In order to support review of the LAR, the NRC issued a request for additional information byletters dated February 8, 2011 (Reference 3) and March 16, 2011 (Reference 5). Duke Energyprovided the 30-day responses on March 7, 2011 (Reference 4) and April 15, 2011(Reference 6). On August 2, 2011, during a conference call between NRC and Duke Energyrepresentatives, the NRC requested that Duke Energy submit a proposed change to revise theFOL Physical Protection license condition to incorporate the language as agreed upon.

Attachments 1, 2, and 3 provide marked changes for Oconee Units 1, 2, and 3; McGuireUnits 1 and 2; and Catawba Units 1 and 2 respectively. No other changes have been made tothe previous submittals regarding the Cyber Security Plan.

There are no commitments associated with this submittal.

The information provided in this response does not impact the Significant Hazards Considerationconclusions provided in the August 16, 2010, submittal (Reference 2).

Pursuant to 10 CFR 50.91, a copy of this proposed amendment is being provided to theappropriate officials of the States of North Carolina and South Carolina.

A. Maximum Power Level

The licensee is authorized to operate the facility at steady state reactor core powerlevels not in excess of 2568 megawatts thermal.

B. Technical Specifications

The Technical Specifications contained in Appendix A, as revised throughAmendment No. 376, are hereby incorporated in the license. The licensee shalloperate the facility in accordance with the Technical Specifications.

C. This license is subject to the following antitrust conditions:

Applicant makes the commitments contained herein, recognizing that bulk powersupply arrangements between neighboring entities normally tend to serve thepublic interest. In addition, where there are net benefits to all participants, sucharrangements also serve the best interests of each of the participants. Among thebenefits of such transactions are increased electric system reliability, a reduction inthe cost of electric power, and minimization of the environmental effects of theproduction and sale of electricity.

Any particular bulk power supply transaction may afford greater benefits to oneparticipant than to another. The benefits realized by a small system may beproportionately greater than those realized by a larger system. The relativebenefits to be derived by the parties from a proposed transaction, however, shouldnot be controlling upon a decision with respect to the desirability of participating inthe transaction. Accordingly, applicant will enter into proposed bulk powertransactions of the types hereinafter described which, on balance, provide netbenefits to applicant. There are net benefits in a transaction if applicant recoversthe cost of the transaction (as defined in ¶1 (d) hereof) and there is nodemonstrable net detriment to applicant arising from that transaction.

The combined set of plans,which contains safeguards information protected under 10 CFR 73.21, isentitled: "Duke Energy Physical Security Plan" submitted by letter datedSeptember 8, 2004, and supplemented on September 30, 2004, October 15,2004, October 21, 2004, and October 27, 2004.

F. In the update to the UFSAR required pursuant to 10 CFR 50.71(e)(4) scheduled forJuly, 2001, the licensee shall update the UFSAR to include the UFSAR supplementsubmitted pursuant to 10 CFR 54.21(d) as revised on March 27, 2000. Until theUFSAR update is complete, the licensee may make changes to the programsdescribed in its UFSAR supplement without prior Commission approval, provided thatthe licensee evaluates each such change pursuant to the criteria set forth in 10 CFR50.59 and otherwise complies with the requirements in that section.

(3) Updated Final Safety Analysis Report

The Updated Final Safety Analysis Report supplement submitted pursuantto 10 CFR 54.21(d), as revised on December 16, 2002, describes certainfuture activities to be completed before the period of extended operation.Duke shall complete these activities no later than June 12, 2021, and shallnotify the NRC in writing when implementation of these activities iscompleteand can be verified by NRC inspection.

In accordance with the Commission's direction in its Statement of Policy,Licensing and Regulatory Policy and Procedures for Environmental Protection:Uranium Fuel Cycle Impacts, October 29, 1982, this renewed operating licenseis subject to the final resolution of the pending litigation involving Table S-3.See, Natural Resources Defense Council v. NRC, No. 74-1586 (D.C. cir. April27, 1982).

H. The licensee is authorized to receive from the Oconee Nuclear Station, Units 1,2, and 3, possess, and store irradiated Oconee fuel assemblies containingspecial nuclear material, enriched to not more than 3.24% by weight U-235subject to the following conditions:

a. Oconee fuel assemblies may not be placed in the McGuire Nuclear Station,Unit 1 and 2, reactors.

b. Irradiated fuel shipped to McGuire Nuclear Station, Units 1 and 2, fromOconee shall have been removed from the Oconee reactor no less than270 days prior to shipment.

Duke Energy Carolinas, LLC shall fully implement and maintain in effect all provisionsof the Commission-approved cyber security plan (CSP), including changes madepursuant to the authority of 10 CFR 50.90 and 10 CFR 50.54(p). The Technical Specifications contained in Appendix A, as revised throughAmendment No. 2-6 which are attached hereto, are hereby incorporated intothis renewed operating license. Duke Energy Carolinas, LLC shall operate thefacility in accordance with the Technical Specifications.

(3) Updated Final Safety Analysis Report

The Updated Final Safety Analysis Report supplement submitted pursuant to10 CFR 54.21(d), as revised on December 16, 2002, describes certain futureactivities to be completed before the period of extended operation. Duke shallcomplete these activities no later than December 6, 2024, and shall notify theNRC in writing when implementation of these activities is complete and can beverified by NRC inspection.

The Updated Final Safety Analysis Report supplement as revised onDecember 16, 2002, described above, shall be included in the next scheduledupdate to the Updated Final Safety Analysis Report required by 10 CFR50.71(e)(4), following issuance of this renewed operating license. Until thatupdate is complete, Duke may make changes to the programs described insuch supplement without prior Commission approval, provided that Dukeevaluates each such change pursuant to the criteria set forth in 10 CFR 50.59and otherwise complies with the requirements in that section.

(4) Antitrust Conditions

Duke Energy Carolinas, LLC shall comply with the antitrust conditionsdelineated in Appendix C to this renewed operating license.

(5) Fire Protection Program (Section 9.5.1, SER, SSER #2, SSER #3, SSER #4,SSER #5)*

Duke Energy Carolinas, LLC shall implement and maintain in effect allprovisions of the approved fire protection program as described in the UpdatedFinal Safety Analysis Report, as amended, for the facility and as approved inthe SER through Supplement 5, subject to the following provision:

The licensee may make changes to the approved fire protection programwithout prior approval of the Commission only if those changes would notadversely affect the ability to achieve and maintain safe shutdown in theevent of a fire.

with the common defense and security, and are consistent with certain specialcircumstances, as discussed in the referenced SER and SSER.
