise transfer the land or any portion thereof except with the previous sanction of the Government.

(3) If the grantee commits breach of any of the conditions or any provisions of the Goa (Abolition of

Proprietorships, Titles and Grants of Lands) Act, 2014 and rules made thereunder, the Collector may resume

and take possession of the land granted to him/her, and that, he/she shall be liable to be evicted from the

said land.

(4) The grantee also agrees to unconditionally abide by any other terms and conditions which the

Collector/Government may like to impose from time to time.

(5) The grantee shall not create any third party rights in respect of the Sanads nor change the nature

of the property, nor exceed the existing plinth area or reconstruct the existing houses, except repairs, until

further Orders of the Hon’ble High Court of Bombay at Goa.

In case, any interested person in the lands specified above, has any objection to the said provisional

declaration, he/she may file objection/say in writing, within two months from the date of publication of

this provisional declaration in Official Gazette and notice is hereby given that the objections received

under sub-section (1) of Section 12, shall be disposed off individually and appeals against such decision/

order of the Collector shall lie with the Tribunal.

The said declaration, as modified by any orders, if any, passed by the Collector, or where an appeal has

been filed with the Tribunal, as modified by the decision of the Tribunal, shall be final and shall be conclusive

evidence of the conferment of the occupancy rights under Sections 4(a) and 8(2) of the said Act. This

conferment of occupancy rights shall be subject to the result of Writ Petition No. 479 of 2016 before the Hon’ble

High Court of Bombay at Goa.

work involves laying of sewer line by trenchlessmethod (Horizontal Directional Drilling, Micro-Tunneling) and construction of manholes. Thesesewer line leads sewage to Sewerage TreatmentPlant (STP) situated at following location:

(1) Kavalem (2) Bandora (3) Curti.

And whereas, it has been further informed thatthey have proposed laying of following sewer linesby Micro Tunneling Method and work order of thesame has been issued to M/s. Rock Drill Project Pvt.Ltd. on 08-01-2016 and requested to issue permissionfor road closure and diversion for 160 days forstretch a) i.e. from Civil Court Ponda to Kapleshwarijunction.

And whereas, the Superintendent of Police,South Goa, Margao, vide letter dated 17-01-2019has submitted no objection for road closure forlaying sewer line in Ponda Taluka.

And whereas, it is revealed that the workmentioned above is of urgent nature and it requires

to divert the traffic;

And whereas, I am satisfied that the diversion oftraffic is essential during execution of the abovework;

Therefore, I, Agnelo A. J. Fernandes, DistrictMagistrate, South Goa, Margao, in exercise of powersconferred under Sections 115 and 116 of the MotorVehicles Act, 1988 (Central Act 59 of 1988) readwith Government Notification No. 5/28/88/TPT (part)dated 26th September, 1989 being satisfied that itis necessary in the interest of public safety andconvenience do hereby permit for temporary closureof roads for stretch a) i.e. from Civil Court Ponda toKapleshwari junction and to also temporarily divertall type of vehicular traffic as per annexed plan for160 days and erect the signages accordingly subjectto compliance with the conditions mentionedbelow:-

Conditions:

1. The applicant/contractor is directed to ensurethat no annoyance is caused to the generalpublic and nearby residents.

2. Should adhere to all the rules and regulationsin force.

3. The applicant/contractor is directed to obtainnecessary permission from other competentauthorities.

4. The applicant/contractor is directed to takenecessary precautions and engage all safetymeasures during execution of the work.

5. The applicant/contractor is directed to ensurethe safety and security of the road commuters.

6. The applicant/contractor is directed to deploy

sufficient number of security guards/traffic

marshals/volunteers with retro reflective

jackets at either side of the road for traffic

control and regulation.

7. The applicant/contractor is directed to display

proper signages of “Road Closed”, “No Entry”,

“Take Diversion/work in progress” etc. on both

the sides of road closure, flash light for

guidance of the motorists, pedestrians and

other road users.

8. If any untoward incident arises due to poor

barricading/non-applying of glowing/

/reflective tapes then the concerned

contractor/authorities shall be held

responsible for the same and be liable for

criminal proceedings.

9. The applicant/contractor is directed to ensure

that there are no loose gravels of soil/stones,

leftovers on the road/shoulder of the road after

the completion of work.

10. All safety measures shall be adopted by theapplicant/contractor for ensuring safety of theworkers engaged for the construction workand of the motorists, pedestrians, etc.

11. The area around the work should be properly//strongly barricaded and illuminated with redlight, glowing/reflective tapes to preventaccidental falling of pedestrians, motorists,cattle and other road users.

12. The applicant/contractor is directed to informin advance the exact date of commencementof actual work to the Traffic Cell, Ponda andPonda Police Station well in advance.

13. The applicant/contractor is directed toapproach IC Traffic Cell, Ponda with a formalrequest for deployment of Traffic Police, ifrequired for traffic regulation, on advancepayment basis as per prevailing Govt. rates//service tax, etc. The same shall be providedas per availability.

14. The equipments/material if any kept on theproposed road shall be covered withilluminating warning sign during night time,so as to avoid from any untoward incident.

15. The applicant/contractor is directed to restorethe original condition of the road soon afterthe completion of the work by all means.

16. The applicant/contractor is directed to ensurethat alternate road made available for diversionis left free for vehicular traffic without anyobstruction.

17. The applicant is directed to ensure that oneofficer is present to oversee the entire worktill its completion.

18. The applicant/contractor is directed to carryout work of road cutting during late nighthours or on public holidays so as to avoidtraffic jams and inconvenience to public ingeneral.

19. The applicant/contractor shall be responsiblefor any major/minor accidents and untowardsincidents occurred due to non observance ofsafety measures.

20. If the applicant/contractor fails to abide bythe conditions laid above or if the NOC issuingauthority feels so, the NOC is subject tocancellation/revocation at any given time.

Theelection to the members of Managing Committee(Managing Board) of Comunidade of Sancoale ofMomugao Taluka, and Comunidade of Balli ofQuepem Taluka will be held as per the directivesof the Hon’ble High Court of Bombay at Panaji-Goaas per Order passed in Writ Petition No. 153/2019filed by Shri Damodar Naik of Sancoale at theirusual meeting place, on 17-02-2019 from 10:30 a.m.onwards.

The Hon’ble High Court has issued the following

directions.

1. Video recording/filming of the entire process

will be done.

2. No mobile phones will be permitted to be

taken inside the polling station.

3. Only the members/voters will be permitted toenter the gate/compound wall of the premises.Non-members/bystanders etc. will not bepermitted to enter inside the gate.

4. No fresh nominations shall be accepted andthe elections to be held on the basis of thenominations already received and acceptedon 2nd December, 2018 with regards toSancoale Comunidade & 9th December, 2018with regards to Balli Comunidade.

5. Only the voters share holders whose namesare reflected in the minutes of theproceedings dated 2-12-2018 as regards toSancoale Comunidade & the voter//components whose names are reflected inthe minutes of proceedings dated 9-12-2018as regards to Balli Comunidade will bepermitted to take part in the election nowscheduled on 17-02-2019.
