Sooners suspend Joe Mixon by Kyle Szymanski

Former Freedom High School football p layer Joe Mixon has been suspended by the University of Oklahoma football team for the upcom­ing season after he was charged with a misdemeanor count of acts resul ting in gross injury, stemming from his alleged as­sault of a 20-year-old woman at an Oklahoma restaurant last month, the University of Okla­homa announced in a statement this week.

"As the university has dem­onstrated in the past, we are committed to winning the right way," Vice President for A thlet­ics Joe Castiglione and head coach Bob Stoops said in a joint sta tement. "As an example to others, OU sets the highest pos­sible standards for its student

athletes, coaches and staff." Mixon, who faces up to

a year in prison if convicted, pleaded not guilty to the charge during his arra ignment in Cleve­land County District Court on Monday. He was booked, but re­leased on his own recognizance with an order to not have any contact with the victim in the case.

"As we have maintained from the beginning, it is our be­lief that Joe reacted instinctively after being racially slurred and physically assaulted by a highly intoxicated young woman a nd her male friend," said Mixon's attorney Kevin Finlay at the time the charges were announced last Friday. "We strongly disagree with the series of events as por­t rayed by Norman PD. Justice knows no gender bias and we do not believe that Joe's actions were criminal in nature. "

Accord ing to the affidavit released by Cleveland County District Attorney Greg Mash­burnt last Friday, Norman, Oklahoma Police o fficers were dispatched to Pickleman's Gour­met Cafe on July 25 on reports o f an assault. Officers contacted the victim, as well as several wit­nesses, who stated that during a

verbal altercation, an unknown black male, later identified as Mixon by at least two witnesses, punched the victim in the face, knocking her unconscious.

The victim was transported to the Norman Regional Hos­pi tal where she was found to have a fractured jaw, fractured cheekbone, fractured sinus and fractured o rbit, which caused a hematoma on the left eye.

Police later viewed a sur­veillance video of the incident, which showed Mixon and the victim in a verbal altercation both outside and then inside of the business, according to the af­fidavit.

After being pushed, Mixon allegedly lunged at the victim in an aggressive manner, lead­ing with his head and wi th his right fist clenched by his side.

Answering the call to public service is about to get more lu­crative if you live in the City of Oakley. After waiving the last opportunity for a stipend raise back in 2012, the Oakley City Council agreed last week to an ordinance proposal that would increase their monthly stipend by $21.75, bringing the total al­lowance to $456.75.

While the ra ise is justified as California law permi ts 5-per­cent stipend adj ustments every two years, the council sa id the primary a im of the ra ise is not to better their own lives, but to make a seat on the council more appealing to qua lified lower-income candidates as

Police confiscate $500,000 pot grow

Oakley police officers respond­ing to a residential fire Sunday at about 4 a.m. on Bramante Court dis­covered the house was being used to grow marijuana, according to Jimmy Lee, spokesman for the Contra Costa County Office of the Sheriff. The fire was extinguished and no injuries were reported.

ln a ll, there were approximately I ,000 plants worth about $500,000 in­side the residence. No residents were home at the time. It appeared someone tampered with the utility box in the ga­rage, where the fire may have started, according to officials. Detectives are continuing to investigate the incident.

The City of Oakley is invit­ing residents to participate in the 2014 Leadership Academy, a free, interactive civic education program designed to provide those who live and work in Oakley a breadth of background and knowledge of the intricacies of City operations and processes.

The purpose of the progra m is to provide a n interesting perspec­tive into the working of Oakley, to develop civic leadership and to build a st ronger communi ty th rough well-informed and engaged residents. Topics of discussion in­clude public safety, communi ty de­velopment and quali ty of li fe.

who relish the chance to enjoy history you can put your hands on. We some­times go to a lot of trouble to immerse ourselves in another era, but the fact is you don't always need to go far to do

that. Come Sept. 14, there 's a prime ex­ample of that taking place right here in East County.

That's when the East Contra Costa Historical Society will hold its an-nual barbecue at the Byer-Nail House, the ECCHS museum located on Sellers

Avenue. The house was built in 1878 and donated to the ECCHS in 1986. Today it houses an amazing collection of rel­ics, from a shotgun owned by Charles Marsh to farm equipment, fire engines, tools and even an omnibus (wagon) used to ferry passengers to the Byron Hot Springs Resort during its heyday.

But although there are hundreds of things at the museum that definitely look their age, don't expect everything to look that way. The house and many of its displays (including the like-new omni­bus) have been restored over the years by volunteers whose efforts are remarkable both in the volume and quality of the work they've done.

The recently restored one-room Eden Plains Schoolhouse will be open for tours at the annual ECCHS Community Barbecue on Sept. 14.

Kathy Leighton has been on the ECCHS board longer than she probably cares to admit. She's witnessed first-hand the progress that has been made to en­sure the history of our area is preserved and made avai lable for locals to learn from and enjoy.

"Things seem to go in cycles," Kathy says. "Some years, there's a lot going on, and others not so much." Right now, she added, the former is true, with dozens of active volunteers pitching in - more than she's ever seen before.

Doing most of the heavy lifting is

a group of retired folks who call them­selves the Breakers. Kathy says they adopted the name because they take a Jot of breaks, but you'd never know it by how much they get done.

I stopped by the museum this week and found Breaker Bob Byer hard at work, repairing the museum's picket fence. A member of the Byer family who has donated countless hours to the mu­seum and local schools, Bob said being a Breaker is more than just something to keep busy. " It's mostly the camaraderie with the other guys and doing things the public can enjoy," he said.

Perhaps the best example of the Breakers' work is the one-room Eden Plains Schoolhouse. Built in 1868 in Knightsen, the building was donated to the ECCHS and moved onto the mu­seum grounds a half-dozen years ago. It's now been fu lly restored and filled with desks, pictures, chalkboards, McGuffey readers and even a coal scuttle like that originally used to fuel the school's pot­belly stove.

The school fits perfectly into one of the ECCHS' most notable projects, a month-long educational project known as School Days. This year, more than I ,400 local third-graders participated, getting hands-on experience pumping water, washing clothes with a washboard, churning ice cream, excavating a midden

Festival returns to The Streets

It's lucky 13 for this year's Brentwood Art, Wine & Jazz Festival as the area's premiere festival returns to The Streets of Brentwood, Saturday and Sunday, Aug. 30 and 31 for its 13th season.

Hosted by the Brentwood Art Society, the popular festival is the Society's biggest fundraising event, with proceeds supporting the arts in local schools and throughout the community.

This year's lineup boasts offerings from local vintners and wineries including Hannah Nicole

The Divas and Jag. Festival headliners include Juan

Escovedo on Saturday night and the Delta Wires on Sunday. Kaye Bohler,

a familiar presence in the blues scene, is hosting a release party for her latest CD at the festival and is also scheduled to perform.

The Artist's Garden will be teeming with paintings, sketches, glasswork, jewelry

Brentwood's Bark in the Park Dog Parade returns to Brentwood City Park this Saturday, Aug. 23 at 9 a.m. The second annual parade, which is hosted by the Brentwood Advisory Neighbor­hood Committee, is a family-friendly community event where dogs are en­couraged to wear costumes and strut their stuff.

Invisible Fence will make a presen­tation of animal oxygen masks to the fi re department at 9:30 a.m. The Res­cue Dog Parade, featuring dogs up for adoption, begins at 10 a.m., followed by the main Dog Parade at 10:15 a. m. Various dog-related vendors will host booths located throughout the park. After the parade, families are encour­aged to visit with the dogs available for adoption and enjoy the playground and water play area.

All participating canines must be leashed, properly licensed, tagged and current on their vaccinations.

Orange in 1956, Mary was preceded in death by her parents Dennis and Matilyn Long. She is survived by her husband Alan Morris, her children Andrew and Amy, her daughter-in­law Corby, her grandchildren Kailey, Faerlene and Theodore, and siblings William Long and Pamela Long.

Mary lived a full and active life. She grew up in Millbrae and attended Mills High School. Mary's first two years of college were at UCLA where she was a member of the Kappa Alpha Theta sorority. Mary graduated with a BA in history from San Francisco State University. Sh01tly after graduation, she met Alan Morris and they were married in 198 1. They moved with their young children to Oakley in 1986.

Her part-time position as the office man­ager for Central Valley Tire in Antioch allowed Mary time and energy to devote to her school­aged child ren and to pursue her involvement

Adrian was an entrepreneur, owning his own painting business. He was a member of the Delta Diablo Detachment 11 55 Marine Corps League and an avid Oakland Raider's fan and season ticket holder.

Adrian lived a joyful life. He had a passion for music. He loved Disneyland and would often vacation there with his family. Adrian will be re­membered as a gentle and kind soul who loved fully and deeply.

Her most recent employ­ment was with Meals on Wheels where she delivered meals to seniors and handled admin­istrative duties. An enthusiastic traveler, Mary and Alan enjoyed several domestic and interna­tional adventures, including a recent European cruise.

Leaving behind many dear friends, co­workers and Soroptimist Sisters, Mary will be most fondly remembered for her kind spirit, her warm and welcoming heart, her beautiful smile, and her easy and genuine laugh. She will be profotmdly missed.

Funeral services will be led by Deacon Tom Kelnhofer of St. Mattin of Tours, Satur­day, Aug. 23, at II a.m. The church is located at 5294 Concord Blvd. in Concord.

LETTERS TO THE EDITOR

Pensions aren't the problem Editor:

I'm not going to try changing anyone's mind about public employee pensions. Every one is entitled to their opinion. They are not, however, entitled to their own facts.

The overriding fact is that the East Contra Costa Fire Protection District Board of Directors has done everything permitted by current law to reduce or manage pension costs. We have implemented every part of the Governor's Two-Tier Plan as passed by the legi slature in 2012. Our latest contracts with the employee associations call for each employee to pay 100 percent of their share of pension costs. We are fully participating in, and current with our payments to, the Contra Costa County Employees Retirement Association program to catch up with unfunded liabilities. Our portion of unfunded liabilities remains the same no matter how many current employees we have.

We have never had the more outrageous pension spiking provisions of some other districts, and our contributions to CCCERA do not help fund those payments. We are only pooled with CONFIRE, which is a net benefit due to our size. As to the vacation sell-back controversy of the last two years, that is gone forever, barring a reversal in an appellate court.

Any employee who was going to exercise that right had to retire by a court-imposed deadline last month . Some did so, from CONFIRE and other county departments, but none did from ECCFPD. We have our own program to eliminate unfunded liabilities from Employee Medical by 2018-19, and we are current with that.

The fire chief and the board finance committee work continuously with CCCERA to stay abreast of developments, obtain our most favorable rates and accurately integrate them into our five- and ten­year budget projections.

Mr. Aliferis of the Contra Costa Taxpayer's Association is well aware of this as we have been reaching out to them for months and providing them with any information they desired. Given that, his statements made at this month's ECCFPD board meeting were shamefully misleading. Both he and Mr. Bray will acknowledge these facts in private conversation, but have chosen to not do so publicly in any media forum I have seen.

Anyone who wants something more done about pension costs, your chariot awaits. It's called the Capitol

Corridor. Get on one and go talk to the only people who can change pension law, or sign an initiative petition, or wait to see what happens in the courts. That is your right.

But if you want to place the lives, health and property of I 05,000 of us at further risk to make a point, you and I have issues.

Benefit assessment is bogus Editor:

I am very disappointed that the ECCFPD is asking for our support for a benefit assessment when they have not addressed their high pension costs.

More than half of their budget is needed to pay the pensions of retired firefighters. They cannot continue operating without a change in course.

As a property owner, I don't mind an increase in assessments if it is to maintain the necessary staffing levels. But I will not vote for an increase when the majority of the costs is for retired firefighters. Once the ECCFPD has adequately addressed the pension problem, then I will vote for an increase.

And I am dismayed that they are blackmailing us into voting for the assessment by planning to temporarily close one station!

Stop the tax madness Editor:

It seems to me that on a daily basis we are constantly hearing we need to raise taxes to raise funds for this or that. The most recent item is for the East Contra Costa Fire Protection District.

The so-called assessment claims the fund s are needed to keep two stations open. When we ask how did this happen in the first place, it appears that we had some personnel that were getting six-figure pensions in retirement even though there weren't funds to cover these kinds of pensions. The problem still exists even today.

If we ran a business like the board is running the district, we would be out of business to say the least. It is my belief that until the board learns to operate in a fiscally responsible manner, we are not to give them a penny more.

It is time the people who are civil servants remember that they are civil servants. If they want to make a large sala ry or a huge pension, they need to seek it in the private sector. We value our firemen and policemen tremendously because they

have answered their calling. Now our public officials need to run their departments as a business as well. Then when they really need the money, people like us won't have to look at every bond request with suspicion.

Nearly 300 people are leaving the state of California per day because they cannot afford to either raise their families here or retire here. The Golden State is quickly becoming the Tarnished State.

This letter is in reference to Rick Lemyre's Living History column. I highly recommend that you read "General Vallejo and the Advent of the Americans" by Alan Rosenus. This book received two awards. One was for Best Biography of the Year, and the second was for Western Writers of America Spur Award. After reading, I think you will change your opinion of John Marsh.

John Bidwell called him "one of the most selfish of mortals."

He technically was not a doctor either. He only received his Bachelors of Art degree from Harvard, so that does not entitle him to be called doctor.

He mistreated and disrespected the Indians and Mexicans who served under him at his homestead. He also disrespected and was dishonest to the host of the time, which was Mexico under General Mariano Vallejo.

If we are going to tell history, then let us tell the truth. It has been a long­standing practice to raise one culture while ignoring and suppressing the other. This must end, and for us to become united, we must acknowledge truth.

Community advocate leaves legacy of love

When it came to helping others, Mary Katherine Morris knew no bounds. Her devotion to the community and particu­larly the senior population was a trade­mark of the popular and much-loved Oakley resident.

This weekend, friends, relatives and co-workers will gather to say goodbye to the woman who touched so many lives.

Morris, 58, passed away Aug. 12 fol­lowing complications from surgery.

A few words all divorcing par­ents should share with their kids

Divorce is w1deniably a tumultuous experience for any couple, regardless of how an1icable the dis­solution may be. It's easy to get caught up in the roll­er coaster of emotions, as well as the challenges of navigating the divorce process itself. It is important to remember there are innocent bystanders sitting on the sidelines, watching and listening. Regardless of their age, careful attention must be paid to the children of divorce, minimizing the fallout as they interpret it Here are a few words of advice to offer children that may help guide them through this dif­ficult period and ease their adjustment.

1) It is not your fault. Whether a child is three or 30, it is a natural response to look for reasons why parents divorce. As children search for answers, one place they may look is inward. How children perceive a situation is altogether unpredictable, and may be based on something as seemingly insignifi­cant as a passing glance or an off-the-cuff comment.

2) There is no wrong way to feel. When adults go through a divorce, emotions run the gamut. The

same holds true for children. Children of all ages need to know that on some days they may feel sad, angry, hurt or even happy about the change in their family's situation. All of these feelings are natural, and may fluctuate throughout the day and over time.

3) There is outside support if you need or want it. As a caveat to the above, if a childs perceptions about divorce become irrational to the point of being self-destructive, it is advisable to seek help from a qualified mental health professional. Even if a child's response is not threatening, turning to an outside party such as a therapist, support group, clergyman, trusted relative or family friend for add­ed support could be beneficial. Help is out there. It is only a matter of asking for it.

whenever the need arose. If there was a need for a driver, regardless of the geo­graphic area, Mary would step up and de­liver meals."

Her quest to make a difference also lead her to Soroptimist International's Pittsburg chapter where she held several volunteer po­sitions over the years before she transferred to the Delta chapter seven years ago. The Soroptimist mission to globally improve the lives of women and gi rls through mentor­ing and empowerment called to Morris, and she remained devoted and heavily involved until her death - in fact she was recently elected treasurer.

"She did an amazing job holding the club together with her financial knowl­edge. She was a wiz at what she did," said Jan Schults, Soroptimist International of the Delta president. " Mary was a won­derful woman who would do anything to help you."

While Mary earned her Bachelor 's Degree and had an open-ended profes­sional future, her sister Pamela Long states that she decided early on to "put aside any personal aspirations and be more involved

in the community." Mary gave up the idea of pursuing a more lucrative career to not only stay home and raise her children, but to become a back-up "mom" to the kids in her neighborhood. The Morris household became what Pamela calls "ground zero," the home where all the kids gathered af­ter school for home-made cookies and an extra watchful and caring eye. According to Pamela, " Her life was richer and fuller because of it."

To those left behind , Mary be­queathed memories of her sense of humor, her compassion and her engaging laugh. She is survived by her husband Alan Mor­ris, her children Andrew and Amy, her daughter-in-law Corby, her grandchildren Kailey, Faerlene and Theodore, siblings William Long and Pamela Long, and the many friends, co-workers and community members whose lives she touched.

Funeral services will be held Satur­day, Aug. 23, at II a.m. at St. Martin of Tours Church, 5294 Concord Blvd. in Concord.

Delta boating safety a top priority by Heather Brewer

Boaters around the Delta are soaking up the last few weeks of sun in the season, but even though the dog days of summer are winding down, the focus on safety should not.

In the Delta, the most commonly seen boating safety mishaps are boat wake and speeding violations, according to Sgt. Paul Beard with Contra Costa County's Office of the Sheriff Marine and Air Support Services. While the numbers of accidents this year are currently fewer than last year, there is also a decrease in the number of boaters out on the Delta.

churning up excessive wake are gener­ally well known, the dangers of riding on the back and sides of boats aren't as well known. These areas of a vessel are particularly dangerous as toxic levels of carbon monoxide can build up anywhere in or around a boat. Death or injury can result from carbon monoxide poisoning, which results when a person breathes in the odorless, colorless gas that can be gen­erated from auxiliary boat equipment like stoves, heaters, refrigerators, generators and hot water heaters, according to the U.S. Coast Guard.

" We are currently sitting at 11 ac­cidents and one fatality this year, com­pared to 16 accidents and one fatality at the same time last year, but we seem to be experiencing a 10 to 20 percent decrease in the amount of boaters this year," said Beard. "Most of our accidents are vessels (colliding with) submerged and station­ary, above-water objects. Too great of speed and improper lookouts seems to be the primary cause."

Some of the places where the dan­gerous fumes can accumulate include under inadequately ventilated canvas en­closures, near blocked exhaust outlets, in any enclosed space, or over and around the backs and sides of boats as they idle. The gas can remain there even after the engines are turned off, so it is important to never sit, teak surf or hang on the back deck or swim platform of boats while the engines are running.

Other issues include irregular life­jackets use and boating while under the influence of alcohol.

"The things I see the most when I am out on the water is children not wearing life jackets and people being lax about drinking on boats," said Dennis Park, a

Heritage boys aim to dominate in pool by Kyle Szymanski

After winning the Bay Valley Athlet­ic League three years in a row, it's easy to predict the Heritage boys water polo team will float to the top of the standings again in 2014.

But if the Patriots don't want their streak to dry up, they must contend with the loss of II players to graduation, in­cluding seven all-league members.

Coming ofT their fourth league cham­pionship in five years, the Patriots will rely on a core quartet of returning players and a few newcomers as they look to take a step forward this season.

Gone is MVP goalkeeper Jake Mat­thiessen and all-league players Daniel Comforti, Ryan Ellis, Brendan Goyette, Austin Conner, Walker Thaning and Daniel Schafer from a squad that went undefeated in league p lay last year before getting bounced in the first round of the North Coast Section playoffs by Las Lo­mas.

Returners Matt Bryant (all-league second team in 2014), Jack Strauss, Rob­ert Hunsinger and Cole Zieman are ex­pected to buoy the squad tlus season, said head coach Nick Araujo.

Colby Baum will take over for Mat­thiessen in the cage. Fellow junior varsity standout Jo hn Moore is a lso expected to make a splash on the va rsity level.

"The boys are committed and buying in," Araujo said. "The boys know they are expected to participate and do well."

Meanwhile at Freedom, which fin­ished in second place in the BVAL with a record of 15-8 and 6-2 in league play, the Falcons will miss the presence of a ll­league members Christian Henry, Cam­eron Ott-Bales and Italo Tapia, but a re

expected to be held up by returners Drew Irwin (all-league first-team in 20 13), Ja­cob Roeder (a ll-league second-team last year) a nd Chris Warren (returning all­honorable mention team member).

Liberty, which coasted into third place last year with a record of 3-9 and 2-8 in league play, will feature an all-se­nior squad that must compensate for a

mixture of injuries, ineligibility and play­ers that have moved out of the area. Key starters Preston Charles-Merrill , Billy Shultz and Nathan Reinders won't be available for the Lions this year, but a pair of first-team all-league players return in Alec Pastor and Austin Power.

Trey Griffen, who split his time be­tween water polo and band, is a lso ex­pected to return for the Lio ns.

"We've only had a few days of p rac­tice but it looks like we have some po­tentially good , solid starters to replace those guys (Charles-Merrill, Shultz and Reinders)," said Liberty head coach Kurt Roessler.

Roessler, who handled coaching the junior varsity and varsity squads by him­self last year, expects to get one assistant and possibly one parent volunteer.

Deer Valley limped to a fourth place finish last year in league play, and figures to rely on a cast of newcomers to help them along this season. All-league play­ers Mark Ortlieb and Noah Abuda have graduated , but the Wolverines should build around returning all-league second­teamer Ryan Herrington.

The 20 12 and 2013 Bay Valley Athletic League girls tennis seasons have fo llowed similar scripts.

While the lineups were far from identical, both seasons ended with the Heritage Patrio ts atop the league standings.

Although the 20 14 season is at its earliest stage, Heritage is a strong favorite to win the league champio nship fo r a third year in a row. The Patri­ots three doubles teams will look a lot different in 2014, as five of the six players have graduated, but five of the six players in the singles lineup are the same.

" It would be pretty surprising if it was any­thing other than Heritage then Pittsburg one and two," said Freedom head coach Steve Amaro. "Af­ter that, it's an open race for the third spot."

Part of Heritage's advantage is the dominance o f No. I p layer Courtney Samuda, a junior.

She's won the league tournament in each of her first two years at Heritage, going virtually un­tested thorough the regular season in both years.

A season ago, she wrapped up the league title by beating Pittsburg's Ivy Hughes, who is also now a junior and figures to help the Pirates to another strong season.

Aside from Samuda. fellow junior Erika Publi­co and seniors Stephanie Mitchener, Micah Balin­git and Samina Collins a ll return from the singles lineup for the Pat riots, while senior Dani Tamura played varsity last yea r on the doubles side.

Freedom's No. I singles player will be senior Sophia Obregon. But perhaps the most important Falcon will be the No. 2 playe1; junior Marisela Lares. Samuda is tough for any team's No. I to beat, but Amaro hopes that Lares can be similarly don'llnant at the No. 2 spot, neutralizing the edge at the top.

"She's in line to really equalize the playing field," Amaro said. " If that's the case, then it comes down to what we and the other teams have in mo­tion."

Freedom will a lso return seniors Georgia Flores, Daphne Torres, MaKenzie GrifTts, Jourdan Eckel and sophomore Bria Eckel.

Li berty's team is young, but head coach Pris­cilla Macksoud is encouraged with the group that she has at the ready.

"We have many new and inexperienced p lay­ers joining the team," Macksoud said. "It may be a rebuilding year, but there is a lot of potential tal­ent we are looking forward to developing. Overall,

The victim reacted by slapping Mixon with an open right hand, near his left ear. He then struck her on the left side of her face with his closed right fist, knock­ing her into a tabletop and then to the ground where she laid motionless.

The victim told officers at the scene that the altercation stemmed from the use of a homosexual slur directed towards her friend by Mixon.

This way, the folks who are voting on the ordi­nance may or may not necessarily obtain any advantage because they may or may not still be on the council when the new rates begin."

Since council passed on its last op­portunity for a raise, the monthly stipend has remained at $435 for nearly four years.

Vice Mayor Doug Hardcastle light­ened the discussion by finding humor in the increase.
