Some of the main concerns that have arisen after the end of the war in May 2009, in the North and East of the Country are in relation to land and land recovery. It is alleged that, large extents of state and even private land have been acquired by the Government for “public purpose”. The loss of relevant documentation has made the process of claiming ownership to land that had been abandoned during the war all the more difficult. This presentation was included in the programme to raise awareness on the Civil, Land and Religious Rights. It was conducted by the 'Religious Liberty Commission' of the NCEASL in Killinochchi in the fourth quarter of the year 2012. One of the main focus areas of the session on “Land and land recovery” was on 'Obtaining legal documents in Sri Lanka'.

• Make the relevant Application in order to receive a copy of the Original Birth Certificate immediately

• Obtain the B38 form from the Registration Department at the Divisional Secretariat

• The reference note that the Registrar hands over should not be misplaced.

• The copy of the Birth Certificate can be obtained on the date that the Registrar at the Divisional Secretariat specifies when the person makes the application

OR it will be posted (a self addressed envelope with a stamp should be provided to the Registrar at the Divisional Secretariat)

• It will take approximately a month for the applicant to receive the Birth Certificate.

• If it’s required urgently an

appointment with the Registrar must be made and the certificate can be received within a day.

• The National Identity Card (NIC) is issued by the Office of Registration of Persons Record Room in Colombo

• The appropriate form must be obtained from the local Grama Sevaka

• The completed form must be handed over to the Grama Sevaka

• The Grama Sevaka will forward an application through the Divisional Secretariat to the office in Colombo

LAND DEED

• Is a result of the transaction between individuals. The document received is called the Deed of Transfer.

• This should be executed by a Notary and the signature of the owner of the said property is required

PERMIT

Document given in accordance to the Land Development Ordinance to register land given by the state. Complete ownership is not given, and the state will set out conditions on how the land can be used and all conditions need to be adhered to by the individual who receives it.

LAND GRANT

• Also called Swarna Boomi, given by the state as a grant. The official document has the official government stamp. The individual who receives this grant will have complete ownership of land, unlike the restricted ownership of the permit land.

• Complete the appropriate form obtained from the Registrar of Lands or the Government Agent (GA) in the respective district

• The reference slip must not be misplaced. The relevant documents should be handed over on the specified date.

Deed

• It should be signed by the Transferor, two witnesses and should be attested by a Notary

• It should be registered in the Land Registry, so the public are aware of the ownership ( the current or past owners of the respective land) and the ownership can be ascertained

• If the Land Deed and the Land registry folios which are maintained by the relevant land registry’s in each area are destroyed, a duplicate Deed can be obtained from the land registry, where the notary to the deed had practiced.

• Permits and Crown Grants are given by the state under the Land Development Ordinance

• For all Permit and Grants, the state will set out certain conditions in the legal document. The individuals must adhere to the conditions stated in the document by the state, if not the Grant or Permit can be cancelled.

• Each Permit will be renewed annually by the Government Agent (GA). If the GA is satisfied with the usage of the land , a Permit maybe transferred into a Grant

• Between 1950 and 1960 land grants were issued by the state - extent of 5 acres per person under the Middle Class Scheme.

• All Permits and Grants will be Registered in the relevant Divisional Secretariat

• The land by way of Permit or Grant cannot be sold. If sold it will not be considered a valid sale. The holders will not be given the land back in the event the state becomes aware of such a transaction. This is a clear violation of Grants and Permits.

• If a Permit / Land Grant is occupied by a third party, the owner of the Permit / Land Grant must make a complaint to the GA. Action in the District Court can be filed.

• Death of the Permit holder– the successor of the Permit / Land Grant must file an application within 6 months in the GA office to gain the property or the successor must hold physical possession of the property. If not the permit will be cancelled.

• Church property – If the church property has been taken over by a third party or the state – the church can file a complaint in the GA office or file a case in the District Court

• Church built on a Permit land – A Church built on such is not valid and deemed an illegal construction. This is so unless the permit gives the right to reside or to build a place of religious worship.
